01.04.2014:Report of 1st Circle Executive committee (CEC) meeting of AIBSNLEA Odisha Circle held on 23.03.2014 at Seminar Hall, RTTC, Bhubaneswar: The first Circle Executive Committee (CEC) meeting of AIBSNLEA Odisha Circle was held on 23.03.2014 at seminar hall of RTTC  Bhubaneswar in a grand manner under the president ship of Com KN Sahoo.  After hoisting the Association flag by the circle president, all the comrades have assembled in the hall. The meeting was attended by Circle Office Bearers, CWC Member, Branch Presidents and Secretaries of Odisha. Our dynamic and beloved leader Com BK Bhattacharjee  OS(East) CHQ, Com BD Nath  Ex Circle Secy  and  Com SK Jena  AGS CHQ also graced the occasion.

At the outset Com SC Pradhan Branch Secy Bhubaneswar welcomed all the participants. In his introductory speech the President  Com KN Sahoo stressed upon the increase of membership under do or die principle due to the forthcoming membership verification. He cited some burning issues to be debated in the CEC.   

Then all the branch secretaries put forth their reports. Com RK Panda Circle Secy Odisha replied to the queries asked by all Branch Secretaries as well as other members. He placed Circle Secy's report in the house regarding various activities done in last six months. In his report he stressed the various HR issues solved at circle level, betterment of services and procurement of stores in Odisha circle. The report of Circle Secy was passed by the house. Com NP Das Finance Secy submitted audited finance report and it was passed in the house. He requested all Branch Secretaries to ensure collection of subscription for CHQ and Circle quota in time.  Com BD Nath Ex Circle Secy in his speech elaborated the role of our association in the development of BSNL. Com BK Bhhatacharjee OS(East) in his speech  elaborated the developments at CHQ level along with the importance of increasing the membership of our association. Com SK Jena AGS CHQ in his speech gave importance to hold seminars and workshops for viability of BSNL. The seminar hall was full-packed by the office bearers and members of different branches of Odisha Circle. The following resolutions  are passed in the CEC. RESOLUTIONS OF CEC:

1. The proposed new promotion policy is not accepted by the staff.

2. In a recent letter no.WLF/8-36/2013 dtd 2.9.2014, the CGM, Odisha has circulated that a BSNL employee can reimburse the medical claim of his dependant parents if he/she is the only son/daughter of his/her parents and the parents reside with them at the same home where the employee resides. The circular seems to be irrelevant. Let the case be clarified by the Corporate Office.

3. Pending DPC's in Corporate Office: It is requested to expedite the pending DPC's in respect of all disciplines and to fill up all the vacancies.

 4. Immediate preparation of Gradation List of 2010 JAO Batch.

5. 30% superannuation benefits for Direct Recruit BSNL employees.

6. Due to the shortage of DE/CAO all out circle and tenure transfer order should be cancelled.

7. Guidelines for IQ Reservations should be clarified:-

So many irregularities are being noticed in reservation of BSNL IQs throughout India.

a.       IQs are normally not allotted to common employees. Some IQs remain permanently reserved for some higher officers.

b.      If at all allotted to common employees any time, the same is cancelled when demanded by higher officers.

c.       IQs are found allotted in the name of higher officers, but actually occupied by others who are not related  to the him.

d.      There is no provision of collecting advance payment for IQ reservation. As a result, some unscrupulous officers book the IQ in advance but do not turn up to stay in such IQs. In many cases, they even do not cancel their requisition and as a result the IQ remains vaccant . Thus the other aspirant is deprived of staying in the IQ and there is a financial loss to BSNL.

e.      In some cases people are staying in IQs for unlimited periods.

In view of above  the detailed guidelines of IQ reservation may please be circulated. 

31.03.2014:Ms Geetha Rau, ED (Finance) retires on superannuation on 31.03.2014:GS, FS, AGS HQ & AGS (F) met ED (Finance) Ms Geetha Rau & greeted her on her retirement on Superannuation we wished her happy and prosperous life after retirement. While talking to the association, she made an appeal to work hard for the growth of BSNL.  She expressed her serious concern towards the viability of BSNL. We appreciated her concern for the BSNL.

On our query for submission of High Level Committee report on 30 % superannuation benefit to BSNL recruited employees in BSNL and pay anomaly of 2007 & 2008 batches JTOs. ED (Finance) informed that she has already submitted the report on both the issues to the competent authority

27.03.2014: AIBSNLEA meeting with DIR (HR) BSNL on the kind intervention of CMD BSNL in response to our letter dated 19.02.2014:GS, FS, AGS (HQ), AGS(Fin) and AFS attended meeting with  Dir (HR) BSNL in response to our letter dated 19.02.2014 on long pending HR issues. . The following officers were also present in the meeting  GM (SR), GM (Pers.), GM (Estt), GM (Restructuring), GM (EF), GM(FP), GM(Admin), GM (CA) and DGM (SR)). DIR(HR) initiated the discussions on pressing pending HR  issues. GS thanked for arranging the meeting and initiated discussions on the HR issues as under:

1.    Implementation of Assured Executives Promotion Policy in BSNL.

(a) Implementation of CPSU cadre hierarchy- Change of designations on each Time Bound upgradation on functional basis. First time bound promotion on 1-10-2004 after completion of four years w.e.f. 1-10-2000 in all the cases.

We have already given the detailed letter on this issue on 20.12.2013. On each time bound upgradation to the next higher grade, the designation and the duties/ responsibilities associated with the grade should also be changed as assured at the time of absorption to the Gr.'B' officers in BSNL i.e. "Non post based time bound promotions upto SG JAG level grade and post based promotions after SAG level post ". Also first time bound promotion on 1-10-2004 after completion of four years w.e.f. 1-10-2000 in all the cases.

Reply: Dir(HR) mentioned that GM (Restructuring) has circulated  a draft proposal on this issue to all the  Executives Associations for comments and discussion in the meeting shortly.  We mentioned that United Forum has already submitted common proposal on this issue but it has not been discussed in detail and management has started discussion on the CPSU Cadre hierarchy of other PSUs, BHEL, NTPC, ONGC etc. We pleaded that BSNL is a PSU converted from a Govt. Department; it has the executives absorbed from DOT and BSNL recruited.  The draft Proposal circulated seems to be an attempt to dilute the Executive Promotion Policy (EPP) rather than improving the promotional avenues of the Executives in BSNL  Dir(HR) appreciated our concern and mentioned that the draft proposal needs thorough discussion since it will have bearing in the future promotion avenues of the Executives in BSNL.  He assured that no arbitrary decision will be taken to dilute EPP.  GM (Rest) assured to hold an early meeting to discuss the issue.

(b)  Date of effect of Implementation of revised IDA Pay Scales for the Executives of Civil /Elect./Architect Engg. Wings and PA/PS cadre w.e.f. 1.10.2000 on notional basis.

BSNL Management has granted benefit of residency period w.e.f. 1.10.2000 to the Executives i.e. JTO/SDE (Civil/Electrical/Arch./TF) Engineering wings, CSSs, PAs/PSs, JAOs etc. for whom the RRs were notified after 1.10.2000 and accordingly the pay scales were upgraded. After implementation of this order no Executive has been benefited. Whereas, as per Dr. Vinay Shahi's Committee recommendations the upgraded scales for the above executives' should have been implemented w.e.f 1.10.2000 on actual basis or notional basis. Recently, notional pay fixation from 01.10.2000 in the upgraded pay scales has been allowed to JAOs. Similar treatment is required to be given to JTO/SDE (Civil/Electrical/Arch.) engineering wings and PAs/PSs cadres.

Reply: We pleaded that notional pay fixation of pay w.e.f. 01.10.2000 should be implemented to JTO/SDE (C/E/Arch/TF) Engineering wings and PAs/PSs Cadre as already implemented for JAO cadre. Dir(HR) after some discussions directed GM(Pers) and GM (FP) to examine the matter at the earliest and to appraise him shortly for decision.

(c) Settlement of Pay anomaly cases wherein senior Executives are drawing less pay than their juniors: Committee headed by PGM(FP) submitted its report and denied stepping up of the pay of seniors w.r.t. their juniors as per the provision of EPP and also did not consider the advice of Hon'ble CAT Ernakulam, bench O.A. NO. 109 of 2011 with O.A. No. 110/2011 and 236/2011 judgment dated 07.12.2011 in the Seniors (SDEs promoted as adhoc DEs before getting the second TBP ) getting less pay than Juniors ( SDEs promoted as adhoc DEs after getting the second Time Bound Promotion ) case :  "The respondents are directed to step up the pay of the applicants to the level of pay of their juniors with effect from the date of arising of the anomaly of seniors drawing less pay than their juniors in respect of each of the applicants within a period of 3 months from the date of receipt of a copy of this order. However, this order will not stand in the way of the Committee set up to deal with the issue under consideration in these O.As, giving a more beneficial recommendation for the applicants."

BSNL CO, Pers. Cell appeal against above judgment has been dismissed by Hon'ble High Court Kerala at Ernakulum i.e. "Hon'ble High Court of Kerala has dismissed the petitions OP CAT 1576,1560 & 1592 of 2012 filed by BSNL against the order of Hon'ble CAT Ernakulum in OAs 109, 110, 236 & 241 of 2011(filed by Sethumadhavan & others) which directed BSNL to fix the pay of the seniors at par with the juniors drawing more pay. The Hon'ble Court also observed the unconstitutional part of the condition incorporated in the pay fixation criteria which prohibits complaining against anomalies. Court also commented that such condition is very primitive and against the fundamental rights. As the applicants in the OAs have already filed petition for contempt of court against BSNL, the Hon'ble Kerala High Court allowed three months' time for BSNL to implement the orders passed by CAT" but BSNL first filed SLP in the Hon'ble Supreme Court in this regard denying its implementation but later on Hon'ble Kerala High Court judgment is implemented for the applicants. We request to extend the same treatment to similar executives.

Reply: We pleaded for the implementation of Hon'ble Kerala High Court Judgment to all affected executives by allowing stepping - up of pay under EPP. Dir(HR) mentioned that  BSNL has filed SLP in the Hon'ble Supreme Court against Hon'ble Kerala High Court Judgment and efforts will be made for early hearing.  AIBSNLEA has already impleaded in the case.  

(d)  Amendment in BSNL MSRRs allowing Diploma holders to the promotion of Executive Engr. (Civil/Electrical) wings at par with other discipline of executives.

As per the BSNLMSRRs, the existing JTOs/SDEs (C/E/Arch) Engineering wings having diploma qualification were not eligible to be promoted to the grade of Assistant General Manager/EE/Arch. and against the DoP&T guidelines & CPWD RRs wherein Diploma holders are also allowed to be promoted to the grade of EE (C/E/Arch). AIBSNLEA strongly protested against this discrimination and demanded to remove discrimination on the pretext of degree/diploma qualification to the promotion of EE from SDE (C/E/Arch) and parity with the JTO (T) / SDE (T) as per BSNL Board decision.

In addition to this, in the Architecture discipline, having valid registration as Architect with the council of the Architects is made compulsory, which is gross injustice to the absorbed Executives of Arch Engineering wings in BSNL.

Reply: We pleaded to Dir (HR) for giving parity to JTO/SDE (C/E/Arch) with JTO/JAO and SDE/AO cadres in the promotional avenues as assured at the time of absorption by amending the BSNLMSRRs. Dir(HR) mentioned that Management is convinced to sort out the issue but due to disputes between degree and diploma holder of  Executives in Civil/Electrical Wings, the decision is delayed but now issue will be resolved shortly.

2. Implementation of E-2, E-3 IDA pay scales for JTO/JAO & SDE/AO equivalent executives in BSNL. AIBSNLEA has taken the issue many times and recently provided the letter on 20.12.2013 on the issue. As per Recommendation of 2nd PRC, DPE has issued order to all CPSEs vide Letter No. 2(70)/08-DPE(WC)-GL-VII/09 dated 02/04/2009 wherein it is clarified that "There will be no change in the ten pay scales of below board level posts as indicated in OM dated 26/11/2008 and there is no justification for introducing intermediary pay scales. In BSNL the Executives of JTO/SDE level are placed in the lower pay scales against their standard IDA pay scales E2 to E3. Almost all the Oil sector, Steel Sector and Power Sector PSUs including MTNL are already adopted the entry level Executives' pay scale starting from E2 scale. The demand to place JTOs and SDEs in standard pay scales of E2 and E3 is very legitimate.

No intermediary scales have been permitted under DPE O.Ms. dated 26.11.2008 and 02.04.2009. Generally, promotion has to be from one 'Grade' to next higher 'Grade' with its corresponding scale as per the promotion policy of respective CPSEs. A CPSE cannot have more than one pay scale in a grade (say DGM & GM in E8 pay scale) to promote its executives within the same grade". Ignoring the DPE O.Ms. on implementation of 2nd PRC recommendation for standard pay scales E-2 & E-3 for JTO/SDE equivalent executives, BSNL Management is continuing efforts to implement E1A & E2A intermediate IDA pay scales in BSNL for JTO/SDE equivalent executives, which is not at all justified. In view of this, standard IDA pay scales E-2 & E-3 as recommended by 2nd PRC are to be implemented in BSNL for JTO and SDE equivalent executives to provide justice.

BSNL Management is not at all serious to introduce CPSU cadre hierarchy and implementation of E-2, E-3 IDA pay scales for JTO & SDE equivalent executives. The Joint Committee of BSNL officers headed by PGM (SR), BSNL CO, New Delhi and the representatives of BSNL Executives Associations was constituted in Feb-2012 to discuss and submit its report on both the issues within a period of six months but even after a laps of two years, no serious discussions has taken place in the Committee Meetings. Executive Associations has already submitted their unanimous opinion/ suggestion on CPSU Cadre hierarchy but the Management side has not started discussion on this. Similarly, E-2, E-3 standard IDA pay scales implementation case has so far not even discussed in any meeting. It clearly shows the ignoring attitude of the BSNL Management.

Reply: Dir(HR) mentioned that a proposal for E-1A & E-2A IDA pay scales for JTOs/SDEs equivalent cadres  has been sent to DoT to get approval from DPE and shortly, the decision is expected. We pleaded that since  intermediate IDA pay scales E-1A and E-2A had been rejected twice from DoT and now again DoT will reject the proposal as the  DPE has not allowed creation of intermediatary  pay scales.. He further mentioned that now DOT has assured to take up the matter with DPE to get settled. However, we further demanded implementation of standard IDA pay scales of E-2 and E-3 for JTO/SDE equivalent executives.

3.     Pay anomaly in the pay of JTOs of 2007 and 2008 batches (recruited after 01.01.2007)

AIBSNLEA has submitted its view on this issue in its letter dated 20.01.2014. Around 5000 talented Direct Recruit JTOs have joined BSNL after 1.1.2007 in JTO 2007 and 2008 batch. They are demoralized and frustrated due to a large difference of around Rs 3500/- in basic pay as compared to the JTOs recruited prior to 01.01.2007. At the time of their recruitment, it was advertised that their pay will be fixed in E1A pay scale, but it is unfortunate that their pay was later fixed in revised E1 scale.

It is worthwhile to mention here that a committee was constituted under the Chairmanship of Shri K C G K Pillai, the then PGM (FP) to find out the possibilities to overcome the situation of the pay loss to 2007 and 2008 batch JTOs/JAOs. The committee was in favour to recommend standard pay scales i.e. E2 for JTO/JAO and E3 for SDE/AO, but the committee recommend provisional pay of E1+5 increments only due to possible enhancement in pension contributions in that situation. Management has extended the E1+5 increments of JTO 2007 and 2008 batches but it is definitely not a permanent solution. The pay differences between the JTOs recruited after 01.01.2007 and their counterparts who joined before 01.01.2007 will boost up largely in 3rd PRC in 2017.

DoT has rejected the proposal of BSNL Management for Intermediary pay scales of E1A and E2A for the JTO/JAO, SDE/AO equivalent cadres. It is pertinent to mention here that as per the recommendations of 2nd PRC, DPE has issued orders to all CPSEs vide Letter No. 2(70)/08-DPE(WC)-GL-VII/09 dated 02/04/2009 wherein it is clarified that "There will be no change in the ten pay scales of below board level posts as indicated in OM dated 26/11/2008 and there is no justification for introducing intermediary pay scales. DPE has provided the guidelines that all CPSUs should switch over to standard pay scales recommended by 2nd PRC. It is pertinent to mention here that many PSUs in Oil, Power and Electrical sectors including the MTNL have already switchover to the new standard IDA pay scales w.e.f. 01.01.2007 as per the guidelines of DPE.

Reply :Dir(HR) mentioned that the matter has been examined but after 01-01-2007 the pay Fixation cannot be given in the pre=revised pay scales to the executives appointed after 01-01-2007 .  We further requested to give parity with respect to JTOs 2005 batch who joined after 01-01-2007. 

4.    30% Superannuation benefits to directly recruited employees as per DPE guidelines.

This Association has already submitted its crystal clear views about the issues related to provisions of Superannuation Benefits to directly recruited employees in its letter dated 20.12.2013.We requested BSNL Management to resolve superannuation benefits to directly recruited employees as per DPE guidelines. BSNL should contribute 12% as Superannuation Benefits in respect of Direct Recruits, to fulfill the limit of 30% contribution and the effective date of implementation of Superannuation benefits of BSNL Recruited Employees must be 01.01.2007.

As per DPE OM 26.11.2008, CPSEs would be allowed 30% of Basic Pay as Superannuation benefits. So, BSNL should contribute at the rate of 12% Basic plus DA on monthly basis and 8.33% Contribution of BSNL and 1.16% of Government to EPS Fund should be continued. Further, as per DEP OM dated 24-1-2013, it has also been clarified that DEP OMs do not provide for mandatory contribution on the part of employees and suggested that employees contribution to their post retirement benefit would enhance their social security and therefore CPSEs can frame scheme as per their requirement. We suggest that the employee contribution in this respect should not be taken mandatory.

Recently BSNL Management has organized a meeting on 15.01.2014 with all the Unions/Association on this issue and insisted for providing only 2% additional contribution as superannuation fund. But all the Unions/Association including AIBSNLEA has submitted their crystal clear stand for providing the remaining 12% contribution as superannuation fund only.

Reply: Dir (HR) mentioned that to re-examine both the issues at Sl. No. 3 and 4, a high level (HLC) committee has been constituted under the Chairmanship of ED (Finance).The committee has already heard the representatives of Associations/Unions and the report is being submitted shortly.

5.   Early Resolution of EPF anomalies with serious discrepancies in respect of Direct Recruited Employees of BSNL.

This Association has already submitted its crystal clear views about the Early Resolution of EPF anomalies with serious discrepancies in respect of Direct Recruited Employees of BSNL in its letter dated 30.01.2014.

Yearly EPF statement is being supplied to BSNL recruited Executives in response to our detailed letter and we are continuously monitoring the same. We requested Director (HR/EB) to resolve EPF issue for BSNL recruited JTOs at the earliest. GM (Estt.) & GM (CA) met EPF Authorities to centralize the EPF accounts online. EPF authorities clarified that EPF account of employees has been centralized at Regional Level and efforts are being made to centralize it on All India level shortly.   But even after a lapse of one year the EPF is not centralized. Hence, BSNL should centralize the EPF. Para-32 of EPF Act clearly stipulates that "no past contribution can be recovered from current salary of the employees, past arrear if any shall be paid by employer in respect of both the contribution". But in many field units in BSNL the past contribution has been recovered from current salary of the employees. A clarification may be issued to field units regarding the same including the refund of the already recovered amount.

BSNL has neither contributed for the diet allowance, nor for the stipend for the period of training, inspite of the mandatory provision of EPF Act. An order in this regard may be issued from BSNL CO for making both the contributions. BSNL Field units (except BSNL CO) are not providing the display of monthly EPF statement to the employees; Due to this the employees are unaware with their actual contribution and relevant shortcomings. Strict instructions may be issued to field units for providing regular EPF statement. The EPF slips are issued with a great delay by EPF authorities. Instructions may be issued to the all concerned IFAs to persue the same with EPF authorities to avoid the said delay.

Reply: Dir (HR) mentioned that GM (CA) is taking solution of this problem and necessary instructions are being issued to all the circles to maintain proper EPF account of BSNL recruited employees. Already an EPF cell has been operated in BSNL CO under GM(CA).

6.  CPCs to fill up the vacant PGM/GM/DGM (Engg.)/DGM(Fin), DE/CAO,SDE(T)/ AO equivalent posts in BSNL on Adhoc/ Regular basis.

A good number of PGMs/GMs/DGMs/DEs/SDEs equivalent posts are lying vacant since long. It is adversely affecting the viability of BSNL and causing stagnation in the career prospects of executives. Hence, immediate CPCs to be conducted to fill up all vacant Group -'A' and Group-'B' level posts.

Reply: CPCs from JAO to AO, AO to CAO, CAO to DGM (Adhoc) and DGM (Adhoc) to DGM (Regular), Dir (HR) directed GM (FP) to initiate the CPC from AO to CAO immediately to fill-up vacant seniority quota CAO posts till the time 25% MT posts diversion decision is taken by BSNL Board.GM (FP) assured to examine the existing vacancies in the cadre of CAO seniority quota and to process the case to initiate CPC.

GM (FP) further mentioned that the CPCs from CAO to DGM (Adhoc) and DGM (Adhoc) to DGM (Regular) are in progress. VCRs are being collected to expedite the CPCs.

Regarding the CPC to fill up 1800 AOs posts, Director HR) has already given the approval to initiate CPC from JAO to AO. The clarification on SC/ST roster implementation as per Hon'ble CAT Chandigarh judgment has been asked from DoP&T through DoT. Dir (HR) directed GM (FP) to pursue in the DoT for an early reply.

Discussions on the CPCs in Telecom Engineering wing:

a)    CPC from DGM (Adhoc) to DGM (Regular): Dir (HR) mentioned that the  proposal to initiate CPC from DGM (Adhoc) to DGM (Regular) who have completed more than 4 years regular service at STS level will be considered  shortly.

b)    CPC from SDE (T) to DE (T): Dir (HR) mentioned that CPC to fill up vacant DEs posts on regular basis was initiated but due to pending contempt case in the Hon'ble High Court Chandigarh and SLP in the Hon'ble Supreme Court could not be completed. The SLP in the Hon'ble Supreme court came for hearing on 26.03.2014 and posted for hearing on 15.04.2014 and the contempt case in the Hon'ble High Court Chandigarh is posted for hearing on 13.05.2014 after the settlement of the contempt case against operation of TES Group-B seniority lists no.6&7 the further action on CPC will be taken.

c)   CPC from DE(T) to DGM (Adhoc): Dir (HR) mentioned that CPC to fill up 480 DGM posts on Adhoc basis is in process but the promotion order will be issued only after the clearance from Hon'ble Supreme Court on 147 SDEs (T) LDCE quota seniority case. The case is listed for hearing on 07.07.2014 in the Hon'ble Supreme Court. GM (Pers.) apprised that legal opinion of Sr. Advocate has been taken in this regard and it is opined that 147 SDEs who have been granted "status quo" can not be promoted but to promote other DEs whose seniority is not disputed, clearance is required to be taken from Hon'ble Supreme Court hence, an application will be filed for clearance at the earliest. We requested for early action in this regard as our senior members are retiring every month without getting DGM promotion on none of their fault. Dir (HR) appreciated our concern.

d)   CPC from JTO(T) to SDE(T): Dir (HR)  mentioned that CPC process to fill up vacant SDEs (T) seniority quota posts is going on but the promotion order will be issued after the vacation of stay order on promotion from Hon'ble CAT Ernakulam Bench. The case came for hearing on 24.03.2014 but could not be heard. Next date of hearing is yet to be pronounced. He assured as soon as the stay is vacated the promotion orders will be issued. We further expressed our serious concern against badly delayed CPC due one or the other reason wherein JTO 1994 batch is still waiting for his 1st functional promotion. Dir (HR) appreciated our concern.

7. Inordinate Delay in holding the 33% LDCE for the promotion of SDE (T): Personnel Section of BSNL Corporate Office has already notified the vacancies for the year 2010-11, 2011-12, 2012-2013 to Recruitment Section. BSNL has a large number of posts of SDE (T) lying vacant. So the LDCE to fill up these vacant posts is the need of hour. This forthcoming Limited Departmental Competitive Examination from JTO (T) to SDE (T) should be conducted with a single and common paper. We have submitted our views on this issue in our letter dated 22.01.2014.

Reply:  Dir (HR) mentioned that a committee headed by GM (TRG) to examine the proposal for reducing the existing papers in terms of single paper on Technical Matters and one paper of General Matters. As soon as the pattern of exam is finalized by the committee the LDCE will be notified. Dir (HR) directed GM (Pers) and GM (TRG) to finalize the papers within 15 days. GM (Pers.) also confirmed receipt of our suggestions in this regard. They assured an early action.

8.  Restructuring, Revision of pay scale of AD (OL) and Hindi Translators.

The committee constituted under the Chairmanship of Addl. GM(CP&M) Shri Harshvardhan has not yet finalized the report to restructure the AD(OL) cadre even after a lapse of one and half year. We request for early restructuring of the AD(OL) cadre as per 6th CPC recommendations and to provide promotional avenues as available in DoT/ Govt.

Reply: Dir (HR) directed GM (Pers) to take the report from the Chairman, Committee Shri Harshvardhan, Addl. GM (CP&M) at the earliest. GM (Pers.) immediately spoke with Shri Harshvardhan, Addl. GM (CP&M) on this issue and assured that within 15 days the report will be submitted.

9.            Regularization of officiating JTOs and removal of FR-35 pay fixation.

The Committee Constituted to amend the JTO RR-2001 has to submit its report. All the Unions/Associations have already given their views/suggestions in this regard. We request for early regularization of the officiating JTOS and removal of FR-35 Pay Fixation by giving pay fixation under FR-22-(1a)(i) to all the officiating JTOs as per the judgment of Hon'ble Apex Court.

Reply:  Dir (HR) mentioned that the committee constituted for modification of JTO RR-2001 has completed the report and will submit it shortly to the BSNL Management Committee for clearance and thereafter to the BSNL Board for approval. After notification of the new JTO RR – 2014, the regularization of officiating JTOs will take place immediately.   

10.          Grievances of PA/ Stenographers' cadre.

(a)  Post based promotions for PA/PS to PPS/Sr.PPS.  

With restructuring and declaring the cadre of stenographers as 'dying cadre', the entry cadre is now Personal Assistants (Executive) with only one promotional avenue available as P.S., as against executives of other streams viz. JTO / JAO having promotional avenue upto the level of G.M. and above. In order to reach at least at the level of SG JAG (E-6) before retirement, we suggested the following post based promotion for the Personal Assistants:-

§  All the posts of Stenographers, Personal Assistants and Personal Secretaries may be pooled together and placed in the ratio of 40% (E-1) PA,  40%(E2) P.S. and 20 %(E3) PPS.

§  As per the recommendations of the H.K. Gupta Committee, all the HAG level officers may be provided with secretarial assistance at the level of E-4.

§  All Officers (PA/PS/PPS) who are in E-4 scale for a period of 5 years or have completed 23 years of service from the date of entry in the cadre may be promoted to E-5.

§  All officers who have been promoted to E-5 and have completed a minimum period of 3 years may be placed in E-6.

Reply: Dir (HR) directed GM (Pers) to form a committee to examine the issue of creation of PPS posts in field units as per the requirement of BSNL and the PA/PS cadre.

(b)  Introduction of Promotion Policy for Stenos (Dying cadre).

There are about 251 Stenographers working throughout the country in the field units of BSNL.  Out of these 251, majority of the stenographers have completed more than 12 years and is placed in the pre-revised executive pay scale of 9850 & 11875 as the case may be at par with PA/PS.  The Stenographers who have been granted ACP in the executive pay scale ceased to be non-executives as per BSNL HQ order No. 1-22/2009-PAT (BSNL) dated 30.04.2009, yet the status attached to the pay scale has not been accorded to them.    Promotion policy for non-executives has also been notified now.  The only cadre which has been kept outside the purview of both the promotion policies is the Stenographers (dying cadre). Neither Executive Promotion Policy nor Non-Executive Promotion policy has been made applicable to this small group of Stenos drawing executive pay scale.  If no promotion policy is implemented, there is no scope of any Time Bound Promotion in future and have to retire from the present position when others may enjoy the benefits. This discrimination is against natural justice.

Reply: GM (Pers) informed that recently BSNL Board has approved to provide one increment benefit in NE-12 scale to such cadres which are not covered under NEPP & EPP.

11. Antedating of pay - anomaly due to accrual of increment of Junior earlier than the senior after fixation of pay in revised pay scale implementation of 2nd PRC.

We requested to BSNL Management to restore the original order dated 23.09.2009 wherein provision for ante-dating the increment of the senior to that of the junior was envisaged. Alternatively, management can think of any other solution that will address the issue of anomaly wherein the junior does not draw more pay than the senior and also the senior does not face any drop in his basic pay which he/she will be drawing by virtue of the 3% annual increment provided in the rule.  

Reply: We pleaded that BSNL CO's initial order on antedating of DNI was correct but later on it has been withdrawn and a wrong clarification has been issued herein senior executives are put in loss. Director (HR) instructed GM (Estt.) and GM (EF) to have separate discussions on this issue with certain examples wherein seniors are at loss on revised order. Shortly a separate meeting will be held on this issue with GM (Estt) and GM (EF).

12 Allowing exercising options to Departmental JAOs on their promotion who got promoted on or after 07.05.2010.

Allow to execute option to the departmental JAOs appointed after 7.5.2010. As 7.5.2010 was the "cut of date" for implementation of 2nd  PRC for non - executives and the pay of non-executives has to be revised w.e.f. 7-5-2010. We requested to consider that as special case wherein the JAO exam result was declared in March 2010 but they were sent to training centers later on in different months due to shortage in Training centre and these JAOs  could join after 7.5.2010 only and they are not allowed to exercise option  on promotion to executive cadre.

Reply:  Dir (HR) directed GM (FP) to submit committee report on this issue at the earliest. GM (FP) mentioned that one committee meeting could be held so far and next committee meeting will be arranged shortly to discuss the matter.

13.  Two weeks of training to executives whose pay is upgraded and on every promotion under EPP.

BSNL issued the letter no. 32-27/2004-Trg[Vol. VII] Dated: 18/02/2013 for relaxation in mandatory Training under Executive Promotion Policy for officers, who are of 55 years and above age on the date of their respective upgradation order, these officers will have the option of undergoing one week Refresher Course as a part of the mandatory training under EPP followed by appearing in online exam at the respective Training Centre. We further request to withdraw the Mandatory Training.

Reply:  Dir (HR) appreciated our concern and directed GM (TRG) to provide one/two weeks study leave to the executives appearing in on line examination. GM (TRG) assured an early action in this regard.

14.   Inordinate delay in settlement of disciplinary cases.

We have been requesting BSNL Management for the settlement of long pending disciplinary cases. Many cases are pending more than 7-8 years and no decision is given, causing undue harassment to the executives on promotions and retirement. As per CVC guidelines all the disciplinary cases needs early settlement.

Reply: Dir (HR) assured to send a letter to the CVO for an early settlement of the long pending disciplinary cases. 15.  Modifications in Executives Transfer Policy for soft tenure stations.

We requested for an early action on amendment in transfer policy clause wherein the condition of serving 3 years in soft tenure station for one executive and further he has to serve some other SSA for next 3 years, thereafter, only his request may be  considered for posting to his choice of station. It is not justified and that is why these soft tenure stations vacancies in Telecom. Circles are not being filled up. Hence, immediate modification in Executive Transfer Policy for soft tenure stations is needed.

Reply: GM (Pers.) and GM (Rest) assured that after discussions on this issue the Management Committee Note will be prepared and sent to the BSNL MC shortly for necessary amendments in this regard in the Transfer Policy.

16.  Recruitment of JTO (E)/ JTO (TF) from TTAs cadre through LDCE.

In order to augment the shortage of JTO (E), we proposed to conduct LICE for TTAs having Diploma / Degree qualification in Electrical / Mechanical Engg by making provision in the JTO (E) RR. Also it is a fact that the working strength of JTO (TF) is very less than the sanctioned strength and direct recruitment is not taking place. So we proposed to conduct LICE for TTAs having Diploma / Degree qualification in Electrical / Mechanical / Metallurgical Engg by making them eligible through modification in the JTO (E)/ (TF) RRs.

Reply: Dir (HR) mentioned that as soon as the JTO (T) RR-2014 is approved by MC of BSNL Board on the same line the JTO RRs of other disciplines will also be modified immediately.

17.  Improvement in the revised policy for service GSM, RSTC & Broadband to Executives.

(a)  Enhancement of 200 free calls limit per month on RSTC, & enhancement of free call limit on GSM Telephone connection to STS level officer from 500 calls to 800 calls.

(b)  Executives working in BSNL Corporate office, New Delhi should be provided GSM service connection from the neighboring BSNL Circles falling under NCR.

(c)  Rent free Broadband service connection to all Executives with BSNL 750 plan.

(d)  All the BSNL executives should be provided GSM Handsets of the cost of Rs.3000/- Rs. 4000/- & Rs 5000/- to the JTO/SDE/DE level executives instead of Rs, 1500/- , Rs 2500/- Rs 3500/- respectively.

(e)  All Executives' should be allowed CUG facility on RSTC at circle level.

(f)   Allowing 3G Mobile service to all Executives.

Reply: GM (Admn) mentioned that the feedback on the issues raised by the association is being taken on number of beneficiaries and financial implications on it. GM (Admn) assured that decision in this regard will be taken within three months.

At last Dir (HR) further mentioned that the management is open to discus the grievances of executives through negotiations rather than agitation approach. We appreciated the concern of Dir (HR) and clarified that AIBSNLEA is always for negotiations only but agitation approach is taken under compelling circumstances only when BSNL management is not responsive to the legitimate issues. We hope that the assurances given during the meetings will be honored in full for the settlement of the issues. We extend our sincere thanks to CMD, BSNL, Dir (HR), GM (SR), GM (Pers.), GM (Estt), GM (Restructuring), GM (EF), GM(FP), GM(Admin), GM (CA) and DGM (SR) for giving patent hearing and holding elaborate discussions on all the issues for their settlement in a time bound manner. We assured our full cooperation. On the issues related to viability of BSNL submitted by this association in the form of resolutions of 4th all India conference held at Nasik. Dir (HR) assured to have a separate meeting on these issues.

27.03.2014: Filling up of the vacant SE(E) posts: GS discussed with PGM(EW) to initiate CPC to fill up vacant SE(E) posts. PGM(EW) mentioned that a proposal to initiate CPC to fill up about 13 SE(E) posts has been sent to the Competent Authority for consideration and approval.

27.03.2014:4th Circle Conference of AIBSNLEA Haryana Circle on 26.03.2014 at Karnal::The 4th Circle Conference of AIBSNLEA Haryana Circle was organised on 26.03.2014 at Gymkhana Club, Karnal in a grand manner. The Conference was  attended by Shri Prahlad Rai, General Secretary AIBSNLEA CHQ, Sh. Devesh Sharma, Organizing Secretary (North) and Shri Alkendra Singh, Asstt. Finance Secretary from AIBSNLEA CHQ side. The Open session of the conference was attended by Shri Chandrahaas , GMTD Karnal as Chief Guest.

Com. Darbara Singh, CS Haryana welcomed all the dignitaries in his welcome address. In his keynote address touched the issue of financial viability of BSNL .and the reasons of financial crisis in today's scenario. He explained the role of AIBSNLEA Haryana Circle in resolving the problems of member He appealed to make BSNL a vibrant Organization. He also stressed to strengthen the Quality of Service and improve customer satisfaction.

Com. Devesh Sharma, Organizing Secretary (North) CHQ in his address explained that in which manner the BSNL is suffering from the discriminatory attitude of the Govt. of India. He mentioned the efforts of AIBSNLEA CHQ in BSNL viability by introducing the concept of Customer Delight Month/Year. He explained the efforts of CHQ in continuously resolving the issues of BSNL Executives. He mentioned  the efforts and role of AIBSNLEA CHQ in resolving the problems of DR JTOs/JAOs.At last he appealed all to put all out efforts to successfully face the forthcoming membership verification.

Com. Alkendra Singh, Asstt. FS(CHQ), in his address appealed that this is the high time to all to and serve the customers more efficiently. He also stressed out the points need to resolve before the proposed merger of BSNL & MTNL. He touched the points related to viability of BSNL and need to adopt the energy saving techniques for revenue enhancement.

GS AIBSNLEA, Com Prahlad Rai, congratulated the comrades of Haryana Circle and specially Karnal SSA for the successful conference and thanked the comrades for their great affection. He appreciated the efforts of Haryana Circle in the Organizational action programmes at HQ and valuable suggestions of the Haryana Circle Comrades.

Com. GS appreciated the positive revenue growth of Haryana Circle and made hope that the same will further enhance and will be as per the expectation of the BSNL Corporate Office. Com GS informed that BSNL have made the Loss of more then 24000 Crores in the last 4 years and Haryana circle along with other circles can provide its contribution in overcome this situation.

He assured that the support of CHQ is always available for this important Circle. In his detailed address Com. GS mentioned that due to un-helping attitude of the Govt. i.e. unjustified payment of spectrum charges (3G & BWA) of Rs. 18,500, non-reimbursement of licenses fee, USO Charges, OPEX Charges, withdrawal of ADC, Payment of AGR, Non payment of rural subsidy inspite of NTP provisions has adversely affected the viability of BSNL. He informed that BSNL is spending a huge amount on 28,000 Rural exchanges in Rural areas telecom services but no decision on ADC charges is being taken by the Administrative Ministry. In addition of this Telecom Advisory Committee, Parliamentary Committees, Spectrum Allocation and bidding process on High rates are the example of step behavior of Government towards BSNL, which is a Government owned company. Scarcity of cables, telephone instruments, MLLN Modem, Broadband Modem, Drop wires etc has affected the quality & growth of services. He explained that how the AIBSNLEA is continuously pursuing these viability related issue with the BSNL Management and DoT. He informed that due to our continuous persuation, 3000 KM cable and 23 million Telephone instruments and BB Modems were procured. He appealed to BSNL Managemnet to suitably use the expertise of BSNL/s Civil/Electrical wings

Com. GS stressed on the need of committed leaders in BSNL. Com GS further explained the burning issues of the Headquarters level He explained the situation on the issues like VRS, 30% disinvestment and unbundling of last mile copper. Com. GS mentioned that the Broadband is the lifeline of BSNL and this is the only role of Trade Unions by which the disinvestment has not taken place in BSNL. Com GS mentioned AIBSNLEA's firm stand for the resolving all the pending issues first before merger of BSNL and MTNL. He apprised the status of HR issues related to mainly DPCs from JTO to SDE, SDE to DE, DE to DGM, DGM (Adhoc) to DGM(Reg), JAO to AO, AO to CAO(Reg) & CAO(Reg) to DGM(F) Adhoc and DGM (F) Adhoc to DGM(F) Regular, LDCE for SDE(T), MT Examination, DPC in C/E/Arch wings, PPS post creation in field units, AD(OL) issues, regularisation of Officiating JTOs. E2-E3 Standard pay scales for JTO/SDE, 30% superannuation benefits to Direct Recruits, Resolution of EPF anomaly, JTO 2007/2008 pay anomaly issue, VRS, Pay anomaly- Sr. are drawing less salary than their juniors, withdrawal of leave encashment for LTC, stopping of LTC etc.

Com GS explained the role of AIBSNLEA in the viability of BSNL. GS mentioned the firm Commitment of AIBSNLEA towards the Viability of BSNL. He appealed all to follow the steps of Kerala and Orissa Circle for ensuring the viability of BSNL. .He mentioned that he is having the full faith on the capability of Haryana Comrades. At last he appealed the all Executives' for make every effort with a team spirit and customer care for making BSNL a vibrant organization.

Chief Guest of the Open session Shri Chandrahaas, Sr. GMTD Karnal , congratulated the AIBSNLEA Haryana Circle Body for the grand success of the Circe Conference. He appealed all to leave the laziness and ensure to serve the BSNL with full enthusiasm like a soldier. He mentioned that in Karnal SSA, growth of revenue have been increased from 6% to 7 %. He stressed on the need of early restoration of telephone connection in true sense. He stressed to strengthen the self satisfaction spirit in BSNL for making it a viable organization. He also suggested increasing the revenue by customer care and Quality of service.

25.03.2014 5th Circle conference of AIBSNLEA, Karnataka Circle at GMA Kalyan Mandap, Raichur held on 21st & 22nd March 2014:The 5th circle conference of AIBSNLEA Karnataka Circle delegate session held on 21st march 2014 at Raichur after the pre CEC circle conference meeting held on 20th march 2014 at Raichur. After hoisting the association flag by the Circle President, all the comrades have assembled in the Hall. Two minute silence was observed as mark of respect to the departed comrades. After opening remarks all the delegates gave self introduction. The agenda was approved after some discussions. All the Branch Secretaries placed their reports and CS sum up the queries. This is first time that all the branches have attended conference. Com. CS placed his report for approval. CS report on parawise after detailed discussions was approved. Com. GS in his address apprised in detail the efforts of AIBSNLEA during last 8-9 years in settling the Implementation of EPP, perks to executives, transparent transfer policy, GSM mobile connection with hand set, second PRC implementation with 30% IDA fitment, BSNLMSRR 2009, filling up of vacant Group-B, STS, JAG, SAG & HAG level posts, Regularisation of Adhoc DEs/ CAOs/ EEs etc. regularisation of officiating JTOs, creation of PPS posts with HAG level posts, restructuring of AD(O/L) cadre, court cases on seniors are drawing less pay than their junior, antedating of pay, modification in BSNL MSRR of EE(C/E/Arch.), notional pay fixation w.e.f. 1.10.2000 to all upgraded cadres at par with JAOs, implementation of CPSU cadre hierarchy as assured at the time of absorption, E-2, E-3 IDA pay scales to JTO/SDE equivalent executives, 30% superannuation benefit to BSNL recruited employees, EPF anomalies and pay anomalies of JTOs 2007, 2008 batches etc.

He also apprised that AIBSNLEA has been granted formal meeting by Director (HR) on 27.03.2014 to discuss all the pressing HR issues. He assured that AIBSNLEA efforts will continue for the settlement of these issues. He appealed to make AIBSNLEA No.1 Executive Association in BSNL during membership verification to safeguard the interest of all the executives of various disciplines. He further mentioned that AIBSNLEA is equally concerned to the viability of BSNL the manner it is concern for the settlement of HR issues. AIBSNLEA is always at forefront in all the agitation calls given by the Joint Forum of BSNL Unions and Associations against the wrong policies of the Govt. and BSNL management.

Com. GS replied all the queries of the delegates in the interactive session to their satisfaction.

On the occasion of 5th KCC of AIBSNLEA, AIBSNLEA Raichur Branch conducted a Mela near to the Venue for selling BSNL products and services. Information on BB tariff plans, GSM plans, data card plans etc were given to public. FWP, BB Modems, Data Cards, 2G and 3G SIMs. CFA Marketing Application forms have been displayed in Mela. Public have shown very much keen interest in BSNL. Shri R K Misra, CGM, KTK Circle inaugurated the Mela along with GM TD and DGM Raichur, GS, President, CS KTK, Com D Siddappa,ACS,Com Prabhu Dorai,DS,Raichur TD. CGM, KTK appreciated the concern of AIBSNLEA about BSNL.

A Beautifully decorated, mammoth gathered open session was started on 22/03/2014 at 1030 hrs with Cultural programme.Com D Siddappa ACS welcomed the all the guests by garlanding. Com H Y Andeli CS, AIBSNLEA KTK Circle explained in his key note address that merger of MTNL with BSNL: Govt. Should not go ahead with the merger without resolving burning issues otherwise the merger will be detrimental for BSNL and its 2.5 lakhs employees. He requested Circle Administration to look in to the following issues-1) After introduction of ERP, all the financial powers have been centralized and delegated to GMs, even single rupee can not be spent by DGMs/DETs/SDEs without approval of GMs. At present GMs are to look after 2 to 3 SSAs. Some GMs are not visiting other SSAs situated outside their HQs even once in a month. Hence, Decentralization of powers of GMs is need of the hour to carry out Developmental, Maintenance activities in time.

2) 50% of total staff as on 1/10/2000 will retire by 2016. ROE (Review of Establishment) should be carried out immediately. Utmost utilization of Man power from top to bottom.

Com Sundar Raju CS, AIGETOA KTK told that marketing policy of BSNL should be changed as we have suggested the Management of BSNL. We have to work hard to give better service to the customer and of HR issues of BSNL recruited executives to motivate them.

Shri Basavaraj Y Dyavakar, DGM, Raichur spoken on staff shortage. He requested CGM to post more no. of JTOs and SDEs to give better service to customer.

Com B Ravindranath Advisor(Legal) ,CHQ told that Financial Condition is deteriorating day by day. All the staff should work hard to reach No. one position

Com S R Patil OS(South), CHQ told that merger of MTNL with BSNL is disastrous to BSNL. He stressed up on the shortage of material for day to day maintenance.

Shri Y Sivasankar Reddy, GM TD Raichur spoken on faults of LL and BB etc  which should be attended immediately and give better service to subscriber. Marketing of SIMs should be increased.

Com P Venugopal President, CHQ spoken on service to the Customer. He explained about the financial condition of BSNL. Giving a better service to the customer is need of the hour. He appreciated comrades of Raichur for excellent arrangement.

Shri R K Misra CGM, KTK Circle Bangalore told Staff should have positive thinking. LL faults should be attended within two hours of time if not possible Staff should inform the customer about delay in rectifying the fault. They should speak politely to customer. Staff should have mobile no. of all LL Customers. They should maintain good relation with subscriber. We are getting more revenue from BB customer. We should give top priority to the high paid customers. Karnataka Circle is much ahead of all the Circles in south Zone in revenue growth. Our Circle growth is more than 9% whereas other southern Circles are struggling with 3% - 6%. Our Growth in GSM is already at the top among all the Circles. Total revenue increased from 1141.36 Cr (April – Oct 2012) to 1246.77 Cr (April – Oct 2013). Karnataka circle is no. one Circle in country for providing Broad Band connections. He further mentioned that there is shortage of material in KTK circle field units

Com. Prahlad Rai GS in his elaborate speech said that how AIBSNLEA was formed by the merger of 11 DoT recognized cadre Associations. GS told that AIBSNLEA is the only association who is raising the issue of all the executive cadres of BSNL. Com. GS informed about the committed firm stand of AIBSNLEA regarding full 30% contribution towards Superannuation benefits to directly recruited employees as per DPE guidelines. AIBSNLEA has already submitted its crystal clear views about the issues related to provisions of Superannuation Benefits to directly recruited employees. GS informed the house that BSNL should contribute 12% as Superannuation Benefits n respect of Direct Recruits. AIBSNLEA has informed to BSNL Management that to fulfill the limit of 30% contribution and the effective date of implementation of Superannuation benefits of BSNL Recruited Employees must be 01.01.2007 and the Employee contribution should not be made mandatory in this regard. He replied all the points raised by the JTO Trainees on this issue. He explained the efforts of AIBSNLEA CHQ in continuously resolving the issues of BSNL Direct Recruit Executives like EPF, Superannuation benefits and Child Care Leave.

On the issue of EPF anomalies, Com GS further informed that AIBSNLEA has already submitted its firm views and irony commitment about the Early Resolution of EPF anomalies in respect of Direct Recruited Employees of BSNL in its letter dated 30.01.2014. GS explained that Yearly EPF statement is being supplied to BSNL recruited Executives in response to our detailed letter and we are continuously monitoring the same. He mentioned the AIBSNLEA's frequent and continuous persuasion with Director (HR/EB) to resolve EPF issue for BSNL recruited JTOs at the earliest.

Com. GS mentioned the demand of AIBSNLEA for Implementation of assured Executives Promotion Policy in BSNL and Implementation of CPSU cadre hierarchy in BSNL. AIBSNLEA has already given the detailed letter on this issue. On each time bound upgradation to the next higher grade, the designation and the duties/ responsibilities associated with the grade should also be changed as assured at the time of absorption to the Gr.'B' officers in BSNL. Also, first time bound promotion on 1-10-2004 after completion of four years w.e.f. 1-10-2000 in all the cases. GS elaborated the importance of this issue for young Executives. 

Com. General Secretary mentioned the efforts of AIBSNLEA for the solution of Pay anomaly in the pay of JTOs of 2007 and 2008 batches (recruited after 01.01.2007) and Implementation of E-2, E-3 IDA pay scales for JTO/JAO & SDE/AO equivalent executives in BSNL.  AIBSNLEA has taken the issue many times GS told that AIBSNLEA is committed for the promotional avenues of Direct Recruit Executives and only AIBSNLEA has shown its resentment against delay in holding the next 33% LDCE for the promotion of SDE(T). GS also mentioned the ongoing efforts of AIBSNLEA for the necessary Improvement in the revised policy for service GSM, RSTC & Broadband connections to the Executives. GS explained in detail the status of CPCs in Telecom Engineering, Telecom Finance & Accounts, Civil/Electrical/Arch. TF Engineering wings and our efforts to fill up all vacant Group 'B', STS JAG, SAG and HAG level posts.

At last Com GS explained the endless contribution and important role of AIBSNLEA in the viability of BSNL. Com. General Secretary appealed all to work whole heartedly for the viability of BSNL, which is the need of the hour. He appealed the young generation to contribute to uplift BSNL from the present financial crises. He appealed them to make strengthen the AIBSNLEA as this is the one and only association who care for every cadre. He appealed to the young Executives' to use this established democratic platform of the association (AIBSNLEA) & fight with unity for their genuine demands.

20.03.2014 Meeting with CMD BSNL: GS met CMD, BSNL & discussed regarding settlement of long pending HR & Viability related issues which were discussed in his presence in the Open Session of 4th AIC of AIBSNLEA at Nashik. We requested for arranging a meeting at Director(HR), BSNL Board for the settlement of the pending pressing issues. CMD appreciated our concern and spoke to Director(HR) and advised him to hold a meeting with AIBSNLEA in the next week  itself to discuss all the issues / resolutions discussed in the 4th AIC at Nashik in his presence. Director(HR) assured to hold the meeting with AIBSNLEA in the next week itself.

We also requested for early posting of CGMs WB Telecom Circle, Kolkata TD Circle and ETP Circle posts since all three present CGMs are retiring on superannuation within one or two months time. We also expressed our serious concern against huge surrender of LL / BB connections in  Kolkata TD Circle and requested his kind intervention to arrest the surrender. CMD appreciated our concern and assured an early action in this regard.

20.03.2014 Meeting with Director(CFA), BSNL Board :  GS met Director(CFA), BSNL Board & expressed our serious concern against continuous surrender of BB/LL Telephones connections in Kolkata TD Circle. Also requested to arrange posting of strong CGMs in WB Telecom Circle, Kolkata TD Circle and ETP Circle in the interest of BSNL. Director(CFA) appreciated our concern & expressed his worry against the functioning of  WB Telecom Circle &  Kolkata TD Circle. He also mentioned that as & when he is contacting Sr. Officers in the morning, it is found that the officers are also not punctual in attending their offices, which is adversely affecting the work culture in the field units. 20.03.2014 Special General Body Meeting at ALTTC Ghaziabad on 19.03.2014:GS, CS UP(West) Circle and Circle President UP(West) attended a Special General Body meeting  at ALTTC Ghaziabad on 19.03.2014 and addressed  the JTO trainees along with our members. Most of the trainees were from UP(West) and NTR. CS ALTTC Circle Shri Satyendra Kumar along with other office bearers have arranged the meeting. GM (EB) , ALTTC Shri M.K. Seth our senior member also attended in the meeting. GS Shri Prahlad Rai were warmly welcomed by the organizers. The Central Coordinator- UP West, SNATTA Shri Amit Gupta was also present in the meeting and welcomed the Guests.

Training of forthcoming batches of trainees from TTA to JTO promotion : We requested to CGM ALTTC to consider the training of forthcoming batches of trainees from TTA to JTO promotion, in ALTTC Ghaziabad. Earlier the CGM ALTTC have some reservation on the issue but after the repeated persuasion from us, he agreed for the conduction of induction training of forthcoming batches of trainees from TTA to JTO promotion in ALTTC after receiving such requests from the respective circles.

2.To ensure the optimum utilization of the resources of ALTTC Ghaziabad by providing the resources and training to the other Government Departments: We requested to CGM ALTTC To ensure the optimum utilization of the resources of ALTTC Ghaziabad by providing the resources and training to the other Government Departments. CGM ALTTC has informed that in this regard, already a proposal for IPV6 training , has been sent to BSNL Corporate Office for the conduction of the induction/departmental training of other Govt. Departments in ALTTC Ghaziabad. By this process, BSNL will earn additional revenue with the optimum utilization of the resources of ALTTC Ghaziabad.

14.03.2014  High Level Committee Meeting on 30% Superannuation benefits: The High Level Committee Headed by ED(Fin.) along with other Committee Members hold meeting with the representatives of Forum of BSNL Unions / Associations to discuss regarding implementation of DPE OMs on 30% Superannuation benefits to BSNL recruited employees. AIBSNLEA  strongly pleaded for 30% Superannuation benefits to BSNL recruited employees wherein at present BSNL is only contributing 18% w.r.t EPF (12%), Gratuity (4.5%) and Post Retirement Medical Benefits(1.5%). Hence remaining 12% has to be contributed in the  Superannuation benefits to the BSNL recruited  employees on their Basic+DA. Employees contribution should not be mandatory.

Chairman Committee ED(Fin.) mentioned that Committee Members have heard the feelings of BSNL Unions/ Associations & shortly Committee report will be submitted. GS & AGS(HQ) attended the meeting.

14.03.2014  GS, AGS(HQ) met Director (HR), BSNL Board and requested for modification in BSNL MSRRs of EE(Civil/Electrical) to provide parity with JTO(T)/SDE(T) in promotions. Director (HR) assured to look into the matter.

13.03.2014 GS met GM (FP) to discussed regarding

a)      CPC from CAO to DGM (F) Adhoc:  GM(FP) mentioned that CPC work is in process but the VCRs are yet to be received from CVO BSNL. He spoke to Dy. CVO for early sending of the VCRs to complete the CPC. He assured that as soon as the VCRs are received the CPC will be expedited.

b)      CPC from AO to CAO: GM(FP) confirmed the approval of BSNL MC on the proposal of diversion of 25% MTs CAO posts to the seniority quota. He also mentioned that efforts will be made, since the policy decision in Telecom Operation on this issues has already taken in the BSNL Board, hence, further this issue should not be sent to the BSNL Board for approval to save time. However, he assured an early action on this issue.

13.03.2014 GS & FS met GM (Admin.) BSNL CO and discussed regarding problems being faced by BSNL CO staff due to non availability of stationery items, canteen facility etc. GM (Admin.) mentioned that recently he has joined in BSNL CO and he is making sincere efforts for finalizing tenders for for stationary items and opening of canteen facility etc.

13.03.2014 GS & Sh. Kabir Das, GS BSNLOA met GM (Estt) and discussed regarding-

Regularization of officiating JTOs: GM (Estt.) mentioned that new JTO RR 2014 are being framed shortly, after the approval of BSNL MC and thereafter from BSNL Board. He assured that new JTO RRs- 2014 proposal will be sent to BSNL MC for approval in the next week itself. As soon as the JTOs RR -2014 are notified the regularization process of officiating JTOs will take place immediately. It is understood that committee has recommended to reduce the eligibility criteria of TTA to JTO from 7 years to 5 years. Also the provision of fixing seniority in JTO cadre. He also wanted our association comments informally on making JTO cadre as All India Cadre instead of Circle cadre etc.

He also apprised that BSNL MC has approved new TTA RRs where in TTA cadre is declared Circle Cadre instead of SSA cadre and all the non executives of NE-6 to NE-9 grades are now allowed to appear in the TTA exam.

13.03.2014  CPC from AO to CAO GS, FS met Sr. GM(Legal) & Company Secretary and enquired about clearance on  diversion of 25% of MT(CAO) Posts to seniority quota from BSNL Management Committee.  He  confirmed that BSNL MC has approved the proposal of SEA Cell.  Now 75% of CAO Posts will be utilized for CAO  regular promotion. We are extremely thankful to CMD BSNL,  ED(Fin.) and  Sr.GM (Legal) and GM(FP)  for getting clear the proposal of 25%  MT (CAO) posts diversion from BSNL MC.  AIBSNLEA's  persistent efforts yielded the result.

13.03.2014  Congratulations ! BSNL Corporate office declared result of LDCE for Promotion from JTO(Electrical) to the grade of SDE(Electrical) under 33 percent quota held on 24.11.2013 - <<<Click here for LDCE Result>>>  

It is reliably learnt that LDCE Result from JTO(C) to SDE(C) is expected shortly.

13.03.2014  BSNL Corporate Office issued letter regarding re-conciliation of inter-s seniority of some SDEs (T) belonging to ST category promoted to the grade against VY 2001-02 vis-a-vis their gradation details -  <<<Click here for letter>>>  

12.03.2014  GS, FS, AGS (HQ) and AGS (Finance) met CMD, BSNL and requested for diversion of 25% CAOs (i.e. 365 MT quota posts) posts to seniority quota posts. CMD mentioned that he will try for clearance from BSNL MC meeting tomorrow, in case it comes in MC agenda.

12.03.2014 GS, AGS (HQ) met GM (Pers) and requested for consideration of pending request/tenure transfer cases of SDE(T)/DEs. GM (Pers) mentioned to look into the matter for an early action. We also requested for early sending of MC note regarding pay fixation of DGM (Adhoc) in E-6 grade under EPP, modification in transfer policy of soft tenure stations and modification in BSNL MSRRs of EE (C/E) etc. GM (Pers.) mentioned that MC note on all these issues have been drafted and shortly will be sent to the BSNL MC and thereafter to BSNL Board for approval.

Regarding filling-up of the vacant EE (C/E) posts, GM (Pers) mentioned that seniority quota of 50% EE (C/E) posts may be filled-up in the ratio of 50:50 and 50% of EEs posts through MT recruitment as per the proposed modification in BSNLMSRR of EE (C/E). Since, the proposal for modification in BSNLMSRR-2009 of EE (C/E) is under consideration , the CPC in BW wing may fill-up 50% of seniority quota of EE (C) posts from degree holder SDEs (C) and 50% of seniority quota posts of EE (C) may be kept reserved for diploma holder SDEs (C).   

12.03.2014 GS, AGS (HQ) met PGM (EW) and discussed regarding filling up of the EE (Elect) vacant posts. PGM (EW) mentioned that the proposal to fill-up vacant about 75 EEs (Elect) posts is pending for the approval from the competent authority.

12.03.2014 GS met Sr. GM (Rectt) and discussed regarding-

(a)  Declaration of the result of LDCE JTO (C/E) to SDE (C/E): We requested for early declaration of the result of LDCE for promotion from JTO (C/E) to SDE (C/E) and removal of discrepancies in the answer key of LDCE of JTO (C) to SDE (C). Sr. GM (Rectt) mentioned that the discrepancies raised by this association and others have been examined. The results will be declared in this month only i.e. March 2014.

(b)  Holding of MT examination: Sr. GM (Rectt) mentioned that 300 MTs (150 MTs internal quota and 150 MTs external quota) in Telecom Engineering wing will be recruited shortly. The common syllabus for internal and out side MTs recruitment has been finalized. The internal quota MTs will pass on the basis of total marks obtained in three papers whereas the outsider MTs will have to pass each paper independently. Shortly MT examination will be notified for internal and outside quota recruitment.

Similarly, the 100 MTs recruitment in finance wing for internal quota has been received from SEA Cell. He immediately spoke to GM (FP) regarding outside MT quota recruitment also.

(c) Notification of LDCE for promotion from JTO (T) to SDE (T): Sr. GM (Rectt) mentioned that a proposal to reduce the papers i.e. one Technical Paper and one General Paper has been sent to GM (Pers) for decision. He assured an early action in this regard.

(d)  Holding of JAO Part-II Examination: Sr GM (Rectt) mentioned that GM (FP) has been asked to finalize the next JAO Part-II Exam on objective type (OMR based). He mentioned that in the earlier subjective type examination, many complaints were received which will be reduced with objective type exam. Shortly JAO Part-II exam will be notified. 

12.03.2014 Meeting with CMD BSNL:Com.V.A.N.Namboodiri, Convener, Forum of BSNL Unions/Associations and Patron AIBDPA  along with Com.K.G.Jayaraj, General Secretary AIBDPA met Shri R.K.Upadhyay, CMD BSNL and discussed the issues of pensioners as well as the viability of BSNL etc.

The representatives pointed out the undue delay in issue of orders on 78.2% IDA for pensioners. They also stated that the Department of Expenditure has sought some clarifications from DOT and further delay may take place.  They urged the CMD to take necessary steps to ensure that the pensioners'  78.2% IDA issue is settled at the earliest.

The union leaders also demanded that the medical allowance without voucher be restored to the pensioners who are put to much difficulties due to the withdrawal of the same. It was also demanded that DOT Pensioners also be given the concession on Broad band connections.

Com. Namboodiri suggested certain measures to reduce the expenditure on electricity, diesel, petrol etc. and as per the decision of the Forum meeting, proposed that a "Save Electricity / Fuel Month" be observed with clear instructions to reduce the consumption through effective methods.  CMD agreed to consider the same and suggested that it can be a continued process.

CMD informed that cabinet has taken decision taken to waive the Notional Loan  of Rs.7,500 crore of BSNL, which will benefit BSNL.  The various efforts being made by the BSNL to improve its financial viability was also stated by CMD.

The union representatives expressed their strong protest against the proposed formation of new companies like tower, optical fiber cable, land assets etc. and demanded that these should be abandoned. CMD BSNL stated that it is only about the tower company that proposal has been made and that it is beneficial for BSNL. The staff side did not agree.

The unions also stated that the Welfare Committee and Sports Committee had not met for more than  one year and that they should be convened early. CMD stated that this will be convened without delay.

11.03.2014AIBSNLEA meeting with BSNL Management in response to our letter dated 19.02.2014 on the pending items of the earlier meeting held on 24.02.2014:GS, AGS (HQ) and AGS (Fin) attended the meeting with BSNL Management in response to our letter dated 19.02.2014 on pending HR issues of the earlier meeting held on dated 24.02.2014. GM (SR), GM (Pers.) and DGM (SR) were present in the meeting. GM (Estt), was not present in the meeting due to leave. GM (SR) initiated the discussion on the pending items as under-

6.  CPCs to fill up the vacant PGM/GM/DGM (Engg.)/DGM(Fin), DE/CAO,SDE(T)/ AO equivalent posts in BSNL on adhoc/ Regular basis.

A good number of PGMs/GMs/DGMs/DEs/SDEs equivalent posts are lying vacant since long. It is adversely affecting the viability of BSNL and causing stagnation in the career prospects of executives. Hence, immediate CPCs to be conducted to fill up all vacant Group -'A' and Group-'B' level posts.

Reply: The status of CPCs from JAO to AO, AO to CAO , CAO to DGM (F- Adhoc) and DGM (F-Adhoc)  to  DGM (Regular-F) have already been discussed in the precious meeting. The status of CPC s in Telecom Engineering wing is as under:

a)  CPC from DGM (Adhoc) to DGM (Regular): GM (Pers) mentioned that proposal to initiate CPC from DGM (Adhoc) to DGM (Regular) who have completed more than 4 years regular service at STS level will be sent to the competent authority for approval shortly.

b)  CPC from SDE (T) to DE (T): GM (Pers.) mentioned that CPC to fill up vacant DEs posts could not be initiated due to the contempt case is pending in the Hon'ble High Court Chandigarh and SLP in the Hon'ble Supreme Court. The SLP in the Hon'ble Supreme court came for hearing today i.e. on 11.03.2014 but could not be heard and now posted for hearing on 24.03..2014, after the settlement of the contempt case against operation of TES Group-B seniority lists no.6&7 the further action on CPC will be taken.

c)  CPC from DE(T) to DGM (Adhoc): GM (Pers.) mentioned that CPC to fill up 480 DGM posts on Adhoc basis is in process but the promotion order will be issued only after the clearance from Hon'ble Supreme Court on 147 SDEs (T) LDCE quota seniority case. The case is listed for hearing on 24.03.2014 in the Hon'ble Supreme Court.

d) CPC from JTO(T) to SDE(T): GM (Pers.) mentioned that CPC process to fill up vacant SDEs (T) seniority quota posts is going on but the promotion order will be issued after the vacation of stay order on promotion from Hon'ble CAT Ernakulam Bench. The court has posted the case for further hearing the entire matter on 23.03.2014.

GM (Pers.) further informed that the CPC from DGM to GM in Telecom Wing was completed and promotion orders issued but he did not comment on the CPC from GM to PGM./CGM.

7. Inordinate Delay in holding the 33% LDCE for the promotion of SDE (T): Personnel Section of BSNL Corporate Office has already notified the vacancies for the year 2010-11, 2011-12, 2012-2013 to Recruitment Section. BSNL has a large number of posts of SDE (T) lying vacant. So the LDCE to fill up these vacant posts is the need of hour. This forthcoming Limited Departmental Competitive Examination from JTO (T) to SDE (T) should be conducted with a single and common paper. We have submitted our views on this issue in our letter dated 22.01.2014.

Reply:  GM (Pers.) mentioned that a committee is proposed to be constituted under the chairmanship of GM (SR) to examine the proposal for reducing the existing papers in terms of single paper on Technical Matters and one paper of General Matters. As soon as the pattern of exam is finalized then the LDCE will be notified. GM (Pers.) confirmed receipt of our suggestions in this regard. They assured an early action.

8.  Restructuring, Revision of pay scale of AD (OL) and Hindi Translators.

The committee constituted under the Chairmanship of Addl. GM(CP&M) Shri Harshvardhan has not yet finalized the report to restructure the AD(OL) cadre even after a lapse of one and half year. We request for early restructuring of the AD(OL) cadre as per 6th CPC recommendations and to provide promotional avenues as available in DoT/ Govt.

Reply: GM (SR) mentioned that GM (Pers.) and he himself will discuss the matter with the Chairman, Committee Shri Harshvardhan, Addl. GM (CP&M) for early submission of the report. GM (Pers.) assured to provide required documents to the committee from the Pers. Cell at the earliest.

9. Regularization of officiating JTOs and removal of FR-35 pay fixation.

The Committee Constituted to amend the JTO RR-2001 has to submit its report. All the Unions/Associations have already given their views/suggestions in this regard. We request for early regularization of the officiating JTOS and removal of FR-35 Pay Fixation by giving pay fixation under FR-22-(1a)(i) to all the officiating JTOs as per the judgment of Hon'ble Apex Court.

Reply:  GM (SR) mentioned that the committee constituted for modification of JTO RR-2001 has completed the report and will submit it shortly to the BSNL Management Committee for clearance and thereafter to the BSNL Board for approval. After notification of the new JTO RR – 2014, the regularization of officiating JTOs will take place immediately. Regarding removal of FR-35 pay fixation, GM (SR) mentioned that the issue will be discussed in the presence of GM (Estt) in the next meeting going to be held shortly.   

10.  Grievances of PA/ Stenographers' cadre.

(a)  Post based promotions for PA/PS to PPS/Sr.PPS.  

With restructuring and declaring the cadre of stenographers as 'dying cadre', the entry cadre is now Personal Assistants (Executive) with only one promotional avenue available as P.S., as against executives of other streams viz. JTO / JAO having promotional avenue upto the level of G.M. and above. In order to reach at least at the level of SG JAG (E-6) before retirement, we suggested the following post based promotion for the Personal Assistants:-

§  All the posts of Stenographers, Personal Assistants and Personal Secretaries may be pooled together and placed in the ratio of 40% (E-1) PA,  40%(E2) P.S. and 20 %(E3) PPS.

§  As per the recommendations of the H.K. Gupta Committee, all the HAG level officers may be provided with secretarial assistance at the level of E-4.

§  All Officers (PA/PS/PPS) who are in E-4 scale for a period of 5 years or have completed 23 years of service from the date of entry in the cadre may be promoted to E-5.

§  All officers who have been promoted to E-5 and have completed a minimum period of 3 years may be placed in E-6.

Reply: GM (Pers.) mentioned that the proposal for creation of PPS posts in the field units with HAG level officers as per the recommendations of the H.K. Gupta Committee was sent to the Estt Cell for clearance but the same was not agreed. We pleaded that already PPS / Sr. PPS posts have been created in BSNL CO, the similar action is required to be taken in field units to motivate the PA/PS cadre. GM (SR) requested to GM (Pers.) to further take up the matter with GM (Estt) in view of the present requirement of BSNL field units. GM (Pers) assured for sending the proposal again to Estt Cell, BSNL CO.  

(b)  Common Recruitment Rules & Nomenclature in BSNL.

Different Recruitment Rules for Stenographers, PAs and PSs have been issued by Corporate Office for field units and Corporate Office. This method does not exist in any of the PSUs and also does not exist for any other cadres in BSNL.  Common RRs for field units Stenographers, PAs & PSs and corporate office stenographers, P.As and PSs should be there.

Reply: GM (Pers.) mentioned that due to certain different recruitment conditions in basic cadre of Steno/PA in field units and BSNL CO separate RRs have been notified, hence review on these RRs seems to be not feasible at this juncture. However, association may further provide justification on this issue.   

(c)  Introduction of Promotion Policy for Stenos (Dying cadre).

There are about 251 Stenographers working throughout the country in the field units of BSNL.  Out of these 251, majority of the stenographers have completed more than 12 years and is placed in the pre-revised executive pay scale of 9850 & 11875 as the case may be at par with PA/PS.  The Stenographers who have been granted ACP in the executive pay scale ceased to be non-executives as per BSNL HQ order No. 1-22/2009-PAT (BSNL) dated 30.04.2009, yet the status attached to the pay scale has not been accorded to them.    Promotion policy for non-executives has also been notified now.  The only cadre which has been kept outside the purview of both the promotion policies is the Stenographers (dying cadre). Neither Executive Promotion Policy nor Non-Executive Promotion policy has been made applicable to this small group of Stenos drawing executive pay scale.  If no promotion policy is implemented, there is no scope of any Time Bound Promotion in future and have to retire from the present position when others may enjoy the benefits. This discrimination is against natural justice.

Reply: GM (SR) mentioned that the matter will be discussed in the presence of GM (Estt). He further mentioned that BSNL Board has taken decision to benefit such cadres recently that will be confirmed from GM (Estt) in the next meeting.

12  Allowing exercising options to Departmental JAOs on their promotion who got promoted on or after 07.05.2010.

Allow to execute option to the departmental JAOs appointed after 7.5.2010. As 7.5.2010 was the "cut of date" for implementation of 2nd  PRC for non - executives and the pay of non-executives has to be revised w.e.f. 7-5-2010. We requested to consider that as special case wherein the JAO exam result was declared in March 2010 but they were sent to training centers later on in different months due to shortage in Training centre and these JAOs  could join after 7.5.2010 only and they are not allowed to exercise option  on promotion to executive cadre.

Reply:  This issue will be discussed in the presence of GM Estt) in the next meeting.

13. Two weeks of training to executives whose pay is upgraded and on every promotion under EPP.

BSNL issued the letter no. 32-27/2004-Trg[Vol. VII] Dated: 18/02/2013 for relaxation in mandatory Training under Executive Promotion Policy for officers, who are of 55 years and above age on the date of their respective upgradation order, these officers will have the option of undergoing one week Refresher Course as a part of the mandatory training under EPP followed by appearing in online exam at the respective Training Centre. We further request to withdraw the Mandatory Training.

Reply:  GM (SR) did not agree to withdraw the mandatory training from EPP since it has the approval of DoT. However, he assured to examine the proposal for allowing one/two weeks study leave before the online exam. 

14.  Inordinate delay in settlement of disciplinary cases.

We have been requesting BSNL Management for the settlement of long pending disciplinary cases. Many cases are pending more than 7-8 years and no decision is given, causing undue harassment to the executives on promotions and retirement. As per CVC guidelines all the disciplinary cases needs early settlement.

Reply: Matter will be discussed in the next meeting.

15. Modifications in Executives Transfer Policy for soft tenure stations.

We requested for an early action on amendment in transfer policy clause wherein the condition of serving 3 years in soft tenure station for one executive and further he has to serve some other SSA for next 3 years, thereafter, only his request may be  considered for posting to his choice of station. It is not justified and that is why these soft tenure stations vacancies in Telecom. Circles are not being filled up. Hence, immediate modification in Executive Transfer Policy for soft tenure stations is needed.

Reply: GM (Pers.) mentioned that views of the association has taken in to consideration and a proposal for amendment in the transfer policy clause wherein the condition of serving 3 years in soft tenure station for one executive and further he has to serve some other SSA for next 3 years, thereafter, only his request may be considered for posting to his choice of station is being sent to BSNL Management Committee shortly for consideration. After the amendment, the executive served soft tenure for three years will be considered for posting to his choice station in the circle in the interest of service. But, GM (Pers.) pleaded that there should be some change in transfer policy for the normal stations/circles.

16.  Recruitment of JTO (E)/ JTO (TF) from TTAs cadre through LDCE.

In order to augment the shortage of JTO (E), we proposed to conduct LICE for TTAs having Diploma / Degree qualification in Electrical / Mechanical Engg by making provision in the JTO (E) RR. Also it is a fact that the working strength of JTO (TF) is very less than the sanctioned strength and direct recruitment is not taking place. So we proposed to conduct LICE for TTAs having Diploma / Degree qualification in Electrical / Mechanical / Metallurgical Engg by making them eligible through modification in the JTO (TF) RRs.

Reply: Matter will be discussed in the next meeting in the presence of GM (Estt).

17.  Improvement in the revised policy for service GSM, RSTC & Broadband to Executives.

(a)  Enhancement of 200 free calls limit per month on RSTC, & enhancement of free call limit on GSM Telephone connection to STS level officer from 500 calls to 800 calls.

(b)  Executives working in BSNL Corporate office, New Delhi should be provided GSM service connection from the neighboring BSNL Circles falling under NCR.

(c)  Rent free Broadband service connection to all Executives with BSNL 750 plan.

(d)  All the BSNL executives should be provided GSM Handsets of the cost of Rs.3000/- Rs. 4000/- & Rs 5000/- to the JTO/SDE/DE level executives instead of Rs, 1500/- , Rs 2500/- Rs 3500/- respectively.

(e)  All Executives' should be allowed CUG facility on RSTC at circle level.

(f)   Allowing 3G Mobile service to all Executives.

Reply: GM (SR) spoke to GM (Admn) and discussed the above matters. He mentioned that these issues will be discussed in the next meeting tentatively decided to be held on 13th March 2014 in the presence of GM (Admn).

At last GM (SR) mentioned that the management is open to discus the grievances of executives through negotiations rather than agitation approach. We appreciated the concern of GM (SR) and clarified that AIBSNLEA is always for negotiations only but agitation approach is taken under compelling circumstances when BSNL management is not responsive to the legitimate issues. We hope that the assurances given during the meetings will be honored in full for the settlement of the issues. GM (SR) mentioned that the next meeting will be tentatively held on 13th March 2014 at 11.00 AM to discuss the pending issues.

11.03.2014Meeting with Dept. of Expenditure Officers on 78.2% IDA for Pensioners on 10.03.2014: Com.V.A.N. Namboodiri, Convener, forum along with Com. K.G. Jayaraj, General Secretary and Com. G.B.Salakki, Treasurer of AIBDPA met Shri. Vijay Kumar Singh, Director (Admn.), Department of Expenditure on 10-03-2014 and discussed the issue of 78.2% IDA merger to BSNL pensioners. The representatives pointed out that there has been much delay in the expenditure department and wanted early approval.

The Director stated that he has seen the file which was put up to him. But the concerned office has made a note in the file regarding 60-40% pension contribution by BSNL which may create problem, if sent to higher officers. Therefore he has returned the file to the concerned office with instruction to delete the note and resubmit. The director was positive in approach and agreed to do the needful without delay.

11.03.2014:Meeting of Forum of BSNL Unions/Associations held on 10.03.2014:A meeting of the Forum of BSNL Unions/Associations was held on 10th March 2014 at BSNLMS office. Com. C.Singh, President, Forum presided. Com. V.A.N. Namboodiri, Convener welcomed all and briefed the meeting about the actions taken after the last meeting held on 3rd March 2014. He reported about the meeting with the CMD BSNL as also Secretary, DOT and the details of the discussions. The Forum has strongly opposed merger and stressed that the issues raised by it should be settled before any merger takes place. He also reported about the discussion with the ED(Finance) on the superannuation benefits issue of the BSNL Direct Recruitees. The Forum has demanded for a meeting with the High Level Committee appointed for recommending on the superannuation issue and it has been agreed to. The meeting is expected to be held shortly. The meeting with the Dept. of Expenditure officers on the issue of 78.2% for the pensioners/retirees and the present position of the case were also reported. GS & AGS(HQ) attended the meeting.

After discussion on all the agenda items, the following decisions were taken:

1. The Forum will strongly pursue with the DOT/Government the issues to be settled before any Merger of BSNL and MTNL. The Forum will also pursue with its strong opposition against the  decision to form a tower company bifurcating BSNL.

2. The matter of pension contribution on the actual basic pay instead of the present contribution on the maximum of the pay scale should be pursued with DOT.

3.  On the issue of superannuation of BSNL Direct Recruitees, Forum should strongly put our arguments for full 30% benefits.

4.  The Forum will ask the BSNL Management to hold the delayed Welfare and Sports Committee meetings urgently.

5.    A letter will be written to BSNL Management with suggestions to reduce the expenditure on electricity, diesel, petrol etc. which is the second biggest expenditure after payment of salary, by avoiding wastage and also  by rationalising effectively. A proposal also will be given to observe a month, "Save Electricity, Fuel Month"  in April/May to focus and educate on the issue.

5.  Next meeting of the Forum will be held on 13th March at 04.00 PM at BSNLMS Office.

11.03.2014:Filling up of the EE(C/E/Arch) vacant posts: AIBSNLEA have been trying for filling of the vacant posts of EE(C/E/Arch) since last one year. We have been pleading for modification of BSNL MSRRs of EE(C/E/Arch)  (wherein diploma qualification of SDE(C/E/Arch) should also be allowed to the promotion of EE(C/E /Arch) at par JTOS/JAOs to the post of DE/CAO. The proposal to give parity with JTO(T)/SDE(T) to JTO/SDE(C/E) was approved by the BSNL Management committee and it was being sent to BSNL Board for approval but the degree holders SDEs in Civil/Electrical wings and PGM(BW) unit opposed the proposal and it was stopped and further GM(Pers) was directed to take the revised opinion of PGM(BW) and PGM(EW) cadre controlling  Officers in this regard. GM(Pers) sent the proposal to PGM(BW)/(EW) for review and in response to this PGM((BW) proposed give 10% posts of EE(C/E/Arch) to diploma holders and it was re-examined by Pers Cell  BSNL CO and further which in accordance with DOP&T guidelines on inter-se-seniority. GM(Pers) suggested to have 50:50% ratio of degree and diploma holders in EE(C/E/Arch) cadres and sent to PGM(BW/EW)  for consideration and the same has been accepted by both the officers, Accordingly a revised proposal is being sent to BSNL MC and Board for approval.

Similarly AIBSNLEA has been pleading in PGM(BW) unit to allow SDEs(C/E) who acquired   degree through Distance   mode of Education while in service with due permission which has already been allowed in PGM(EW) unit. But PGM(BW) did not consider it  and on our request Director((HR) constituted a Committee of three Officers i.e. GM(Pers), PGM(BW) and PGM(EW). Convener DGM(Pers). Committee after its first meeting sought clarification on the validity of degree availed through Distance Education from UGC which was also received and committee further discussed the matter wherein they decided further to seek the opinion on distance Education from AICTE and accordingly a letter is being sent to AICTE by GM(Pers) cell.

Meanwhile, PGM(BW) and PGM(EW) sent the proposals for filling up of the vacant EE(C/E) posts i.e. about 75 EE(Elect) and about 125 EE(Civil) posts.

AIBSNLEA met PGM((BW) on 05.03.2014 and pleaded that since the proposal of modification  in BSNL MSRRs is in process as well as the committee on to examine the  validity of distance Education while in service is also on job, hence till the finality of both the issues, CPC should not be initiated  since already more than one year is over. PGM(BW) categorically told that now he can not wait for the decisions on both the above  issues and want immediate filling up of the vacant (about 125 EE(Civil)) posts. Also mentioned that in case the BSNL MSRRs of  EE(C/E) are modified, these will be applicable on prospective date only. We pleaded that we have been protesting BSNL MSRRs of EE(C/E/Arch) since after its notification in 2009  but he did not agree and told that he has already sent the CPC proposal to the Competent Authority for approval.

On 07.03.2014 we further met Director (HR) and requested for an early action on modification of BSNL MSRRs of EE(C/E/Arch) and decision on distance Education in civil Wing in presence of PGM(EW). Director(HR) mentioned that though both the proposals under consideration of the BSNL Management but it may take time in decision. Hence, the proposals of PGM(BW/EW) to fill-up vacant EE(C/E) vacant posts cannot be delayed further to initiate  CPCs on the basis of present BSNL MSRRs of EE(E/C/Arch)). PGM(EW) also pleaded for early  filling-up of the EE(Elect)  posts.  Director (HR) advised to PGM(EW)  that shortly in the presence of PGM(BW) a decision will be taken on this issue. We further pleaded that it will be a great in justice to the diploma holders if all the EE(C/E) vacant posts are filled up by degree holders SDEs(C/E) only and it will be a breach of assurance which was given to provide parity with JTO(T) to the JTO(C/E)   at the time of  absorption in BSNL and thereafter decision of the BSNL Board wherein JE/AE(C/E/Arch) cadres were restructured w.e.f. 01.10.2000 by  giving parity at par JTO/SDE(T). It may also invite litigations.

10.03.2014:GS, AGS (HQ) & Advisor (Legal) met CVO BSNL CO on curtsy call meeting. CVO while discussing the viability of BSNL, mentioned that during his one year period he could understand that there should be proper check at all levels i.e. SSA, Circle and BSNL CO, simply decentralizing the powers will not help the organization. Every one should understand that some percentage of check is there by his superior and he is being checked also. It will bring discipline in the organization.

He also mentioned that transfers as per transfer policy should also take place to avoid long stay, which develops vested interest and complaints. We explained that normally transfers are taking place as per the transfer policy only but due to financial crises in BSNL the mass transfer are discouraged. However, we insisted for post tenure transfers in SSAs/Circles. CVO appreciated our concern and mentioned that this can reduce no. of vigilance cases.

10.03.2014:Status of Court case in the Hon'ble Supreme Court on the issue of seniors entitled to same pay scales w.r.t. their juniors I.A.No.3/2013, SLP (C) No.7716/2013, All India BSNL Executive Association and in the matter of BSNL & Anr. vs. M. Sethu Madhaban:The application for impleadment filed by All India BSNL Executive Association which was listed for hearing before the Chamber Judge of the Hon'ble Supreme Court after notice today. The Hon'ble Court after hearing all the parties allowed the application for impleadment on the ground that similarly situated persons like respondents happens to be seniors are also entitled to same pay scales as are enjoyed by juniors. The petitioners are directed to amend the cause title accordingly.

10.03.2014:6th Hyderabad Telecom District AIBSNLEA branch conference held on dated 07-03-2014 at ASMAN MAHAL,Lakdi ka pool, Hyderabad:The 6th District Conference of AIBSNLEA Hyderabad Telecom District Branch was held on 07-03-2014 at Asman Mahal, Lakdi-ka-Pool, and Hyderabad. The conference started at 09-30 a.m. which was presided by Com. B. Rajeswara Rao, the President of the branch and Com. N. Rajendra Prasad, the District Secretary presented his report which was accepted by the meeting unanimously. Com. G. Shankar, the Finance Secretary presented the audited accounts of the branch for the period 09-08-2011 to 06-03-2014 and the same was unanimously accepted.

Com. Prahlad Rai, GS AIBSNLEA who was present at Hyderabad for participating in the District Conference called upon the CGMT AP Circle on courtesy along with AGS (Engg), OS, ACS (Engg), Branch President and Secretary, Circle Office Branch, Vice President of AP Circle, Ex- CHQ Office bearers and had detailed talk about the viability of BSNL in general. CGMT appraised the GS that AP Circle had been consistently increasing the revenue to the tune of more than 8% for the last 3 years and this year it may still be better. The importance of providing satisfactory services in CFA wing especially of Broad Band and CM wing was discussed. It was felt that perhaps Hyderabad is the only city which is facing stiff competition from other Telecom Service Providers and in spite of the same AP BSNL is trying to surge ahead. Many other issues pertained to viability of BSNL were discussed.

The Open Session in connection with the District Conference started at 12.15 hours and to which Sri. P.V. Muralidhar Garu, PGM HTD was the Chief Guest and Sri. M. Ratna Babu Garu, GM (F) HTD was the Guest of honor. Com. Prahlad Rai, GS AIBSNLEA and Com. J. Saibaba AGS (Engg) were the special guests. The GS, (Officiating JTOs Association), CS, AIGETOA, CP SNATTA, DS AIGETOA, DS SNEA, DS, SEWA graced the occasion.

The key note address was presented by Com. N. Rajendra Prasad, DS HTD which discussed elaborately about the difficulties in the field arising out of Hyderabad Metro Rail works, the working of FTTH, the importance of CM wing with respect to revenues etc.

GM (F) HTD Shri M. Ratna Babu Garu spoke the details of revenue of HTD and expressed hope that this year also the revenues will be at par with that of previous year. He also indicated that the outgo on salaries is increasing in spite of the fact that good number of employees is getting retired. Hence the only way to cope up with the demand for money is to improve the services and better marketing.

AGS (Engg) requested HTD Administration for deployment of the staff in the needy sectors immediately as the staff is to be better utilized.

GS Com. Prahlad Rai spoke at length about the revenues of BSNL from the date of inception and how we were a profitable company upto 2008-09 and the issue of payment of encashment of leave through LIC funds, the issue of IUC, ADC and the effects of stoppage of IUC and ADC, and the issue of compensation for providing Rural services, the issue of provision of mobile services to the citizens of India to which the license was delayed and it is only due to the pressure mounted by Unions / Associations which made the Government to allow BSNL to operate mobile services, the issue of proposed BSNL and MTNL merger, the issue of BBNL, the proposal of Government to chalk out a cell tower company out of BSNL and the opposition to the same from Association, the issues of  CPSU cadre hierarchy,  Standard E2 and E3 scales to the Executives instead of in between scales, 30% superannuation benefits to the BSNL recruits as promised and EPF anomalies etc,.

Chief Guest Sri. P.V.Muralidhar PGM HTD spoke in detail about the status of various issues of HTD and appreciated the information percolated by GS AIBSNLEA, who has given a global picture of BSNL and its work force. PGM HTD asked all to give their best output for BSNL which is giving us bread and butter.

The Open session ended with National anthem.

In the afternoon session a combined General body meeting of the branches at Hyderabad was arranged and interactive session with the GS was arranged. To a query about participation in the Strike, AGS (Engg), explained the General body that it was on 6th Feb 2014 AIBSNLEA was of the opinion that it is not correct also to give a call for agitation in view of the progress of agitation of one of the constituent of the UNITED Forum and hence unanimous decision was taken by both the associations that, the time is not right now for agitation and we need to wait for 15 to 20 days and thereafter, again having a meeting with AIGETOA on common issues all three executive Associations under the banner of United Forum may give notice for agitation program. But suddenly agitation call was given by other association on
10.02.2014 without  informing us. Also on BSNL's viability related issues i.e. Arbitrarily Govt. decision on merger of BSNL & MTNL without resolving HR and financial issues, formation of tower subsidiary and payment of pension contribution  to DoT etc. have been discussed in the Joint Forum of BSNL Unions & Associations and to protest against a notice of Indefinite strike  has been given by Joint Forum on 04.03.2014 wherein AIBSNLEA is at forefront.
GS explained the members about the status of various DPCs especially that of the JAO to AO and other DPCs such as AO to CAO, CAO to DGM, JTO to SDE, SDE to DE, DE adhoc to DE regular, SDE to DE regular, DE to adhoc DGM, DGM adhoc to DGM regular, promotions in Civil and electrical wing, status of soft tenure transfers, Regularization of Officiating JTOs, Discrepancies in the question papers of TTA to JTO of AP Circle, the necessity of all of us to work more and more revenues as otherwise our 3rd PRC implementation may be a difficult task, the achievements of AIBSNLEA which is always at the fore front to resolve the issues of executives and in the fore front of the JOINT Forum also.

The venue was jam packed for both the sessions of open session and that of the combined General body meeting.
Com. B. Rajeswara Rao the President of HTD branch ,who retired as Assistant General Manager was felicitated on his superannuation at the Conference.

The Conference ended with unanimous elections for the next term for HTD Branch. Com S.Saya Goud, Com P.Christopher and Com G.Shankar are elected as the President, Branch Secretary and Finance Secretary respectively.

06.03.2014: GS met Director(HR), BSNL Board and discussed

(i) Settlement of HR issues: We extended our thanks for arranging a formal meeting with AIBSNLEA on 24.02.2014 on HR Issues. Wherein some of the issues have been discussed but still some issues are pending for discussion & settlement. We requested for arranging an early meeting. Director (HR) assured for holding an early meeting with AIBSNLEA.

(ii) Proposed Merger of BSNL & MTNL: We expressed our serious concern against the arbitrary proposal of Merger of BSNL & MTNL without resolving the HR issues & financial issues of BSNL. Director (HR) mentioned that yesterday, the matter was discussed with DoT officer wherein the concern of BSNL Unions/ Associations has been submitted. However, the issues related to BSNL/MTNL merger can be resolved only when a policy decision is taken by the Govt. for BSNL/MTNL Merger. He further mentioned that in case the merger of BSNL & MTNL is taken by the Govt., the HR & financial issues of BSNL will be settled.

(iii) CPC from DGM(Adhoc) to DGM(Regular): We requested for CPC from DGM(Adhoc) to DGM(Regular), who have been completed more than 4 years of DGM(Adhoc) services. Director(HR) assured an early action in this regard.

(iv) Filling up of the vacant EE(C/E) post: We requested for filling up of the vacant EE(C/E) vacant posts (i.e. about for 75 EE(E) and about 100 for EE(C)) . Director(HR) assured to look into the matter.

We also requested for modification of BSNL MSRRs of EE(C/E) to allow diploma holders SDEs for the promotion in the cadre EE(C/E). Director (HR) assured to look into the matter.

05.03.2014:GS, Advisor (HQ) met PGM (BW) BSNL CO and extended thanks for issuing JTO(C) to SDE(C) promotion orders. We requested for consideration of pending request transfer cases of SDEs(C). PGM (BW) mentioned that some cases on medical ground have been considered and some more genuine cases of SDEc (C) will be considered shortly.

b)  CPC from SDE (C) to EE(C) : PGM (BW) mentioned that the proposal to fill up vacant EE ( C ) posts have been sent to the competent authority for approval to initiate the CPC and the same is awaited.

c)  Validity to Degree acquired through Distance mode of Education: PGM (BW) mentioned that as per the committee decision a letter is being sent to AICTE by GM (Pers.) for clarification shortly.

d) Discrepancies in the Answer Key of JTO (C) to SDE (C) LDCE held in December 2013: PGM (BW) mentioned that some of the officers to examine the discrepancies have been sent to the Sr. GM (Rectt.) for further necessary action. Hence, now Sr. GM (Rectt.) has to take action in this regard.

05.03.2014:GS met Addl. GM (CP&M) Sh. Harshwardhan and expressed our serious concern against delay in submitting the committee report on Restructuring of AD (O/L) cadre. Addl. GM mentioned that some informations have been asked from some of the units of BSNL CO on this issue. However, he assured for early submission of the report after holding committee meeting in the next week. AIBSNLEA has already provided feed back to the committee on this issue.

05.03.2014:GS, Advisor (HQ) met GM (Pers.) and discussed:-

a)    CPC from DGM (Adhoc) to DGM (Regular): We further requested to initiate CPC from DGM (Adhoc) to DGM (Regular), since they have completed more than 4 years regular service at STS level. GM (Pers.) assured for an early action in this regard.

b)    CPC from SDE (T) to DE (T): GM (Pers.) mentioned that CPC to fill up vacant DEs posts could not be initiated due to the contempt case is pending in the Hon'ble High Court Chandigarh and SLP in the Hon'ble Supreme Court. The SLP in the Hon'ble Supreme court is posted for hearing on 11.03.2014, after the settlement of the contempt case against operation of TES Group-B seniority lists no.6&7 the further action on CPC will be taken.

c)  CPC from DE(T) to DGM (Adhoc): GM (Pers.) mentioned that CPC to fill up 480 DGM posts on Adhoc basis is in process but the promotion order will be issued only after the clearance from Hon'ble Supreme Court on 147 SDEs (T) LDCE quota seniority case. The case is listed for hearing on 24.03.2014 in the Hon'ble Supreme Court.

d)  CPC from JTO(T) to SDE(T): GM (Pers.) mentioned that CPC process to fill up vacant SDEs (T) seniority quota posts is going on but the promotion order will be issued after the vacation of stay order on promotion from Hon'ble CAT Ernakulam Bench. The court has posted the case for further hearing the entire matter on 23.03.2014. AIBSNLEA has already impleaded in the case.

e)  Consideration of request transfer cases of SDEs & DEs and retention after 31.03.2014 of DEs: GM (Pers.) mentioned that some cases wherein the SDEs & DEs have completed 2½ or 3 years services in the circle may be considered in April 2014. But he mentioned that there should be a difference between the consideration of  the request transfer cases of the executives, who have been working in the hard tenure stations / Circles and the Executives working in the soft Circles/ stations

Regarding retention of DEs after 31.03.2014 in their parent Circles, GM (Pers) mentioned that they should go to their original posting stations / Circles since others have joined. Only, some genuine cases on merit may be considered for further retention.

f)   Restructuring the AD (OL) cadre: We request to intervene in the matter so that the committee report in this regard is submitted early. GM (Pers.) assured to talk with Addl. GM (CP &M) for early submission of the report.

g)  Modification in BSNL MSRR and validity of degree acquired through distance education mode: GM (Pers.) mentioned that shortly a letter is being sent to AICTE for clarification to verify the validity of degree acquired through distance mode of education as per committee decision. Also the proposal for modification in BSNL MS RR for EE (C/E) will also be processed shortly as per the recommendations of the committee.

04.03.2014:DoP&T issued instructions w.r.t. 04.03.2014: GS , AGS (Finance) met GM (Estt.) BSNL Corporate Office and discussed regarding framing of JTO RR 2014.  GM (Estt.) mentioned that committee meeting was over yesterday to finalize the JTO RR 2014 draft, the minutes of the meeting are being prepared and the report  will be submitted to BSNL management committee meeting in the next week for considering and approval thereafter it will be putup to the next BSNL Board meeting. He estimated to compete the whole exercise upto May 2014 to notify  the new JTO RR 2014.

He briefed regarding seniority, eligibility age limit etc. e.g. the seniority of  all the LICE qualified JTOs will be above to all recruited JTOs as per JTO RR 2014. The seniority will be fixed up on the basis of year of vacancy. All the officiating JTOs will be regularised as per JTO RR 2014 immediately. The eligibility age limit may be reduced from 7 years of service to 5 years of service as we have been demanding. On promotion from TTA to JTO one increment benefit will be granted as per rule on the JTO basic pay of Rs.19020/- . We requested to grant two increments benefit on promotion .  

04.03.2014:  Meeting with Chairman TC & Secy (T):GS, Convener of Forum Com. V.A.N. Namboodiri and GS , President SNEA met Chairman  TC & Secy (T) and discussed regarding arbitrary proposal for merger of BSNL and MTNL without resolving the HR issues, Disinvestment, MTNL`s market  liability  and opposed the formalities of a Tower Company bi-furcating BSNL.  Chairman, TC & Secretary (T) after giving a patience hearing mentioned that any decision will be taken after holding the meeting with the BSNL Unions / Associations.  He has already directed the concerned authorities in DOT and BSNL/MTNL  management in this regard.  He further mentioned that some time Government is delaying the good decision and some time Unions are also not taking proper decision as per the requirement of the present scenario.  He further mentioned that MTNL being a small PSU may revive with the support of Government but it will be difficult to revive BSNL, if its revenue goes down to its operational expenditure . He cited the example of HMT (Hindustan Machine and Tools), a premier PSU which was inaugurated by First Prime Minister of India Pd. Shri Jawahar Lal Nehru who told that these PSUs are the Temples of India and now HMT is  suffering  continues losses wherein the employees salary could not be revised since 1986 onwards.

He expressed his serious dis-satisfaction regarding the poor quality of service in MTNL  and BSNL since he is directly receiving the complaints of Telephone faults e.g. a message over his mobile telephone was that one customer of MTNL has send him today that his telephone is faulty for the last 10 days and his relative's telephone is faulty for the last  two months and has requested for restoration.  Similarly, he appraised that one month before, the  Attorney General of India called him for the restoration of his residence Telephone at Mumbai which was lying faulty more than 15 days.  Immediately, the matter was referred to CMD  MTNL and he reported next day that Telephone is now restored.  The AG next day thanked him and mentioned that he was compelled  to make complaint at Secretary (T) level.  In  this manner Secy. (T) expressed his feelings and told that similar type of complaints, he is receiving in BSNL also. While coding the examples he mentioned that quality of service in BSNL/MTNL must be improved to increase the customer base and revenue. Increase in revenue will be your profit since employees salary and operation expenses are static.

Regarding pension contribution payment on actual basic of BSNL employees from BSNL, payment of Rs.2350 crores against Rural  deficit charges to BSNL.  Secy (T) assured to look into the matter. He further mentioned that still EGOM (Empowered Group of Ministers) meeting is expected shortly on the revival of BSNL/MTNL wherein some pending agenda issues will be discussed. He assured to consider our feedback/concern for the betterment of BSNL/MTNL.

04.03.2014: Meeting with CMD BSNL:GS and Convener of Forum of BSNL Unions/Associations Com. V.A.N. Namboodiri met CMD BSNL and discussed regarding merger  of BSNL and MTNL and creation of Tower Subsidiary.  We expressed our serious concern against such arbitrary move of Govt. without hearing the BSNL Unions / Associations the stake holders. CMD, BSNL appreciated our concern and mentioned that Govt may take decision of BSNL and MTNL merger but it will be implemented after the settlement of HR issues and other concerns related to financial matters .  He assured that, he is there to safeguard the interest of BSNL and its employees. 

Regarding creation of Tower Subsidiary , he has already asked  GM (SR) for arranging a presentation to all the Unions and Associations on this issue to remove the  misgivings and shortly a presentation will be arranged. He also mentioned  that we are jumping over the issue without knowing the facts.  He expressed his serious concern that we are not doing well for the revenue growth of BSNL.  We pleaded that employees are trying to do their best in the available resources.

03.03.2014: Meeting of Forum of BSNL Unions/ Associations:The meeting of the Forum held today, 3rd March, has decided to go on immediate indefinite strike if Govt. arbitrarily decides on merger of BSNL & MTNL without resolving HR and disinvestment etc. issues and on bifurcation of BSNL in to Tower company.

Also superannuation benefit to BSNL recruited employees wherein BSNL should contribute 12% on employee's Basic pay + DA as per DPE guidelines. Forum leaders will also meet Smt. Geeta Rau ED (Fin.) & Chairman HLC, on superannuation benefit to BSNL recruited employees and will give a letter for 12% contribution to superannuation benefit. Com GS, Advisor, CHQ and CS UP (East) attended the meeting.

a) CPC from JAO to AO: GM(FP) mentioned that instructions have been issued to the circles to conduct screening of APARs/VCRs of the eligible JAOs to AO promotion and to sent to BSNL CO for conducting the CPC to fill up about 1800 AOs posts within one month time. Also a letter has been sent to DOT for seeking clarification on Hon'ble CAT Chandigarh Judgment on implementation of SC/ST roster on promotion. All the CHQ office bearers, Circle/Branch Secretaries are requested to ensure early sending of screening reports to BSNL CO.

b) CPC from AO to CAO:- GM(FP) mentioned that the proposal to initiate CPC from AO to CAO and diversion of 365 MTs posts is still pending for BSNL MC approval. However, he assured that he will try to get the MC approval early so that CPC from AO to CAO can be initiated.

c) CPC from CAO to DGM (Fin.) and DGM (Fin.) Adhoc to DGM (Regular): GM(FP) mentioned that CPC from CAO to DGM Adhoc basis and DGM(Fin) Adhoc to DGM(Regular) are in progress. The VCRs are being collected by CVO BSNL CO. About 150 VCRs have been received in CVO BSNL CO. He assured an early action in this regard.

d) Grant of grace marks in JAO part-II exam: We requested for consideration of granting grace marks to departmental candidates, since vacancies are there. GM (FP) mentioned that matter has been informally discussed at  higher level but they are not supporting such move in the executive cadre. We coded the earlier decisions. However, he assured to process the case for consideration to the competent authority.

e)  Filling up the vacant JAOs posts: GM(FP) mentioned that a proposal has been sent to Sr. GM (Rect.) BSNL CO to notify for the recruitment of 962 DR JAOs and 1000 JAOs from departmental /internal quota. He further mentioned that shortly notification for examination of DR recruitment and internal quota will be issued. The syllabus for internal quota exam has already been released to have only two objective type papers.

03.03.2014:  GS meet GM(Pers.) and discussed regarding

a)    Time bound promotion in E-6 grade to DGMs promoted from SDE/AO cadres: We requested to give E-6 IDA pay scale under EPP to DGMs promoted from SDE/AO cadres. GM(Pers.) after some discussions in the presence of DGM (Pers.) and concern DM  assured for early decision in this regard.

b)   DGM (Adhoc) to DGM (Regular) promotion: We requested to hold early CPC from DGM (Adhoc) to DGM (Regular) for the DEs/ DGMs Adhoc who have completed 4 years regular service of DE. DGM (Pers.) assured for an early action in this regard.

03.03.2014:Report of Special General Body Meeting held on 26th February 2014 at Telecom Factory,BRBRATTC Jabalpur ,T&D Circle & GMTD Jabalpur Branch: Special General Body Meeting of Telecom Factory Jabalpur was held on 26th February 2014 in the conference hall of Telecom factory, GS Com.Prahlad Rai along with Circle President M.P.Circle Com H.M. Bajpai, Circle Secretary Md. Parwez Khan, Circle Treasurer Com Amar Singh attended the meeting. Meeting was attended by all the executives of Telecom Factory.GM TF Com.& Shri Jaswant Singh President TF Branch & Shri Narender General Manager Telecom Factory were present. Branch Secretary Com.S.M.Prasad outline the issues of Telecom Factory .Circle President MP Circle Com. HM Bajpai in his address give stress on the fourth coming membership verification. & appeal to work hard for it.In his address Circle Secretary Com. Parwez Khan advocated the demand of Secretary TF for considering the demand of Branch Secretary TF in respect of HR issues. He also appeal the members to work hard for the viabilty of BSNL,he also out line the views of GS in respect of functioning of Telecom Factory. He appreciated the concern of GS in respect of Telecom Factory. His views that before out sourcing, Telecom Factory should be given opportunity to carry out the manufacturing the work of BTS Towers, Sim Cards, Telephone Instruments, Power Plant Battaries etc.

Com  Prahlad Rai GS, AIBSNLEA, CHQ  addressed and briefed on going activities related to CPCs of various disciplines . He informed regarding  promotion orders to fill up about 26 SDE's (TF) posts, from JTO (TF) to SDE (TF).He also explained about E-2 & E-3 IDA pay scales and resolution of 2007 and 2008 batchs pay anomaly. details regarding the viability of BSNL i.e. payment of spectrum charges (3G & BWA) of Rs 18500 crores, non reimbursement of OPEX charges, withdrawal of ADC, payment of interest @ 14.5% on notional loan of Rs 7500 chores etc. He further informed that BSNL is spending more than 9000 crores in maintenance of all the 28000 rural exchanges in India. He explained the efforts made by BSNL Unions/Associations in getting approval of refund of Rs 6724 crores of BWA spectrums and made appeal to all the members to support actively during membership verification and try to make AIBSNLEA a number one executive association. In reference to the   Implementation of Assured Executives Promotion Policy in BSNL & Implementation of CPSU cadre hierarchy he also informed that we are demanding Change of designations on each Time Bound up gradation on functional  First time bound promotion on 1-10-2004 after completion of four years w.e.f. 1-10-2000 in all the cases. BSNL Management has granted benefit of residency period w.e.f. 1.10.2000 to the Executives i.e. JTO/SDE (Civil/Electrical/Arch./TF) Engineering wings, CSSs, PAs/PSs, JAOs etc. for whom the RRs were notified after 1.10.2000 and accordingly the pay scales were upgraded. Whereas, as per Dr. Vinay Shahi's Committee recommendations the upgraded scales for the above executives' should have been implemented w.e.f 1.10.2000 on actual basis or notional basis. Recently, notional pay fixation from 01.10.2000 in the upgraded pay scales has been allowed to JAOs. Similar treatment is required to be given to JTO/SDE (Civil/Electrical/Arch/TF.) engineering wings and PAs/PSs cadres. GS also explained the case of Settlement of Pay anomaly cases wherein senior Executives are drawing less pay than their juniors & give the latest position in this respect.GS inform the house regarding Amendment in BSNL MSRRs allowing Diploma holders to the promotion of Executive Engr. (Civil/Electrical) wings at par with other discipline of executives.

In addition to this, in the Architecture discipline, having valid registration as Architect with the council of the Architects is made compulsory, which is gross injustice CPSEs  to the absorbed Executives of Arch Engineering wings in BSNL. GS Inform that as per Recommendation of 2nd PRC, DPE has issued order to all wherein it is clarified that there is no justification for introducing intermediary pay scales. In BSNL the Executives of JTO/SDE level are placed in the lower pay scales against their standard IDA pay scales E2 to E3. Almost all the Oil sector, Steel Sector and Power Sector PSUs including MTNL are already adopted the entry level Executives' pay scale starting from E2 scale. The demand to place JTOs and SDEs in standard pay scales of E2 and E3 is very legitimate.

BSNL Management is not at all serious to introduce CPSU cadre hierarchy and implementation of E-2, E-3 IDA pay scales for JTO & SDE equivalent executives. The Joint Committee of BSNL officers headed by PGM (SR), BSNL CO, New Delhi and the representatives of BSNL Executives Associations was constituted in Feb-2012 to discuss and submit its report on both the issues within a period of six months but even after a laps of two years, no serious discussions has taken place in the Committee Meetings. Executive Associations has already submitted their unanimous opinion/ suggestion on CPSU Cadre hierarchy but the Management side has not started discussion on this. GS also replied the queries of members. Meeting ended in a full satisfaction of members & slogans of gathering.

Meeting at TTC Jabalpur:

In his second assignment GS reached AB Hall BRBATTC Jabalpur to address the trainees who were in ongoing training from TTA to JTO.The hall was jam packed to cpacity.The trainees were from Madhya Pradesh, Bihar & Gujrat. The office bearers of BRBRATTC Jabalpur,District Secretary GMTD Jabalpur Shri P.S.Rathore,CWC Member Kailash Nayak, Branch Secretary TF Shri Prasad were also present. HM Bajpai in his address out line the functioning of AIBSNLEA & appeal to join & strength the hands of AIBSNLEA in the coming membership verification. In his address Com. Manish Samadhiya appreciated the efforts made by AIBSNLEA & its GS Com. Prahlad Rai in respect of justified demands of BSNL recruits TTA's. He raised the issue of  Superannuation Benefits, EPF issue of Direct Recruited Employees of BSNL.He also demand 2 Extra increments at the time of promotion. In his address GS Com.Prahladh Rai give the details how AIBSNLEA was formed by the merger of 11 cadre Associations. AIBSNLEA is the only association who raise the issue of all the executive cadres of BSNL. He replied to the points raised by Com.Samadhiya and informed that regarding Superannuation benefits to directly recruited employees as per DPE guidelines. This Association has already submitted its crystal clear views about the issues related to provisions of Superannuation Benefits to directly recruited employees. He informed the house that We requested BSNL Management to resolve superannuation benefits to directly recruited employees as per DPE guidelines. BSNL should contribute 12% as Superannuation Benefits in respect of Direct Recruits, to fulfill the limit of 30% contribution and the effective date of implementation of Superannuation benefits of BSNL Recruited Employees must be 01.01.2007.

This Association has already submitted its crystal clear views about the Early Resolution of EPF anomalies with serious discrepancies in respect of Direct Recruited Employees of BSNL in its letter dated 30.01.2014.GS explained that Yearly EPF statement is being supplied to BSNL recruited Executives in response to our detailed letter and we are continuously monitoring the same. We requested Director (HR/EB) to resolve EPF issue for BSNL recruited JTOs at the earliest. GS appreciated the contribution of TTA's in BSNL & welcome them to the Executive cadre. He appeal them to work whole heartedly for the viability of BSNL,the need of the hour for young generation to contribute to uplift BSNL from the present crises.He appeal them to strength the AIBSNLEA as this is the only association who care for every cadre, they can use this establish platform & fight untidily  for their genuine demands. Special meeting of T&D Circle and GMTD Jabalpur Branch:

In the evening GS addressed the Spl.GB of T&D Circle & GMTD Jabalpur branch in the seminar hall of T&D Circle. Large number of members attended the meeting.Shri N.D.Gupta President T&,D Branch.Branch Secretary Shri Rhul Dongre were present. Direct recruit JTO Shri Pradeep Chourasey, Shri Piyush Soni & Shri Praveen Kumar actively participated in the meeting & gave useful suggestions. The meeting was anchored by Organising secretary T&D Circle Shri D.K.Khare. GS thank the organizers for conducting the very successful programme in a very short notice.
