30.12.2011:Meeting with Secy(T), DoT: GS, President AIBSNLEA, GS SNEA(I) & GS(MEA) MTNL met Secy(T), DoT and expressed their serious concern against the uncertainty prevailing in BSNL due to phased manner repatriation of ITS officers. BSNL Management has only concern to bring back ITS officers by framing RRs but there is no concern of BSNL Management to fill up the vacant JAG/SAG/HAG equivalent posts by its own executives. The Lateral Direct Recruitment Rules-2011 has notified today for 450 posts (including 38 posts of CGM/PGM) of GM & above in E-9 scale and 600 posts at Sr. DGM level in E-6 scale posts are in contradictory  to the initial contingency plan of BSNL and it is an attempt to block the carrier prospects of BSNL executives. We pleaded that 600  Sr. DGM posts should not be utilized from the existing 1400 DGM posts. These 1400 DGM posts are to be filled up from the basis of existing BSNL MSRRs only. Secy(T), DoT appreciated our concern & assured that uncertainty prevailing due to delay in repatriation process will end shortly within two months time. Regarding holding of DPCs for the existing BSNL Executives, he assured to look into the matter.

29.12.2011: 3rd Branch Conference of AIBSNLEA Jaipur Telecom District on 24.12.2011 at Jaipur:  The 3rd Branch Conference of AIBSNLEA Jaipur Telecom District was held on 24.12.2011 at Hotel Diana Palace, Jaipur in a grand manner. The Conference was  attended by Shri Prahlad Rai, General Secretary AIBSNLEA CHQ, Shri P. Venugopal, President AIBSNLEA CHQ, Sh. Bhagwan Singh AGS(HQ), Sh. Devesh Sharma, Organizing Secretary (North) and Shri Karan Singh, AIBSNLEA CHQ side. AIBSNLEA Rajasthan Circle President Sh. P.R. Leel and Circle Secretary Sh.O.P. Jat also attended the conference. The Open session of the conference was presided by Shri D.K.Maheshwari, Sr. GM (CFA) and look after PGMTD Jaipur. Shri Arun Agarwal Sr. GM(CM), O/o PGMTD Jaipur was the Guest of Honour.

After the welcome of dignitaries, Sh. M.K.Morodia, Branch Secretary presented his report, wherein he described the achievements of the Branch body during his tenure as Branch Secretary. Com. O.P.Jat, CS Rajasthan Circle congratulated Jaipur Telecom District Body for their contribution in  strengthening the AIBSNLEA in Rajasthan Circle. He assured the Administration, on the behalf of members to provide every contribution to strengthen the BSNL. Com P.R. Leel , Circle President in his address informed that recently, the Rajasthan Circle has make some progress in the revenue trend. He hope that the same trend will remain continue in forthcoming months also. Shri Karan Singh, Advisor CHQ , congratulated the Comrades of JP TD branch for the successful holding of conference. He hoped for the early settlement of all the pending issue. He further appealed to all for ensuring the viability of BSNL. Com. Devesh Sharma, Organizing Secretary (North) CHQ in his address explained the manner by which  BSNL is suffering from the discriminatory attitude of the Govt. of India. He explained the efforts of CHQ in continuously resolving the issues of BSNL Executives. He appealed that the proper supply of the materials, GSM equipments, MLLN Modems, Telephone instruments etc should be ensured for the viability of BSNL. Com. Bhagwan Singh, AGS(HQ) , in his address appealed all the members to continuously visit the AIBSNLEA CHQ website for regular updates of the burning issues like VRS , ITS repatriation etc and also appealed to all to be united and successful implement the Trade Union Programmes announced by CHQ in near future.

Guest of Honour of the Open session Shri Arun Agarwal, Sr. GM(CM), O/o PGMTD Jaipur informed that the growth rate of mobile sector in Jaipur is +4% to +6%. He also informed that Jaipur is generating approximately the 1/5th of the total Circle revenue and it should be further improved at the level of circle. He appealed to all for best utilization of available resources and infrastructure. He mentioned that our approach should be aggressive and customer oriented. He mentioned that the GSM network availability is 97% in Jaipur SSA against the target of 99%. In urban areas this is better but in rural areas, this is slightly low due to electricity problems. He suggested that if we improve the GSM availability by 1%-2% , then we can enhance the revenue by 3% to 5%. He hoped that very soon the store material scarcity in BSNL will be over.

Com. P. Venugopal, President AIBSNLEA CHQ in his address congratulated the members for the overwhelming response for the conference. He mentioned the effort of CHQ AIBSNLEA in originating the idea of customer delightness on which JAC observed 'Customer Delight Month' and 'Customer Delight Year'. He expressed his great dissatisfaction  against the Management as they are  least concern about the non-procurement of necessary equipments and store. He informed the house that in last 5 years the profit of BSNL is declined due to ADC withdrawal and license fee issue. He informed that the income is around 27,000 Cr-29,000Cr but the Expenditure is around 34000 K to 35000 Cr and the per day collection is around 80 Crores only. He expressed his serious concern that the Management should show his strong concern before the Govt. for the viability of BSNL He also briefed the house the issues of VRS, ITS repatriation , various DPCs and IDA pension revision issue. At last he thanked the Jaipur TD comrades and congratulated for the grand success of the conference.

GS AIBSNLEA, Shri Prahlad Rai , congratulated the comrades of Jaipur TD for the successful conference and thanked the comrades of his home branch for its great affection . In his detailed address Com GS explained the role of AIBSNLEA in the viability of BSNL. He mentioned the success of AIBSNLEA in recently issued order regarding pension fund contribution on actual basic pay. He mentioned that  BSNL earned profit in its early days but due to un-helping and over-jealous  attitude of the Govt. [ i.e. unjustified payment of spectrum charges (3G & BWA) of Rs. 18,500, non-reimbursement of licenses fee, USO Charges, OPEX Charges, withdrawal of ADC, Payment of AGR, , Interest, payment of notional loan Rs. 7500 Crores] the viability of BSNL is adversely affected. He informed that BSNL is spending more then 9000 Crores rupees in Rural areas services but No ADC charges is being given by the Govt. In addition of this non-procurement of GSM equipment, cables, telephone instruments, MLLN Modem, Broadband Modem, Drop wires etc have affected the quality & growth of services. He explained that how the AIBSNLEA is continuously pursuing these viability related issues with the BSNL Management and DoT. Com GS. Further explained the burning issues of the Headquarters level like ITS Repatriation process and the stand of AIBSNLEA and JAC on this issue. He mentioned that the BSNL Executives' are fully compatible to hold the higher responsibilities and BSNL Management should implement the contingency plan suggested by the United Forum for completing the ITS repatriation process.  He explained the stand of JAC on the issues like VRS, 30% disinvestment and unbundling of last mile copper. He apprised the status of HR issues related to mainly DPCs from JTO to SDE, SDE to DE(Adhoc/Regular), DE to DGM, DGM to GM, GM to Sr. GM/PGM, JAO to AO, AO to CAO & CAO to DGM(F), DGM(F) to GM(F) and GM(F) to PGM(F) etc., modification in transfer policy & Benchmark of EPP, Tightening of staffing norms, VRS,  Pay anomaly- Sr. are drawing less salary than their juniors etc.  In the last, he appealed all the Executives' for making BSNL as an vibrant organization.

Shri D.K. Maheshwari, Sr. GM (CFA) and look after PGMTD Jaipur in his address suggested to stop the unnecessary purchase of equipment like WIMAX equipments. He suggested that limited fund should properly utilized. He mentioned that we should explore and utilize the capacities of IP TAXs - an NGN switche. He appealed for the timely restoration of faults and changing of the attitude & mindset towards the customer delightness. He further suggested to deploy the IT enabled Executives in fully explore the expertise of BSNL own Executives'.

A new Branch body was formed. Sh. A.K. Rawat, AO , PGMTD Jaipur, Sh.M.K. Morodia, Commercial Officer (LC), PGMTD Jaipur and Sh Rambabu Gupta, AO PGMTD Jaipur were unanimously elected as Branch President, Branch Secretary and Financial Secretary  respectively. 28.12.2011:  Fixation of Seniority in SDE(T) grade under qualifying quota based on LDCE-2003 pursuation on OA no.38/2009 dated 10/02/2011 of CAT,Cuttack -disposal of representations in the matter. 23.12.2011:It is reliably understood that our demand of E1 +5 increments for JTOs who have joined after 01.01.2007 finally been approved by the BSNL Board. However we will continue our efforts to get approval for standard payscale for E2 and E3 pay scales. since the pension contribution will now be paid on actual basic pay.
 
Management has approved to conduct LDCE from JTO(T) to SDE(T). Very shortly the LDCE will be notified for the same vacancy years and for the same number of vacancies.  

23.12.2011: GS, President, AGS(HQ) met CMD, BSNL & discussed about filling up vacant Group-'A' & Group-'B' grade posts. CMD mentioned that I am interested to fill up all vacant Group-'A' & Group-'B' equivalent posts but due to various court cases finding difficulty in promoting executives. We explained him the status of the pending court cases i.e. 270 SDEs(LDCE quota) seniority case pending in Hon'ble APEX Court & its solution. Similarly we apprised him the judgment of various court on TES Group-'B' seniority based on Rule 206 & RR 1966. We requested for his kind intervention  to sort out  the seniority disputes at the earliest. The status of MT RRs Court case pending in Hon'ble PBCAT, New Delhi wherein the provision of the age & qualification has been challenged as per DoP&T instructions. CMD further mentioned that I am keen to bring MTs as well as to promote our own executives against vacant posts. He also assured that the DGMs recently recruited seniority issue & young JTOs carrier prospects will also be look into. We assured him to provide necessary feedback on all pending court cases as & when he desires to discuss the matter. CMD assured that shortly he will study the HR issues and will take decision to avoid discontentment of executives.

2.Holding of Committee Meetings on withdrawal of clarification issued by Pers. Cell dated 19.02.2010(AAO/Sr. AO/Sr. SDE Cases) and Senior executives drawing less pay than their juniors: We requested CMD, BSNL  to intervene in the matter as the Committee formed on the above mentioned subjects have not given its report in two years time. CMD assured to look into the matter.

23.12.2011: GS, President, AGSs SNEA(I), GS(Team) MTNL, GS(MEA), MTNL  met Sh. S.R. Rao, Addl. Secy(T), DoT in the presence of Jt. Secy(T) Sh. Malay Srivastava & discussed regarding phased manner repatriation of non-optee ITS officers, which is adversely affecting viability of BSNL. Uncertainty is prevailing. To end the uncertainty, immediate steps are required to end the uncertainty in BSNL/MTNL. The existing absorbed Group-'A" level executives are not being given responsibility/promotion against their quota vacant posts.  Addl. Secy(T) mentioned that he will convey our feeling  to CMD,  BSNL/MTNL.

23.12.2011:GS discussed with PGM(BW) as follows

(a) DPC from SDE(C) to EE(C): We requested for early issuance of promotion order from SDE(C) to fill up vacant EE(C) posts. PGM (BW) informed that DPC from SDE(C) to EE(C) has been completed to fill up 17 vacant EE(C) posts & a DPC minute has been to the competent authority for approval. Shortly promotion order will be issued.

(b) DPC from JTO(C) to SDE(C): We expressed serious concern against delay in conducting DPC from JTO(C) to SDE(C). PGM (BW) mentioned that DPC to fill up vacant SDE(C) posts has been initiated and ACRs/VCRs of the eligible JTOs have been called for from Circles/CVO. However, a reminder will be issued to expedite DPC shortly.

(c) Consideration of request transfers of SDE(C)/EE(C): We requested to consider pending request /tenure transfer cases of SDE(C)/EE(C). PGM (BW) assured to look into the matter. 

23.12.2011:GS, AGS(HQ) met Sr. GM(Trg.) and discussed about allowing Physical Mandatory Training in RTTCs at the request of candidates instead of Online Training. GM(Trg.) informed that vide Training Cell, BSNL Corporate Office letter no. 32-27/04/Trg.-Vol-VII dated 05.01.2011 letter instructions/guidelines regarding mode of training has already being issued which is clarified in Para (f) i.e. “The training centres will organize class room training on requests from SSA Heads/CGMs on demand basis, wherever appropriate should there be felt insufficiency in above methods of dissemination of learnings”. 22.12.2011: Meeting with CLC: GS, President attended meeting convened by Chief Labour Commissioner (CLC) in Shram Shakti Bhawan, New Delhi to discuss the demands of JAC on which strike took place on 15th Dec'2011. Director(HR), PGM(SR), DGM(SR), Director (PSU), DoT and the other JAC leaders were present in the meeting. All the demands of JAC were first explained by JAC leaders in details and it was replied by BSNL Management and DoT side officers. JAC leaders expressed their serious resentment against un-helping attitude of the Govt. towards BSNL and failure of BSNL Management in not settling the legitimate demands of BSNL employees. They insisted for early repatriation of deputationist from BSNL to end uncertainty. After detailed discussions about two hours, CLC decided to hold next meeting on 31.1.2012 and directed all concern to attend the next meeting with full preparation so that some conclusive discussion take place <<Click here for brief note on discussion>>

21.12.2011:Meeting with Member(S), DoT on 21.12.2011:  GS, President, AIBSNLEA,  GS, AGSs SNEA(I) met Sh. S.C. Mishra, Member(S), DoT and discussed the following issues:

(a) 270 SDEs Seniority case: To remove stalemate in the promotion from DE to DGM. After detailed discussions on 270 SDEs seniority case, M(S) advised us to give the latest feedback to discuss further so that some decision is taken in this regard.

(b) VRS: At present no definite views are available in DoT. Everything depends on the financial support from Govt. However, if any financial help is given by Govt. it may be in terms of loan.

(c) ITS absorption issue: Discussion took place at length and we expressed our serious concern against phased manner repatriation wherein uncertainty is prevailing in BSNL, which is adversely affecting the viability of BSNL. He appreciated our concern and mentioned that BSNL Management should come out with some concrete proposal to end the stalemate.

21.12.2011: Bi-Annual conference of AIBSNLEA Lucknow Telecom District Branch on 18.12.2011: Shri Prdeep Goel AGS CHQ attended and addressed the bi-annual conference of AIBSNLEA Lucknow Telecom District Branch was held on Sunday 18th December 2011 at Conference Hall Indira Nagar, TE Building, Lucknow. More then 100 members from all the segments i.e accounts, engineering and others wings are participated in the conference.  Shri P.C. 20.12.2011: Partisan  attitude of the BSNL Management / Govt. towards BSNL's absorbed executives/non-executives: It is reliably learnt that BSNL Management is proposing RRs as under:

1. ITS unabsorbed officers will only be eligible to apply. Mode of entry shall be immediate absorption. Pay package shall be negotiable.

2. Entry will be at E6, E7and E9 levels. Board note to make E6 and E7 substantive grades to be made for the next board meeting.

3.    Existing vacancies in E5, E6 and E7 to be redistributed.

4.   Total 450 posts shall be filled in E9 level and 600 posts in E6 and E7 level.

5.  Selected officers shall be given additional increments up to four increments based on length of service.

6.   Seniority shall be as per UPSC (matter has been referred to DoPT)

It clearly reflects the partition attitude of the BSNL Management/Govt. towards BSNL's absorbed executives/non-executives as follows

1.   ITS absorbed officers will not be eligible to apply. Hence they will draw less emoluments than the unabsorbed ITS Officers being recruited through back door entry.

2. In Telecom Electrical /Civil Wings no RRs being framed to fill up the vacant JAG/SAG/HAG level posts.

3.   As per BSNL MSRRs E6 & E7 grades are non functional grades. The proposal to make E6 & E7 substantive grades is an arbitrary attempt to temper the BSNL MSRRs.

4.  Existing vacancies in E5 (DGM) grade can't be distributed into E6 & E7 as per BSNL MSRRs.

5.   As per BSNL's initial contingency plan the total 280 posts shall be filled up in E8/E9 level and 300 posts in E5/E6/E7 level but now it is increased to numbering 1050 just to rehabilitate  the unabsorbed ITS officers in BSNL.

6.   No additional increnments are given to the existing absorbed executives / non-executives even to remove their pay anomaly.

7.   As per BSNL MSRRs the executives recruited through lateral / outside entry will stand en-block junior to the existing absorbed executives.

Such attempt of BSNL Management / Govt. will face the legal complications. BSNL Management /Govt. should not give extraordinary treatment to the unabsorbed ITS officers who defy the absorption process by framing separate set of rules of absorption in the same organisation. It will create serious frustration amongst the absorbed employees who have honored the Govt. decision and having combined pension under Rule 37-A.

Let us, get ready to protest strongly Organisationally and Legally against such discriminatory attitude of the Govt./BSNL Management.

20.12.2011:Circle Conference of AIBSNLEA Punjab Circle on 17.12.2011 at Hoshiarpur: The 3rd Circle Conference of AIBSNLEA PUNJAB Circle was held on 17.12.2011 at Hotel Maharaja Palace, Hoshiarpur in a grand manner. The Circle  Conference was  attended by Shri Prahlad Rai, General Secretary AIBSNLEA CHQ, Shri P. Venugopal, President AIBSNLEA CHQ and by Sh. Devesh Sharma, Organizing Secretary (North) AIBSNLEA CHQ side.  Many media persons from print and electronic media attended the conference.

After the welcome of dignitaries, CS Punjab Sh. Kamlesh Dadhwal presented his report, in which he described the achievements of the Circle body tenure as Circle Secretary. After the CS report the presentation of the reports of Branch  Secretaries were taken place.

Sh Devesh Sharma, Organizing Secretary (North) CHQ  in his address explained that in which manner the BSNL is suffering from the discriminatory attitude of the Govt. of India. He explained the efforts of CHQ in continuously resolving the issues of BSNL Executives. He appealed all the members to be ready for the implementation of and Organizational Activity call from CHQ in future. He congratulated Punjab Circle comrades in the recent strike on 15.12.2011 making ist a 100% sucess.

Sh. P. Venugopal , President AIBSNLEA CHQ in his address appealed to further strengthen AIBSNLEA in Punjab Circle. He appreciated JAC for observing 'Customer Delight Month' and 'Customer Delight Year' and on the issues of VRS and ITS repatriation and IDA pension revision issue. He expressed his great dissentment against the Management least concern about the non-procurement of necessary equipments and store. He informed the house that in last 5 years the profit of BSNL is declined due to ADC withdrawal and license fee issue. He informed that the income is around 27000 Cr-29000Cr but the Expenditure is around 34000 K to 35000 Cr. He further informed that BSNL is paying lot of money to GoI. He presented the BSNL overall economic scenario by the help of financial figures. He expressed his serious concern that Management should show his strong concern before the Govt. for the viability of BSNL. At last he thanked the PB circle comrades and hope for the grand success of the conference.

GS AIBSNLEA, Shri Prahlad Rai in his detailed address explained the burning issues of the Headquarters level like ITS Repatriation process and the stand of AIBSNLEA and JAC on this issue. He mentioned that the BSNL Executives' are fully compatible to hold the higher responsibilities and BSNL Management should implement the contingency plan suggested by the United Forum for completing the ITS repatriation process.  He explained the role of AIBSNLEA and Trade Unions in the viability of BSNL. He mentioned the success of AIBSNLEA in recently getting the pension fund contribution approved on basic pay w.e.f. 01.01.2007 and many benefits due to its implementation and creation of Retirement Leave encashment fund by the BSNL Management. BSNL earned profit but due to un-helping attitude of the Govt. i.e. unjustified payment of spectrum charges (3G & BWA) of Rs. 18,500, non-reimbursement of licenses fee, USO Charges, OPEX Charges, withdrawal of ADC, Payment of AGR, Interest, payment of notional loan Rs. 7500 Crores to DoT has adversely affected the viability of BSNL. He informed that BSNL is spending more then 9000 Crores rupees in Rural areas services but No ADC charges is being given by the Govt. In addition of this non-procurement of GSM equipment, cables, telephone instruments, MLLN Modem, Broadband Modem, Drop wires etc has affected the quality & growth of services. He explained that how the AIBSNLEA is continuously pursuing these viability related issue with the BSNL Management and DoT. He apprised the status of HR issues related to mainly DPCs from JTO to SDE, SDE to DE(Adhoc/Regular), DE to DGM, DGM to GM, GM to Sr. GM/PGM, JAO to AO, AO to CAO & CAO to DGM(F), DGM(F) to GM(F) and GM(F) to PGM(F) etc., modification in transfer policy & Benchmark of EPP, Tightening of staffing norms, VRS, Group 'A' officer absorption, Pay anomaly- Sr. are drawing less salary than their juniors, withdrawal of leave encashment, stopping of LTC etc.Com.. He explained the stand of JAC for the ITS repatriation process and further course of action of JAC.  At last he appealed the entire Executives' of Punjab Circle for fully implementing the CHQ organizational calls with a team spirit.

In the election, a new Circle body was formed. Sh. Baldev Singh, AO (Cash), NTR Jalandhar, Sh.Balwant Rai DE(Internal) Hoshiarpur and Sh.Kuldip Ram, CAO (Banking & IA) Chandigarh were unanimously elected as Circle President, Circle Secretary and Financial Secretary respectively.

(a) Holding LDCE for the promotion of JTO (T) to SDE(T):-GM (Estt.) mentioned that Hon'ble High Court Shimla has delievered its decision in this regard and now only a single examination will be held for the LDCE from JTO(T) to SDE(T) in the month of March-2012.

(b) Local Officiating promotion of TTAs to JTOs in Rajasthan Circle:  We informed GM(Estt.) that approx 70 TTAs who were working as officiating JTOs in Rajasthan Telecom Circle, were not given this promotion from last oneyear, inspite of availability of many JTO vacant posts. GM (Estt.) assured to look into the matter.

(c) Pay anomaly wherein senior executives are getting lower pay than their juniors due to getting adhoc promotion in the next IDA pay scale before the date of their IDA pay scale up-gradation under Executive Time Bound Promotion Policy : We pleaded for the implementation of Hon'ble CENTRAL ADMINISTRATIVE TRIBUNAL, ERNAKULAM BENCH O.A. NO. 109 OF 2011 with O.A. No. 110/2011 and 236/2011 judgment dated 07.12.2011 so that the anomaly can be resolved. GM (Estt.) assured to look into the matter.

(i) DPC from AO to CAO: We requested PGM(FP) to expedite DPC to fill up vacant CAO posts. PGM(FP) informed that this week no MC is being held hence in the next week he will try to get clear from MC to fill up vacant CAOs posts. He also reiterated that ACRs are already available and missing ACRs if any are required will be collected after MC approval to initiate DPC.

16.12.2011:GS, President & GS, AGSs SNEA(I) met Director(HR) and discussed

(a)  Vindictive attitude of CGM Chennai Circle towards BSNL employees:- We strongly resented against the vindictive attitude of CGM Chennai Circle, who has filed FIR against BSNL employees and got them arrested in Police. Director (HR) assured to intervene in the matter immediately.

(b) Filling up vacant HAG/SAG/JAG/STS Level vacant posts:- We expressed our serious concern against non-filling of vacant HAG/SAG/JAG/STS level posts by holding DPCs by its own eligible executives. BSNL Management is seized with framing of RRs to rehabilate  ITS Officers in BSNL rather than giving responsibility to its own executives. Director (HR) mentioned that BSNL Management to end uncertainly in BSNL due repatriation order of DoT for ITS officers is making efforts to frame the RRs so that required number of ITS officers can be recruited and rest of them may be repatriated . It is only possible when no litigation takes place. To fill up the DGM Posts he mentioned that due to contempt notice of Hon'ble Supreme Court on 270 SDEs Seniority case, clarification from DoT is being taken and thereafter the promotion order can be issued. We pleaded that this issue needs only one hour time to discuss the matter with Member (S),  DoT and can be settled but it depends on BSNL Management's willingness to settle the issue. However, Director (HR) assured an early action on this issue.

15.12.2011: Successful implementation of One day Strike on 15th Dec'2011: Congratulations!  for successful implementation of One Day Strike Call given by JAC throughout the country. All the Circles reported 100% success of strike. It has reflected the anguish of BSNL employees against the wrong policies of Govt. & BSNL Management, which has adversely affected the viability of BSNL, wherein BSNL is continuously making losses for the last two years.

JAC leaders at BSNL Corporate Office, New Delhi sat on dharna in CMD's PS Chamber to register their  protest where CMD has not shown any concern towards BSNL's employees protest and their legitimate demands. After some time CMD along with Director(HR) and PGM(SR) came out of his chamber and expressed his concern seeing that JAC leaders are sitting on the floor. He advised JAC leaders to sit in Board Room & discuss the issues. JAC leaders expressed their resentment against CMD's neglecting attitude towards employee's struggle wherein lakhs of BSNL employees are on strike and he has not conducted any meeting at his level to diffuse the situation.

However, JAC leaders accepted CMD's appeal and attended meeting with CMD in the presence of Director(HR), PGM(SR), GM(Admn.) & GM(Estt.). Convener, JAC  and other JAC leaders explained  the demands i.e. No VRS, Payment of PLI, Restoration of medical allowance, LTC and Leave encashment, Conclusion of the process of absorption of ITS, Merger of 78.2% IDA and Policy related issues i.e. Compensation for BSNL's rural operations, Pension contribution on actual basic pay, Refund of RS.8313 crore to BSNL, which  was paid towards BWA spectrum charges, Reimbursement of License Fee, Allowing BSNL to surrender 3G spectrum of unviable circles.( Private companies are given the freedom to select circles of their choice), Refund of Rs. 7500 crore with interest, collected from BSNL towards "Notional Loan" , Procurement of equipments, Discontinue TACs and impressed upon for immediate repatriation of ITS Officers as per DoT order.

After hearing all, CMD explained that in view of the present financial condition of BSNL the demands of Payment of PLI, Restoration of medical allowance, LTC and Leave encashment can't be resolved immediately but when BSNL starts making profit, the issues can be considered. 78.2% IDA fitment benefit will again be discussed in the BSNL Management Committee & thereafter to BSNL Board. VRS implementation  depends on Govt's decision. On ITS absorption issue, he explained that at present it is not possible to repatriate ITS officers but within 2-3 months period the issue will be resolved. We strongly opposed the back door entry to ITS officers by framing RRs. We pleaded that first BSNL absorbed Group-'A' officers should be promoted by holding DPCs against vacant HAG/SAG/JAG level posts and thereafter only as per the requirement senior level executives can be recruited from open market. On this issue CMD mentioned that he has already directed his team to start the process of DPCs but no development is visible in this direction. Regarding procurement of GSM equipment & stores; CMD mentioned that sincere efforts are being made in this regard. On policy related issues, CMD explained that all these issues have been taken up with DoT and the letters written by Unions / Associations have been recommended to DoT for consideration.   

In totality, it is observed that BSNL Management & Govt. is not at all interested to resolve any of the issue immediately but trying to lingering on the problems. In view of the above, to save BSNL & its employees, sustained struggle is needed and shortly JAC after analyzing the situation will further decide future course of actions which may be in terms of indefinite strike.

AIBSNLEA express its sincere thanks for all the members for their active participation & making its a complete success i.e. historical one day strike on 15th Dec'2011. 14.12.2011: BSNL employees will be on strike on 15th December, 2011 -  Joint Action Committee of Associations/Unions of BSNL Executives & Non-Executives has given call of one day strike on 15th Dec'2011 to strongly protest against the wrong policies of Govt. and BSNL Management which are adversely affecting the viability of BSNL and its employees.

 

Govt. is disowning its responsibility towards its own company, BSNL by withdrawing  its supports which were assured at the time of its formation in Oct'2000.

 

More than Rs.3000 crores is being charged as license fee and USO charges contrary to NTP-1999. The OPEX charges Rs. 5000 crores payment to BSNL has been denied by DoT. On the basis of TRAI recommendations, ADC to BSNL has been withdrawn but the telecom services in rural  areas are being provided on reduced rental. Rs. 18500 crores has been charged from BSNL against 3G & BWA spectrum allocation on the highest bidding rate without giving fare opportunity to BSNL for participating in the bidding process to decide circles on the basis of profit & loss criteria.

 

BSNL has  already surrendered non-stranded BWA spectrum & has demanded refund of Rs. 7000 crores. Govt. decision to impose VRS to 1,00,000 (One lakh) employees can't be accepted without any road map that how it will help BSNL's viability. 

 

BSNL Management is not implementing DoT order dated 03.11.2011 for repatriation of non-optee ITS officers whose deemed deputation ended on 08.11.2011, which is adversely affecting the viability of BSNL. BSNL management is making its best efforts to rehabilitee ITS officers in BSNL by framing illogical RRs. The existing Group-'A' level executives are not being promoted against vacant HAG/SAG/JAG level posts in BSNL.

 

BSNL Management failed in procurement of GSM/NGN equipments, Cables, telephone instruments, MLLN Modems etc which has also adversely affected the viability of BSNL.

 

Let us, actively participate in the JAC strike call on 15th Dec'2011 to make its a complete success and to defeat the wrong policies of the Govt. and  BSNL Management, which are adversely affecting the viability of BSNL and its employees.<<click here for press release>>

13.12.2011: JAC emphatically decides to go on strike on 15.12.2011 : The JAC meeting took place today and took the following decisions. President & FS attended the Meeting.

i) To powerfully conduct the strike on 15.12.2011. The strike will be

from 0600 hrs to 1800 hrs.

ii) To block the non-opted ITS officers from entering the offices on the day of the strike, i.e., on 15.12.2011.   

 

All the CHQ Office Bearers, Circle / Branch Secretaries are requested to mobilize the members for active participation in One Day Strike on 15.12.2011.

13.12.2011: 3rd CEC Meeting of AIBSNLEA, Gujarat Circle  on 09.12.2011:3rd CEC Meeting of AIBSNLEA, Gujarat Circle held at Funpoint Club, Ahmedabad on 9th December, 2011. Shri C.M. Saste, Organising Secretary (West) & Shri M.M. Kanani, Advisor (CHQ) attended the meeting on behalf of CHQ.

Circle President, Shri R.S. Parihar in his address covered the present financial situation of the BSNL as well as various reasons for BSNL's present condition. He appealed CEC Members to work hard to regain the lost glory of BSNL. Circle Secretary, Shri Amalendu Guha in his address touched various achievements of Association in the circle. Shri M.M. Kanani, Advisor (CHQ) in his address requested the members to be united always to take BSNL as well as Association to greater hights. He also emphasised the need of giving better services to the customers. Shri C.M. Saste, Organising Secretary (West) in his elaborate address gave a clear picture of situation prevailing in BSNL like ITS absorption, VRS, issues taken up by CHQ with BSNL management etc.. He also pointed out the areas where Association has to put effort to strengthen the Circle activities. Circle Financial Secretary, Shri T. Raja also addressed the gathering and touched various financial points.

12.12.2011: No improvement in the talk Strike will take place: Based on the strike notice issued by the JAC, talks were held between the Director (HR) and the Joint Action Committee today the 12-12-2011. President and FS attended the meeting.  Management was not able to solve any of the issue for which notice has been given.

Hence, there is no change in the decision to go on strike. Strike will take place on 15-12-2011. All are requested to gear up the preparations for the strike

12.12.2011: Hon'ble CENTRAL ADMINISTRATIVE TRIBUNAL, ERNAKULAM BENCH O.A. NO. 109 OF 2011 with O.A. No. 110/2011 and 236/2011 judgment dated 07.12.2011 in the Seniors (SDEs promoted as adhoc DEs before getting the second TBP ) getting less pay than Juniors ( SDEs promoted as adhoc DEs after getting the second Time Bound Promotion ) case :  "The respondents are directed to step up the pay of the applicants to the level of pay of their juniors with effect from the date of arising of the anomaly of seniors drawing less pay than their juniors in respect of each of the applicants within a period of 3 months from the date of receipt of a copy of this order. However, this order will not stand in the way of the Committee set up to deal with the issue under consideration in these O.As, giving a more beneficial recommendation for the applicants."


This issue is under active consideration with the Committee headed by PGM ( Finance), CO, New Delhi. As per the consistent efforts of this association, the said committee has been constituted and AIBSNLEA has already given its inputs to the Committee in this regard and have had a number of discussions on this issue with the members of this committee for resolution of this anomaly at the earliest.

08.12.2011:   Congratulations, Continues efforts of AIBSNLEA yielded the  result in getting released order for calculation of monthly contribution based on existing basic pay instead of maximum of pay scale w.ef. 01.12.2011.(AIBSNLEA Letters dated 14.06.2010, 9.2.2010, 25.03.2010 and 18.10.2010).

08.12.2011:   On AIBSNELA and BSNL Management continues persuasion, Government finally decided to refund around Rs.7000 crores towards obsolete BWA spectrum charges to BSNL.  

08.12.2011:   GS, President AIBSNLEA, GS, AGSs SNEA(I) met Director(HR) Sh. A.N. Rai and discussed:-

(i) Holding of DPCs to fill up HAG/SAG/JAG/STS posts: We expressed our serious concern against non holding of DPCs to fill up vacant  HAG/SAG/JAG/STS posts by the existing eligible executives. BSNL Management is only concern to re-habitat the ITS Officers in BSNL by framing RRs in their favour. Director(HR) appreciated our concern & mentioned that both the actions are simultaneously required & in this connection he will discuss with Sr. GM(Pers.) to expedite the DPCs.

(ii) Immediate fill up the vacant DGM(Engg.) posts: We requested to get the early clearance from DoT regarding 270 SDEs seniority court case & to initiate DPC to fill up about 600 vacant DGM posts of seniority cum fitness quota.  Director(HR) assured that he will discuss the matter with Member(S), DoT shortly to resolve the issue.

(iii) Harassment of executives in Bihar Circle: We requested  Director(HR) for his kind intervention in the affairs of Bihar Telecom wherein executives are being harassed by some ITS officers.  Director(HR) assured to look into the matter.

(iv) Online mandatory training: We requested  Director(HR), GM(Trg.) to arrange physical mandatory training course in the training centre at own cost of the candidates since the executives are finding lot of difficulty in attending online examination of mandatory training. GM(Trg.) in the presence of  Director(HR) assured to have separate detail discussion on this issue. We will shortly meet with GM(Trg.) to discuss the matter.

08.12.2011:   GS, President, FS, AGS(HQ), AGS(F) met PGM(FP) and discussed:-

(i) DPCs from JAO to AO and AO to CAO(Adhoc/Regular): We expressed our serious concern against delay in holding DPC from    JAO to AO and AO to CAO(Adhoc/Regular). PGM(FP) mentioned that for holding DPCs to fill up about 487 CAOs posts on adhoc basis and about 230 CAOs posts on regular basis have been sent to BSNL Management Committee for approval. He assured that in the next MC Meeting, he will get clearance from MC and DPCs will start. Similarly DPC to fill up about 476 vacant AOs posts has been initiated, the  ACRs will shortly be collected.

(ii) DPC from CAO to DGM(F): PGM(FP) mentioned that the Lucknow Bench of SC/ST Commission has restricted the DPC till their clearance. Efforts are being made to get clearance.

(iii) Request/Modification Transfer cases of AOs/CAOs: We requested for consideration of pending request /modification transfer cases of AOs/CAOs. PGM(FP) assured to look into.

(iv) Holding of Committee Meetings on withdrawal of clarification issued by Pers. Cell dated 19.02.2010(AAO/Sr. AO/Sr. SDE Cases) and Senior executives drawing less pay than their juniors: PGM(FP) mentioned that tomorrow itself committee will hold the meeting on clarification issued by Pers. Cell dated 19.02.2010 (AAO/Sr. AO/Sr. SDE Cases). For other issues committee will hold the meeting shortly.

08.12.2011:   GS, President, FS, AGS(HQ), AGS(F) met Sr. GM(Pers.) and discussed:-

(i) DPC from DE to DGM: Sr. GM(Pers.) informed that contempt Notice of Hon'ble Supreme Court in 270 SDEs Seniority case has been sent to DoT for clarification and he also advised us to meet concern DoT Officers at the earliest. However, we will meet concern DoT Officers on this issue in the next week.

(ii) DPC from SDE(T) to DE (Adhoc/Regular): We requested to expedite DPCs from SDE(T) to DE (Adhoc/Regular) by arranging ACRs/VCRs from Circles. Sr. GM(Pers.) mentioned that some Circles viz Chennai TD, Kerala, STP, STR, HP, BRBRAITT, UP(E) and ETR have sent ACRs as on date and efforts are being made to collect early all pending ACRs.

(iii) Consideration of request Transfer cases of SDEs/DEs: We requested for consideration of pending request transfer cases of SDEs/DEs. He assured to look into.

All the Circle/Branch Secretaries are requested to ensure early dispatch of ACRs/VCRs from their Circles to BSNL Corporate Office.

All the CHQ Office Bearers, Circle / Branch Secretaries are requested to mobilize the members for active participation in Massive rallies on 8th December 2011.

It is found that some TELEWAVE Bundles are returned to CHQ due to wrong Postal address . The available mailing list of Circles is e-mailed to all Circle Secretaries for updating. Kindly correct it immediately & re-mail to CHQ. It is urgently needed to avoid wastage.

Orrisa: There was a silent candle march as per directives of CHQ on 1st Dec-11. It started at 1720 hrs from the gate of o/o the CGMT after a little brief by CSs. About 150participants were there. We moved in two lines upto the Rajbhawan, about 2.5KM from the starting place. We reached at 1820hr.
