30.06.2010 : Mega Promotion Order from SDE (T) to DE (Adhoc) issued : Historical achievement : CONGRATULATIONS !! Consistent and untiring efforts of AIBSNLEA yielded result in getting released the promotion order of 1679 SDEs (T) to DE (Adhoc). 1530 DEs on promotion have been given posting in the same Circles accept 149 SDEs i.e. 73 from CHTD, 52 from STR and 17 to NE-II, 7 to NE-I from some Circles due to non-availability of vacant posts of DEs. The SDEs of promoted from OC category are 1308 (up to seniority no. 15300), from SC category are 286 (up to seniority no. 16221.1) and from ST category are 85 (up to seniority no. 24491).

AIBSNLEA ensured for strict implementation of SC-ST point to point roster. This DPC was initiated in January 2009 to fill up 2400 DEs vacant posts on adhoc basis but delayed due to some court cases and after finalisation of court cases again restarted in June 2010 and found that during the period many OC/SC/ST SDEs have retired. Hence in absence of ACRs / VCRs of required SC/ST SDEs, the OC candidates promotion could not be made. Though their ACRs / VCRs were available for DPC.

AIBSNLEA expressed its serious resentment against non-filling up of 2400 DEs posts as approved by the competent authority and demanded that the required ACRs/VCRs of eligible SC/ST candidates should immediately be called to fill up all vacant DEs posts immediately. Director (HR) assured that immediately the ACRs/VCRs of all eligible OC/SC/ST SDEs will be called and he directed GM (Pers) to issue the promotion order to fill up all vacant DEs posts by the end of July 2010. All the CHQ office bearers, Circle/Branch Secretaries are requested to ensure immediate sending of the ACRs / VCRs of the eligible SDEs to BSNL CO.

We are extremely thankful to the CMD, Dir (HR), GM (Pers), DGM (Pers), CVO, DGM (Vig) and the officers and staff of Pers Cell and Vigilance Cell for their extraordinary efforts in completing the DPC process and issuing the posting order on promotion. We request all newly promoted DEs to contribute more with greater zeal and motivation for the growth of BSNL.

01.07.2010: Status of Court Case against SDE(T) to DE(Adhoc) DPC in Hon'ble CAT Bangalore: The case filed by SC-ST Welfare Association in Hon'ble CAT Bangalore against SDE(T) to DE(Adhoc) DPC was heard today but the advocate of the applicants side was not present. It is posted for hearing on 21st July'2010

30.06.2010:  JAC meeting with CMD BSNL:- JAC leaders met CMD BSNL, Director (HR), GM(Estt.), GM(SR) were also present in the meeting.  

(a) Implementation of DPE OM dated 02.04.2009 regarding 78.2% IDA fitment benefit regarding:- JAC pleaded for immidiate implementation of DPE OM dated 02.04.2009 regarding 78.2% IDA fitment benefit instead of 68.8%. After detailed discussions CMD assured that Committee headed by ED(F) on this issue will submit its recommendations within 15 days period and thereafter as per the decision of BSNL Board necessary action in this regard will be taken. GM(Estt.), Convener Committee invited BSNLEU, AIBSNLEA and SNEA representatives to discuss the matter separately but JAC informed to CMD BSNL, GM(Estt.) that JAC will only discuss the matter instead of individual Union/Associations.

(b)Poor growth of BSNL Telecom Services- CMD expressed his serious concern against the poor growth of BSNL GSM Services in comparison to the private operators. JAC pleaded that proper monitoring in Circles /SSAs is required and the problems /deficiencies if any should immediately be looked into. JAC suggested that some Circles/SSAs of poor growth should be identified and some groups/teams represented by Management side and Staff side should visit the Circles and should find out the reasons of poor growth and immediate corrective measures should be taken. CMD agreed to the proposal and early decision in this regard. 

(c) Payment of 3G and BWA spectrum charges- JAC expressed its serious resentment against the payment of 3G and BWA spectrum charges without discussing with JAC. CMD explained that there was a tremendous pressure from Govt. to release the payments of 3G and BWA spectrum charges . He mentioned that matter has been taken up with DoT Member (F) regarding reimbursement of the spectrum fee being the BSNL state owned company and providing Telecom Services in the rural part of the Country on reduced rental.    

30.06.2010: GS met Director (HR) and discussed regarding - 

(a) Issuance of promotion order from SDE(T) to DE(Adhoc) today itself since several SDEs(T) eligible for DE promotion are retiring today. Dir (HR) assured an early action in this regard.

(b) Regular promotion to DE- We requested to complete the regularisation of Adhoc DEs. Director (HR) assured early DPC.

30.06.2010: GS, AGS(HQ) met Secy(T) and discussed:-

(a)  Reimbursement of 3G and BWA spectrum charges to BSNL:- We requested for the reimbursement of 3G and BWA spectrum charges to BSNL since BSNL is providing services in the rural parts of the Country and BSNL was not given proper opportunity to participate in the spectrum bidding process and deciding Telecom Circles for  operating the services. We further requested that BSNL should be allowed to pay only reserve price as happened in the case of 2G spectrum allocation to BSNL. Secy(T) mentioned that BSNL is not in short of funds as per the Balance Sheet. Hence BSNL payment is justified.

(b)  ITS Officers absorption and IDA pension revision:- We expressed our dissatisfaction against delay in finalizing the Cabinet note on ITS Officers absorption and IDA pension revision. Secy(T) mentioned that Cabinet Note on both the issues is being finalised and shortly will be sent to inter-ministerial circulation.

(c)  Implementation of DPE OM dated 02.04.2009 regarding 78.2% IDA fitment benefit regarding:- On this issue Secy(T) further reiterated that on this issue BSNL Management has to take decision.

29.06.2010 : JAC Meeting - Joint Action Committee meeting held today and discussed about the meeting held with Hon'ble MoC&IT at Coimbatore on 25.06.2010 and decided further follow up action. Com. Convener apprised that the venue for National Convention at New Delhi on 19.07.2010 is being finalised shortly. State level conventions are decided at Hyderabad on 07.07.2010 and at Chennai on 09.07.2010. JAC wanted that circle/branch level JACs should immediately arrange dispatch of Postcards to Hon'ble Prime Minister before 05.07.2010. JAC expressed its serious concern against non-implementation of DPE OM dated 02.04.2009 regarding 78.2% IDA fitment benefit instead of 68.8% fitment. JAC got appointment with CMD BSNL to discuss the matter tomorrow morning 09:30 AM.

29.06.2010: DPC from SDE (T) to DE (Adhoc) - GS, President and other CHQ office bearers at New Delhi continuously persuaded BSNL Corporate Office Vigilance Cell and Pers. Cell to compile the VCRs received from various Circles to complete the DPC. On our sincere efforts majority VCRs are compiled by Vigilance Cell and sent to Pers. Cell. Efforts are being made to get released the promotion order from SDE (T) to DE (Adhoc) immediately so that our retiring Comrades on 30.06.2010 are benefited.

28.06.2010 : GS, AGS (HQ), AGS (Fin) met PGM (FP) and discussed regarding modifications / cancellations of unjust mass transfer and posting orders of CAOs/AOs and modification of posting order on promotion to DGM (Fin) on genuine grounds. We expressed our serious concern against delay in considering the modifications / cancellations of unjust mass transfer and posting orders of CAOs/AOs and modification of posting order on promotion to DGM (Fin) on genuine grounds. PGM (FP) mentioned that some modifications of posting order to DGM (Fin) have been issued and some cases are being examined as raised by our association. The CAOs and AOs transfer and posting orders for modification / cancellation are under consideration as requested by our association. He assured for an early action.

28.06.2010 : As per the recommendations of Joint Committee of BSNL Officers and representatives of BSNL Executives Associations regarding change of designation on Time Bound Up gradations / promotions, we have been demanding of its implementation. Now GM (SR) has further asked the views / suggestions of AIBSNLEA on this issue. All CHQ Office Bearers, Circle Secretaries are requested to submit their view / suggestions to CHQ before 1st July 2010 for further submissions.

28.06.2010 : GS and GS (SNEA) met GM (Pers) regarding SDE (T) to DE (Adhoc) DPC and requested him for early issuance of promotion order from SDE (T) to DE (Adhoc) since all the Circles have sent the VCRs of eligible SDEs to BSNL CO. GM (Pers) assured an early action in this regard. We are extremely thankful to all CGMs, our CHQ office bearers, Circle / Branch Secretaries for their extraordinary efforts in sending the VCRs from their Circles to BSNL CO.

25.06.2010:  JAC leaders meeting with Hon'ble MOC&IT at Coimbatore :- Com. GS alongwith JAC Leaders met Hon'ble MOC&IT at Coimbatore today and expressed their serious concern against the payment of Rs. 18,500 Carors as 3G Spectrum & BWA Spectrum charges to DoT HQ from BSNL.  They requested Hon'ble MOC&IT for immediate refund of highest bidding spectrum charges to BSNL as BSNL was not given opportunity in the bidding process & to decide the Circles for operating these services. JAC requested that Govt. should charge only Reserve Price / Bench Mark spectrum charges of 3G & BWA Services from BSNL,  as was in the case of 2G Spectrum Charges from BSNL. JAC also expressed its dis-satisfaction for non action of the DoT administration & BSNL Management for the settlement of JAC demands & the assurances given by Hon'ble MOC&IT on 20.04.2010 during indefinite strike mainly the Cabinet note of ITS Officers absorption in BSNL/MTNL & IDA Pension revision even after the laps of two months have not been sent for Inter-Ministerial Circulation. Similarly the 10 Million GSM lines equipment procurement order is delayed. The IDA fitment benefit of 78.2% from 68.8% as per DPE OM dated 02.04.2009 is not being implemented despite the direction given by Hon'ble MOC&IT. After detailed discussions on above issues, Hon'ble MOC&IT assured that he will take-up the issues of refund of 3G & BWA Spectrum charges to BSNL & payment based on Reserve Price with the empowered Group of Ministers, Hon'ble Finance Minister and also with Hon'ble Prime Minister.  He appreciated the concern of JAC & assured to stood behind for the viability of BSNL. Regarding other demands of JAC and the assurances  given by him, he mentioned that he will shortly discuss all these issues on his return to Dehli.

JAC Leaders extended thanks to Hon'ble MOC&IT for granting the meeting at Coimbatore despite of his very busy schedule. JAC Meeting is decided to be held on Tuesday i.e. on 29.06.2010 at New Delhi to decide the further strategies.  JAC Chennai convention is decided to be held on 9th July'2010.

24.06.2010 : DPC from SDE (T) to DE (Adhoc) held up – VCRs from only 20 Circles have been received in BSNL Corporate Office so far. VCRs from the following 23 Circles are still awaited- A&N, AP, AS, ETP, BR, CHTD, GJ, HR, HP, J&K, JKD, KRL, MH, MP, NTR, NCES, OR, PB, RJ, TN, UP(E), UP(W) & WB. All the Circle Secretaries are requested to immediately pursue with the respective DGMs (Vig) and CGMs for immediate sending of VCRs by tomorrow morning so that the same are collected by GM (Pers) from CVO BSNL Corporate Office. DPC is held up in the absence of VCRs.

24.06.2010 : Payment of BWA Spectrum charges of Rs. 8313 Crores from BSNL to DOT HQ - BSNL Management paid BWA spectrum charges of Rs. 8313 Crores  to DOT HQ despite the assurance given by the CMD BSNL in the presence of BSNL Management Committee that the payment will be made after discussion with the JAC. Rs. 30 Crores as penal interest for two days i.e. 23rd & 24th June 2010 has been raised by DoT HQ.  Hence BSNL has paid Rs.18500 Crores spectrum charges of 3G and BWA which has minus the BSNL reserve from Rs. 28000 Crores to Rs. 8500 Crores. The same will be finished after the payment of wage revision (about Rs. 4000 Crores for wage revision) & for creating fund for leave encashment (about Rs. 5000 Crores). It is a matter of great concern to all BSNL personnel. JAC will consider immediate strong protest actions against arbitrary payment.

23.06.2010 : In the JAC meeting held on 23.06.2010, JAC decided to meet Hon'ble MoC&IT Shri A. Raja at Coimbatore. Since he is busy in World Tamil Conference at Coimbatore and will return New Delhi after 28.06.2010. JAC leaders after getting appointment with Hon'ble MoC&IT will meet today on 24.06.2010 at Coimbatore requesting to defer the payment of BWA spectrum charges or allow to pay reserve price charges. Government is pressing BSNL Management for immediate payment of Rs. 8313 Crores BWA Spectrum charges. BSNL has already paid Rs. 10,178 Crores to DoT. Payment of BWA Spectrum Charges of Rs. 8313 Crores from BSNL to DoT will finish the BSNL reserves. The JAC meeting was chaired by Com. GS AIBSNLEA.

21.06.2010 : GS, AGS (F), FS along with GS, AGSs, SNEA (I) met Dir (HR). GM (Pers), GM (Estt) and GM (Rectt) were also present in the meeting. The following issues were discussed :

(a) DPC from SDE (T) to DE adhoc and DE Regular : We expressed our serious concern against delay in completing the DPC process from SDE (T) to DE adhoc and DE Regular. Dir (HR) mentioned that the DPCs are under process but the VCRs are not being received from the Circles. He requested to cooperate the BSNL Management in completing the VCRs so that DPC can be completed at the earliest.

(b) LDCE to fill up 33% of SDEs vacancies : We requested to hold the LDCE from JTO to TES Gr. B against 33% LDCE quota. GM (Rectt) mentioned that as per Hon'ble PB CAT New Delhi judgment the JTOs recruited in 2005 and thereafter should also be allowed to appear in the LDCE. Similarly hundreds of JTOs are filing court cases to appear in this LDCE. GM (Pers) informed that against Hon'ble PB CAT New Delhi's judgment an appeal is being made in the Hon'ble High Court, New Delhi.

(c) Continuous deprivation of Sr. SDEs who were drawing less salary than their juniors : Case of 1990 year DPC SDEs (T) : We requested Dir (HR) to intervene and direct GM (Pers) to examine the pay fixation cases wherein after implementation of EPP and 2nd PRC the Sr. SDEs promoted in 1990 DPC are drawing less salary than their junior SDEs. We requested to examine and allow stepping up of the pay of seniors from their juniors.

(d) Appeal case of Shri E.Sivaramadu, DE HTD and Ex. Circle Secy, AIBSNLEA, AP Circle : We expressed our serious resentment against dropping of Shri E. Sivaramadu in DGM DPC based on 1 average and 1 good entry. Director (HR) assured to look into the matter.

(e) Change of Designation on each time bound upgradation:- We requested that as per the recommendation of the Joint Committee of BSNL Management  & the  Executives Associations of BSNL, the designation on each time bound promotion indicating higher status may be given.  Since there was an agreement in principle & in general among both sides on this issue, further deliberations on designation change should have been carried out separately but till now no deliberations could be arrange by BSNL Management on this issue. GM (Pers.) informed that deliberation has already been made recently on this issue & Committee Members will be discussing on 23rd June & will submit Committee report before 30th June 2010. Director (HR) assured to look into the matter.

21.06.2010 : Joint Action Committee meeting : After the meeting with BSNL Management Committee, the JAC leaders met separately and discussed the developments and decided that JAC will meet tomorrow 9.30 with Hon'ble MoSC&IT Shri Sachin Pilot to discuss the burning issues and will arrange immediate meetings with Hon'ble MoC&IT and Ministry of Finance.

The JAC after detailed discussions decided to apprise and mobilize the BSNL workers against Govt's wrong policies which are adversely affecting the viability of BSNL and its workers as well as to apprise the general public through media and by convening conventions / meetings etc. The following decisions were taken unanimously :

1. Postcard Campaign before 5th July 2010 : JAC decided to send 3 lakh postcards to the Hon'ble Prime Minister, to be signed by the BSNL employees, on the unjustified collection of a huge amount towards spectrum charges. These postcards are to be posted latest by 5th July, 2010. Matter for postcard campaign

2. Holding of Conventions : With a view to mobilize the workers, as well as to campaign among the public, JAC decided to conduct conventions immediately throughout the county.

3. National Convention at New Delhi : A national convention is to be organized at New Delhi on 21st July, 2010. It is also decided to invite the Central Trade Union leaders / MPs to this convention.

4. Regional Level Conventions : It is decided to hold regional level conventions at least at Kolkata, Chennai, Bangalore, Mumbai (or some other place in Maharashtra), Jaipur and Lucknow before the national convention is held at New Delhi.

5. Formation of Circle and District level JACs : JAC decided that immediately Circle and District level JACs should be formed.

All the CHQ / Circle / Branch office bearers are requested to ensure successful implementation of the above decisions to safeguard the interest of BSNL and its survival.

21.06.2010 : JAC meeting with BSNL Management Committee : JAC leaders had meeting with BSNL Management Committee. Com GS, AGS (Fin) attended the meeting.

(a) JAC strongly protested the payment of 3G spectrum charges of Rs. 10,178 crores and demanded to stop the payment of BWA spectrum charges of Rs. 8,313 crores since BSNL has not given opportunity to participate in the spectrum bid process and BWA spectrum allocation to BSNL is not much beneficial. After detailed discussions CMD assured to look into the matter and to take up the issue with Govt.

(b) AGR payment to Govt. : JAC demanded that BSNL should go to TDSAT against the payment of higher AGR to Govt. from BSNL whereas private operators approached to TDSAT against the increased payment of  AGR and obtained stay order in this regard. CMD BSNL assured that BSNL would also approach to TDSAT in this regard.

(c) Procurement of GSM equipment : CMD BSNL mentioned that BSNL Board has taken the decision for the procurement of 5.5 million GSM lines equipment as per the immediate requirement in North and East zones and 50% of 5.5 million GSM lines equipment can be further ordered if requirement is more. Director (CM) mentioned that the tender for 5.5 million GSM lines will be completed by the end of August 2010 and APO will be placed immediately.

18.06.2010 : Joint Action Committee Meeting with Secy (T) : JAC leaders met Shri P.J.Thomas, Secy (T) and discussed :

(a) 3G and BWA Spectrum Charges payment by BSNL : We expressed our serious resentment against payment of 3G spectrum charges of Rs. 10,178 crores and further payment of BWA Spectrum charges of Rs. 8,313 crores as per the highest bidding amount. JAC demanded waiving of these spectrum charges or defer payment or payment equal to benchmark since BSNL is the state owned company having socio-economic responsibility, providing telecom services on reduced rental to the rural part of the country and BSNL was not allowed to participate in the bidding process to decide the telecom circles for license etc. Secy (T) mentioned that now at this stage no exemption can be granted to BSNL, Ministry of Finance is only empowered to consider the demands of JAC.

(b) Procurement of 10 million GSM lines equipment : JAC expressed its serious concern against reducing the procurement of 10 million GSM lines to 5.5 million GSM lines despite the assurance given by Hon'ble MoC&IT on 20.04.2010. Secy (T) clarified that BSNL Board is fully competent to take decision in this regard as per the requirement.

(c) IDA pension revision for BSNL pensioners who retired before 01.01.2007 : JAC expressed its dissatisfaction against delay in finalizing the cabinet note in this regard. Secy (T) informed that cabinet note is being finalized and shortly will be sent for inter-ministerial circulation and will get the cabinet approval in the time frame assured by Hon'ble MoC&IT.

(d) ITS officers absorption in BSNL / MTNL : JAC expressed a serious concern against delay in completing the ITS officers absorption in BSNL / MTNL as delay is adversely affecting the viability of BSNL. Secy (T) mentioned that cabinet note in this regard is being prepared and shortly will be sent to nodal ministries for circulation and thereafter to cabinet for approval. He assured the issue will be resolved in the given time frame.

(e) Implementation of DPE OM dated 02.04.2009 regarding IDA pay fixation of 78.2% : JAC resented against formation of committee in BSNL to submit its report on this issue strongly protested against the BSNL Management discriminate attitude.

JAC leaders requested Secy (T) to arrange a meeting to review the status of JAC demands. Secy (T) assured for an early meeting. Com GS along with other JAC leaders attended the meeting.

18.06.2010 : Status of the Case filed against SDE (T) to DE (adhoc) DPC : The case filed against SDE (T) to DE (adhoc) DPC in the Hon'ble CAT, Bangalore by SC-ST Welfare Association and others vide OA No. 243/2010 was heard today and stay on the DPC process, as requested by the applicants, was not granted by the Hon'ble CAT. Next date of hearing is 01.07.2010.

17.06.2010 : Joint Action Committee Meeting : JAC meeting held today to discuss the developments after implementation of Demonstration on 14.06.2010 and Massive Dharna on 16.06.2010. JAC expressed its serious concern against Govt's letter to BSNL Management for the payment of BWA Spectrum Charges of Rs. 8313.86 crores by 22nd June 2010 positively. JAC also expressed its serious resentment against the payment of 3G Spectrum fees of Rs. 10,178 crores and demanded its refund and not to make the payment of BWA Spectrum Charges or payment for few Circles only where BSNL actually need BWA Spectrum.

JAC also expressed its serious concern against wiping out of BSNL's reserve funds by paying Rs. 10,178 crores for 3G Spectrum charges, Rs. 8313.86 crores for BWA Spectrum Charges to be paid by 22nd June 2010 (if paid), Rs. 4000 crores estimated payment for Non-Executive wage revision arrears, about Rs. 4500 crores for separate reserve fund to be created for leave encashment and about Rs. 3000 crores to meet out the deficit of the current FY. Hence the BSNL's present reserve of about Rs. 28000 crores will be finished by the end of Dec 2010. In view of the above facts, in January 2011, BSNL will not have any reserve fund and all the expenditure (including salary) will depend upon cash inflow (collection through Circles). In case of insufficient funds it is presumed that all the expenditures will be met out through the aid of Govt, if any, or managed through loan from outside.

JAC on the above issues will immediately send detailed protest letter to the Govt. and will meet to CMD BSNL, Secy (T), Hon'ble MoC&IT and Hon'ble Prime Minister of India demanding waiving off BWA Spectrum Charges and refund of 3G Spectrum Charges already paid in view of BSNL being state owned company and its continuous decline in profit or BSNL should be given freedom to provide its services in the areas of its choice as in case of private operators.

16.06.2010 : Implementation of Massive Dharna - Call given by JAC - Massive Dharna call given by Joint Action Committee throughout the country on 16/06/2010. Com. GS along with CHQ office bearers at New Delhi participated in Dharna and addressed the meeting at BSNL CO. We extend our sincere thanks to all the members for their active participation and Overwhelming support. JAC meeting is taking place at 16.00 Hrs. on 16/06/2010 at New Delhi to discuss and decide the strategies for further course of action against inaction of DOT administration and BSNL Management in resolving the JAC demands even after the assurance given by Hon'ble MoC& IT in the meeting held on 20th April-2010 with JAC representatives and oppose the Government's demand of BWA spectrum charges of Rs.8313.86 Crores from BSNL and refund of Rs.10178 Crores 3G spectrum charges already paid by BSNL.

15.06.2010:  GS, President, AGS(HQ), AGS(F) met ED (Finance) & expressed serious resentment against unjust mass transfer & posting orders of AOs/CAOs & distant Circle Postings on promotion to DGM(F) posts. We requested to intervene & review the transfer policy & for immediate modifications / Cancellations. ED (Finance) after detailed discussions assured to examine the matter.

14.06.2010 : Massive Demonstration on Monday, 14th June 2010 during Lunch / Closing hours - Call given by JAC - As per the call given by JAC the Massive Demonstration throughout the country during Lunch / Closing hours on Monday, 14th June 2010. Overwhelm support of BSNL Executives/ Non-Executives made the call successful.

Mass Dharna for one day on Wednesday, 16th June 2010 at BSNL Corporate Office, all Circle / SSA HQs. All the Circle / Branch Secretaries are requested to ensure successful implementation of Agitation Programmes. Future course of action will be decided by JAC shortly.

Com. GS, President along with all CHQ office bearers at New Delhi attended and addressed the meeting after Demonstration. Com GS in his address along with other JAC leaders expressed serious dissatisfaction against delay in implementation of the assurances given by Hon'ble MoC & IT on 20th April-2010 during indefinite strike and expressed serious resentment against payment of 3G spectrum charges of Rs.10000 Crores and getting ready to pay Rs.9000 crores against BWA spectrum charges. He pleaded for immediate implementation of DPE OM Dated 2nd April-2009 regarding Payment of 78.2 % IDA fitment benefit instead of 68.8%.

JAC strongly demanded that BSNL being state owned company should be exempted from 3G / BWA Spectrum charges or minimum bench mark charges may be paid to Government. Com. GS expressed his serious concern against wiping out the BSNL reserve of Rs. 30000 Crores and mentioned that in view of the cash flow statement BSNL will face minus 12000 Crores corpus at the end of the FY 2010-11.

09.06.2010 : Joint Action Committee (JAC) Meeting : JAC leaders met today to discuss and analyse the status of demands / assurances given by Hon'ble MoC&IT in the meeting held on 20.04.2010 during Indefinite Strike. JAC after detailed discussions and analysing the actions taken by DOT / BSNL expressed its serious dissatisfaction that there is no seriousness in DOT for the redressal of the JAC demands and on the assurances given by Hon'ble MoC&IT. Even after a lapse of 1 month and 20 days period the Cabinet Note on IDA pension revision and ITS officers' absorption issues has not been prepared and circulated to nodal ministries, whereas the assurance was given that within one month period the Cabinet Note on both the issues will be sent for inter-ministerial circulation and thereafter within 2-3 months Cabinet approval will be taken.

The 78.2% IDA fitment benefit instead of 68.8% as per DPE OM dated 02.04.2009 has not been implemented by BSNL Management, despite the assurance given by the Hon'ble MoC&IT.  Issue is being dragged by forming a committee.

The assurance given by Hon'ble MoC&IT for the procurement of 10 million GSM lines immediately has been reduced to 5.5 million GSM lines by BSNL Board which will adversely affect the growth of BSNL and its viability.

BSNL Management has promptly paid 3G spectrum charges to DOT Rs.  10,186.56 Cr.  without showing any resistance and request for deferred payment in view of the continuous decline of BSNL's profit and is now ready to make the payment of WiMAX and Broadband about Rs. 9000 Cr. BSNL Management ignoring the protest of JAC and without bothering the BSNL's financial health is trying to exhaust the BSNL reserves. It was seriously viewed and JAC demanded that 3G spectrum charges should immediately be refunded to BSNL and may be taken as deferred payment on yearly basis and further WiMAX/Broadband license fee charges should be paid only on deferred payment basis.

JAC demanded that Govt. of India should issue instructions / order to all Central / State Govt, departments and PSUs to take telecom services compulsorily from BSNL / MTNL only and also should allow BSNL to procure equipments on competitive rates from the suppliers / vendors on international security standards irrespective of technology.

On the above issues, JAC unanimously decided to resort immediate trade union action programmes i.e. Massive Demonstration on Monday, 14th June 2010 during Lunch / Closing hours and Mass Dharna for one day on Wednesday, 16th June 2010 at BSNL Corporate Office, all Circle / SSA HQs. 08.06.2010 : GS, President along with CHQ office bearers at New Delhi met PGM (FP) and discussed :

(a) Unjust mass transfers of AOs & CAOs- We expressed our serious resentment against mass transfer orders of AOs / CAOs issued on pick & choose method in violation of BSNL Executive transfer policy. The AOs / CAOs having 57-58 years age have been transferred to distant Circles in large numbers from the Circles on the pretext of long standing and equalisation of vacancies in Circles. We pleaded that we are not against transfers to consider the request transfer cases as well as to fill up some vacant posts of deficit Circles but that should be strictly as per the guidelines of BSNL Executive transfer policy. We demanded to revise the transfer orders as per the transfer policy. PGM (FP) after detailed discussions assured to examine the objections raised by the associations. 

(b) Consideration of pending request transfers of JAOs/ AOs/ CAOs- We expressed our serious concern against non consideration of pending request transfers of JAOs/ AOs/CAOs. PGM (FP) mentioned that all pending request transfer cases are being examined and will shortly be processed.

08.06.2010 : GS, President along with CHQ office bearers at New Delhi met Director (HR) and discussed :

(a) DPCs from SDE(T) to DE (Adhoc) and DE(Regular)- We expressed our serious concern against delay in completing the process of DPCs from SDE(T) to DE (Adhoc) and DE(Regular). We requested that the DE promotion orders on regular and adhoc basis should be issued before 30th June-2010. So that further ACRs / VCRs are not required. We also resented that for DE regular promotion ACRs of the year 2002 onwards have been again called for by GM (Pers) which will delay the DPC process. It is under stood that the ACRs screening work for DPCs of  DE regular and adhoc was already completed by the committed headed by GM(Pers ) and now again repeating the same exercise will further delay the DPC process. We requested that at this belated stage the change of DPC members is not justified. Dir(HR) assured to look into the matter.

07.06.2010 : GS, AGS (HQ), AGS (F) met GM (Pers) and discussed :

(a) DPC from SDE (T) to DE on adhoc and regular basis : We requested to complete the DPCs from SDE (T) to DE on adhoc and regular basis. GM (Pers) mentioned that both the DPCs of DE on adhoc and regular basis are under process. The necessary feedback has been provided to the DPC members. The DPC members have prepared a checklist and have asked some clarification which are being clarified shortly. This may delay the process. We expressed our dissatisfaction against delaying the DPC on one or the other pretext.

(b) DPC from JTO (T) to SDE (T) : We expressed our serious concern against delay in conducting the DPC from JTO (T) to SDE (T). GM (Pers) informed that the DPC from JTO (T) to SDE (T) is held up due to incomplete data received from 16 Circles as required in 9 annexures to decide All India seniority of eligible JTOs i.e. A&N, UP (W), JKD, KRL, NE-II, UP (E), BBNW, WTP, BR, MH, NTR, RJ, WB, NE-I, ETR & ITP. All the concerned Circle Secy's are requested to ensure early dispatch of required information.

(c) Declaration of final eligibility list of JTOs allowed to appear in LDCE of TES Gr. B being held on 4th July 2010 : GM (Pers) informed that some JTOs of 2005, 2007 and 2009 have filed case in Delhi PB CAT for allowing them to appear in LDCE being held in July 2010. The hearing in the case is taking place on 08.06.2010. Thereafter only the position in this regard will be clear.

03.06.2010 : GS spokes to GM(Pers.) & discussed:-

(a) DPC from SDE(T) to DE - We requested to complete DPC from SDE(T) to DE before 30th June'2010 and discussed the status of court case in Hon'ble CAT Chandigarh in this issue. GM(Pers.) mentioned that sincere efforts are being made to complete the DPC at the earliest.

(b) Consideration of Pending request transfer cases of SDEs/DEs- We requested for early consideration of pending request transfer cases of SDEs/DEs. GM(Pers.) assured to look into the matter.

(c) Posting of SDE(T) in NE-II Circle on the stations declared for One Year tenure- We apprised GM(Pers.) that some SDEs requested to NE-II Circle for one year tenure posting have been posted by CGM NE-II Circle to Arunachal Pradesh & other stations having two years tenure is not justified. GM(Pers.) assured to look into the matter.

03.06.2010 : Status of Court Case against Promotion from SDE(T) to DE:- Hon'ble CAT Chandigarh Case no. 392 filed by SC-ST Welfare Association, J & K Circle Vs. Union Govt. of India- Case was listed for hearing at S.No. 24 on 03.06.2010.  The applicant Advocate pleaded that the Promotion Rules should be followed while making promotion from SDE(T) to DE. BSNL Advocate agreed for it. The case is posted for hearing on 13.08.2010. Com. Kamlesh Dadwal, Circle Secy., Punjab Circle alongwith other affected members was also present during the hearing. AIBSNLEA will shortly impeded in the case.
