30.11.2010:  THREE DAYS STRIKE CALL - MAKE IT A GRAND SUCCESS - CMD BSNL called JAC Leaders & discussed about Three  days strike & JAC demands. During discussion he mentioned that 78.2 % IDA fitment benefit issue has been discussed in the BSNL Board Meeting two months before but the BSNL Board advised to implement DPE Order only when BSNL starts earning profit and regarding procurement of GSM equipment he mentioned that 5.5 Million GSM lines tender is going to be finalised very soon because evaluation of Techno-commercial bids is completed and the evaluation of Financial Bids of this tender is in process. Regarding other issues i.e Refund of 18,500 Crores Spectrum Charges, 30% Disinvestment of BSNL, VRS to 1 Lakh Employees, Unbundeling of BSNL's last mile copper conductor, ITS Officers absorption, IDA Pension revision of BSNL Pensioners, Issuing instructions to all Govt. Departments /PSUs to take Telecom Services from BSNL, Reimbursement of license fee and USO charges etc. he mentioned that all these issues are under the consideration of DoT and he advised to meet DDG(SU) DoT to discuss further the status of all these issues.

After CMD's meeting, JAC analyzed the developments & found that BSNL Management is not ready to settle the issues which comes under their perview and Secretary(T)/Hon'ble MoC&IT are not holding any meeting with JAC to resolve the issues, it reflects the negligent attitude of the BSNL Management and DoT administration towards BSNL workers. Hence, against the casual treatment of BSNL Management / DoT Administration, JAC decided to implement three days strike a complete success. All the Circle / Branch Secretaries are requested to ensure successful implementation of  three days strike call.

29.11.2010: JAC Meeting with RLC:- The Regional Labor Commissioner (RLC), New Delhi called JAC leaders & BSNL Management for conciliation Meeting Today & discussed in detail the demands of JAC & the view points of BSNL Management on demands. After hearing both the parties RLC appealed, JAC to withdraw the agitation till the time BSNL Management / DoT Administration settle the demands. JAC requested RLC that , in case the demands of JAC are resolved, Three days strike call can be withdrawn otherwise agitation will continue. RLC issued notices to BSNL Management / DoT Administration for submitting their reply & attending a meeting with him tomorrow at 11.30 AM. RLC also invited JAC leaders for discussion tomorrow at 1400 hrs. Since there is no break through for the settlement of JAC demands, all the Circle / Branch Secretaries are requested to mobilize and make three days strike call a Grand Success.

26.11.2010: CMD BSNL Called JAC Leaders: CMD BSNL invited JAC leaders to discuss about the Three days strike call & demands. CMD in the presence of ED(F), Sr. GM(SR), Sr. GM(Estt.), PGM (Regulation), Sr. GM(ERP), PGM(CDR Proj.)  & other Senior Officers. CMD BSNL discussed & apprised the Govt's /BSNL's stand on the JAC demands i.e. 30% disinvestment, VRS to One lakh employees, Unbundling of BSNL Copper Conductor are not being decided by Govt. immediately. Regarding ITS absorption issue, IDA Pension Revision; DoT is pursuing with the Cabinet. Regarding procurement of 5.5 million GSM lines equipment BSNL is evaluating the Financial Bids and shortly decision will be taken. Regarding 78.2% IDA fitment benefit; CMD further re-iterated that issue will be considered when BSNL makes profit. During discussion, JAC leaders expressed serious resentment against DoT/BSNL Management lack of concern for the settlement of the demands & JAC Three days strike call where the notice was served one month before. JAC leaders categorically told that Administrative Ministry should  come out with concrete solution of the demands & BSNL Management should immediately implement 78.2% IDA fitment benefit. However JAC leaders will meet on Monday to review the developments. All the Circle / Branch Secretaries are requested to mobilize for an active participation to make Three days strike grand success.

22.11.2010:- JAC meeting:- GS, FS attended JAC meeting to discuss and decide the strategies for successful implementation of 3 days Strike call w.e.f.01 Dec 2010 to 03 Dec 2010. After detailed discussions the following decisions were taken unanimously:

1. The meeting reviewed about the Parliament March held on 15th November 2010 and congratulated all for making it a good success.

2.The meeting decided to make all preparations for making the 3 days strike from 1st December 2010 a grand success.

3.The 3 days strike will continue from 06:00 A.M. on 1st December and will end at 06:00 AM on 4th December 2010.

4. JAC at Circle/SSA levels should meet immediately and make preparations for joint campaign for the success of the strike. They are advised to contact sister trade unions etc for getting support and solidarity. MPs, MLAs, political party leaders etc. be contacted for support and taking up the issues at government level. Press Conference be conducted to give wide publicity to the strike and demands.

5. Organise demonstrations at all office/exchange premises on 29th November 2010 with massive participation.

24.11.2010: CEC MEETING AIBSNLEA DELHI CIRCLE : GS, AGS(HQ) and AGS(F) attended and addressed the Circle Executive Committee (CEC) meeting of AIBSNLEA Delhi Circle. Com. GS in his address appreciated the active participation of Delhi Circle in the All India activities in making all CHQ calls successful at Delhi. Com GS apprised in detail the efforts of AIBSNLEA for the settlement of important HR issues and the efforts being made for the settlement of pending issues. He called upon the members for making three days strike call of JAC a complete success and for starting the Organizational Action Programmes against non-settlement of pending legitimate issues of Executives'in BSNL. Com Satish Kumar, Circle Secretary in his Welcome address discussed the Circle/ All India level issues and Com. Tiwari Circle President extended vote of thanks.

24.11.2010: GS, AGS(HQ) , AGS(F) and AGS(C/E/Arch/TF) met ED(F) and discussed:-

(a) Consideration of requests/tenure transfers of CAOs/AOs/JAOs who are completing 2 years of service in November 2010. ED(F) assured to look into the matter

(b) Withdrawal of clarifications dated 19.02.2010  and 13.10.2010 issued by BSNL Corporate Office w.r.to AAO/Sr.AO/Sr.SDE and PA/PSs cadres, pay fixation in Executive Promotion Policy and Early settlement of Pay anomaly cases wherein senior Executives are drawing less pay than their juniors- We requested his kind intervention for the settlement of the above issues. ED(F) assured to look into the matter.

24.11.2010: GS, AGS(HQ) , AGS(F) and AGS(C/E/Arch/TF) met Sr. GM(Estt.) and discussed

(a) Withdrawal of clarifications dated 19.02.2010  and 13.10.2010 issued by BSNL Corporate Office w.r.to AAO/Sr.AO/Sr.SDE and PA/PSs cadres, pay fixation in Executive Promotion Policy.:- We apprised him about the wrong clarification issued by BSNL CO Pers. cell wherein huge recoveries are being made and the pay of the Executives'is reduced . We requested him to examine the case being the member of the Committee. Sr. GM(Estt.) assured to look into the matter.

(b) Anomaly due to accrual of increment of Junior earlier than the senior after fixation of pay in revised pay scale implementation of 2nd PRC:- We requested to restore the original order dated 23.09.2009 wherein provision for ante-dating the increment of the senior to that of the junior was envisaged. Alternatively, management can think of any other solution that will address the issue of anomaly wherein the junior does not draw more pay than the senior and also the senior does not face any drop in his basic pay which he/she will be drawing by virtue of the 3% annual increment provided in the rule. Sr. GM (Estt.) assured to reprocess the case EF Cell of BSNL CO for comments.

(c) Pay fixation of the Executives on 2nd time bound financial up-gradation:- The clarification issued by PAT Section on pay fixation on promotion/up-gradation has confused the different divisions in BSNL Corp. Office rather than easing the fixation cases.  CSS Section and Pers. Section are following the PAT Section guidelines issued on 31.3.2009, but Pers Cell and SEA Section of BSNL CO are interpreting the PAT guidelines in a different manner.  It is understood, PAT Section has issued clarification without even taking finance concurrence from Establishment Finance. We requested for rectification of pay fixation of the executives on promotion/up-gradation. Sr.GM(Estt.) assured to re-examine the case.

(d) Promotion from JTOs Offg. (TTAs) to JTO (Telecom) on regular basis:- Sr.GM (Estt.) informed that legal opinion on this issue has been sort thereafter only the action can be taken. He also apprised that against creation of super-numeric posts of JTOs contempt has been filed in Hon'ble  Chandigarh High Court and hearing date is 10th Dec. 2010.

23-11-2010:GS & AGS (C/E/Arch&T/F) met PGM (BW) and discussed various issues as under:

1. Regularization of EE (Civil) -  PGM (BW) mentioned that  DPC is in progress to regularizes all Adhoc EEs (Civil).   He assured for early issuance of promotion orders.

2. Promotion from JTO (Civil) to SDE (Civil) of ST category -  PGM (BW) mentioned that the VCRs of eligible JTOs have been  received and the promotion orders will be issued shortly.

3. Promotion from SDE (Civil) to EE (Civil) on regular basis - PGM (BW) informed that DPC process is going on and after completion of DPC the promotion orders will be issued soon. 

23-11-2010:GS & AGS (C/E/Arch&T/F) met  PGM (Electrical) and discussed various issues as under:

1. Regularization of EE (Electrical) - PGM (Elect) informed that to hold DPC for for  regularization of about 100 Adhoc EEs (Electrical) has been sent to competent  authority for administrative approval. He assured that as soon as the approval is received DPC will immediately be conducted.

2. Recruitment of JTOs (Elect.) - PGM (Elect.) informed that the case for recruitment of 350 JTOs (Elect.) has been sent to GM (Rectt.) for further action.

3. Promotion from JTO (Elect.) to SDE (Elect.) PGM (Elect) mentioned that the DPC from JTO(Elect) to SDE (Elect) will start after regularization of EE (Elect.).

23-11-2010: GS & AGS (C/E/Arch&T/F) met PGM (Arch.) and discussed various issues as under:

a. DPC for regularization of EE (Civil) PGM (Arch) mentioned that  being the Chairman of DPC for regularization of EE (Civil) he will completed the process at the earliest as soon as he receive all required documents. We requested to expedite DPC.

b. Remove discrimination based on qualifications in Arch. Wing to SDE/EE promotion- PGM (Arch) mentioned that diploma qualification is not being registered in the Architectural Council of India as per Parliament Act, hence in BSNLMSRRs the degree has been made mandatory to SDE/EE promotion. He mentioned that existing diploma holders Architect/ JTOs in BSNL may acquire needful  qualification and register in  Architectural Council of India.

22.11.2010: GS, AGS(F) and AGS(HQ) met Sr. GM (Pers.) and discussed:-

(a) Keeping in abeyance the clarifications dated 19.02.2010  and 13.10.2010 issued by BSNL Corporate Office w.r.to AAO/Sr. AO/Sr. SDE and PA/PSs cadres pay fixation in Executive Promotion Policy:- We strongly protested against 19.11.2010 orders only for keeping abeyance the recovery of pay as per  wrong clarifications  dated 19.02.2010  and 13.10.2010 issued by BSNL Corporate Office. Whereas , the entire clarifications could have been kept in abeyance as assured by CMD BSNL. Sr. GM (Pers.) mentioned that the representation of our Association will shortly be examined by a committee to sort out the issue. We expressed our resentment against the indifferent attitude of BSNL Corporate Office Pers. Cell wherein discriminatory and wrong clarifications on EPP are being issued which is causing heavy recoveries and downgrading the pay scales of Executives'. Similarly the pay anomaly cases wherein senior Executives'are drawing less pay then their juniors , no suitable instructions in this regard are being issued by BSNL CO. A good number of DGMs/DEs/SDEs posts are lying vacant since long but are not being filled up on one or the other pretext. Hundreds of requests / tenure transfer cases and seniority cases of SDEs /DEs are not being considered since long.

Against this indifferent and unhelping attitude of BSNL CO Pers branch we have to start Organizational Action Programmes at the earliest. All the CHQ Office Bearers, Circle/Branch Secretaries are requested to keep Organizationally ready.

22.11.2010: GS, AGS(F) met Sr.DDG (Vig.) DoT and discussed:-

(a) Cancellation of zonal transfers of BSNL Executives'based on ODI lists/Agreed lists- We requested to withdraw / modify DoT letter no. 17-38/2010-VM-I Dated 04.02.2010 wherein the direction was given to CMDs BSNL/MTNL regarding issuance of transfer of Officers appearing in agreed list/ODI (Officers of doubtful integrity). We pleaded that as per CVC guidelines Officers of agreed list /ODI list are to be transferred from sensitive post to non-sensitive post but not on zonal basis. Sr. DDG (Vig.), DoT spoke to CVO BSNL and advised him to issue direction to all DGM (Vig) to review ODI lists after every 6 months for its updation but he was non-committal for cancellation of zonal transfers. On this issue we shall again meet to Member (S) on his return from his tour/ leave upto 06.12.2010.

(b) Amendments in Rule 61 of BSNL CDA Rules , 2006- Sr. DDG (Vig.) informed that BSNL Management has been directed to ammend in Rule 61 of BSNL CDA Rules 2006. Click here for the order

22.11.2010: GS, AGS(F) met DDG (Estt.) , DoT and discussed :-

(a) IDA pension revision of BSNL pensioners:- We requested for early reply of some queries on Cabinet note sent on IDA pension revision of BSNL pensioners. DDG (Estt.) mentioned that some additional feedback on Cabinet Note for IDA pension revision for BSNL pensioners is being prepared and will be sent shortly after the approval of Secretary (T) .He expected that Cabinet approval on IDA Pension Revision issue will be available within a period of one month.

(b) Corrigendum on Pay fixation in case of Group 'B' officers absorbed in BSNL, who have opted for IDA pay scale from the date of promotion after 01.10.2000:- DDG (Estt.) informed that corrigendum on this matter has been issued today as it was brought to his notice by this Association. Regarding clearance from DoP&W on this issue DDG (Estt.) informed that DoP&W has commented to take clearance from DoP&T, hence the case will be sent to DoP&T for clearance shortly. 15.11.2010: JAC's Parliament March- A Great Success:-The JAC call to Parliament March programme held at New Delhi today and it was a Great Success. The rally started from BSNL Corporate Office, New Delhi at 1130 hrs. Thousands of BSNL Non-Executives' and Executives' participated in the rally with banners, play cards and flags. The involvement and enthusiasm shown  by the  participants  is  a  warning  to  the  government. The slogans were raised  against the  wrong BSNL  policies of the Government e.g. 30% disinvestment of BSNL/privatization, VRS to 1 Lakh Employees, unbundling of BSNL's last mile copper conductor and non-procurement of GSM equipment to BSNL. Immediate settlement of ITS Officers absorption issue. The rally went through Janpath, Tolstoy Marg and Parliament street. It was stopped at the Parliament street police station, where a huge  meeting  was  conducted. Com. Basudev  Acharya, Hon'ble M.P., and  a  leader of the CPI(M) group in the Lok Sabha, inaugurated the meeting. Others who addressed the meeting were Com.V.A.N. Namboodiri, Convenor, JAC, Com. P. Abhimanyu, General Secretary, BSNLEU, Com. Prahlad  Rai, GS ,AIBSNLEA, Com. A.A. Khan, AGS (SNEA), Com.C.Singh GS,NFTE, Com. K. Vallinayagam, GS (FNTO), Com. V. Subburaman, GS (TEPU), Com. S.P. Sharma (WRU), Com. Hari Singh (BTU) and Com. R.S. Yadav (ATM) BSNL addressed the meeting.

AIBSNLEA members in large number from nearby states , BSNL CO and Delhi Circle actively participated in the rally. 12.11.2010: GS, AGS(F) & GS, AGS SNEA(I) met CMD BSNL & discussed. Sr. GM(Pers) was also present in the meeting.

(a)    DPCs from DE to DGM, SDE(T) to DE(Adhoc), Regularization of Adhoc DEs & JTO(T) to SDE(T): We requested CMD for his kind intervention for early holding of DPCs  from DE to DGM, SDE(T) to DE(Adhoc), Regularization of Adhoc DEs & JTO(T) to SDE(T) to fillup all vacant DGM, DEs & Adhoc SDEs(T) vacant posts. Sr. GM(Pers) apprised the status of DEs. CMD directed Sr. GM(Pers) to expedite the DPCs.

(b)   Implementation of DPE OM dated 02.04.2009 regarding 78.2% IDA fitment benefit:- CMD further mentioned that let the BSNL earn profit thereafter the issue of 78% IDA fitment benefit may be considered. He further mentioned that in the next BSNL Board Meeting approval is being taken to take Rs. 2000 Crs Bank loan before 31st March 2011 & Rs. 10,000 Crs for the next financial year to meet the operational & Maintenance & wage payments requirement.  He apprised that in last quarter there is a growth of GSM lines in BSNL but revenue should also be increased.

(c)    5.5 Million GSM Lines Tender:- CMD BSNL informed that the financial bid of 5.5 million GSM lines tender has been opened & it is found that Alcatel Lucent is the L-1 bidder in RF segment (about 225 Crs.) & ZTE is L-1 for Core equipment (about 1500 Crs.). These rates are less than the Phase-V GSM tender.

(d)   Withdrawal of BSNL Corporate Office clarification on EPP regarding recoveries of AOs/AAOs pay & PA/PSS pay:- We requested CMD to withdrawal   of BSNL Corporate Office clarification on EPP regarding recoveries of AOs/AAOs pay & PA/PSS pay. We pleaded that the clarification issue are not justified & against the BSNL EPP & DOT instructions. CMD after detailed discussions, advised GM(Pers) for keeping the clarification held in abeyance till the time cases are re-examined.

(e)    Removal of Pay anomaly cases wherein juniors are drawing more salary than their Sr. Executives after implementation of EPP & 2nd PRC :- We requested CMD for removal of Pay anomaly cases wherein juniors are drawing more salary than their Sr. Executives after implementation of EPP & 2nd PRC. CMD assured to look into the matter.

JAC PARLIMENT MARCH ON 15.11.2010: Joint Action Committee of BSNL Executive Associations and Non-Executives Unions decided Parliament March on 15-11-2010 at New Delhi to protest against the wrong Policies of the Government which are adversely affecting the BSNL viability and its workers. The Parliament March will commence from BSNL Corporate Office (Bharat Sanchar Bhavan ) Janpath New Delhi at 11.00 AM and will reach to Janter Mantra in form of Rally. A meeting will be addressed by eminent Trade Unions leaders and Hon'ble MPs. All the Circle Secretaries of nearby Circles, i.e. UP (W), Haryana, Rajasthan, Punjab and the Circle Secretaries BSNL CO Circle and Delhi circle are requested to ensure maximum participation.

10.11.2010: 3rd circle conference of AIBSNLEA J&K Circle at Jammu on 9th and 10th Nov. 2010:- Third circle conference of AIBSNLEA J&K was held on 9th and 10th November 2010 in City of emples Jammu circle. In the delegate session, the deliberations were held on organizational and other viability related issues. The discussions were held in democratic and congenial atmosphere and it was resolved that everybody will strengthen the organization which in turn will help in strengthening the BSNL. In the afternoon, a delightful and impressive open session was started with cultural programme depicting Jammu and Kashmir culture in Abhinav Theatre, the historical theater of Jammu.

In the open session, Sh. R.K. Kaul, CGMT  J&K Circle was the chief guest. Sh. B.D.Garg , GM(A) Circle office, Shri Sandeep Srwakar GMTD Jammu, Shri S.K.Kaul GM Finance, Shri Neeraj Goel, Chief Engineer (Civil) and Shri A.K. Gupta Chief Engineer (Electrical) were Guest of Honour from administration.

Shri Prahlad Rai, Beloved General Secretary, Shri Satish Kumar, Organising Secretary (North) were special guests from Association side. Viability of BSNL was the main focus of discussion. A welcome address was delivered by Sh. P.C.Thappa D/S Jammu. It was followed by inaugural address by Shri Fiyaz Koul, President who stressed the need for unity among all to fight for the real cause. An impressive and vibrant address on viability on BSNL was delivered by Comrade Sunil Parimoo. He asked the members not to get panicky but to concentrate on result oriented work and adapt themselves to the changed external environment. It was followed by the key note address of Shri R.J.Kaw C/S who highlighted all the organizational and other viability points that were discussed during the session.

GM(A) stressed for the growth of BSNL through dedication and by motivating the staff. GMTD Jammu stressed on the need to initiate the actions rather than discussions only. Chief Engineer(Civil) stressed that BSNL expertise can be outsourced to other deptts for earning the revenue. Shri S.K.Kaul, GM(F) showed the confidence that BSNL will bounce back to healthy position.

Beloved General Secretary in his impressive speech touched all the aspects of BSNL right from Corporate office to Circles and of each unit i.e. Engineering, Accounts, Electric, Civil, Official Language Officers, PA and PSs etc. His long firebrand speech of two hours enthused enthusiasm in the audience. The large gathering of Executives, representatives of all other associations and unions lauded applause a number of times during the address of General Secretary.

CGMT J&K Circle in his address stressed for cohesive and comprehensive coordinated work culture in J&K circle . He also emphasized on the roll of marketing strategy and business plans that can improve the growth and revenue. He delighted the house by informing that J&K Circle is a profitable Circle. The session concluded by felicitating Retirees (retired after 2008) with mementos. The dignitaries on the dais specially Sh. R.K. Kaul who had recently joined on promotion as CGMT J&K, were facilitated on this occasion. The open session due to its healthy, democratic and well managed atmosphere lasted upto 10 PM in the night. The vote of thanks were given by Shri M.A.Masoodi D/S Srinagar. The stage was managed by dynamic and composed comrade Shri R.K.Boni, DGM(Finance) and he was assisted by Shri Bodh Rah Bhagat DE Satellite, the sefless worker in the association. On 10th November, 2010 an interaction meeting was held between General Secretary and delegates in Premier Hotel Jammu wherein General Secretary replied to the specific queries raised by the representative  Counsel. It was followed by unanimous elections conducted by Senior Comrade Shri T.K.kaul as Chairman and assisted by Shri M.L. Fotedar (Xen-Electric) in cordial and comradeship atmosphere. 08.11.2010: GS, AGS(F), FS met Member (T), DoT and extended Diwali greetings. We requested him to extend his support to BSNL for making it again a profit making PSU. Member (T) mentioned that DoT is extending its support to BSNL and avoiding undue interference. He further mentioned that BSNL employees should change their attitude and behavior to the customers. It will not only retain the customers but will also increase customer base. Reply to our query regarding CMD and Director (F) appointment in BSNL he mentioned that matter is pending with ACC and approval is expected shortly.

08.11.2010: GS, AGS(HQ) met Sr. GM(Pers.) and discussed:-

(a) DPC from DE to DGM (Engg.):- We requested to expedite the DPC from DE to DGM. Sr.GM (Pers.) informed that DPC work is in final stage but the vigilance clearance is still awaited. DPCs from JTO to SDE and SDE to DE are also in process. 

03.11.2010: GS, FS, AGS (F) met Secy. Telecom, DoT and greeted him on Diwali festival. During courtesy call meeting, we requested him to extend his support to BSNL for its growth & viability mainly procurement of  GSM Equipment, Settlement of ITS Officers absorption issue in BSNL/MTNL, Reimbursement of license fee, USO Charges etc. Secy. Telecom mentioned that DoT always support BSNL alongwith other operators but in the present scenario BSNL needs to perform to earn more profit. He assured that due support to BSNL will always be their.   

03.11.2010: GS, FS, AGS (F) met Member(S) and greeted him on Diwali festival & discussed :-

(a) Viability of BSNL: - We requested for DoT support to BSNL to make it further profit making PSU. Member(S) mentioned that today morning Hon'ble MOC&IT conducted performance review meeting of BSNL with CMD, BSNL & Board of Directors of BSNL. Wherein BSNL Management presented the developmental plans revenue earning data etc and it is found that BSNL revenue earning is reducing year by year. In the last year, the revenue from Landline was about 20,000 Cr, which is now reduced to 8,000 Cr & revenue of GSM  Lines from last year i.e. 5,000 Cr has increased to 10,000 Cr. Hence overall revenue earning has reduced. Which reflects that even after the withdrawal of ADC Charges, payment of license fee, USO Charges, payment of spectrum charges; the revenue of BSNL has decreased. In view of this, BSNL has to earn revenue to earn profit.

(b) IDA Pension revision Case:- Member(S) informed that Cabinet note after the approval of Hon'ble MOC&IT has been sent to Cabinet for approval, which may take minimum one to two months time.

(C) Cabinet note on ITS absorption issue:- Member(S) informed that Cabinet note has been sent to nodal ministries for inter-ministerial circulation, which may take minimum two to three months time in clearance.

(d) Deferred Option from CDA to IDA Pay scale after 01.10.2010:- We requested for early decision to allow deferred option from CDA to IDA pay scale after 01.10.2010 on absorption in BSNL. Member(S) informed that the case has been understood properly on the basis of feedback given by the Associations / individuals & ruling positions and now it has been sent to DOP&W for clearance. It is understood that the case will be settle favorably.

(e) Cancellation of Zonal transfer order of BSNL Executives issued on the basis of ODI list:- We requested for early clarification on the letter of CMD, BSNL regarding zonal transfer of BSNL executives based on ODI list & CVC guidelines- Member(S) immediately contacted to Sr. DDG(Vig.) to know the status but Sr. DDG was not available at that time. He advised to discuss the matter in the next week in the presence of Sr. DDG(Vig.)

(f) Regarding media coverage i.e. "DoT rejects Pitroda panel suggestions on BSNL" : On our queries to media coverage regarding DoT rejects Pitroda panel suggestions on BSNL;  Member(S) mentioned that so far the Committee headed by him report has not been discussed in the Telecom Commission Meeting, hence question doesn't arise for rejection.

02.11.2010: GS, AGS(HQ), AGS(F), FS and Org. Secy(N) met CMD BSNL, Director(CFA) BSNL, Director (CM) BSNL & other Sr. Officers of BSNL HQ and greeted them on Diwali festival. On the issue of payment of PLI; CMD mentioned that he will taking up the matter in the next BSNL Board Meeting by the end of this month only.

(a) Regarding 78.2% fitment benefit:- CMD BSNL mentioned that the matter has been discussed in BSNL Board meeting but Board advised  that DPE order can be implemented when BSNL makes profit. We further pleaded that on the date of issuance of DPE order i.e. 02.04.2009; BSNL Profit Before Tax (PBT) was more than 570 Cr, hence DPE order needs implementation. CMD further mentioned that at this juncture BSNL not in a position to afford additional expenditure of about 1000 Cr in implementing DPE order. However he mentioned that at this stage DPE order for 78.2% fitment benefit can be implemented when the earlier pay fixation benefit of 30% is reduced to 24%, which we strongly opposed.  

(b) Promotion of DE to DGM & DE regularization: - CMD further mentioned that DPC are under process & shortly promotion order will be issued. He further mentioned that recently 37 DGMs from other PSUs/Private Companies has joined BSNL & they are under going for training at ALTTC, GZB, which will provide new experience to BSNL.

02.11.2010:  GS, FS and OS(North) and Advisor-I met Sr. GM(Estt.) and discussed:-

(a) Anomaly due to accrual of increment of Junior earlier than the senior after fixation of pay in revised pay scale implementation of 2nd PRC:- The issue of anomaly was addressed by PAT, BSNL C.O. and an order on this count was issued vide No.2-8/2009-PAT(BSNL) dated 23.09.2009. As per this order, anomaly has to be settled by ante-dating the increment of the senior to that of the junior who draws more pay than the senior after implementing the 2nd PRC. Antedating the increment of the senior was the only solution available in these cases and the above order has been implemented by many Circles.

Now vide letter No.2-8/2009-PAT(BSNL) dated 14.06.2010, PAT, BSNL C.O. has modified the above order. The revised order says that wherever, the anomaly occurs, the pay of the senior has to be stepped up to that of the junior without antedating the increment and the senior will draw his/her next increment after 12 months from the date of such stepping up. After this order the seniors will be subjected to recurring and perpetual loss in pay on application of the revised PAT order. However, if the anomaly is not settled, the junior will always be drawing more pay than the senior every year during the period from Feb to Jul in this particular case.

We requested to restore the original order dated 23.09.2009 wherein provision for ante-dating the increment of the senior to that of the junior was envisaged. Alternatively, management can think of any other solution that will address the issue of anomaly wherein the junior does not draw more pay than the senior and also the senior does not face any drop in his basic pay which he/she will be drawing by virtue of the 3% annual increment provided in the rule. Sr. GM (Estt.) assured to re-examine the case at the earliest.

(b) Pay fixation of the Executives on 2nd time bound financial up-gradation:- The clarification issued by PAT Section on pay fixation on promotion/up-gradation has confused the different divisions in BSNL Corp. Office rather than easing the fixation cases.  CSS Section and Pers Section are following the PAT Section guidelines issued on 31.3.2009, but Pers Cell and SEA Section of BSNL CO are interpreting the PAT guidelines in a different manner.  It is understood, PAT Section has issued clarification without even taking finance concurrence from Establishment Finance. The following points regarding pay fixation on promotion/up-gradation needs consideration for review of clarification already issued on 31.3.2009:

(i) The pay fixation on up-gradation of Executives in BSNL Hqrs.  from E3 to E4 Scales vide SEA order No.7-4/2007-SEA dated 11.1.2010, has been fixed by giving one notional increment of 3% on the basic pay arrived at after giving normal annual earned increment of 3% on 1.10.2009.  (This is as per the clarification issued by M/Finance on the subject, vide letter No.1/1/2008-IC dated 13.8.2008).

(ii) As per OM dated 30.3.2009 by PAT Section, One notional increment equal to the increment being drawn by the executive in the pay scale, before such promotion would be granted and pay fixed in the promoted pay scale and rounded off to the next multiple of Rs.10. 

(iii) The rate of increment has since been fixed as 3% uniformly  the enhancement of pay on promotion cannot be taken in terms of rupees, or less than 3% of basic pay.   In other words, the full 3% increment is admissible as notional increment on promotion.

(iv) Since 3% rate of increment has also been adopted by Govt. of India under CDA scales, M/Finance, Dept. Of Expenditure (Implementation Cell) has issued correct method of fixation of pay on promotion vide letter No.1/1/2008-IC dated 13.8.2008. 

(v) The pay fixation on promotion as adopted by some of the PSUs namely, M/s HPCL, M/s ONGC, M/s MTNL as given below may also be referred.  "Pay Fixation on Promotion    One notional increment equal to the increment being  drawn by the  executive in the pay scale  (i.e. @ 3% of pay), before such promotion would be granted and pay fixed in the  promoted pay scale and rounded off to  the next multiple of Rs.10/-"

We requested for rectification of pay fixation of the executives on promotion/up-gradation. Sr.GM(Estt.) assured to re-examine the case.

01.11.2010: Special General Body Meeting of AIBSNLEA, A&N Circle was conducted on 26-10-2010 at Hotel Sun Sea Resort, at 1930hrs.The meeting was presided by Circle  President, Shri.V.T. Gunasekaran and was graced by Shri.P.Venugopal, AGS,(F) CHQ, New Delhi. The meeting was conducted successfully and almost all the members of Association stationed in Port Blair had attended meeting and actively participated in the deliberations. Circle Secretary Shri.A.Thomas had highlighted the issues relating to A&N  Circle pending to be pursued by CHQ and presented a memorandum to AGS(F).

Shri. P.Venugopal, AGS(F) addressed the gathering and clarified the current status of the pending issues raised by the members. He has elaborately explained the Achievements of the Association such as Time Bound Promotion Policy, etc and Current Financial position of BSNL, The urgent need to improve our Services and strengthening of our Association. (A) Harassment and victimization of Executives of Bhandara SSA by GMTD Bhandara:- We strongly protested against the harassing attitude of the GMTD Bhandara towards BSNL Executives' and requested for immediate intervention. Sr. GM(Pers) assured to look into the matter

(B) Immediate withdrawal of clarification regarding counting of residency period and consequent up gradation under EPP/ACP- Sr.GM (Pers.) assured to reexamine the case.

(C) Holding of LDCE to fill up about 5000 vacant SDEs(T) posts:- We demanded to hold LDCE to fill up about 5000 vacant SDEs(T) posts at the earliest. Sr.GM (Pers.) assured an early action.

(D) Posting of SDEs(T)/ DEs in DoT cell- Sr.GM (Pers.) informed that DoT cell has demanded to send about 250 SDEs(T)/DEs to DoT cell in all circles (about 7-8 DEs in each Circle) and shortly BSNL CO will call for the volunteers.

(E) Withdrawal of  clarification issued treating Sr.AO/AAO and Sr. SDE of DoT as pure time bound promotion- We strongly protested and demanded to withdrawal the clarification issued of Sr.AO/AAO and Sr. SDE as pure time bound promotion, whereas in DoT these were post based promotions. Sr. GM (Pers.) assured to look into the matter.
