CWC Meet at Guwahati: Almost all Circles has informed the list of participants arrival & departure schedule to attend CWC Meet at Guwahati to be held on 5th & 6th April'2013. It is observed that lot of Circles have intimated more numbers of participants. In this regard, all the Circle Secretaries are requested to ensure that participants are allowed strictly as per AIBSNLEA Constitution. No observers will be allowed.

Kind Attention to All Circle Secretaries: All the Circles are requested to sent the name of the participants, their arrival and departure details to Host Circle i.e. Assam. This is extremely urgent because hotel rooms are to be booked accordingly and last minute booking may not be available. All Circle Secretaries are requested to send the details again to the followings, immediately by 10th March to avoid discomfort to the participants. Circles should bring CWC members strictly as per the quota paid by them.

Instructions to members attending CWC at Guahati

Kind attention to all Delegates/Guests participating in the CWC to be held on 5th & 6th April,2013 at Hotel Prag Continental, Panbazar, Guwahati.

(i) All are requested to bring their Photo ID card like Pan/Driving license/Departmental Photo ID etc. Pl. bring one Xerox copy of photo ID. Being a North Eastern State it is required for Hotel Admission

(ii) Weather will remain moderate with possibility of short spell of rain .Those visiting Shillong requires to bring one half sweaters.

(iii) Accommodation in hotel is available only from 1200 hrs of 4th April to 1200 hrs of 7th April, 2013. Over stay in hotel has to be paid by the Delegates.

(iv) Food will be available from Dinner on 4th April to breakfast on 7th April only.

(v) Delegates with family members are allotted accommodation in HOTEL RIALTO which 150 m away from the venue. Additional expenses are to be borne by the delegates.

31.03.0212: CEC Meet of MP Circle at Indore on 22.03.2013: CEC of AIBSNLEA MP Circle was a grand success.The CEC was blessed by General Secretary Shri Prahlad Rai and Organizing Secretary(West) Shri CM Saste. In the first session Circle Secretary Com. Parwez Khan presented report of MP Circle before the Executive Committee Meeting at Indore for the Period October 2011 to February 2013. The dais of open session was blessed with not only the top most leadership of AIBSNLEA but also with the top most Management of MP Circle.CGM MP Circle Shri N.K. Yadav along with Sr.GM (Admin) Shri Prakash Ballal, Sr. GMTD Indore Shri.G.C. Pandey & Sr. GM (NOP) Shri. Piyush Khare were there to address our members. The Anchor of Open Session our Senior Most Comrade Shri.A.B. Banke conducted the program in a very dignified manner. DS Indore presented the welcome speech & win the heart of all those who were present. After welcome speech Circle Secretary AIBSNLEA MP Circle presented the Key Note address.

This association was formed in BSNL by merger of 10 separate associations of Group B & Group-'A' officers of different stream in DOT. Earlier in DOT these association were functioning separately but after the merger in AIBSNLEA the things are changed totally. Now the service matters & welfare matters of all these 10 associations are being taken strongly & continuous persuasion by our beloved GS Shri Prahladh Rai the results are well seen. We are the proud circle to hold first ever CWC of AIBSNLEA at Bhopal & again the CWC was successfully organized at Jabalpur on 19th To 20th October 2011. As you know BSNL's survival at this stage is on threat, Market share is declining. Basically our existence is due to Wired Line Service but the real competition is between Land line & Mobile. If we want survival then our land line services should be improved & should be at par with Mobile services. In today's open session we have chosen the topic which itself explain our concern regarding revenue generation of BSNL.

GS spoke to concern officers of DOT to pursue regarding implementation of 78.2% IDA Pay fixation the other day. It is understood that DOT has further sent a letter to CMD, BSNL to reply some more queries. It seems that DOT administration is dragging the issue on one pretext or the other. Hence, Forum of BSNL Unions and Associations need to take immediate steps in terms of harder Trade Union actions to get the justice for BSNL Employees. BSNL Management who signed agreement with Forum of BSNL Unions/Associations on this issue has never pursued the matter in DOT for its implementation. He also discussed important HR issues. We have a serious concern regarding non settlement of seniority cases in different courts since long time. We request CHQ to resolve the seniority cases by conducting meeting with all executive associations ITS Repatriation Issue : On this issue I would like to narrate these lines of a prominent Urdu poet "Souch ko Badlo Sitare Badal Jayegain Nazar ko Badlo Nazare Badal Jayegain,Zaroorat Nahi Kashtiyan Badal ne ki Dishauan ko badlo Kinare badal jayegain�.

After the Key Note address of CS Organizing Secretary Com. C.S. Saste addressed the open session & summaries the issues his experienced & well balanced address was well appreciated by the house.

Sr.GM(NOP) spoke & gave valuable suggestions on the subject of open session.

Sr.GMTD Indore Shri.G.C.Pande in his address out line the achievements of Indore SSA & appreciate the role of not only the group B officers in outstanding realization but also the role of all the staff of Indore SSA on the subject. He informed that Directorate will soon issue the orders for all India on the same pattern as Indore for outstanding realization. A very attractive & informative address was given by CGM Shri N.K.Yadav.replying to the various points raised in the Key Note address CGM was very positive & covered all the issues.Replying to one of the point "CGM said that from the next year, now no kadvi davai".

After the address of CGM, our beloved GS addressed the house. It was wonderful to listen GS. Every issue related to each cadre was covered by GS. Regarding court cases, ITS repatriation,78.2% IDA issue, Viability of BSNL, shortage of store, role of group B officers in the growth of BSNL, DOT's attitude in resolving various issues and all those issues which were in the mind of our members was covered by CS. All those who were in the house was overwhelmed by the address of GS. The approach of GS & his knowledge of all the issues of all the cadres was very much appreciated by all those present there. The vote of thanks was given by Circle Vice President Shri Vijay Kumar. After the lunch the house reassembled and CEC continued. Important decision taken by CEC Shri G.D. Sejkar was nominated as ACS & Shri Sabir Husain as Web site secretary. CEC passed the resolution "To congratulate Indore branch for hosting successful CEC & Open Session in Indore" It was decided to hold next CEC at Ujjain. <<<Click here for glimpses>>>>

31.03.0212:Circle executive committee meeting of AIBSNLEA AP Circle: The Circle executive committee meeting of AIBSNLEA AP Circle was conducted at Hyderabad on dated 23-3-2013 as notified earlier. The CEC was given a warm welcome by Com. Nageswara Rao OS. As per the agenda, the reports of CS, DSs and Circle office bearers was put before the meeting and was adopted. Similarly the report of Financial Secretary also was placed before the house and the same was accepted. CS in his brief report explained the issues taken up by the association from the date of 4th Circle conference to till date and also explained the developments to the body.

In the afternoon session GS joined the meeting along with other CHQ office bearers i.e. OS(S) CHQ, Advisor CHQ and Auditor CHQ. Advisor CHQ enumerated the achievements of CHQ and asked all to strengthen CHQ. Auditor CHQ gave instances of the issues where in the CHQ intervened in crucial issues of the organisation and asked that CHQ needs to be strengthened.

OS(S) CHQ in his brief address informed the members that the elections for recognition of association for executives is likely to take place shortly and asked all to mobilize membership in a big way so that the very good work in progress from AIBSNLEA can continue further and assured GS that he is taking care so that AIBSNLEA will be the most leading association in south. Of course in North it is already leading.

CS (SNEA) and GS (Officiating JTO's association) were also present during the session.

Com GS Prahlad Rai touched upon many issues of vital importance to the executives and the gist is Pension contribution at the highest of the basic pay than the current basic pay is costing the company to the tune of Rs. 400 Crores more than required. The loan what so ever was not taken by BSNL is shown as notional and BSNL is asked to pay the interest at very high rates, compulsorily. As the unions and associations have been opposing the divestment of BSNL we could save the national property worth several lacs of crores from getting diverted to private people. Remember the case of VSNL. MTNL is disinvested is not showing any appreciable difference and if so where is the need to disinvest BSNL. Even if disinvestment is made to the tune of 30% there is no guarantee that the money so got will be utilized for BSNL growth. That money will be utilized by Govt. for education roads etc,.

VRS was imposed on MTNL. But what is the result? Things have not improved. For them they do not have Govt. pension. Management is not ready to discuss the issue of managing BSNL after VRS and BSNL being a PAN INDIA company cannot be compared to other smaller PSUs. If unbundling of Copper to the last mile is agreed the revenue that we have been getting by L/L and B/B ,L/C etc, we will be losing.GOI is yet to refund BWA spectrum charges to us and JOINT forum is perusing such issues.

In the field there are no stores for maintenance such as Drop wire, instruments, cables and management wants us to bring profits. But, we can surely say that BSNL executives have been performing very well in the given circumstances. Repatriation of ITS officers was ordered because of our continuous efforts only and they have been still continuing without any conviction/commitment. If the agreed 78.2% IDA fixation is not given we may have to go further on struggle.

GS also has thrown light on the issues various CPCs, issue of AD(O/L),Civil and electrical wing issues and replied to all the queries raised by the comrades.

CS summed up the deliberations by giving suitable replies to the queries raised by members in between and presented a memento to GS.

26.03.2013:  BSNL Corporate Office issued instructions regarding modification in policy for provision of concessional Broadband Connection to the below JAG level employees in BSNL at their residence to include JAG level and above.<<<Click Here for the order>>>

The MC of BSNL Board decided to modify the policy for provision of concessional BB concessional connection  to the below JAG level employees in the BSNL at their residence and has approved to extend the same to JAG and above level retired officers at their residence residing in BSNL service areas only.

25.03.2013: Hon'ble  Delhi High Court judgment dated 19.03.2013 in Writ Petition 1803/2013 filed jointly by AIBSNLEA, SNEA(I) and BSNLEU praying for quashing the order of DoT dated 11.03.2013 to deploy unabsorbed ITS in BSNL.

Hon'ble  bench clearly states that the impugned orders dated 11.03.2013, which both in letter and spirit violate the orders which are passed in W.P.(C) 22515/2005 and especially the order passed in CM No. 16683/2012 (our impleadment application).
Judgment:
"Learned senior counsel for the petitioners, on instructions rightly states that the petitioners are really aggrieved by the impugned orders dated 11.3.2013 which both in letter and spirit violate the orders which are passed in W.P.(C) 22515/2005 and especially the order passed in CM No. 16683/2012".
"--- Petitioners are also at liberty to initiate, if so required, appropriate independent proceedings in accordance with law".

The order of Hon'ble High Court is the outcome of DoT and BSNL order dated 11.03.2013 and a clear endorsement of the prayer contained in our WP. On the basis of this order, we are filing original application in Pr. CAT, New Delhi.
We engaged Senior Advocate Shri Neeraj Kaul for this case.

(a) Regularization of offg. JTOs: We requested for regularization of offg. JTOs as one time measure. Director (HR) advised us to give proper suggestions in this regard. 21.03.2013:GS, AGS(F),  AGS(HQ), CS BSNL CO met  Addl. Secy(T), DoT on 20.03.2013 and discussed

(a)  Implementation of 78.2% IDA pay fixation case of BSNL employees: We requested for early clearance of 78.2% IDA pay fixation case as the same is a part of basic pay and also it affects the pensioney benefits of retired officers, which has been approved by BSNL Board long before.  Addl. Secy(T) mentioned that decision will be taken as per rule and the same  will be informed to BSNL Board at the earliest.

(b) Repatriation of ITS officer's case: We requested to provide the copy of Cabinet decision on ITS Officers absorption issue and expressed our serious concern against arbitrary deployment of ITS officers in BSNL, which is in violation of Hon'ble Delhi High Court judgment dated 15.02.2013. Addl. Secy(T) mentioned that the cabinet decision has been mentioned in the terms & condition of the letter dated 11.03.2013 and she clarified that ITS Officers will not be promoted against BSNL/MTNL posts & they will be relieved in diminishing order on year to year basis in next ten years and detained is already explained in Annexure-'C' of letter dated 11.03.2013. She further clarified that ITS Officers will get their promotion against 463 Group-'A' posts in DoT.

21.03.2013:GS, AGS(F),  AGS(HQ), CS BSNL CO met  Shri Uma Shanker, Jt. Secy(T), DoT on 20.03.2013 and greeted  him on  assuming the charge of Jt. Secy(T), DoT and discussed

(a)  Implementation of 78.2% IDA pay fixation case of BSNL employees: We requested for early clearance of 78.2% IDA pay fixation case of BSNL Employees. Jt. Secy(T), DoT  mentioned that the case is pending in his office to examine the BRPSE observations on BSNL viability. He categorically mentioned that "I am fully convinced that your claim of 78.2% IDA pay fixation is correct.  However, I am trying to fulfill the requirement of BRPSE recommendations" and assured for early clearance.

Central Working Committee Meet at Guwahati

The 3rd Central Working Committee of AIBSNLEA is meeting at Guwahati on 05th and 6th April'2013 after the 1st and 2nd CWC Meetins held at Jabalpur(MP), Ahmadabad (Gujarat) and 3rd All India Conference held at Kolkata in Jan'2011 . This would certainly be an important CWC meeting before our 4th All India Conference scheduled to be held in Sept'2013 in Maharastra Circle. During the period, after 3rd All India Confercne, Kolakata to this CWC Meet at Guwahati, there had been numerous important developments which needs thorough and critical examination mainly issues related to Modifications in BSNL MSRRs & Executives transfer policy, CPCs to fill up vacant DGM (Engg.)/DGM(Fin), DE/CAO,SDE(T)/ AO equivalent posts, Modifications in SDE RRs, MT RRs & DGM RRs, CPSU Cadre Hierarchy, Implementation of Standard IDA pay scales E2, E3 instead of intermediate E1A, E2A IDA Pay Scales for BSNL executives, Anti-dating of DNI, Pay anomaly wherein seniors are drawing less pay then juniors, Pay anomaly case of Departmental JAOs, Regularization of Officiating JTOs, Restructuring of AD(O/L) Cadre, Creation of PPS posts, BSNL MRS and Implementation of DPE OM dated 02.04.2009 regarding 78.2% IDA fitment benefit etc..

In the Organisational front, we are to ascertain that Circles/Branches are functioning well by holding regular Branch/Circle elections. All the organisational action calls given by CHQ are implemented successfully. The membership has increased at Branches / Circles and some more efforts are required to enroll more & more executives to strengthen the Association. CHQ/Circle quota is being remitted regularly. We are to ascertain that the integration of ten associations which merged together to form the AIBSNLEA has actually taken place. There should be critical examination of our strength and  weaknesses, so that proper corrective measures, wherever necessary, could be decided.

We are to discuss the status of above mentioned HR issues related various cadres, which are taken up by AIBSNLEA at the appropriate level. Settlement of the issues is too judged on proper perspective, so that the unresolved issues could be planned to be got resolved expeditiously.

We are to also have detailed evaluation of our efforts to get the common issues pertaining to all the Executives/Employees of BSNL resolved. No amount of discussion on these issues can take us to a meeting point, unless we are able to appreciate the complexity of these issues. We are to be very cautious to design our approach and decide action plan.

BSNL's very existence and its viability is one of the important issues which needs a thorough discussion. Performance of BSNL in all fronts will have to be analyzed properly.  Its drastic fall in market share has been a matter for concern to all of us. We shall have to analyse why the growth of BSNL is not upto our expectation and come out with concrete proposals to make BSNL a strong and viable Organisation. Confidence building measures in the customers shall have to be given the priority. Measures required for more revenue generation and its collection, reduction of operational cost, stoppage of unwarranted expenditure has to be suggested. Government's decision to  impose VRS to 1,00,000 employees needs through discussions. The CWC cannot and will not keep its eyes closed on this development.

BSNL Management's indifferent attitude towards the Executives shall become a focused issue in the CWC. Its negative approach on HR issues is really a matter, of serious concern. In fact, the HR functions in BSNL are in a mess and CWC might like to take a view on this. The increased frustration and consequent demoralization in BSNL Executives because of in-apt handling of their career progression is another important issue to be discussed in the CWC. BSNL Management has implemented EPP contrary to the Promotion Avenue offered at the time of absorption of the Group-'B' Officers can never get the appreciation of any Executive. The time bound non-post based promotion upto JAG Selection Grade was an assurance at the time of calling of option for absorption. BSNL Management has deviated from that assurance. The CWC might take a stand on the issue.

Our historic joint struggle along with SNEA (I) and AIGETAO demanding implementation of the assured Promotional Avenue i.e. CPSU Cadre hierarchy implementation of E-2 & E-3 Standard pay scales  will take the centre stage during the discussions in the CWC. Its impact and the results achieved will have to be assessed. The present status of the issue on which the agitation was launched shall certainly be reviewed. We are aware that the Management is not ready to implement CPSU Cadre hierarchy and E-2, E-3 standard IDA Pay scales. In that background, CWC shall also be critically examining the pros and cons of the current proposals of reduction of 30% DGM/DEs posts which will stagnate the carrier prospects of executives. This CWC would also like to adopt time bound an action plan to get the issue sorted out once for all. Let the Guwahati CWC be a complete success.

Circle President spoken on financial condition of Karnataka Circle ,He appealed to all not to withdraw GPF since GPF Account is maintained by Govt, of India. CP replied the queries raised by members on ERP.He clarified allocation of Maintenance fund to all SSAs without discrimination. CS spoken on General Transfers, Time bound promotion a twice year, Sanction strength of SDEs is calculated based on Revenue of LL,BB, Mobile, CDMA, etc Posting of SDEs will be done accordingly during General transfers. So, Executive staff may be redeployed in SSAs based on the working strength of SDEs. (a)  Promotion from DE to DGM: We requested to fill up vacant DGMs posts from eligible DEs. Sr. GM(Pers.) mentioned that he will talk with CGMT Kerala Circle for pursuing in the Hon'ble High Court Kerala through BSNL's Advocate for early delivering the judgment on 147 SDEs (LDCE Quota) Seniority Case.  Thereafter only the promotion order will be issued.

(b)  Restructuring of AD(O/L) Cadre: We expressed our serious concern against non-holding of Committee Meeting and submission of report on this issue for last one year. Sr. GM(Pers.) assured to look into the matter and for eatly completion of the Committee report.

(c) Regarding recently issued transfer orders in the grade of SDE(T), which is called volunteers for posting in ERP Cell, BSNL CO: We expressed our serious concern against Own Cost transfer order issued on dated 12.03.2013 by BSNL Corporate Office on which  volunteers has been asked for posting in BSNL CO. Sr. GM(Pers.) mentioned that if transferred SDEs(T) represents  to Pers. Cell that the transfer orders are issued on Govt. Cost, they will immediately join ERP Cell, the transfer order will be modify on Govt. Cost immediately.

(d) Consideration of tenure/request transfer cases of DEs/SDEs: Sr. GM(Pers.) mentioned that all the pending request/tenure transfer cases will be considered in the month of April'2013.

19.03.2013AIBSNLEA, SNEA(I) and BSNLEU Writ petition 1803/2013 filed jointly praying for quashing the order of DoT dated 11.3.2013 to deploy unabsorbed ITS to BSNL came up for hearing today in the Hon'ble Delhi HC. Hon'ble HC while mentioning the order of DoT dated 11.3.2013 is a clear infringement of the judgment of the Hon'ble HC in WP 22515/2005 and CM 16683/2013 (Application filed by AIBSNLEA, SNEA(I) and BSNLEU), however advised the applicants to move applications seeking similar relief at appropriate forum. Hon'ble bench during the course of argument observed that passing any order in the instant writ petition might prejudice contempt proceedings already initiated by the Hon Delhi High Court.
We engaged Senior Advocate Sh. Neeraj Kaul and heated arguments took place. UOI represented by Addl. Solicitor General Sh. Rajeev Mehra and BSNL by Sr. Advocate Sh. V. K. Rao. We will be taking further course of action shortly.

18.03.2013AIBSNLEA,  SNEA(I) and BSNLEU  filed writ petition in the Hon'ble Delhi High Court praying for quashing the DOT order dated 11.03.2013 deploying the unabsorbed ITS officers in BSNL on BSNL posts - The case is listed for hearing on 19-03-2013 (today).

18.03.2013 The Contempt petition filed by AIBSNLEA, SNEA(I) and BSNLEU in the Hon'ble High Court Delhi against DOT orders dated 11.03.2013 to deployment of non-optee ITS Officers in BSNL came for hearing today in Hon'ble High Court of Delhi and after arguments, the contempt petition is admitted and  posted for hearing on 25th July 2013.

14.03.2013GS, AGS(HQ), CS Delhi Circle met GM(FP) and discussed:

(a)  CPC from CAO to DGM(F): We resented against delay in expediting CPC from CAO to DGM(F). FM(FP) mentioned that VCRs from CVO are not being received even after continuous efforts. However, today we brought to the notice of Director(Fin.) and he has assured to personally speak to CVO for an early action in this regard.

(b)  Consideration of tenure/request transfer cases of AOs/CAOs: GM(FP) mentioned that all the cases will be considered in the month of April'2013 positively.

13.03.2013BSNL CO has issued orders on Child Care Leave on 08th MARCH 2013: 

Gist of Child Care Leave (CCL):

Women employees having minor children may be granted Child Care Leave (CCL) by an authority competent to grant leave for a maximum period of 730 days during their entire service for taking care of up to two children, whether for rearing or to look after any of their needs like examination, sickness, etc.  Child Care Leave shall not be admissible if the child is eighteen of age or older.  During the period of such leave, the women employees shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.  It may be availed of in more than one spell. Child Care Leave shall not be debited against the leave account. Child Care Leave may also be allowed for the third year as leave not due and commuted leave upto 60 days (without production of medical certificate).  It may be combined with leave of the kind due and admissible.

CONDITIONS :

1.       Requires prior sanction.

2.        Intervening holidays will count as Child Care Leave as in the case of Earned Leave.

3.         In respected of disabled / mentally challenged children, it is permitted upto the age of 22 years subject to condition and submission of certificates.

4.         Child Care Leave may not be granted in more than 3 spells in a Calendar Year.

5.         Child Care Leave may not be granted for less than 15 days.

6.         Child Care Leave should not be sanctioned during probation period except in cases of certain extreme situations and a minimal leave should be sanctioned.

7.         LTC cannot be availed during Child Care Leave.

8.         Child Care Leave is also admissible to civilian  female industrial employees working in Defense Establishment subject to conditions.

12.03.2013GS, AGS(HQ), GS & President SNEA(I) and Vice President & AGS, AIGETOA met Director(HR/EB), BSNL Board and  thanked for issuing Child  Care Leave order for BSNL Employees and discussed

(a) Holding of Committee Meetings on CPSUs Cadre Hierarchy and finalization of E-2, E-3 standard IDA pay scales: We expressed our serious concern against non-holding of Committee Meetings on CPSUs Cadre Hierarchy and finalization of E-2, E-3 standard IDA pay scales. Director (HR/EB) mentioned that he will intervene in the matter and assured an early action in this regard.

(b)  Implementation of 78.2% IDA pay fixation case: We requested Director (HR/EB) for pursuance in DoT of 78.2% IDA pay fixation case. Director (HR/EB) assured to look into the matter.

(c) Reduction of 25% DGMs/DEs posts in BSNL in the grab of Remuneration Committee: We resented against DOT/BSNL's move to reduce 25% posts of DGMs/DEs in BSNL under the grab of Remuneration Committee. Director (HR/EB) informed that BSNL Management is aware with the issue and will present the actual facts in the BSNL Board Meeting and assured to look into the matter.

(d) EPF issue for BSNL recruited JTOs: We requested Director (HR/EB) to resolve EPF issue for BSNL recruited JTOs. Director (HR/EB) informed that the said issue will be discussed in the Committee Meeting on 15th March'2013 and assured to look into the matter.

(e) Superannuation benefits to directly recruited employees as per DPE guidelines: We requested Director (HR/EB) to resolve superannuation benefits to directly recruited employees as per DPE guidelines. We requested that BSNL has to deposit only 2% share and rest 10% share will be deposited by BSNL employees and this will help the directly recruited employees on superannuation.  Director (HR/EB) assured to look into the matter.

(f) Promotion from DE to DGM: We requested to fill up vacant DGMs posts from eligible DEs. Director(HR/EB) mentioned that on our discussion/request with Sr. GM(Pers.) has already written  a letter to CGMT Kerala Telecom Circle for pursuing in the Hon'ble High Court Kerala through BSNL's Advocate for early delivering the judgment on 147 SDEs (LDCE Quota) Seniority Case.  Director (HR/EB) assured to look into the matter.

(g) CPCs to fill up vacant DEs/SDEs(T) posts: We requested to allow utilization of MT quota  STS posts till MT recruitment as per BSNL MSRRs and to expedite CPC from JTO(T) to SDE(T). Director(HR/EB) mentioned that to fill up STS vacant posts, he will discuss with CMD, BSNL and spoke to Sr. GM(Pers.) to collect VCRs at the earliest to expedite JTO to SDE(T) CPC. He also mentioned that LDCE quota promotion of 2627 JTO to SDE will be issued only when the stay order on promotion granted by Hon'ble CAT Guwahati is vacated. However, the case is posted for hearing on 20th March'2013.

08.03.2013:Circle Executive Committee (CEC) Meeting of AIBSNLEA Gujarat Circle  held 02.03.2013:  The Circle Executive Committee (CEC) Meeting of AIBSNLEA Gujarat Circle  was held on  02.03.2013 at 'Hotel Golden Plaza', Ahmedabad in a grand manner. Circle Office bearers, CWC Members, Advisors, Branch President, Branch Secretary and CEC Members from all over Gujarat attended the CEC Meeting. Shri C.M. Saste, Organization Secretary (West) CHQ and Shri M.M.Kanani Advisor  CHQ were also attended and addressed the meeting.

Shri R.C. Dhala, Circle President welcomed all participants and took the item as per agenda points circulated. In his Circle Secretary report Shri R.M. Belani, Circle Secretary elaborated the achievements and activities carried out during the period. He also requested OS (W) to take-up the  pending issues with CHQ for their early settlement.

All the Branch Secretaries also submitted their branch report and issues to be taken-up at Circle as well as CHQ level. Shri T. Raja, Finance Secretary presented finance report and requested the branches to ensure collection of contribution in time. Shri Raveendra Babu, CWC Member raised various issues pertaining to PA/PS cadre.   Com. R.S Parihar, Advisor, AIBSNLEA, Gujarat, in his address appealed all the members to change the erstwhile DoT mindset and serve the customers more efficiently. He stressed upon the excellent customer care mechanism. Com. A. Guha, Advisor, AIBSNLEA, Gujarat  in his address stressed upon the need for team work in BSNL is essential in the present scenario is must.  

Com. M.M.Kanani , Advisor AIBSNLEA CHQ , in his address, mentioned the need of settlement of the problems related to transfer and HR issues facing by BSNL Executives due to shortage and substitute problem for account officers, AGM/DE, DR-JTO in various SSAs. Consideration of Intra circle transfer request for DR-JTO/SDE/DE.

Com. S.M.Saste, Organizing Secretary (West) CHQ in his address explained  that the BSNL is suffering from the discriminatory attitude of our management, DOT and the Govt. of India. He explained the efforts being put by CHQ in resolving the issues of BSNL Executives. He explained the burning issues  like ITS Repatriation process and Cabinet Note and 78.2 % IDA fitment benefit case. He assured to look into reported issues at CHQ related to Gujarat Executives. He also impressed upon the need of Organisational joint action programmes and the concern of trade Unions in Viability of BSNL to get the legitimate demands and right. He informed nos. of court cases are hurdles in releasing promotion orders and for the settlement of HR issues in almost all cadres.

07.03.2013: Repatriation of ITS officers case: We met concern officers of DoT on this issue and requested for implementation of court decision in accordance with Hon'ble High Court Delhi judgment. It is understood that DOT may file SLP in the Hon'ble APEX Court against Hon'ble Delhi High Court judgment and thereafter only Cabinet decision may be implemented. However, we have already filed caveat in the Hon'ble APEX Court on this issue.

07.03.2013:GS, CS BSNL C.O. and GS, AGS SNEA(I) met DDG(TPF), DOT (Govt. nominee Board of Director of BSNL Board) and discussed :

(a) Implementation of 78.2% IDA pay fixation case: We requested for early clearance from DOT to BSNL Board decision for implementation of 78.2% IDA Pay fixation case. DDG(TPF) after detailed discussions assured to look into the matter.

(b) Reduction of 25% DGMs/DEs posts in BSNL in the grab of Remuneration Committee: We expressed our serious resentment against DOT/BSNL's move to reduction of 25% posts of DGMs/DEs in BSNL under the grab of Remuneration Committee. DDG(TPF) after detail discussions assured that absorbed executives interest will be taken care of.

06.03.2013:  GS, FS met CMD, BSNL and invited him as Chief Guest to attend the CWC Meet at Guwahati. CMD assured to make it convenient to attend the CWC. Also discussed:-

(a) Allowing All India LTC facility to BSNL employees, who has a retirement period less than 2 years: We requested for issuance of order for LTC to be availed by BSNL employees retiring after Sept'2013. CMD assured to examine the matter.

(b) Filling up of the vacant DEs posts: We requested to allow filling up of all vacant DEs posts as per BSNL MSRRs to reduce the stagnation period in SDEs cadre and for the growth of BSNL. CMD assured to look into the matter.

06.03.2013:  GS, FS, CS Delhi Circle met GM(FP) and discussed:-

(a) CPC from CAO to DGM(F): We expressed our serious concern against delay in conducting CPC from CAO to DGM(F). GM(FP) mentioned that today also he has spoken to Addl. CVO for sending the VCRs and assured that efforts will be made that CPC is completed earliest and promotion order is issued by the end of March'2013.

(b) CPC from AO/CAO(Adhoc) to CAO Regular: GM(FP) mentioned that still some ACRs are missing and today only he has talked with NATFAM, Hyderabad for sending of two CAOs missing ACRs. However, he assured that just after the DGM promotion, the CAO Regular promotion order will be issued.

(c) CPC from JAO to AO: GM(FP) mentioned that Court Case in the Hon'ble CAT Chandigarh Case came for hearing on 5th March but the applicants advocate could not appear, hence the case is posted for hearing on 20th March'2013. BSNL's reply is already filed.

(d) Consideration of request / tenure transfer cases of AOs/CAOs: We requested for consideration of AOs/CAOs request/tenure transfer cases. GM(FP) appreciated our concern and assured that all the cases will be considered for transfer in the month of April'2013.

05.03.2013:  GS, FS, AGS(HQ), AGS(F) and CS UP(E) Circle met Director(HR/EB), BSNL and invited him to attend Open Session of CWC Meeting to be held on 5th April'2013 at Guwahati. Director (HR/EB)  accepted our invitation to attend the CWC Meet at Guwahati and discussed

a)  Regularization of offg. JTOs: We requested for regularization of offg. JTOs as one time measure. Director (HR/EB) mentioned that due to Hon'ble High Court, Chandigarh directions, we are not in a position to do the same. He also mentioned that Management is fully aware with the issue and advised to suggest any legal solution in this regard.

b)  Allowing All India LTC facility to BSNL employees, who has a retirement period less than 2 years: We requested to allow All India LTC facility to the employees who have a retirement period less than 2 years. Director (HR/EB) mentioned that Management is fully aware with the issue and assured to release necessary instructions at the earliest.

c)  Promotion from DE to DGM: We requested to fill up vacant DGMs posts from eligible DEs. Director(HR/EB) mentioned that on our discussion/request with Sr. GM(Pers.) on yesterday, a letter has been issued to CGMT Kerala Telecom Circle for pursuing in the Hon'ble High Court Kerala through BSNL's Advocate for early delivering the judgment on 147 SDEs (LDCE Quota) Seniority Case.

d)   Seniority cases pending in different Court: We expressed our serious concern regarding non settlement of seniority cases in different courts since long time. We also requested to resolve the seniority cases by conducting meeting with all executive associations. Director (HR/EB) assured to look into the matter.

e)  Consideration of request/deputation transfer cases of JTOs: We requested to consider pending transfer/deputation cases of JTOs(DR) on inter-circle basis. Director (HR/EB) mentioned that some JTOs have been posted to North East Zone, Gujarat Telecom Circle from different Circles and continuously requesting for deputation/Para-8 transfers but due to shortage of JTOs in these Circles, it is difficult to consider all the cases. However, he assured that some solution will be taken to settle the problem for further to fill up the vacant JTOs posts of these circles. We suggested for Circle recruitment, which can settle the problem. Director (HR/EB) assured to look into the matter.

05.03.2013:  Status of Hon'ble Chandigarh CAT case on DPC from JAO to AO: The case came for hearing on today. Now the case is postponed to 20.03.2013.

05.03.2013: Status of Audit and Accounts Pay parity, which was granted notionally  w.e.f. 01.01.1996 and actually from 19.02.2003:  All India Railway Accounts Staff Association (AIRASA) in Trivandrum (Shri Jose Sebastian and 4 others) challenged the decision of the Railway Board (i.e. Govt.) to grant the higher pay scale from 19.02.2003 and demanded that higher pay (and subsequent arrears of pay) be paid from 01.01.1996, in the Hon'ble CAT, Ernakulam.  Hon'ble CAT, Ernakulam, on 30.6.2006, quashed the order of Railway Board granting notional fixation from 1.1.1996 to 18.2.2003 and directed that the higher pay scale be paid in real terms with effect from 1.1.1996. The Railway board moved Hon'ble HC of Kerala against this directive of the Hon'ble CAT, Ernakulam. Finding no merit in the writ petition moved by the Railway Board, the Hon'ble HC of Kerala rejected the appeal (27.03.2012).
Railway Board planned to move the SC. The petitioners (only three are still in service, other two have since retired), i.e. AIRASA filed caveat in the Hon'ble SC so that the SLP by the Railway Board is not admitted without hearing the original petitioners.
The case finally came up for admission on 25th February 2013 and the Hon'ble SC rejected the SLP, rather the SLP moved by the Railway Board was not admitted - i.e. the Hon'ble CAT directive to pay arrears of pay from 01.01.1996 is upheld.
There are two more cases filed by the AIRASA members - one at Patna, Bihar and Guwahati, Assam -  which are to yet to be disposed of.
The case has come to finality. It is to be seen how the government would implement the directive of the court.

04.03.2013: Present Status of ITS repatriation Case: ASG Sh. Mehra (DoT) today again mention to Hon'ble High Court to reconsider the judgment of dismissal of review application filed by him today morning. Hon'ble High Court Delhi again called the concern Advocates and after hearing their arguments, adhere its earlier judgment of dismissal of the review application.

04.03.2013:  GS, AGS(HQ) met Sr. GM(Pers.) and discussed

(a) CPC from DE to DGM: We requested to contact CGMT Kerala Telecom Circle for pursuing in the Hon'ble High Court Kerala through BSNL's Advocate for early delivering the judgment on 147 SDEs(LDCE Quota) Seniority Case. Sr. GM(Pers.) immediately spoke to CGMT Kerala Telecom Circle for pursuance and getting an early judgment since the CPC from DE to DGM is badly delayed. CGMT Kerala Telecom Circle assured him for early pursuance.

(b) CPC from SDE(T) to DE: We requested to expedite CPC to fill up all vacant DEs posts. Sr. GM(Pers.) mentioned that the CPC to fill up 760 DEs posts is in progress but getting delay due to stay order granted by Hon'ble CAT Chennai. However, in addition to 760 DEs posts to fill up all vacant DEs posts a proposal has been sent to the Competent Authority for consideration but CPCs can be held only when stay order on promotions is vacated.

(c) Request transfer cases of DEs from AP, MH, GUJ, Kerala Telecom Circle to KTK, TN, Chennai TD, STR/STP Circles: We requested for early consideration of request transfer cases of DEs from AP, MH, Kerala and Gujarat Telecom Circles to KTK, TN, Chennai TD, STR/STP Circles, who have completed more than two years service in these Circles. Sr. GM(Pers.) assured that some DEs who have completed two years services upto 31.10.2012 may be consider for request transfer to avoid mass transfers. However, he assured an early action in this regard.

Kind Attention to All Circle Secretaries: Inspite of earlier request no circles except Karnataka, Kolkata TD and Jharkhand, have sent the name of the participants, their arrival and departure details to Host Circle i.e. Assam. This is extremely urgent because hotel rooms are to be booked accordingly and last minute booking may not be available.
All Circle Secretaries are requested to send the details again to the followings, immediately by 10th March to avoid discomfort to the participants. Circles should bring CWC members strictly as per the quota paid by them.

04.03.2013: Hon'ble High Court Delhi dismissed DoT review application on ITS repatriation case:  Hon'ble High Court Delhi today dismissed DoT review  application on ITS repatriation case. DOT filed review application to Hon'ble High Court Delhi praying that DoT is implementing Hon'ble High Court judgment dated 15.02.2013 for repatriation of ITS officers from BSNL/MTNL immediately & as per the decision of Union Cabinet ITS officers will further be sent on deemed deputation to BSNL/MTNL for the next 10 years and during these 10 years period, BSNL/MTNL will create their Management at higher level.

Hon'ble High Court Delhi at first instance itself dismissed the DOT review application & directed to implement Court order in its true spirit.

DOT prayer before Hon'ble High Court Delhi  on ITS Case:
12. That in compliance with this Hon'ble Court order dated 15.02.2013 and also with a view to implement the Cabinet decision dated 13.02.2013,the respondent Department of Telecommunications wishes to issue the following orders:-
i. Repatriation of all Group-'A' officers including ITS officers currently on deemed deputation to BSNL/MTNL to DOT with immediate effect and consequent relieving of officers by BSNL/MTNL thereby completing the process of absorption of Group A officers of the DoT in BSNL/MTNL under Rule 37-A of CCS Pension rule 1972.
ii. Deployment of ITS officers in BSNL/MTNL for a period of 10 years on year to year diminishing basis as per the requirement plan on the terms and conditions as approved by the Cabinet w.e.f the date the BSNL/MTNL leave officers in pursuance of (i) above. This deployment has been approved by the Cabinet as a special dispensation to ensure that the services in these organizations are not disrupted and their operation do not suffer due to the lack of manpower and has no relation whatsoever with the absorption process initiated and completed under Rule-37A CCS pension Rules 1972.
iii. Direction to all the cadre Units of group A Services of the DoT to complete the process of cadre review which is already underway and declare the officers as are in excess of the revised sanction strength consequent on cadre review as surplus as per Cabinet approval.
PRAYER:
a) The Hon'ble Court may take cognizance of the course of action proposed in para 12 above pursuant to the decision of the Cabinet and this Hon'ble Court's orders dated 17.04.2012, 01.10.2012 and 18.12.2012 and pass orders clarifying, if necessary, the order dated 15.02.2013.
b) Pass any order or further orders it deems necessary ----.

01.03.2013: 1st Circle Executives' Committee Meeting of AIBSNLEA Rajasthan Circle on 01.03.2013 at Udaipur: The 1st Circle Executives' Committee (CEC) Meeting of AIBSNLEA Rajasthan Circle was organised on 01.03.2013 at  Udaipur  in a grand  manner. Shri Prahlad Rai, General Secretary AIBSNLEA CHQ, Shri Ravindranath, FS, Shri Bhagwan Singh, AGS (HQ), Sh. Devesh Sharma, Organizing Secretary (North) and Shri Karan Singh, Advisor from CHQ side attended and addresed the meeting. The Open session of the conference was attended by Shri A.K.Bhargava, CGMT Rajasthan Circle as Chief Guest and Shri H.P. Meena, Sr. GM(F) Rajasthan Circle, Shri R.N. Mathur, GMTD Udaipur as Guest of Honour. Many representatives of print and electronic media also attended the conference.

Chief Guest of the Open Session Shri A.K. Bhargava, CGMT Rajasthan Circle inaugurated the function by lightning of lamp. All the distinguished guests were welcomed by the garlanding. Com. R.K. Khokhawat, Branch Secretary, AIBSNLEA Udaipur branch delivered the welcome address. Com. Devi Lal, President AIBSNLEA Udaipur branch lookafter all the arrangements regarding stay/Food/Transport etc.

Com. M.K. Morodia, Circle Secretary AIBSNLEA Rajasthan, in his key note address, explained that how the impact of latest technologies in taking place in our services. Com. CS highlighted the problems of the shortage of materials in the field units and appealed the Management to ensure the proper supply of the material to the field units. Com. CS also mentioned the problems regarding the cadre and HR issues of the Executives of Rajasthan Circle and impressed upon for the early settlement of the same. He assured that if Management provides full support then the Executives' of Rajasthan Circle are committed for making BSNL, a vibrant Organisation.

Com. Karan Singh , Advisor AIBSNLEA CHQ , in his address, mentioned the need of settlement of the problems faced by BSNL Executives like Shortage of materials in the field units and non- delivery of materials in accordance of demand. He also impressed upon the final settlement of the ITS issue so that the environment of uncertainty may be end.

Com. Devesh Sharma, Organizing Secretary (North) CHQ in his address explained that in which manner the BSNL is suffering from the discriminatory attitude of the Govt. of India. He explained the efforts of CHQ in continuously resolving the issues of BSNL Executives. He also impressed upon the need of Organisational action programmes and the concern of trade Unions for Viability of BSNL.

Com. Ravindranath, FS(CHQ) , in his address appealed all the members to change the erstwhile DoT mindset and serve the customers more efficiently. He stressed upon the Excellent customer care mechanism.  He also advised for avoiding to adopt the way of Courts for the settlement of HR issues.

Com. Bhagwan Singh, AGS (HQ), in his address thanked AIBSNLEA Rajasthan Circle for inviting him in the OPEN Session and appealed all the members of making the BSNL a vibrant Organisation by providing the Quality of Services to them with excellent customer care.

Guest of Honour, Shri R.N. Mathur, GMTD Udaipur  in his address thanked AIBSNLEA Rajasthan Circle for inviting him in the session. He impressed upon the need of Team working in BSNL's present scenario. He further mentioned about the FTTH progress in Udaipur and smooth work of EPP/NEPP  in Udaipur SSA.

Guest of Honour, Shri H.P. Meena, Sr.GM(F) Rajasthan Circle, in his address expressed his delight ness for inviting him in CEC, Rajasthan Circle at Udaipur. He expressed his firm believe for the good health of BSNL upto 2015. He mentioned that in Rajasthan Circle, there is overall 20 Crores saving is there as compared to last year. He further mentioned that now the tariff war is over and now if the tariff will enhance 15%-20%, then the revenue of Rajasthan will enhance by approximately 300 Crores. He presented the finance figures of the SSAs of Rajasthan Circle in various segments. He appealed all for the maximum revenue  realization for the viability of BSNL.

GS AIBSNLEA, Shri Prahlad Rai , congratulated the comrades of Rajasthan Circle for the successful CEC and thanked the comrades for their great affection. In his detailed addres;s Com. GS mentioned that today the Quality of Service is a big challenge in front of BSNL and in view of this AIBSNLEA found the concept of Customer Delight Month in its CHQ Office Bearer's meeting. Com. GS further mentioned that due to un-helping  attitude of the Govt. i.e. unjustified payment of spectrum charges (3G & BWA) of Rs. 18,500, non-reimbursement of licenses fee, USO Charges, OPEX Charges, withdrawal of ADC, Payment of AGR, Huge expenditure on Telegraph services, payment of notional loan Rs. 7500 Crores to DoT has adversely affected the viability of BSNL. Non-procurement of GSM equipment, cables, telephone instruments, MLLN Modem, Broadband Modem, Drop wires etc hasalso  affected the quality & growth of services. He stressed to strengthen the quality of our mobile services to enhance the MNP towards BSNL like on the same pattern in Karnataka, AP and Orissa. He explained that how the AIBSNLEA is continuously pursuing these viability related issue with the BSNL Management and DoT. 

Com GS further explained the burning issues like ITS Repatriation process & Cabinet Note and 78.2 % IDA fitment benefit case. He mentioned that Govt. has practically failed to settle the ITS issue and now the Govt. has taken the 'U' turn. He mentioned that trade Unions are Vigilant on the ITS issue but the uncertainty on this issue is not healthy for the viability of BSNL. He explained in detail about the issues like VRS, 30% disinvestment and unbundling of last mile copper. He apprised the status of HR issues related to various DPCs from JTO to SDE, SDE to DE(Adhoc/Regular), DE to DGM, JAO to AO, AO to CAO & CAO to DGM(F), DPC in Civil/Electrical wing, Restructuring of AD(OL) case etc., meeting of Remuneration Committee, VRS, Pay anomaly- Sr. executives are drawing less salary than their juniors, stopping of LTC, CPSU cadre hierarchy, regularization of Officiating JTOs etc. Com GS explained the role of AIBSNLEA in the viability of BSNL. He mentioned the success of BSNL Unions/Associations in creation of trust for Retirement Leave encashment fund of Rs 4825 Crores in LIC by the BSNL, by which BSNL is getting 400 Crores interest per annum.   At last he appealed the all Executives' and  BSNL pensioners  to make every effort with a team spirit for making BSNL a vibrant organization. At last he congratulated AIBSNLEA Rajasthan Circle for the success of the open session. During interactive session, Com.GS replied all the queries raised by the members.

Chief Guest of the Open Session Shri A.K.Bhargava, CGMT Rajasthan Circle thanked AIBSNLEA Rajasthan Circle for inviting him in the conference. He appreciated the efforts of Com. GS for his untried efforts at the Central Headquarters. He  suggested to resolve the problems by mutual discussions. He mentioned that views from all sides are important and we should respect them for problem solving. He suggested that we should make efforts from today itself for making BSNL a vibrant organisation. He assured that the the Circle will soon cop-up with the problem of shortage of material and we should try to give our best results in available resources. He suggested that layout and plans for the upcoming technologies like NGN and IP based networks should be prepared. He impressed upon making of pleasant atmosphere for attracting the customers and make them satisfied and delighted from our services. At last he thanked to all for inviting him in the open session and congratulated for the grand success of the session.
