19.11.2018: GS writes to Smt. Sujata Ray, Director(HR), BSNL Board regarding generalization of the fixation of pay under FR-22 (1) (a) (i) to the officials, who were screening test passed & were officiating in the grade of JTO, to all Cirlces instead of limiting to some circles alone <<<<Click here for letter>>> .

19.11.2018: Meeting with CMD BSNL and  Director(HR) BSNL Board: GS, President, AGS(Fin) and CS Kerala  met CMD BSNL and DIR(HR),  while discussing the AO to CAO Promotion orders we requested to generalize the BSNL CO order dated 15.11.2018 to all Ex Officiating JTOs. In this regard AIBSNLEA submitted a letter to the DIR (HR) which was immediately marked to Sr.GM (Estt) for discussion.

CS Kerala requested for allotment of sufficient funds for Kerala Circle for its growth since it is a profit making Circle. On this issue CMD BSNL and DIR (HR) mentioned that funds are being allotted to all the Circles on pro rata basis.

19.11.2018:  Status of Court Cases:

(a)  DE to DGM (Engg.) Promotion case: DE to DGM (Engg.) Promotion case is heard today in the Hon'ble CAT Chandigarh. Hon'ble CAT is ready to amend the order already issued by the Hon'ble CAT Chandigarh and accepting for DE to DGM promotion on Adhoc basis. But the Applicant's Advocate argued that Seniority List as per Catch up rule to be prepared by BSNL and to be submitted to the Hon'ble CAT Chandigarh since no Seniority List is available for AGM Grade. BSNL Counsel argued that as per the latest Judgement of Hon'ble Supreme Court of India Catch up rule need not to be applied for promoting 800 DEs to DGM on Adhoc basis, however he assured that Eligibility List will be prepared and submitted by BSNL. Hon'ble CAT Chandigarh has given one week time for the submission of DE Eligibility List by the BSNL and the case is listed for next Hearing on 26.11.2018

(b) FR 22 (I) a (1) Pay fixation case of erstwhile Officiating JTOs: OA No.100/892/2016 filed by AIBSNLEA in respect of FR 22 I (a) (1) Pay fixation case of erstwhile Officiating JTOs is listed for hearing in the Hon'ble PB CAT New Delhi today 19.11.2018 for final argument. Due to paucity of time the case could not be heard and listed for next hearing on 21.02.2019.

The contempt case filed by AIBSNLEA for the payment of Arrears vide FR 22 (I) a ( 1) in respect of Ex Officiating JTOs is listed for hearing in the Hon'ble PB CAT New Delhi  on 30.11.2018.

19.11.2018:  Today Executives assembled in BSNL Corporate Office, New Delhi:

 

AIBSNLEA BSNL Corporate Office, New Delhi executives assembled in the office of Sr. GM(FP), Director(HR), BSNL Board,  CMD BSNL Offices to express their serious concern against not issuing AO to CAO promotions, JTO(T) to SDE(T) promotions & consideration of all the proposals of upgradation in all disciplines. Sr. GM(FP) was reluctant to meet & discuss the matter. Then GS, President along with other office bearers met Director(HR) and expressed the concern on the above issues. Director(HR) mentioned that she has already directed Sr.GM(FP) to process the case of AO to CAO promotions in the line of 2nd legal opinion issued from Sr. Advocate for promotions and advised to meet Sr.GM(FP) & CMD BSNL for further necessary action.

Thereafter when Sr. GM(FP) did not met and discussed the matter, AIBSNLEA representatives met CMD BSNL & apprised the developments wherein some officers of BSNL Corporate Office are stopping the promotions. CMD BSNL after detailed discussions assured to discuss the matter with Director(HR) for issuing AO to CAO promotions against vacant posts. CMD further informed that 3 days before he has already cleared 17 nos. CAO to DGM(Fin.) promotion orders.   We extended thanks to clearing CAO to DGM(Fin.) promotions. We requested to fill up 5000 vacant SDE(T) posts. CMD mentioned that let the contempt case in Hon'ble CAT Kerala be decided ,promotion orders from JTO(T) to SDE(T) will be issued.

We further requested to consider upgradation of the posts in the next higher grade to the eligible executives for promotions in all the disciplines. CMD BSNL assured that let the existing vacancies in CAO cadre & SDE(T) cadre be first fill up thereafter immediately upgradation proposals will be considered.

19.11.2018:    General Body meeting of Amritsar SSA on 18th November  2018 at Amritsar:

General Body meeting of Amritsar SSA was organised on 18th November  2018 at the Inspection Quarters Amritsar. The GB Meeting was attended by Shri Prahlad Rai GS and Shri Devesh Sharma Org.Secy.(North) from AIBSNLEA CHQ side .DGM Pathankot Shri C.L. Verma was the special guest in the meeting. GS and OS were welcomed by the garlanding .

Com. Amit Bhatti, District Secretary AIBSNLEA Amritsar, in his address welcomed the GS and OS in the Amritsar HP SSA. He explained his efforts for the increment of the members in AIBSNLEA Amritsar SSA. He thanked the GS AIBSNLEA for extending the full support to Punjab Circle and Amritsar SSA for resolving the problems of the members. He also apprised about the local problems and requested Circle/CHQ intervention.  He expected the same support in future also.

Com. Devesh Sharma, Organizing Secretary (North) CHQ in his address thanked the Amritsar comrades for attending the GB with huge participation, even on Sunday. He made hope that Amritsar Comrades will win in the next membership verification. He appreciated the tireless efforts of GS AIBSNLEA for his continue persuasion in DoT for 3rd PRC and BSNL’s viability related issue. He appealed to all comrades to extend their full participation for making the indefinite strike 100 percent successful on AUAB call we.f.03.12.2018.

At last he thanked to all for inviting him in the open session and congratulated for the grand success of the session.

Shri Prahlad Rai GS AIBSNLEA thanked the comrades for their big participation in GB , even on holiday. Com. GS assured that AIBSNLEA CHQ will extend its full support to Amritsar and Punjab Circle.

Com GS further explained the burning issues of the Headquarters level. He informed that BSNL employee will definitely get 3rd PRC with 15 % fitment benefits.  Com. GS explained in detail the efforts of AIBSNLEA in getting resolved the important HR issues after the formation of BSNL and in DoT setup He appraised the status of HR issues about various DPCs in various cadres.  He also appraised the house about DPCs from JTO to SDE, SDE to DE, DE to DGM, JAO to AO, AO to CAO & DPC in Civil/Electrical wing, Restructuring of AD(OL) case, Creation of PPS posts in field Units, filling up of EE(C/E) vacant posts, Regularization of offg. JTOs, CPSU cadre hirarchy etc., modification in transfer policy & Benchmark of EPP, etc. He explained the efforts of AIBSNLEA CHQ in continuously resolving the issues of BSNL Direct Recruit Executives like EPF, Superannuation benefits and Child Care Leave. Com GS further explained the role of AIBSNLEA in the viability of BSNL. 

Further Com. GS appealed to all comrades to extend their full participation for making the indefinite strike 100 percent successful on AUAB call we.f. 03.12.2018 and to not execute any work including the Government projects in the strike period.

Com GS explained the commitment of AIBSNLEA for obtaining the 3rd PRC with 15% benefits.

At last he congratulated AIBSNLEA Amritsar SSA for the success of the GB meeting on short notice.

19.11.2018:   Special General Body meeting of Pathankot SSA on 16th November 2018 at Pathankot: General Body meeting of Pathankot SSA was organised on 16th November 2018 at the Inspection Quarters Pathankot. The GB Meeting was attended by Shri Prahlad Rai GS and Shri Devesh Sharma Org.Secy.(North) from AIBSNLEA CHQ side . Shri C.L.Verma DGM Pathankot was also present in the meeting. GS and OS (N) were welcomed by the garlanding and presenting bouquets.

Com. Sandeep Sharma, District Secretary AIBSNLEA Pathankot, in his address welcomed the GS and OS in the Pathankot SSA. He thanked the GS AIBSNLEA for extending the full support to Punjab Circle and Pathankot SSA for resolving the problems of the members. He expected the same support in future also.

Com. Devesh Sharma, Organizing Secretary (North) CHQ in his address thanked the Pathankot comrades for attending the GB with big participation. He appealed to make AIBSNLEA stronger in Pathankot SSA.

Further Com. GS appealed to all comrades to extend their full participation for making the indefinite strike 100 percent successful on AUAB call we.f. 03.12.2018 and to not execute any work including the Government projects in the strike period. He stressed that without struggle we cannot expect the 3rd PRC. Com GS explained the commitment of AIBSNLEA for obtaining the full 15% PRC benefits.

19.11.2018:    2nd CEC meeting of Himachal Pradesh Circle on 16th November  2018 at Maclodganj, Dharmshala:

2nd CEC meeting of Himachal Pradesh Circle was organised on 16th November  2018 at the conference hall of Hotel Spring Valley Resort, Maclodganj, Dharmshala. The Open Session of the CEC Meeting was attended by Shri Prahlad Rai GS and Shri Devesh Sharma Org. Secy.(North) from AIBSNLEA CHQ side . Shri Balvinder Kumar, GM (Admn), O/o CGMT Himachal Pradesh was the Chief Guest & Shri Pradeep Singh GMTD Dharmshala, Shri V.K. Morya, GMTD Hamirpur, Shri D.N. Katyayan, GMTD Mandi attended the Open Session as Guest of Honour.

All the distinguished guests were welcomed by the garlanding and by presenting Himachali Caps , Shawls and flower Bouquets.

Com. Rakesh Dhiman, Circle Secretary AIBSNLEA Himachal Pradesh, in his key note address welcomed all in the 2nd CEC meeting of HP Circle at Dharmshala. He thanked to GS AIBSNLEA for his persistent efforts for issuing the 12000 Mega promotions in different cadres first time in BSNL. He conveyed his sincere thanks to Com. GS for raising the issues of all the wings. He described his achievements in his report and the increment of the members in AIBSNLEA HP circle from 60 to 200 members.  He assured that if Management provides full support then the Executives' of Himachal Pradesh Circle is committed for making BSNL, a vibrant Organization. Com CS also raised the need of resolvement of the problems associated with the GPF payments to the Employees. At last he thanked to all for attending the open session and congratulated all for the grand success of the session.

Shri Pradeep Singh GMTD Dharmshala in his address congratulated AIBSNLEA Himachal Pradesh Circle for the successful organization of the CEC meeting and welcomed all the guests in the Dharmshala. He stressed to follow the quality of service and dedication in facing the challenges. At last he thanked to all for inviting him in the open session and congratulated for the grand success of the session.

Shri V.K. Morya, GMTD Hamirpur in his address praised the efforts of the CS HP AIBSNLEA for his effort and cordial relations with the Management. He thanked to all for inviting him in the open session and congratulated for the grand success of the session.

Shri D.N.Katyayan, GMTD Mandi in his address opined that the need of 4G spectrum to BSNL is more important than the 3rd PRC to the BSNL Employees. He opined that for keeping our market sustainability, we should add more and more customers and to appoint more and more DSAs in every village. He congratulated for the grand success of the session.

Com. Devesh Sharma, Organizing Secretary (North) CHQ in his address thanked for the efforts of GS AIBSNLEA in resolving the issues of 12000 promotions BSNL Executives in one month. He congratulated the HP comrades for their great working spirit for providing the services in the hilly areas. He congratulated the Himachal Pradesh Comrades for their historic victory in the membership verification. He congratulated the CS AIBSNLEA HP Circle for his tremendous efforts for enhancing the membership three times. He appreciated the tireless efforts of GS AIBSNLEA for his continue persuasion in DoT for 3rd PRC and BSNL’s viability related issue. He appealed to all comrades to extend their full participation for making the indefinite strike 100 percent successful on AUAB call we.f.03.12.2018.

Shri Prahlad Rai GS AIBSNLEA congratulated the comrades of Himachal Pradesh Circle for the organizing successful Circle Executive committee meeting and thanked the comrades for their great affection. GS told that the HP Circle is a very important Circle for BSNL as well as for AIBSNLEA.

He also congratulated the Executives of Himachal Pradesh Circle for making AIBSNLEA as Number one Association in Circle in referendum. Com. GS mentioned that the due to the overjealous attitude of the DoT officers, Govt. has withdrawn the ADC charges and not allowed BSNL to participate in the 3G BWA spectrum bid and subsequently BSNL was imposed the 3G  BWA spectrum with highest rate.  Subsequently Govt has taken away the reserve fund of 30,000 crores from BSNL and BSNL was not able to procure the equipment required for its expansion. Com. GS condemned the indifferent attitude of DoT for not allowing BSNL for taking loan of 12000 Crores whereas Reliance has taken approximately 145000 Crores loan. Com. GS informed that due to this situation the financial position of BSNL is suffering and we are facing the problem for Medical claims, payment of electricity bills, GPF payments and payment of Tower rents. Com. GS told that this is a “DO or DIE” situation and he appealed to all comrades to extend their full participation for making the indefinite strike 100 percent successful on AUAB call we.f. 03.12.2018 and to not execute any work including the Government projects in the strike period.

Com GS explained the role of AIBSNLEA in the viability of BSNL. GS mentioned the firm Commitment of AIBSNLEA towards the Viability of BSNL .Com. GS mentioned the efforts of AIBSNLEA for the BSNL viability e.g SWAS, Customer Delight Month etc. Com. GS mentioned the history of the formation of AIBSNLEA and its role in the better policy formulation like Executive Promotion Policy, BSNL MSRR, transparent transfer policy 2nd PRC with  30 % fitment benefit etc due to which a large number of BSNL Executives have achieved the DGM level posts, 2nd PRC, 78.2 IDA merger, BSNLMS RR, GSM SIM and Handset to BSNL Executives, Concessional BB Connections to the Executives at their residences, Khan Committee Recommendations, Superannuation Benefits, AD(OL) Pay revision, issues of BSNL pensioners, Recent 12800 Mega Promotions in all Cadres in BSNL by upgrading 3105 AGM posts, 1400 AO posts etc. Com. GS told that he is also perusing for around 4500 more promotions from JTO to SDE, filling up of 621 vacant CAO posts.

He  also briefed about the HR issues and achievements of the AIBSNLEA. Chief Guest of the Open Session Shri Balvinder Kumar, GM (Admn), O/o CGMT Himachal Pradesh Circle attended the CEC on the behalf of the CGMT HP Circle Shri Arun Agarwal and read the message of CGMT. He welcomed all the guests in the HP Circle. He appealed to all for making the efforts for the revenue enhancement and assured the best co-operation from the Circle Management. He assured the timely resolvement of all the issues raised by CS HP Circle. He thanked to all for inviting him in the open session and congratulated for the grand success of the session.

19.11.2018:   Status of Court Cases:

(i) DE to DGM (Engg.) Promotion case: DE to DGM (Engg.) Promotion case is listed for hearing today 19.11.2018 in the Hon'ble CAT Chandigarh. As per the request of AIBSNLEA DGM (Legal) and AGM(Legal) of BSNL Corporate Office have been deputed to pursue with the BSNL's Advocate for the vacation of the Stay order.
(ii) FR 22 I (a) (1) Pay fixation case of erstwhile Officiating JTOs:
OA No.100/1540/2016 filed by AIBSNLEA in respect of FR 22 I (a) (1) Pay fixation case of erstwhile Officiating JTOs is listed for hearing in the Hon'ble PB CAT New Delhi today 19.11.2018 for final argument .

16.11.2018:  Status of AO to CAO Promotion: GS requested Director(HR), BSNL Board for issuing AO to CAO Promotion order. Director(HR) mentioned that GM(Pers.) has given some remarks in the AO to CAO promotion file which needs to be resolved. However, Director(HR) assured that shortly decisions will be taken and promotion orders will be issued.

It is observed that some officers in BSNL Corporate Office with an indifferent and biased attitude are working against Accounts & Finance cadres and stalling their justified promotions. AIBSNLEA will shortly decide the organizational action programmes to defend the ulterior motives of these over-jealous  officers. Let us, keep ready for agitation programme.

15.11.2018:   Status of AO to CAO Promotions: As per the assurance given by Director(HR), BSNL Board in yesterday's meeting held with  AIBSNLEA the promotion order from AO to CAO will be issued by tomorrow.

15.11.2018:   Meeting with GM (Pers)  BSNL C.O.:-

GS, President and AGS (Finance) met GM (Pers) and discussed regarding:-

(a) AO to CAO promotion: GM (Pers) informed that Second Legal Opinion from the Sr. Advocate has been received yesterday morning and the file has been sent to  Sr.GM (FP) for further necessary action.

(b) Implementation of Rule-206 on TES Group ‘B' seniority after Hon'ble Supreme Court judgment: GM(Pers.) informed that DOT has given its comments on BSNL's proposal and has advised to implement in BSNL itself ,we further pleaded that Hon'ble Supreme Court has upheld the impugned judgment of Hon'ble High Court Chandigarh and CAT Chandigarh. Accordingly, BSNL should implement the judgment in its true spirit. We further suggested that Legal Opinion from Sr.Advocate may be obtained if further clarity is required. GM (Pers.) assured to look in to the case.

c)  DE to DGM (Engg.) Promotion:  We requested to depute to depute DGM (Legal) from BSNL Corporate Office to Hon'ble CAT Chandigarh for the next hearing scheduled to be held on 19.11.2018. GM (Pers) assured that DGM (Legal) will be deputed for the next hearing to pursue with the BSNL's Advocate for the vacation of the Stay order.

d) JTO to SDE Promotion: GM (Pers) informed that he will appear in the case personally in the Hon'ble High Court Kerala at Ernakulam on 30.11.2018 and will give the assurance to the Hon'ble High Court Kerala for implementing its interim order by issuing the Promotion order

e) SDE to DE left out promotion cases:  We requested for the early issuance of Promotions orders for the left out SDEs to DEs. GM (Pers) informed that due to Contempt notice against CMD in the Hon'ble CAT Chandigarh the left out SDEs cases could not be considered for Promotion. However, after the disposal of the Contempt case further action will be taken particularly for the SC &ST left out candidates.

14.11.2018:  Successfully implemented the Rally on 14.11.2018 throughout India:

As per the call given by AUAB, rallies were successfully conducted throughout India for the implementation of Five point Charter of demands. In New Delhi more than 2000 Executives & Non Executives of BSNL Corporate Office New Delhi, NTR, NTP, Haryana, Rajasthan, and UP (W)  Circles were actively participated in the rally  from BSNL Corporate Office to Sanchar Bhawan. At the end of the rally, GS AIBSNLEA and other General Secretaries of the AUAB addressed the gathering.

After the rally the AUAB Leaders met PS to Hon'ble MOSC (I/C) Shri.Saket Kumar, IAS, and submitted memorandum addressed to Hon'ble MOSC(I/C) and discussed in detail. PS to Hon'ble MOSC (I/C) assured to appraise to Hon'ble MOSC (I/C) regarding our discussion. We are thankful to our members of BSNL Corporate Office New Delhi, NTR, NTP, Haryana, Rajasthan, and UP (W) Circles for their active participation.

14.11.2018:  Meeting with Director (HR) BSNL Board: GS, President met Director (HR) and discussed regarding

A) AO to CAO Promotion: We requested Director (HR) for the issuance of AO to CAO Promotion orders. Director (HR) informed that Second Legal Opinion from the Sr.Advocate has been received and Sr.GM (FP) has been directed to process for the issuance of AO to CAO Promotion orders. She assured an early action in this regard.

B) Settlement of AUAB Demands: Director (HR) informed that today morning at 1000 hrs Secretary(T) called her to discuss regarding the ongoing Agitation Programme of AUAB even after the meeting held on 2.11.2018. Director(HR) appraised to Secretary (T) that in the meeting held on 02.11.2018 positive assurances were given by the Secretary (T) in the presence of all the Senior Officers of DOT/BSNL to the AUAB Leaders. But on 6.11.2018 DoT issued a letter to BSNL wherein practically all the demands of AUAB have been denied in a calculated manner. After seeing the Dot letter dated 6.11.2018 Secretary(T) got annoyed and called the JS(Admin) and Director(PSU) and fired them that how such letter has been issued to BSNL without the concurrence of her good office. Secretary(T) reiterated her assurances and directed JS(A) to issue corrigendum and accordingly the DoT has sent another letter to BSNL today evening toning down the earlier letter wherein it is mentioned that DoT queries are to be immediately replied by BSNL and thereafter DoT will take immediate action on 3rd PRC recommendations, regarding Payment of Pension contribution on actual basic DoT will give a positive note to DOE and the Cabinet Note approved by Hon'ble MOSC(I/C) has been sent for Inter-Ministerial Circulation. We extended thanks to Director (HR) for her timely intervention and mentioned that AUAB will continue its Agitation Programme till the time all the demands are settled.

Sr.GM(FP), GM(SR) and GM(SR) were also present in the meeting.

14.11.2018: 

Dear comrade,
The AUAB met at New Delhi today and decided to organise indefinite strike from 03-12-2018, demanding settlement of wage revision, 4G spectrum and other issues. It is also decided to boycot the execution of all government projects like NOFN, NFS and LWE from 03-12-2018. Immediately give wide publicity to this news and organise the employees for the indefinite strike. Detailed communication follows.

13.11.2018:  Meeting with CMD BSNL: GS, President & AGS (Finance), met CMD BSNL and discussed regarding
A) Meeting with Secretary (T) regarding Implementation of 3rd PRC in BSNLand other demands of AUAB :
We expressed our concern against the queries raised by the DOT on 3rd PRC implementation in BSNL despite the assurances given by the Hon'ble MOSC(I/C) and Secretary (T) which needs to be further discussed in DOT /Ministry. We explained that in case the assurances given by the Hon'ble MOSC and Secy (T) are not implemented AUAB will go for serious agitations in terms of even Indefinite Strike. CMD assured to discuss the matter in DOT.
B) AO to CAO Promotion:
We requested CMD for the early issuance of Promotion order from AO to CAO. CMD mentioned that Second legal opinion on SC/ST roaster implementation on Promotions is being taken by the Director (HR) from a Sr. Advocate and assured that immediate action will be taken on receipt of the Second Legal opinion.
C) CAO to DGM (F) Promotion:
We requested CMD for the early issuance of promotion order from CAO to DGM (Finance) since every month executives are retiring. CMD BSNL mentioned that he has asked some queries on CAO to DGM (Fin) Promotion and assured that the Promotion orders will be issued after the receipt of the replies from the Cadre Controlling Authority.

A) Meeting with Secretary (T) regarding Implementation of 3rd PRC in BSNLand other demands of AUAB :
We discussed regarding implementation of 3rd PRC in BSNL , Director(HR) mentioned that DOT has asked many queries on 3rd PRC implementation in BSNL which reflects that DOT is not keen to settle the issue. We explained that in case the assurances given by the Hon'ble MOSC and Secy (T) are not implemented AUAB will go for harder trade union actions Programmes.
B) AO to CAO Promotion:
We requested to issue promotion order from AO to CAO and CAO to DGM(Finance). Director(HR) after some discussions immediately called Sr GM(FP), GM(Pers) &DGM(Pers) in the presence of GM(SR) and OSD and discussed regarding AO to CAO Promotion wherein she directed GM(Pers) to send a letter to Sr Advocate by itself for taking second legal opinion on SC/ST roaster implementation on Promotions. She informed that CMD has agreed to issue AO to CAO promotion also by ensuring that contempt of court case should be avoided while issuing promotion order. She also directed Sr.GM(FP) that immediate action should be taken once formal communication receive from Advocate.
C) CAO to DGM(F) Promotion:
We resented against the delay in the process of promotion from CAO to DGM(F) as every month executives are retiring. Director HR along with Sr.GM(FP) and GM (Pers )discussed the matter with CMD BSNL immediately. wherein CMD BSNL has asked some queries on CAO to DGM(Fin) Promotion which will be replied shortly by Sr GM(FP) and CAO to DGM(Fin) Promotion orders will be issued.
D) JTO to SDE (T), SDE to DE and DE to DGM (Engg.) Promotion orders:
We expressed our serious concern against the casual handling of the court cases i.e. SDE(T) to DE contempt case and DE TO DGM(Engg.) court cases in the Hon'ble CAT Chandigarh wherein the cases have been posted for hearing in the month of Januarary-2019 which is delaying the promotions in the cadre of DE and DGM.Director(HR) directed GM(Pers) to take matter seriously.
Director (HR) appreciated our concern and mentioned that a legal opinion on JTO (T) to SDE (T) promotion on the basis of Hon'ble High Court Kerla Judgement /contempt case is being taken from Sr Advocate and on that basis the promotion orders will be issued.
E) Consideration of request /tenure transfer cases of AOs/CAOs /DGM (F): We requested for the consideration of request /tenure transfer cases of AOs/CAOs/ DGM (F) . Director (HR) and Sr.GM (FP) assured to assured for consideration.
Sr.GM(FP),GM(Pers),GM (SR) ,DGM(Pers.)& OSD were also present in the meeting.

F) MT recruitment in BSNL :
We strongly protest against the SEA cell letter to GM (Rectt.) regarding MT recruitment in Accounts wing . Sr .GM(FP) told that SEA cell has sent letter in line with Pers. cell letter to Rectt. Cell regarding MT in Telecom wing . Director (HR) told that these letter are as per decision taken by Management committee of BSNL Board. Director (HR) also asserted that BSNL is reviewing/ Held up the new recruitment in view of present financial condition of BSNL. However AIBSNLEA protested against any MT recruitment above JTO/JAO level.
09.11.2018:  Implementation of AUAB agitational call: AUAB has given a call of organizing Rallies at Delhi CHQ/Circle HQ/ SSA HQ levels on 14th Nov., 2018 demanding immediate resolution of  following  issues
1. Implementation of 3rd PRC in BSNL with 15% fitment benefit
2. Payment of Pension contribution on actual basic pay
3. Pension revision of BSNL Pensioners
4. 4G spectrum allocation to BSNL etc.
5. Left out items of 2nd PRC.

AIBSNLEA requests all the Circle / District Secretaries to organize rallies effectively by maximum participation at all the levels on 14th Nov., 2018.
All the nearby Circle Secretaries to Delhi i.e. Haryana, UP()West), Rajasthan, Punjab are requested to bring their maximum members at Delhi on 14th Nov., 2018 (Morning) for making rally successful at Delhi.
09.11.2018:  Legal opinion on SC-ST roster implementation on promotion in BSNL: GS discussed with GM(Pers.), BSNL Corporate Office, New Delhi regarding 2nd legal opinion to be taken from other Senior advocate on SC/ST Roster implementation on promotion in BSNL after judgment delivered by the Hon'ble Supreme Court. GM(Pers.) informed that the draft proposal for taking 2nd Legal Opinion has been send to Director (HR), BSNL Board  through CGM(Legal). He assured that after the approval of competent authority, the letter will be send to Sr. Advocate immediately. We expressed our serious concern against the delay is being caused in taking 2nd legal opinion.

08.11.2018:  AIBSNLEA Kerala Circle submitted their views on Revival of BSNL on 02nd Nov., 2018 to IIM Ahmadabad  engaged by DOT :

AIBSNLEA Kerala was called for submitting their views on Revival of BSNL by the team IIM Ahmadabad engaged by DOT for submitting revival plan for BSNL on 02-11-2018. The IIM Team Comprise of Madam Prof: Rekha Jain, Prof:  Ajay Pandey,  Prof:Vishal Guptha and Shri.Miheer Agnihothri.

Circle Secretary, Kerala Circle  Com V. Shaji, CEC Member TVM Com.Rajan and ADS CO Branch Com. Sherafudeen were from AIBSNLEA Side. Shri. Robin Poddar GM(A/HR) and Shri. Satheesh Jt GM were there as BSNL Management representatives.

AIBSNLEA got the first opportunity to submit  their views. They submitted all the relevant points to the IIM team for the revival of BSNL in a very delightful way. Total interaction was there from all team members  on all our suggestions and all points were noted after amiable discussions.  Our presentation and discussions were lasted for one hour.

AIBSNLEA clearly emphasized that allotment of 4G spectrum and award of 3rd PRC to BSNL employees with 15% benefits will be the two pillars to fix the first stepping stone for the revival of BSNL. While submitting our view for no recommendation for VRS / CRS, committee sought clarification. As of now BSNL suffering to meet funds for disbursing salary, now how can we expect a good VRS package from BSNL employees ?, we replied. We further replied to the comment , if DOT give money for VRS package?, DOT must pump capital for constructive activities of BSNL like 3rd PRC and 4G spectrum not destructive  activities like CRS/VRS. While asking why are we against non-absorption in BSNL, we submitted that BSNL has very talented officers including absorbed ITS/IES and absorbed officers  in Finance department burning for getting timely  salary at least , the non absorbers simply enjoying facilities of BSNL  those are barred for others, along  with 7th CPC benefits. In addition, they are blocking promotion avenues of absorbed officers by occupying higher posts.  

We discontent another association's suggestion that training only motivate employees than 3rd PRC. Though training will definitely motivate employees, the need of the time is 3rd PRC and 4G   spectrum.

06.11.2018:  AGM(Estt.-IV) writes to CGMs of AP, MH, Telegana, MP, Tamil Nadu, WB Telecom Circles for information regarding implementation of the order dated 26.08.201o in OA No. 1282/2010 <<<<Click here for letter>>>> ....

Due to Contempt petition filed by AIBSNLEA in the Hon'ble PCAT New Delhi; CO BSNL called for information. In this regard GS AIBSNLEA has already written a letter to Director(HR), BSNL Board  to withdraw the instructions issued vide CO BSNL i.e. dated 22.12.2015 and fix the Pay of EX Officiating JTOs under FR 22 I a(i) with arrears.

06.11.2018:  GS AIBSNLEA along with Shri O.P. Gupta, CGMT Rajasthan Circle,  Shri R N Mathur, PGMTD Jaipur & Shri B.N. Roy, GM(S&M), O/oPGMTD, Jaipur with other officers of Jaipur SSA visited BSNL's Jaipur Franchisees / Retailers: As per the advise given by CMD BSNL, Com. GS along with CGMT, Raj. Circle, PGMTD, Jaipur, GM(S&M), O/oPGMTD, Jaipur and other officers of Jaipur SSA visited BSNL's franchisees & retailers shops to take the feedback on BSNL Brand Sale. The visit was encouraging  & found that BSNL's Mobile Plans 429/319 are most popular brands in public. Retailers appreciated the connectivity of BSNL in comparison to other operators but they demanded 4G Services at the earliest to increase the sale further.....

02.11.2018:  Meeting between the Secretary, Telecom and the AUAB:

A meeting between Ms.Aruna Sundararajan, Secretary, Telecom and the All Unions and Associations of BSNL(AUAB) was held today.

Com.P.Abhimanyu, GS/BSNLEU, Com.Chandeswar Singh, GS/NFTE, Com.K.Sebastin, GS/SNEA, Com. Prahlad Rai,GS/AIBSNLEA, Com. Ravi Shil Verma, GS/, AIGETOA, Com. Suresh Kumar,GS/BSNL MS, Com. Revti Prasad, AGS/BSNL ATM, Com. Rashid Khan, AGS/TEPU and Com.H.P.Singh, Dy.GS/BSNL OA participated in the talks on behalf of the AUAB.

From the DoT, Ms. Anuradha Mitra/Member(Finance), Shri Ravi Kant/ Member(Services), Shri.N.Sivasailam/Special Secretary and Shri R. K. Khandelwal/ Joint Secretary(Admn) Shri Pawan Gupta,Director (PSU),Shri Sanjay Agarwal,Director(Esst) of participated.

From the BSNL Management side, Shri Anupam Shrivastava/CMD BSNL, Ms. Sujata Ray/ Director(HR), Shri Saurab Tyagi/Sr.GM(Estt) , Shri. A.M.Gupta/ GM(SR) and Shri Sheo Shankar Prasad/DGM(Estt.) participated.

At the outset, the representatives of the AUAB pointed out that DoT failed to take appropriate action to implement the assurances given by the Hon'ble MoS(C) in the meeting held on 24-02-2018, in view of which the AUAB has been compelled to go on agitational programme. On the 3rd Pay Revision issue, the Secretary, Telecom assured that the Cabinet Note, for getting the approval of the Cabinet, would be sent at the earliest. The AUAB pointed out that within three months the Pay Revision issue has to be settled fully, otherwise, Parliament elections would be announced; settlement of Pay Revision would become difficult. Secretary informed that some queries are there from IFD, it will be raised by DoT to BSNL in a week and BSNL assured to reply all the queries within one week time ,As and when BSNL replies and after the discussion with CMD BSNL it will be processed. AUAB demanded the formalities of Cabinet memo to be completed before this month. Secretary, Telecom assured to act fast.

On the issues of allotment of 4G spectrum, Payment of Pension Contribution on the actual basic pay and Pension Revision issues, very useful discussion took place. On the 4G issue, the Cabinet Note has been sent for inter-ministerial consultation, and at the earliest it will be sent for the approval of the Cabinet. On the issue of Payment of Pension Contribution on actual basic pay instead of maximum of the pay scale , the matter is being recommended for the approval of the Department of Expenditure, with a positive note of the DoT, by next week. On the Pension Revision of BSNL retirees, the Secretary Telecom appeared to be convinced with the arguments of the AUAB, that it should not be linked with the Pay Revision of the serving employees. She directed the Member (Services) to immediately discuss the issue with her. On the 30% Superannuation benefits for the Directly Recruited employees, the Secretary Telecom said that it should be settled by the BSNL. Thereafter CMD assured to examine another 2%.
After the meeting with the Secretary, Telecom, the meeting of the AUAB was held. The meeting expressed it's satisfaction about the discussions on the issues of Allotment of 4G spectrum, Payment of Pension Contribution and Pension Revision. However, the meeting viewed that there is no improvement in the matter of 3rd Pay Revision. Hence, the meeting decided to go ahead with the agitational programme of Rally on 14.11.2018. The meeting called upon the employees to effectively organise the rallies on 14-11-2018. It is decided that the AUAB will again meet on 14-11-2018, to review the situation.
In addition to the above issues Com GS discussed the issue of replacement of E-1 by E-2,E2A by E-3 and upgradation of subsequent pay scales E-3byE-4,E-4 byE-5,E-5 by E-6 and E-6 by E-7 as per the proposal of BSNL sent on 6-6-2016 .He pleaded that downgrading of the pay scales from E-1A to E-1 and E-2Ato E-2 has degraded the caders Secy(T) directed SST to re look in to the matter. Com GS also apprised Secy(T) that despite the assistance given by Hon' ble MOSC a writ petition has been filed by DoT in tn the Hon'ble High court Delhi against the PBCAT ND judgement in withdrawal of the additional increments in the same pay scale under EPP.Secy(T) assoured to look into the matter.During discussions Com GS AIBSNLEA actively participated along with other General Secretaries.
Organisational decisions of the AUAB:
Prior to the meeting with the Secretary, Telecom, a meeting of the AUAB was held at NFTE's office, under the chairmanship of Com. Chandeswar Singh, GS, NFTE BSNL. After finalising the strategy to be adopted in the meeting with the Secretary, Telecom, the meeting discussed about the ways and means to strengthen the unity of the AUAB and its functioning. After detailed discussion, the following decisions are taken unanimously:-
(1) Com.Chandeswar Singh, GS, NFTE BSNL, is elected as the Chairman of the AUAB.
(2) Com.P.Abhimanyu, GS, BSNLEU, is elected as the Convenor of the AUAB.
(3) Notices for struggles will go with the signatures of all the General Secretaries of the constituents.
(4) All other letters / communications to the BSNL Management/ DoT / Government, will be signed by the Chairman and the Convenor.
(5) AUAB should immediately be formed at all circles and districts, wherever it is not formed so far. As regards the posts of Chairman and Convenor, the pattern adopted at the All India level should be adopted at the circle and district levels also.

01.11.2018:  Meeting with CMD BSNL.:-

GS, President, AGS (Finance) and AGS (DR) met CMD BSNL   and discussed regarding

(a) Holding of CPC to promote the eligible executives in the next grade: CMD BSNL further mentioned that let the contempt cases be settled thereafter the CPC's will be considered.

Regarding CAO to DGM (F) promotion:  We requested CMD BSNL  to allow promotion since the sufficient vacant DGM(F) Posts are there and eligible candidates are less. CMD assured to discuss the matter with  the Dir(HR) for early promotion.

On the issue of AO to CAO promotion;; we requested for his kind intervention to direct the concern officers for issuing early promotion orders, since the CPC has been completed two months before, CMD assured to look into the matter.

(b) Viability of BSNL: We expressed our concern against non-releasing of funds to the circles even for operation and maintenance purpose. It is reported by circles that  electric connection of Telephone Exchanges are disconnected  due to non-payment of electricity  bills, vendor payments are not being released for the last 6-7 months, Tower sites rent payments are not being paid, medical bills of BSNL employees and retirees are not paid etc. It has caused serious problems in field units. CMD BSNL appreciated our concern and mentioned that due to financial constraints  this situation has arises, However, it's a temporary phase for 2-3 months after that situation will change. Thus we have to put our all efforts during these 2-3 months' time to face the situation .He also mentioned that Govt. is now allocating  4-G Spectrum to BSNL This will help to BSNL. CMD also mentioned that it is instructed to all senior officers to visit exchanges on day of Diwali whichever place they available on Diwali. This will give positive massage to customers that BSNL is working even on Holidays and festivals.

01.11.2018:  Meeting with Sr.GM (Estt.)BSNL C.O. :

GS, President, AGS (Finance) and AGS (DR) met Sr.GM (Estt.)  and discussed regarding implementation of FR22(I)a(i) for pay fixation of officiating . JTO's per the judgments of Hon'ble  CAT Ernakulum bench upheld by Hon'ble High Court Kerala and Hon'ble Supreme Court .Also requested to withdraw the reference of BSNL CO. letter dated 22.12.2015 immediately for the true implementation of the court Judgment's GM(Estt.) assured to look into the matter.

01.11.2018:  Meeting with GM (Pers)  BSNL C.O.:-

GS, President, AGS (Finance) and AGS (DR) met GM (Pers) and discussed regarding:-

(a) AO to CAO promotion: We requested GM(Pers.) to decide the policy on SC/ST roaster implementation in BSNL as the AO to CAO promotion case is pending for want of policy. GM(Pers.) mentioned that 2nd legal opinion of another Sr. Advocate  is being taken by sending a draft proposal by explaining the Hon'ble Supreme Court judgments and available DOP&T orders. He assured to send a letter to Sr. Advocate today itself.

(b) Implementation of Rule-206 on TES Group ‘B' seniority after Hon'ble Supreme Court judgment: GM(Pers.) informed that DOT has given its comments on BSNL's proposal and has advised to implement in BSNL itself ,we further pleaded that Hon'ble Supreme Court has upheld the impugned judgment of Hon'ble High Court Chandigarh. Accordingly, BSNL should implement the judgment in its true sprit. GM (Pers.) assured to examine the case.

(c) Restructuring of AD(O/L) Cadre: We extended thanks for issuing the AD(O/L) Cadre restructuring order, but requested to clarify the date of effect of implementation .GM(Pers.) assured to look into the matter.

(d) Consideration of some request transfer of executives: We requested for the consideration of some request /tenure transfer cases of SDEs/DEs/ DGMs on genuine grounds. GM (Pers.) assured to look into the matter for early consideration.

GS, President, AGS (Finance) and AGS (DR) met Director (HR) BSNL Board and discussed regarding:
a) Implementation of 3rd PRC in BSNL:
Director (HR) mentioned that Secretary (T) has fixed up the meeting with AUAB leaders on 2nd November 2018 at 17.00 Hrs. to discuss the demands –
1. Implementation of 3rd PRC in BSNL with 15% fitment benefit and left out issue of 2nd PRC
2. Payment of Pension contribution on actual basic pay
3. Pension revision of BSNL Pensioners and
4. 4G spectrum allocation to BSNL etc.

Director (HR) further mentioned that now it depends on AUAB leaders that how they plead the issues to Secretary (T) for their settlement. She told that DoT should help BSNL for its revival in the present scenario.
(b) CPCs from AO to CAO and CAO to DGM (Finance):
We expressed our serious concern against not issuing promotion orders from AO to CAO and CAO to DGM (Finance). Director (HR) mentioned that Pers. Cell has further asked the second legal opinion from other senior Advocate by submitting the detail draft on the basis of DoP&T orders and Hon'ble Supreme Court judgements to the Sr. Advocate to give his legal opinion on SC/ST roster implementation. Sr. Advocate has assured that within 2-3 days he will give the legal opinion. Similarly in todays NCSC/ST meeting Hon'ble Vice Chairmen informed that he has personally spoken with Secretary DoP & T for issuing orders w.r.t. recent Hon'ble Supreme Court. Judgement and he has assured for early issuance of the orders from DoP&T. However, Director (HR) further mentioned that let, the legal opinion be received on that basis action will be taken for issuing promotion orders.

We requested Director (HR) to discuss the matter with CMD BSNL to fill-up the DGM (Finance) vacant posts. Director (HR) assured that she will discuss the matter with CMD BSNL for issuing DGM (Fin) promotion orders.
(c) Promotion from JTO to SDE (T), SDE (T) to DE and DE to DGM (T): We requested Director (HR) for the consideration of promotion orders from JTO to SDE (T) to fill –up about 5000 vacant SDE (T) posts, promote all the eligible SDEs (T) of the seniority lists no. 8 and 9 to the rank of DE by upgradation of posts and DE to DGM (T) promotions to fill –up about 900 DGM vacant posts. Director (HR) mentioned that management is willing to promote the executives but due to contempt cases and stay on DE to DGM promotion, the necessary action for promoting executives is held- up CMD BSNL has also directed that let, the contempt cases be settled thereafter only the promotions can be considered.
(d) Consideration of request /tenure transfer cases of AOs/CAOs /DGM (F): We requested for the consideration of request /tenure transfer cases of AOs/CAOs/ DGM (F) . Director (HR) assured to discuss the matter Sr.GM (FP) for early consideration.

29.10.2018:  Group Term Insurance Committee Meeting: AIBSNLEA was invited for the Group Term Insurance Committee Meeting held at Corporate Office, BSNL, New Delhi at 1500 hrs today. President AGS (Fin) and AGS (DR) attended the meeting. GTI Committee meeting was conducted under the Chairmanship of Sr. GM (Estt). Committee members GM (Trg) & GM(CA) participated in the meeting. The Committee meeting held today to finalize the proposal & various modalities of GTI scheme for BSNL Executives.
1) It is proposed to implement GTI Scheme from 01.01.2019.
2) Committee discussed the modalities of the subscription deduction and claim settlement procedure.
3) Annual premium will be deducted from January month salary of every year
4) Annual Premium will be Rs.9440/- (Rs.8000 + GST) for the Insured amount of Rs.50 Lakh for the Executives below Age group 50 years.
5) The option form will be created by ERP team in the ESS portal.
6) A nodal cell will be formed at BSNLCO for coordination and approval of procedure to ERP about the module development.
7) The salient features and terms & conditions of the scheme will be uploaded in the Intranet.
8) The name of the nominee should be with reference to the Service Book entry.
9) Options should be submitted by Executives through ESS Portal.
10) Minimum subscription to GTI scheme will be for 3 years, i.e., till the next review of the premium.

29.10.2018:  All Circle/Branch Secretaries of AIBSNLEA are requested to ensure successful implementation of  AUAB agitation Progromme as per the detailed mentioned below:-

(i) Press release/Press Conference at CHQ/Circle/SSA levels on 29.10.2018 high lighting the demands.

ii) One full day Dharna at BSNL CO/Circle/SSA levels on 30.10.2018.

iii) Rallies at Circle and SSA levels and submission of Memorandum to the respective CGMs/GMs on 14.11.2018.

iv) To intensify the Agitational Programme in terms of Indefinite Strike will be decided after 30.11.2018 in case the AUAB demands are not settled.

v) AUAB decided to issue protest letters to CMD regarding

a) Outsourcing of Passive Infra Maintenance of Non BSNL Sites amounting Rs.1800 Crores per Annum and

b) Repatriation of excess ITS Officers against the Sanctioned Strength to DOT as per the Hon'ble High Court Delhi Judgement of in diminishing order.

 

The demands are as under

1) 3rd PRC implementation with 15% fitment

2) Pension Revision

3) Pension Contribution on Actual Basic Pay instead of Maximum Pay.

4) Immediate Allocation of 4G Spectrum to BSNL.

28.10.2018:  Proposed AUAB Meeting with Secy(T), DoT: Today morning at 10.30 AM Secy(T), DoT hold a meeting with CMD BSNL, Director(HR) & GM(SR) wherein Secy(T) wanted to discuss the demands of AUAB with General Secretaries of AUAB but all the GSs were not available at Delhi  thus the next meeting is fixed upon 2nd Nov., 2018 at 17.00Hrs in DoT with Secy(T), DoT.

In today's meeting Secy(T) mentioned that DoT is seriously implementing all the assurances given by Hon'ble MOSC (l/C) to AYUB Leaders in the meeting held on 24th Feb., 2018. Secy(T) DoT further informed that before 2nd Nov., 2018 Cabinet Note on 3rd PRC implementation in BSNL and 4G Spectrum allocation to BSNL will be ready for further necessary action.

DoT recommendations on payment of pension contributions on actual basic pay of BSNL employees will be send to DOE for clearance shortly. Pension revision of BSNL pensioners is also under active consideration. Secy(T) DoT  advised CMD BSNL &  Director(HR), BSNL Board to inform this status to all the leaders of AUAB. 26.10.2018:  AIBSNLEA efforts in achieving 30% Superannuation benefit for the BSNL recruited  employees :- AIBSNLEA along with other unions and associations strongly demanded 30% superannuation benefit to BSNL recruited executives as per the recommendations of 2nd PRC. BSNL was giving  18% superannuation benefit  in terms of gratuity, EPF and Medical benefit etc., to BSNL recruited employees. The pension through EPF is a meager amount to DR employees  in comparison to BSNL absorbed employees Pensionary benefit  as per the CCS(CCA)Rules.1972.The EPF contribution of DR employees was also settled by the  vigorous  pursuance of AIBSNLEA  in the year 2004-2005 and persuaded to Provident fund authorities for making it transparent and online assessed. To achieve 30% superannuation benefit AIBSNLEA continued  its efforts initially in BSNL C.O. Establishment cell where the GM(Estt.) was accepting only 1% contribution which  was not agreed by us and on our demand  a committee headed by Smt Geeta Rao the then ED(Finance )was constituted to whom AIBSNLEA pleaded for 12% remaining superannuation  benefit and the committee recommended 3% contribution. In the month of May-June 2016 AIBSNLEA and AIGETOA under the banner of United Forum of BSNL Executives Associations launched the agitation programme and got achieved 3% contribution from BSNL in superannuation benefit. However, AIBSNLEA continued its efforts to increase it upto 12% and management further considered to increase 2% and total now 5%.AIBSNLEA efforts will continue to achieve 12% contribution to achieve 30% superannuation benefit to BSNL recruited employees.  .

E2 and E3 standard Pay scales  to JTO and SDE equivalent executives :   

After the 2nd PRC recommendations notified in March -2009,AIBSNLEA demanded standard Pay Scales E2 and E3 to JTO and SDE equivalent executives. And got rectified the Pay anomaly from the Sh. K.C.G.K. Pillai, the then PGM(FP) committee report by giving 5-advance increments in the  revised Pay Scale after 2nd PRC implementation which removed the pay anomaly of JTO/JAO. Initially issue of granting intermediary pay scales E1-A and E2-A to JTO and SDE equivalent executives was sent to DOT/DPE by BSNL but DPE denied to grant intermediately pay scales, these intermediary  pay scale effort was made by BSNL but all the time DPE disagreed BSNL proposal. In view of the DPE denial of intermediately Pay scales AIBSNLEA and AIGETOA demanded the standard pay scales E-2 and E-3 to JTO and SDE equivalent executives and subsequent upgradation of E-3 to E-4,E-4 to E-5, E-5 to E-6 and E-6 by E-7. Accordingly on 06.06.2016 BSNL management sent proposal to DOT recommending replacement of E1-A by E-2, E-2A by E-3 and upgradation of subsequent pay scales of E-3 by E-4,E-4 by E-5 , E-5 by E-6 and E-6 by E-7.This proposal was in  active consideration of  DOT. But after the membership verification of Executive Association in Dec.2016 Majority Association  mounted the pressure on BSNL management to limit the proposal up to the replacement of E1-A by E-2 and E-2A by E-3 only. BSNL Management further send a revised proposal to  DOT limiting replacement of Pay scales E1-A by E-2 and E-2A by E-3 and the subsequent upgradation of  E-3 by E-4,E-4 by E-5 , E-5 by E-6 and E-6 by E-7 may be considered at the time of implementation of 3rd PRC. This kind of modification was not appreciated by DOT and they categorically mentioned that in case E1A and E2A are replaced by E2 and E3 Pay scales leaving aside the upgradation of subsequent pay scales will invite litigation and  not logical. In view of this DOT Administration decided to downgrade the E1A by E1 and E2A by E2 standard scales and issued the Presidential orders. In a systematic manner the issue was killed by the so called Majority Association. However, AIBSNLEA will continue its efforts to get replaced E1A by E2 and E2A by E3 and subsequent upgradation of E-3 by E-4,E-4 by E-5 , E-5 by E-6 and E-6 by E-7 .

Vivek Banzal, Director (CFA), BSNL Board and greeted him on assuming the high office of  Director (CFA), BSNL Board. Sh. Vivek Banzal was working as PGM Gujarat Circle and he is an absorbed ITS Officer in BSNL of the recruitment year of 1987 betch. Sh. Banzal is having 8 years of service left. 24.10.2:018  AIRBSNLEWA Delhi Circle Meeting:

GS, President attended and address the annual GB meeting of AIRBSNLEWA in the recreation club conference hall Kidwai Bhawan ND at 14.00 Hrs. Com R. D. Arora, CS Delhi Circle welcomed the guests and Com Kishan Singh ji GS apprised the status of pension revision of BSNL pensioners, payment of Pension from CPMS system and non- reimbursement of medical claims etc.

Com GS and President AIBSNLEA also discussed in detail the financial viability of BSNL, 3rd PRC implementation in BSNL, Pension revision, payment of pension contribution on actual basic pay instead of maximum of the pay scale, payment of pension through CPMS being developed by DoT, medical bills reimbursement and CGHS facility etc. They extended thanks to Com GS and CS for inviting them in the meeting. They also assured all the cooperation and support of AIBSNLEA to AIRBSNLEWA in settling the issues. They appealed all the pensioners to join and support AUAB (BSNL) agitation programmes Com Nandi, Vice President extended Vote of thanks. The house was jam packed.

24.10.2018:  Meeting with GM (Pers)

GS & President met GM (Pers) and discussed regarding

A) JTO to SDE (T) Promotion: We requested GM (Pers) for the immediate issuance of Promotion order from JTO to SDE for the 5000 vacant posts in the cadre of SDE (T). GM (Pers) informed that the exemption application of CMD BSNL personal appearance in the JTO to SDE Promotion Contempt case in the Hon'ble CAT Ernakulam has been filed and the case is listed for hearing on 29.10.2018 after the clearance from the Court for CPC from JTO to SDE (T) will be expedited.

BSNL has also filed review Petition against the Hon'ble High Court Kerala  Judgement.

B) AO to CAO Promotion:   We resented against the delay in the process of promotion from AO to CAO on the pretext of legal opinion. The stay order was vacated by the Hon'ble CAT Chandigarh one and half month before but the promotion orders are not being issued. GM(Pers) informed that a meeting is being hold by Director (HR) today to discuss the matter and some break through will be made in this direction  to  issue AO to CAO Promotion orders immediately.

C) CAO to DGM (F) Promotion: We requested  GM (Pers) to get approved  CAO to DGM(F) CPC minutes from CMD BSNL which is kept pending for more than one month. We explained the GM (Pers) that no Contempt case or Stay is pending in any Court for the CAO to DGM(F) Promotion and the CAO to DGM(F) CPC was conducted after the approval MC of the BSNL Board. After detailed discussion GM (Pers) assured to discuss the issue with the CMD for getting early clearance.

D) Consideration of some request/ tenure transfer of SDEs/DEs /DGMs: We requested for the consideration of some request /tenure transfer cases of SDEs/DEs/ DGMs on genuine grounds. GM (Pers.) assured to look into the matter for early consideration.

24.10.2018:   AIBSNLEA efforts in getting released about 13000 executives promotion orders through CPCs before implementation of proposed CPSU Cadre hierarchy :

After the Membership verification AIBSNLEA was granted the 2nd Majority Association status and later support Association. Even after winning in the 17 Circles and losing in 14 Circles, AIBSNLEA was granted support Association status on the basis of total votes secured. Against this AIBSNLEA filed a case in the Hon'ble High Court Allahabad which is still pending for decision. After the referendum the so called Majority Association impressed upon the Management that they should only be discussed all the issues no other Association should be heard or allow to function. This created great disunity among the executives and Management very successfully divided the executives to their convenience. So called majority Association instead of killing of other Associations should have taken efforts with all Associations to bring them together on the common issues for the betterment of executive cadres but they avoided this.

Present Status of promotions through CPCs & CPSU CH:  In view of the Court cases on TES Group “B' seniority the promotions were held up. To overcome with this situation AIBSNLEA proposed to implement CPSU cadre hierarchy  in the year 2012 and to achieve this AIBSNLEA, SNEA and AIGETOA launched agitation programs in February 2013 under the banner of United Forum of BSNL Executive Associations and thereafter a Committee headed by the then  PGM (FP) Shri S.R. Kapoor was constituted to discuss the matter. AIBSNLEA, SNEA and AIGETOA were the members of the committee. But due to serious difference of opinion between the staff side and management side members of the committee could not submit the report.

Again second time the then PGM (SR) Shri N.K. Narang was made the Chairman of the committee but this Committee also failed to submit the report. In the year -2015 after the Joining of New CMD Shri Anupam Shrivastava the matter was further raised and he was kind enough to further reconstitute the Committee headed by the Shri. M.A .Khan the then ED (NB), GM (Estt.) and GM (EF) were official side members and AIBSNLEA, SNEA and AIGETOA were the staff side members. After marathon meetings Mr. Khan Committee submitted its recommendations. AIBSNLEA constantly persuaded for the implementation of Khan Committee recommendations but meanwhile BSNL Management started the MV process of Executive Association which derail the process. Pers. Cell BSNL C.O. was not at all interested to implement Khan Committee report on CPSU Cadre hierarchy and ignored the views of  other Executive Associations and in collusion with so called majority Association diluted the Khan Committee report and tried to limit functional  promotions up to Sr. SDE level only etc. Against this dilution AIBSNLEA strongly protested   with CMD BSNL, Director (HR) and they appreciated the concern of AIBSNLEA and directed PGM (Pers.) to discuss the matter with AIBSNLEA wherein AIBSNLEA demanded Khan committee implementation in the true sense i.e.

  • Functional promotions up to AGM level, 

  • E-5 Grade AGMs to be designated Jt. DGM 

  • Selection on the basis of  numerical benchmarks,

  • Reduction of residency period from SDE/ AO to DE/CAO from 12 years to 5  years,

  • Date of effect from the last DPC conducted and ;

  • SC/ST roaster implementation as per DoP & T guidelines 

  • No functional Post of Sr SDE/Sr AO

  • No MT recruitment beyond JTO /JAO cadre etc.

PGM (Pers.) after detailed discussions incorporated  some suggestions of AIBSNLEA  i.e. functional promotion up to AGM level, Jt. DGM designation E-5 grade AGMs and bench marks on numerical basis etc. This got approved by the MC and thereafter BSNL Board.

AIBSNLEA persuaded up to level of JS (Admin), DoT cum Govt. Nominee Director in BSNL Board for improvement in Draft CPSU instead of the implementation of half cooked policy with severe Bottlenecks . which yielded result as Board while giving approval to CPSU cadre hierarchy directed to complete the ongoing CPCs before implementation of CPSU CH.

BSNL Board approved the CPSU Cadre hierarchy with date effect from its date of notification i.e. prospective date. It created path hole in CPSU Cadre hierarchy concept and most of the existing executives are not benefited with this policy. However, knowing this fact AIBSNLEA convince the BSNL Management to held CPCs to promote all the eligible executives to the next grade on functional basis before implementation of the CPSU Cadre hierarchy. BSNL Management appreciated AIBSNLEA concern and conducted CPCs in all the cadres and promoted about 13000 executives to the next higher grade on functional basis. This could not be tolerated by the so called majority Association and they protested against holding of CPCs and demanded to implement CPSU cadre hierarchy only. But they failed and to create a road block and they demanded parity among all the cadres which was not immediately possible as in all the Cadre there was difference from DoT legacy.  To stall the process of CPCs filed contempt cases against CMD and Director (HR) for issuing promotions. It frustrated the Management and finally all the promotions through CPCs are stalled. AIBSNLEA is still trying that as soon as the contempt cases are settled promotions should be made available through CPCs immediately to benefit the executives' monitory and status. Now so called majority Association is claiming that due to their pressure on CPSU Cadre hierarchy, CPCs has taken place which is beyond truth.

23.10.2018:   Meeting with DDG (Estt)   DOT:

GS & President met DDG (Estt), DOT and discussed regarding

A) Pension Revision: We requested the DDG (Estt), DOT for the Pension Revision of BSNL Pensioners by delinking the Pay Revision as the Pension of BSNL Pensioners is also being paid under CCS (CCA) Pension Rules 1972 as Govt. Pension. DDG (Estt) mentioned that the BSNL Pensioners Pension is being paid as per the CCS (CCA) Pension Rules 1972 but there is no mention about the Pension Revision. Govt. Pensioners Pension is being revised along with the Pay Revision as the practice. Similarly the BSNL Pensioners Pension Revision was also made along with the Pay Revision of BSNL Employees on implementation of 2nd PRC. At present 3rd PRC implementation in BSNL is under consideration in DOT and after the Pay Revision only the Pension can be revised. This stand has been taken by the Establishment Cell of DOT.

B) Payment of Pension contribution on Actual basic pay instead of Maximum of the Pay:  DDG (Estt) informed that n the meeting held on 17.10.2018, Hon'ble MOSC(IC) has directed the Member (Finance) to look in to the matter. Thus some early decision is expected in this regard.

C) CGHS Medical Facilities to BSNL Pensioners: We appraised the DDG (Estt) that in some Circles where the BSNL Pensioners have applied to switch over to CGHS Medical facility from BSNL MRS are not being allowed by the respective Circle Medical Authorities on the pretext that the Head of Account has not been mentioned in the PPO. The same has been clarified by the respective Circle CCAs and the Head of Accounts is also given but the Medical Authorities wants a copy of the letter of DOT Budget Cell. We requested DDG (Estt) to settle the issue. DDG (Estt) advised us to give a letter in this regard for necessary action. We will submit the Letter shortly. 

23.10.2018:  Meeting with DDG (PM) DOT:

GS & President met DDG (PM), DOT and discussed regarding

A) Implementation of 3rd PRC in BSNL:  DDG (PM) DOT who is dealing with the Revival Plan of BSNL mentioned that this issue can be sorted out at the level of Hon'ble MOSC(IC) only. Administrative Channels will restrict as per the 3rd PRC recommendations only. He also confirmed that there was a meeting with Hon'ble MOSC(IC) on 17.10.2018 on BSNL Revival wherein also the matter was discussed.

B) 4G Spectrum allocation to BSNL: DDG (PM), DOT mentioned that the Cabinet Note for the allocation of 4G Spectrum to BSNL has been sent to DOE for comments. After the clearance from DOE further action will be taken.

GS & President met Director (PSU), DOT and discussed regarding

A) Implementation of 3rd PRC in BSNL:  Director (PSU) confirmed that the BSNL proposal for 3rd PRC with 15% fitment benefit is being returned to BSNL for re-examination on the basis of the queries made by the Internal Finance of DOT. He further mentioned that this proposal will be sent back to BSNL within this week only.

B) 4G Spectrum allocation to BSNL:  Director (PSU) informed that the Cabinet Note for the allocation of 4G Spectrum to BSNL has been sent to the higher ups for consideration.

22.10.2018:  Meeting with PGM (Admn.) BSNL CO:  

GS, President and GS, FS AIRBSNLEWA met PGM (Admn.) BSNL C.O. ND and discussed to issue correct eligibility criterion order of BSNL Pensioners for medical claim by considering April -2018 IDA instead of April -2016. After April -2016 the necessary order for eligibility of medical claim for BSNL Pensioners has not been issued by BSNL CO. PGM (Admn) after some discussions assured to look into the matter.

(b) Allotment of funds to settle the medical claims of BSNL serving employees and Pensioners:  We expressed our concern against the non- reimbursement   of medical claims of BSNL serving employees and BSNL Pensioners. PGM (Admn) mentioned that due to the financial constraints the funds have not been released. However, the matter will be resolved in the next month.   

22.10.2018: Meeting with CMD BSNL: GS, President, met CMD BSNL and discussed regarding:
(a) Promotion from AO to CAO:
 We expressed our serious concern against non- issuance of the promotion order from AO to CAO even after the stay order vacated from Hon'ble CAT Chandigarh one and half month before. The AOs promoted in the year 2003 and 2005 are still waiting for CAO promotion. We explained him about the stalemate created in Pers / SEA Cell of BSNL Corporate Office on SC & ST roster implementation after the Judgement delivered by the Hon'ble Supreme Court and on the pretext of Senior Advocate opinion. CMD after detailed discussion assured to discuss the matter with Director (HR) for an early solution.

(b) CPCs in all the streams of BSNL: We requested CMD BSNL to allow holding of CPCs in all the disciplines of BSNL to the eligible executives for their promotion in the next higher grade. CMD BSNL after discussing the status of the various court cases pending, assured that after the settlement of these pending court cases the process of CPCs will be considered.
(c) Implementation of 3rd PRC in BSNL, Pension Revision, Payment of Pension Contribution on actual basic and Allotment of  4G Spectrum etc.,: We apprised CMD regarding meeting with Hon'ble MOSC(I/C)  and meetings in DOT. We requested CMD BSNL to use his good office in DoT/MOSC office for getting implementation of 3rd PRC in BSNL and settlement of other issues. CMD, BSNL mentioned that he will discuss the matter with Hon'ble MOSC(I/C) and will try to arrange a meeting on 29.10.2018.

d) Financial Viability of BSNL: We appraised him about our Seminar on "BSNL at Your Door Step" arranged by AIBSNLEA Tamilnadu Circle at Madurai which was inaugurated by the CGM TN Circle and PGM Madurai on 13.10.2018. More than 200 Executives attended the Seminar. We also expressed our serious concern against Revenue dip in Kerala circle also in this Financial Year. CMD appreciated the efforts taken by the AIBSNLEA and mentioned that Kerala Circle should continue to provide 4G Service to our Customers with the available resources. He further empathized that we should market our available Services in a aggressive manner because the BSNL Services are still better than any other Service Provider.

22.10.2018: Meeting with Director (HR) BSNL Board: GS, President and AGS (Finance) met Director (HR), BSNL Board and discussed regarding

A) AO to CAO Promotion:   We resented against the delay in the process of promotion from AO to CAO by SEA Cell BSNL C.O. on the pretext of legal opinion. The stay order was vacated by the Hon'ble CAT Chandigarh one and half month before but the promotion orders are not being issued. Director (HR)  mentioned that after our last meeting she has already directed Sr.GM(FP) to discuss the matter for an early resolution but last week Sr.GM(FP) was on leave and in this week itself some decision will be taken to issue AO to CAO Promotion.

B) Consideration of request/ tenure transfers of AOs /CAOs/ DGM (F)s: We requested DIR (HR) for the consideration of request/ tenure transfers of AOs /CAOs/DGM(F)s. Also expressed our serious concern against the transfer orders issued by SEA Cell on "Pick & Choose" method. DIR (HR)  informed that GM(SR) was asked to take the para wise comments on our letter dated 9.10.2018 from Sr.GM(FP) and the same has been now received which will be examined and judicious decision will be taken shortly. 

C) Delay in reimbursement of medical claims: We expressed our serious concern against the delay in reimbursement of the medical claims of BSNL serving employees for the last 2-3 months and BSNL pensioners for last six months respectively.. We requested to timely release funds against medical claims.  Dir (HR)  mentioned that Management is seriously taking efforts to obtain Loan from Banks for meeting the latest financial crunch and assured that all the pending medical claims will be settled in the next month  November 2018.

D)  Implementation of 3rd PRC in BSNL, Pension Revision, Payment of Pension Contribution on actual basic and Allotment of  4G Spectrum etc.,: We requested DIR(HR) to use her good office in DOT for the settlement of 3rd PRC in BSNL, Pension Revision, Payment of Pension Contribution on actual basic and Allotment of  4G Spectrum etc.Dir (HR) informed that in last week i.e., on 17.10.2018 she attended a meeting with Hon'ble MOSC(IC) in the presence of Secretary (Telecom ), Member (Finance), SST and other Senior Officers of DOT  with reference to revival of BSNL wherein she pleaded that BSNL should be allowed to take Loan from Banks with the Letter of Comfort to meet the OPEX. During discussion DOT Officers informed that the 3rd PRC proposal approved by the BSNL Board will be returning back to BSNLfor their own consideration. But without the settlement of excess payment towards the Pension contribution and allowing BSNL to take Loans from Banks how this issue can be settled by the BSNL. Thus she advised to further take up the matter with the Hon'ble MOSC(IC) only to settle these issues at DOT level itself because these are under the purview of DOT only.

GM (SR) & OSD were also present in the meeting.

19.10.2018: The biennial GB and Open Session of TVM branch of Kerala  have been completed enthusiastically at Hotel Chirag Inn , Trivandrum with the auspicious presents of AIBSNLEA stalwart Leader Com. Prahlad Rai and CHQ President Com.Sivakumar along with the guest of honor Shri.S.S.  Thampi ITS , PGMT Trivandrum BA.

 

Open Session started by lighting the traditional lamp was welcomed by Com.Rajan DS TVM . He elaborated the associational activities has been carried out for the benefits of branch members and Thanked PGMT for the relentless support extended to AIBSNLEA for all the genuine grievances submitted on his table. Also he extended profound gratitude and thanks to circle body for the total support in all activities of TVM branch. In the presidential address Com.Ajayakumar DP endorsed the support of both Circle body and PGMT TVM  and CE Civil , Kerala Circle.

 

CS Com. Shaji  narrated the wholehearted support extended by GS and CHQ President to circle body in each and every matters of Circle body taken up with CHQ including the latest matter of FR -22 (1) a(1)( anomaly . He viewed that all BSNL employees are pushed to stress by authorities in many ways lastly by discontinuing the basic medical benefits. He narrated  the healthy relations AIBSNLEA having with circle management for solving the grievances of our beloved members and expressed special thanks to PGMT TVM for the very favorable epithetical consideration for employees grievances while holding the post of CGMT Kerala.

 

CHQ President in his half an hour long speech explained all the activities being taken out by CHQ by our beloved and dynamic leader Com. Prahlad rai along with him including 3rd PRC implementation,  stoppage of the formation of Tower company through court , 30% superannuation benefits to BSNL DRs , Contemptuous order on FR-22(1)a(1)  , anomalies of 2nd PRC and all . He informed that CHQ is hopeful in releasing the very pending AO-CAO promotions within a couple of week time .

 

GS in his hour long speech opened the treasure of knowledge of the events in BSNL and the fighting of AIBSNLEA to accomplish benefits for BSNL executives. He beautifully portrayed the reasons for the present bleeding stage of BSNL and the role of AIBSNLEA has been doing marvelously for protecting the viability of BSNL . He  explained the time line of activates he has done so far for the much awaited 3rd PRC ending with the very fruitful meeting with Hon'ble Minister of Communication (I/C) Shri. Manoj Sinha ji . He assured to continue his fight till the materialization of 3rd PRC . Entire house reciprocated his efforts with applause full of energy. He touched all the pending HR/Service matters . Regarding  pending CPCs he opined that AIBSNLEA could release more than 12000 long pending promotions and we are on the move to complete all CPCs before the implementation of CPSU Cadre Hierarchy. He is very hopeful for the implementation of FR22(1)a(1) as directed by Hon'ble SCI . He is hopeful of releasing the long pending AO-CAO Promotions within a fortnight. AIBSNLEA is perusing for the release of DE to DGM , JTO to SDE and all other pending CPCs. He whole heartedly thanked all employees of Kerala Circle and Circle Management on holding up the top position revenue making circle in BSNL .

 

PGMT Thiruvananthapuram thanked all speakers for their good words. He recommended every employee to take all out efforts to improve revenue by marketing FTTH and other services. He reminded the importance of earning more revenue for the stability of BSNL and thereby enjoying more benefits to employees.  PGMT stressed the need for enhancing our working style to uphold the latest slogan “ BSNL AT YOUR DOOR STEPS” though a good number of employees in TVM BA are striving hard already for customer satisfaction. He assured to extend rather continue all his possible help for employees  through Associations/Unions .

15.10.2018: Brief Report on General Secretary and President CHQ visit to Madurai during the extended Circle Executive Committee meeting of AIBSNLEA TamilNadu Circle on 13.10.2018: Extended Circle Executive Meeting of TN circle was held at Hotel North Gate, Temple City Madurai on 13.10.2018.  The meeting has started with Association Flag hoisting by Com. P. Tamilselvam Circle President alongwith CHQ President Com. S. Sivakumar sharply by 10.00 AM.  Com. P. Tamilselvam Circle President has presided over the CEC.  Com A. Arunachalam District Secretary, Madurai has extended the welcome address.  Homage to the departed souls during the period was announced by Com V. Sundararajan ACS.  Two minutes silence was observed by the body.   Com. S. Kamaraj ACS in his inaugural speech has brief the achievements of Circle body and CHQ body. He also welcomed Com Chandrasekaran EX-ACS & Com. Alagar Swami, SDE of SNEA and all other front line erstwhile leaders of SNEA who were joined in AIBSNLEA.  The tall personalities in the trade union/association movements of sister association who enrolled as members of AIBSNLEA were greeted with shawl.  Com. C. Duraiarasan Circle Secretary has submitted the Report to the CEC and accepted by the body.   CS has elaborately covered the current situation in BSNL in respect of revenue decrease, outsourcing of O&M and S&M activities of towers, 3rd PRC, HR issues including all pending DPCs and organizational activities during the period in between the CECs. All the District Secretaries have submitted their district report and status of increase in the membership of AIBSNLEA in their district.  Undoubtedly, each and every district secretary has suggested the ways for the improvement of BSNL, its revenue and profit.  The points were consolidated and elaborated by the CS in the open session.  Com. Govindarajan and Com C. Arumugam CWC members attended the CEC.

Com J. Badrinarayanan, CS AIBSNLEA Chennai Telephones has graced the CEC by his presence and addressed the gathering.  He has briefed about the cash crunch and how it affects the efficiency of the service and employees.  Com. P. Udayasurian Organizing Secretary (South) who is always a great support to Tamil Nadu circle has addressed the extended CEC.  He has covered all the important issues in BSNL and the great services of General Secretary for the last 12 to 13 years and the roll the GS has played in getting our 2nd PRC, 78.2 fitment, time bound promotion, and the seed the GS first sow for the CPSU cadre hierarchy etc.  He has also appreciated the services of ex-all India President Com. P.  Venugopal and the President CHQ Com S. Sivakumar.  

Com. S. Sivakumar has addressed the lunch hour session about the pending issues at CHQ and the pursuance being made by the GS and the CHQ.  He has brief about all the court cases in respect of tower company, FR 22 (1)(a) (i) fitment, CPC related cases and the current position and the plan to overcome the bottle necks created by sister association etc..

OPEN SESSION:  The need of the hour is coined as the topic for the Open session i.e. “ BSNL AT YOUR DOOR STEPS”.   Com. C. Arumugam CWC member has presided over the Open session.  Com. S. Karuppaiah Ex-District secretary Madurai branch has welcomed the gathering and briefed about the selection of the topic and its important in the current scenario.  Com. C. Duraiarasan in his inaugural speech covered and briefed all the important points discussed in the morning session by various district secretaries about the new business opportunities like internet of things(IOT) linked with our Broadband services, FTTH business improvement and  requirement of some store items to implement development activities.  CS has very much appreciated the  efforts of Sri V. Raju CGM and his style of participative management.  AIBSNLEA has adopted Madurai SSA in addition to Thanjavur SSA for its physical and revenue growth.  Madurai SSA has been readily accepted as it is headed by a very efficient PGM Madam Smt. S.E. Rajam in addition to the dedicated team of officers and employees.  CS also emphasized that the adoption is as a lead association and other sister unions and association contribution is equally there.   Com R. Guruprasad Advisor CHQ in his address briefed about the image building, individual contribution of employees.  He has also suggested for expanding the 3 G services foot print from the present level of 12% to more than 50% to earn more revenue.   For intra comparison and inter comparison of data speed with our own BTS to BTS and other service providers in a same BTS area, google and facebook is offering paid analytical datas ( isp.google.com, partners.facebook.com etc.) which are used by other private service providers.  In respect of fund crunch for our expansion, BSNL may seek a portion of  unutilized, idle USO fund of around Rs.50,000 crores as loan with interest.  Com. P. Venugopal ex CHQ president has addressed the open session about the golden era when we earned profit and had a reserve of Rs.40000 crores and how the Government has taken all the money from BSNL for giving 3 G licenses, BWA spectrum  etc.   He also briefed the Government expectations on  the hand and leg tied BSNL competing with the other service providers.  Com. Chandrasekar the newly inducted CWC member has assured that all the BSNL employees with put their maximum efforts to turn around.     Smt. S.E. Rajam in her vibrant addressed made the gathering “we the best”.   Madam has narrated the examples of educational institutions how they have gone from our services and come back in BSNL.  Service with Quality is the only Mantra which will keep us proud.  If these two things are there, we can go to any door step and offer our products.  She also emphasized that we have a lot to sell.  The unexplored areas may be taped and revenue may be increased.  PGM Madurai has appreciated our District President Com.S. Karruppasamy  for his contribution in MM module and his guidance to others including L2 and L3.  Madam has also recognized and mentioned in her speech about the contribution of employees at Trichy, Virudhunagar and Karikudi SSAs.  

Com S. Sivakumar  CHQ  president has addressed the open session about the quick management decisions taken by the Board of directors in CPAN equipment procurement, devising the tariff plans and promoting 13000 executives etc.  He has appreciated the efforts taken by the present CGM in regularly conducting the Opinion leaders meeting.  President has elaborated the 2017-18 financials.  AIBSNLEAs continuous pursuance of implementation of 3rd PRC is briefed.  The cash in-flow position of BSNL in the first half year compared to Previous year and why we are getting less allotment under medical even for retired employees against the assurances given at the time of absorption etc.   Under these circumstances, he explained the need of BSNL at Your Door Step campaign.  

Com. Prahlad Rai General Secretary in his special address appreciated CGM TN Circle Sri V. Raju for achieving more than 100 % in EB Business and got appreciation letter from Director for ‘Aseem Plan'.  GS has explained the assurances given at the time of absorption and the change of attitude by Administration Ministry and the Government in respect of BSNL employees and support to BSNL.  The present situation has raised in a planned manner by stopping ADC support to BSNL, not supporting the rural service expenditures from USO fund, compelled to pay the highest quoted rate for allotment of 3G spectrum for all the circles, not allowing BSNL to borrow funds for its operational needs  etc.  Under these circumstances, the current 1.74 lakh employees are shouldering the responsibility of more than 3 lakh employees in 2002-05.  While the Government is putting hurdle in raising funds by BSNL, private telcos are liberally offered loans from Banks.  One service provider was allowed to offer 6 months free of service to the public thereby destroyed other service providers.  At present only 4 operators including BSNL is in the field actively.  All others were closed their business.  He has advised the gathering to put their maximum efforts in improving the service.  GS has briefed the AIBSNLEA services to its members in respect of getting PRC, fitment, recruitment and promotion etc. GS has briefed about the meetings with the Hon'ble Minister on the issues of 3rd PRC implementation with 15% fitment benefit, Pension revision, Payment of pension contribution on actual basis and 4G Spectrum allocations to BSNL etc. wherein Hon'ble MOC has assured for positive decision on the above issues and other DoT officers on various issues.  Finally, Sri V. Raju Chief General Manager Tamil Nadu telecom circle has addressed the Open session.  Inspite of his hectic schedule, he made it a point to attend the meeting and address the gathering.   CGM has briefed the various para meters in which TN circle is showing improvement like Aseem plan, EB Business, Prepaid sales in respect of IN figures, fault control, decrease in down timings, making more no. of agreements with cable TV  operators on revenue share model for offering FTTH connections etc.  He is confident with the dedicated team of TN circle, this year will end up with profit.  This is the one and only motto of all.  CGM has made a thorough analysis and explained three key important areas where we can immediately improve our business.  1 Mobile 2.  EB  3.  FTTH & Broadband.  In respect of mobile, he told that Point of Sales (PoS) is to be  increased and it is increasing month on month.  Bringing back the retailers who left the BSNL and it is happening.  Visiting the retailers.  This is regularly conducted by all the SSAs now.  He has told that BSNL Management is taking all efforts and supports to improve our Business.  He is regularly appraising the developments to all the Union and Association leaders.  He is very much sure that with the contribution of all the  employees in Tamil Nadu circle, this year we will improve our revenue and see that TN circle earns profit.

12.10.2018: General Secretary's Visit to Mysore on 11.10.2018: The Comrades of AIBSNLEA Mysore TD arranged a meeting on the occasion of GS visit to Mysore TD. A full fledged Dist. Executive Body Meeting along with ACS  Com. Krishne Gowda  KTK, CWC Member, CHQ advisor, CS, CP and GS was held in the premises of Laxmipura Exchange. The meeting was presided over by District President Com. C Muralidhara. The newly elected young and energetic District Secretary' Com. R Ganesh welcomed the gathering. Thereafter Sr. Com. and ACS KTK Circle Com. Krishne  Gowda elaborated various problems and issues of the district and how he could able to overcome and settle the issues amicably. He stressed the need to give due priority to Mysore TD  being a big and loyal Distt. Association.

CS Com. S.K. Hiremath spoke on the occasion and clarified about the issues pending at Circle level. He congratulated and thanked the new body and assured all the support and cooperation.

GS Com. Prahlad Rai gave all the details about HR issues, CPC's, viability of BSNL, Pension revision, 3rd PRC etc. In his inspirational speech he called upon all to work together to enhance the membership. He also congratulated each and every executive member.

R Ganesh AO, C. Muralidhara D.E, and H N Ramesh SDE have been elected as District Secretary, District President and Finance Secretary respectively.

12.10.2018: GENERAL SECRETARY'S Visit to BANGALORE ON 10/10/2018: The young and energetic comrades of AIBSNLEA BGTD District, organized a special General body meeting on 10th of October 2018 at Auditorium VI floor Telephone House, Office of PGM BGTD in a grand manner. The hall was jam packed with huge gathering. The meeting was presided by Com. S G Hegde District President AIBSNLEA BGTD. District Secretary Com. Nagaraju welcomed Shri Prahalad Rai GS AIBSNLEA, VP(CHQ) Com. Chakoli Appalal, CP Com. Ulhas V Gurau, CS Com. SK Hiremath to the dias.  Com. Meena kumari C G ADS (PA/PS) welcomed the dignitaries on the dias and all the comrades for the meeting.

He explained the efforts of AIBSNLEA CHQ in continuously resolving the issues of Direct Recruitment executives, the role of AIBSNLEA in the viability of BSNL etc.,. He also mentioned about the progress regarding pension revision and 3 rd PRC in detail. He appraised the meetings with DDG(Budget) / DDG(Pers), DoT and meeting with Hon'ble Minister of State for Communications (I/C), Govt. Of India Shri. Manoj Sinha in respect of implementation of 3rd PRC with 15% benefit held on 8th & 9th of Oct'2018. 10.10.2018:   AIBSNLEA Executive Diary - 2019:

AIBSNLEA has brought BSNL EXECUTIVE DIARY-2019 containing updated information on service matters mostly concerning the BSNL employees and also important information on Telecom Engineering, Financial matters including GST. The Executive Diary is having full page for each day.

09.10.2018AIBSNLEA Meeting with Shri Manoj Sinha Ji, Hon'ble Minister of State for Communications (I/C), Govt. Of India:  GS, President, AGS (Fin) and AGS(DR) met with  Hon'ble MOSC (IC) Shri Manoj Sinha Ji for early settlement of various issues viz. (i)   Implementation of 3rd PRC with 15% fitment benefit in BSNL(ii) Revision of pension of BSNL Pensioners (iii) Payment of pension contribution on actual basic Pay (iv) Allocation of 4G spectrum to BSNL (v) Payment of pension through  existing Banking CPCs instead of CCA

Hon'ble Minister  mentioned that BSNL should have serious approach towards Its Revival. BSNL has to grab the opportunity through "BSNL Wings" and FTTH connections and increase its revenue as finally burden will come only on BSNL. BSNL should increase its CFA customer base from 1 crore to 1.5 crore during next 8 months to increase its revenue. In mobile segment there is stiff competition.   We insisted that about 20 lakhs people dependent on BSNL and are watching with hope towards Hon'ble Minister. We requested that Hon'ble Minister can only decide the fate of these 20 lakh people as approach of Bureaucracy is always as per line of rule book.

After detailed discussions, Hon'ble Minister assured that after arrival of Secretary (T) from US tour on 14.10.2018, he will hold a meeting with Secretary (T) and CMD, BSNL. Unions and Associations   may also be invited for aforesaid meeting and try to resolve issues at earliest. On our pleading Hon'ble Minister assured to give good news within this month itself.

We provided all  the letters addressed to Hon'ble MOSC (IC) on above issues which he marked to Shri Saket Kumar , PS, (IAS) to conduct above meeting .

09.10.2018Meeting with DDG (Budget), DoT: GS, President AGS(F) and AGS (DR) met DDG (Budget) ,DOT and enquired about clearance on the proposal of BSNL Board for the implementation of 3rd PRC in BSNL with 15% fitment benefit. DDG (Budget) mentioned that the file is already sent to nodal cell of DoT with its comments that decision in this regard may only be taken by Cabinet. We requested for favourable comments on file when case come into finance for vetting of Cabinet Note .

09.10.2018Meeting with DDG (Pers) ,DoT: GS, President AGS (F) and AGS (DR) met DDG (Pers), DOT and discussed the case of implementation of Rule 206 of seniority of TES Group B officers  as per Hon'ble Supreme Court Judgement  dated 14.12.2017 and explained the impugned Judgement verdict in detail . We requested to DDG (Pers) for early reply from DOT to BSNL in this regard. DDG (Pers.) assured for same .

GS, President and AGS (Finance) met Director (HR), BSNL Board and apprised her regarding meeting with Hon'ble MOSC(I/C)  and meetings in DOT. Director (HR) appreciated the efforts of AIBSNLEA in this regard. We further discussed regarding

GS, President and AGS (Finance) met Director (HR), BSNL Board and discussed regarding

A) AO to CAO Promotion:  We requested the DIR HR) for considering the promotion from AO to CAO. DIR (HR) in the presence of Sr.GM (FP), GM (Pers) and OSD and discussed the matter in detail on SC & ST roster implementation vis-à-vis Hon'ble Supreme Court judgement. Sr.GM (FP) informed that today Senior Advocate Shri R.D.Agarwala has submitted the legal opinion wherein he has opined that let, DOP&T issue the endorsement/guidelines on the basis of Hon'ble Supreme Court judgement on SC &ST roster implementation. Till that time BSNL should restrain from issuing promotion orders. We contested against that and requested DIR (HR) to take appropriate decision in this regard so that promotions can be made. DIR (HR) further mentioned that she will further discuss the matter and will upload the view of the BSNL Management on this issue in the BSNL Intranet Portal. The decision will be applicable to all the cadres for promotions.

B) Consideration of request/ tenure transfers of AOs /CAOs/ DGM (F)s: We requested DIR (HR) for the consideration of request/ tenure transfers of AOs /CAOs/DGM(F)s. Also expressed our serious concern against the transfer orders issued by SEA Cell on "Pick & Choose" method. DIR (HR) assured to look in to the matter and examine the transfer orders issued on "Pick & Choose" method. 

08.10.2018Meeting with GM (Pers):

GS, President and AGS (Finance) met GM (Pers) and discussed regarding

A) Implementation of Rule 206 of TES Gr.B Seniority case: We provided all the Judgement copies of impugned orders and the Hon'ble Supreme Court Judgements and requested GM (Pers) to implement Hon'ble Supreme Court Judgement in its true spirit. GM (Pers) assured to re-examine the issue.

B) JTO to SDE(T) Promotion: We requested the GM (Pers) to consider the JTO to SDE (T) promotions to fill up the vacant SDE (T) Posts on the basis of Hon'ble High Court, Kerala Judgement. GM (Pers) mentioned that let the Contempt case pending in the Hon'ble CAT Ernakulum be decided and the AIEL be prepared, immediately CPC will be expedited to fill up the vacant SDE(T) Posts.

08.10.2018Meeting of AUAB : Today All Unions and Associations of BSNL hold its meeting at NFTE CHQ Office at New Delhi. On behalf of AIBSNLEA GS & President attended the meeting. Com. C. Singh, GS, NFTE presided the meeting. AUAB expressed its serious concern against the non-implementation of the assurances/directions given by the Hon'ble MOSC (I/C) in the meeting with AUAB held on 24.2.2018. Also expressed dissatisfaction against the poor response of the BSNL Management in this regard. After detail discussions AUAB unanimously decided to serve the Notice of Trade Union Action Programmes as under:

i) Press release/Press Conference at CHQ/Circle/SSA levels on 29.10.2018 high lighting the demands.

ii) One full day Dharna at BSNL CO/Circle/SSA levels on 30.10.2018.

iii) Rallies at Circle and SSA levels and submission of Memorandum to the respective CGMs/GMs on 14.11.2018.

iv) To intensify the Agitational Programme in terms of Indefinite Strike will be decided after 30.11.2018 in case the AUAB demands are not settled.

v) AUAB decided to issue protest letters to CMD regarding

a) Outsourcing of Passive Infra Maintenance of Non BSNL Sites amounting Rs.1800 Crores per Annum and

b) Repatriation of excess ITS Officers against the Sanctioned Strength to DOT as per the Hon'ble High Court Delhi Judgement of in diminishing order.

All the Unions and Associations of BSNL will be requested by AUAB Leaders to come together and fight collectively on the common demands. The demands are as under

1) 3rd PRC implementation with 15% fitment

2) Pension Revision

3) Pension Contribution on Actual Basic Pay instead of Maximum Pay.

4) Immediate Allocation of 4G Spectrum to BSNL.

All the Circle Secretaries/District Secretaries are requested to implement the Agitational Programme successfully.

04.10.2018 Meeting with GM (Pers.) BSNL CO               

GS, President and AGS (Finance) met GM (Pers.) and discussed regarding

(a) AO to CAO promotion clearance: We requested GM (Pers.) to give early comments on SC/ST roaster policy in BSNL to SEA cell so that SEA cell can issue the promotion order. GM(Pers.) mentioned that today he has given the comments in this regard and returned the file to SEA Cell.

(b) Implementation of Hon'ble Supreme Court Judgement on  Rule-206 in TES Group “B” seniority: We further explained that Hon'ble Supreme Court has upheld the impugned Judgement (i.e. Hon'ble High Court Chandigarh and Hon'ble CAT Chandigarh judgements ) with  further observation that those who have been given further promotions may not be disturbed. And make it clear that no arrears will be payable in terms of the impugned judgement. Consequential benefits of pay fixation including the pensionary benefits, if any, will be payable in terms of the impugned judgement only w.e.f 1.1.2018 and not for the post.

GM (Pers.) after details discussions mentioned that matter has now been sent to DoT for comments and after receiving the comments further matter will be examined in light of the impugned order.

 (c) Consideration of some request/ tenure transfer of SDEs/DEs /DGMs: We requested for the consideration of some request /tenure transfer cases of SDEs/DEs/ DGMs on genuine grounds. GM (Pers.) assured to look into the matter for early consideration.       

04.10.2018 Meeting with Sr. GM (Estt.) BSNL CO:

GS, President and AGS (Finance) met Sr. GM (Estt.) and discussed regarding

(a) FR 22(1) a (i) pay fixation to the JTOs officiating as per the Hon'ble CAT Ernakulum bench and Hon'ble High Court Kerala Judgement: We expressed our concern against the BSNL CO recent order for the implementation of Hon'ble Supreme Court Judgement on FR 22(1) a (i) pay fixation case wherein Estt Cell has again mentioned the order dated 22.12.2015 to revert the JTOs as TTA on 1.1.2007 and re-fixed in JTO scale which is causing heavy   financial loss to these JTOs  and against this order AIBSNLEA has already filed the contempt petition in the Hon'ble PB CAT New Delhi. Sr. GM (Estt) after detail discussions assured to look into the matter for an early solution.

(b) SC/ST roaster implementation in CPSU cadre hierarchy committee report: Sr. GM (Estt) mentioned that some Associations/Unions are yet to give their feedback on this issue thereafter only the committee will give its report.

04.10.2018 Meeting with Sr. GM (FP) BSNL CO:

GS, President and AGS (Finance) met Sr. GM (FP) and discussed regarding

(a) AO to CAO Promotion: We requested Sr.GM (FP) for issuing promotion order from AO to CAO. Sr. GM (FP) mentioned that she is going to discuss the matter with Sr. Advocate Shri R.D. Aggarwala by tomorrow. She also mentioned that the comments of GM (Pers.) on SC/ST roster implementation policy in BSNL are also await, thereafter only with the approval of the competent authority the necessary action for promotion will be taken.  

(b) Consideration of some request /tenure transfer cases if AOs/ CAOs/ DGMs (Finance): We requested for consideration of some request /tenure transfer cases of AOs/CAOs /DGMs (Finance) on genuine grounds. We also expressed our serious concern against some “Pick & choose” method transfers. Sr. GM (FP) assured to look into the matter.

04.10.2018 Left item of meeting with CMD BSNL on dated 03.10.2018:

(f) Delay in reimbursement of medical claims: We expressed our serious concern against the delay in reimbursement the medical claims of BSNL serving employees for the last 2-3 months and BSNL pensioners for last six months respectively. We explained that majority of BSNL employees exercise their options in view of BSNL MRS also. This was also one of the factor for absorption in BSNL but now on the pretext of financial constraints the medical bills of BSNL serving employees and pensioners are pending months together. we requested to release timely funds against medical claims. Some employees are interested to switch over to CGHS Scheme for BSNL MRS but they are not being considered due to confusion in code number by the respective CGHS dispensaries. This issue needs to settled in DoT level and those who are allowed to switch over CGHS Scheme their one time medical fee reimbursement from BSNL is also getting delayed. We requested CMD BSNL for his kind intervention for the settlement of above mentioned issues. CMD BSNL after detailed discussions assured to look into matter.

03.10.2018 Meeting with CMD BSNL:
GS, President, AGS (Fin) met CMD BSNL and discussed regarding:

(a) Promotion from AO to CAO:
We expressed our serious concern against non- issuance of promotion order from AO to CAO even after the stay order vacated from Hon'ble CAT Chandigarh. The AOs promoted in the year 2003 and 2005 are still waiting for CAO promotion. CMD appreciated our concern and assured to discuss the matter with Director (HR). He further mentioned that respective cell should ensure that after issuing the promotion orders, the contempt of Court case should not arise.
(b) CPCs in all the streams of BSNL:
We requested CMD BSNL to allow holding of CPCs in all the disciplines of BSNL to the eligible executives for their promotion in the next higher grade. We explained that majority of the executives are interested to get promoted in the next higher grade through CPCs only and not through CPSU Cadre hierarchy. CMD BSNL after discussing the status of the various court cases pending, assured that after the settlement of these pending court cases the process of CPCs may resume.
(c) Implementation of 3rd PRC in BSNL:
We requested CMD BSNL to use his good office in DoT/MOSC office for getting implementation of 3rd PRC in BSNL.CMD, BSNL mentioned that he has been trying in this regard but we should also pursue the matter with Hon'ble MOSC (I/C) for an early decision.
(d) Payment of Pension contribution on actual basic pay of BSNL employees and pension revision:
CMD BSNL mentioned that Hon'ble MOSC (I/C) in the meeting held on 24.02.2018 directed DoT officers for necessary action and now we should follow -up in DoT & MOSC office for settlement.
(e) Allocation of 4G spectrum to BSNL:
CMD, BSNL mentioned that BSNL took up this issue with DoT, 3 years before but till date it is not allocated and further delay will not help even after its allocation. He further mentioned that he is regularly perusing in DoT and MOSC office.

03.10.2018Meeting with Director (HR) BSNL Board
GS, President and AGS (Finance) met Director (HR), BSNL Board and discussed regarding:
(a) AO to CAO promotion:
We resented against the delay in the process of promotion from AO to CAO by SEA Cell BSNL C.O. on the pretext of legal opinion. The stay order was vacated by the Hon'ble CAT Chandigarh three weeks before but the promotion orders are not being issued. We apprised Director (HR) that Sr. GM (FP) has sent the fill to Pers. Cell BSNL C.O. One week before to get clearance on SC/ST roaster implementation policy for clearance and guidance but the reply is still awaited, similarly the legal opinion from Sr. Advocate Shri R.D. Agarwala is also awaited . Director (HR) appreciated  our concern and assured that tomorrow she will talk to GM (Pers.) and Sr. Advocate Shri R.D. Agarwala for an early clearance / legal opinion respectively.
(b) CAO to DGM (Finance) CPC:
We requested to issue promotion order from CAO to DGM (Finance) as the CMD BSNL has advised to discuss the matter. Director (HR) mentioned that she has already directed Sr. GM (FP) to discuss the matter with CMD BSNL and to get approval. However, she assured to look into the matter.
(c) Implementation of FR 22(1) (a) (i) pay fixation to the officiating JTOs as per the Hon'ble CAT Ernakulum and Hon'ble High Court Kerala Judgements:
The SLP of BSNL has been dismissed in the Hon'ble Supreme Court. The implementation order has been issued by Estt. Cell but it is against the Court judgements. It will cause further litigations. On our letter Director (HR) directed Sr. GM (Estt.) to put up the case.

29.09.2018Report on Special General Body meeting of AIBSNLEA Alwar  District on 29.09.2018 at Alwar: The Special General Body meeting of AIBSNLEA Alwar  District was organised on 29.09.2017 at IQ Hall of GMTD Office in  a grand manner. The meeting  was attended by  Com. GS  Shri Prahlad Rai and Shri Devesh Sharma, Organizing Secretary (North) from AIBSNLEA CHQ side. The session of the meeting was attended by majority of the members of AIBSNLEA. The meeting was presided by Com. R.K. Meena, IFA Alwar SSA.

Alwar Branch Office Bearers and Organizing Secretary (North) Shri Devesh Sharma welcomed  Com. GS  Shri Prahlad Rai.  All the dignitaries were welcomed by garlanding. He also thanked to AIBSNLEA CHQ for extending every support to AIBSNLEA Rajasthan. 

Com. Devesh Sharma, Organizing Secretary (North) CHQ in his address welcomed the GS AIBSNLEA in Alwar  and thanked him for continuously resolving the issues of BSNL Executives. He welcomed the GS, to attend the meeting in spite of his busy schedule. He explained that how the GS AIBSNLEA is continuously pursuing these viability related issue with the BSNL Management and DoT.

GS AIBSNLEA, Shri Prahlad Rai, congratulated the comrades of Alwar for the successful meeting and thanked the comrades for their great affection. In his detailed address Com. GS mentioned the earlier time when the Alwar was the most progressive SSA in Rajasthan Circle.  He explained that how the AIBSNLEA is continuously pursuing these viability related issue with the BSNL Management and DoT. Com.

Com GS further explained the burning issues of the Headquarters level. He informed that BSNL employee will definitely get 3rd PRC with 15 % fitment benefits.  Com. GS explained in detail the efforts of AIBSNLEA in getting resolved the important HR issues after the formation of BSNL and in DoT setup He appraised the status of HR issues about various DPCs in various cadres.  He also appraised the house about DPCs from JTO to SDE, SDE to DE, DE to DGM, JAO to AO, AO to CAO & DPC in Civil/Electrical wing, Restructuring of AD(OL) case, Creation of PPS posts in field Units, filling up of EE(C/E) vacant posts, Regularization of offg. JTOs, CPSU
Cadre hierarchy etc., modification in transfer policy & Benchmark of EPP, etc. He explained the efforts of AIBSNLEA CHQ in continuously resolving the issues of BSNL Direct Recruit Executives like EPF, Superannuation benefits and Child Care Leave. Com GS further explained the role of AIBSNLEA in the viability of BSNL. 

At last he appealed the all Executives' for make every effort with a team spirit for making BSNL a vibrant organization. He also made hope that very soon Alwar Telecom District will gain its shining  past glory and will become the number one SSA in Rajasthan Circle in all the parameters.

28.09.2018 Status of AO to CAO Promotions: GS, President, AGS(Fin.) met concerned officers of SEA Cell & Legal Cell of BSNL Corporate Office, New Delhi to know about the legal opinion to be received from Sr. Advocate Sh. R.D. Agrawala.

It is informed that Sh. R.D. Agrawala Sr. Advocate will return to Delhi from Chennai on 2nd Oct., 2018, thereafter only he will give the legal opinion. We further requested Director(HR) to consider in house legal opinion of CGM(Legal), BSNL Corporate Office, New Delhi & issue the promotion order. Director(HR) assured to look into the matter. We are expecting promotion orders in the next week only.

28.09.2018 Meeting with DDG(PM), DoT: GS, President, AGS(DR) met DDG(PM), DoT and discussed regarding

(i)      4G Spectrum allotment to BSNL: DDG(PM) informed that Cabinet Note has been prepared & it will be send to all Nodal ministries for comments and thereafter to Cabinet for approval. He expected that these exercise will be completed within two months time. Raj. Circle will getting 800 MHz band and all other Circles will get 2100 MHz band.

(ii)     Consultant Report on Revival of BSNL:  DDG(PM) informed that IIM Ahmedabad have been appointed to submit its report on 'Revival of BSNL' which may takes two months time. We may expect through this revival plan to get financial help from Govt.

(iii)    Implementation of 3rd PRC: DDG(PM) mentioned that this decision may be taken by Hon'ble MOSC(I/C) only who can get relaxation in affordability clause of 3rd PRC from Cabinet. Thus we should take-up matter with MOSC(I/C).

27.09.2018 Group Term Insurance Committee Meeting: AIBSNLEA was invited for the Group Term Insurance Committee Meeting held at Corporate Office, BSNL, New Delhi at 12.30 hrs today. GS, President & AGS (DR) attended the meeting. GTI Committee meeting was conducted under the Chairmanship of SR.GM (Estt). Officer In charge from LIC attended the meeting and quoted the rates as detailed below.

Scheme (A) Executives below Age Group: 50 years

 - Rs.1.80/Rs.1000 + GST 18% for Rs.50 Lakh without Medical claim.

Scheme (B) Executives Age Group: Above 50 years - Rs.7.40/Rs.1000 + GST 18% with Medical Claim.

After detail discussions and negotiation the Officer In charge of LIC  agreed for the negotiated rates for Scheme (A) for Rs.1.60 and Scheme(B) Rs.6.75 subject to approval of the Competent Authority of LIC. But the Committee Members bargain for Rs.1.50 for Scheme (A) and Rs.6.50 for Scheme (B)

Salient Features of Scheme (A):

1) Maximum Limit of Coverage: Rs.50 Lakh

2) No Undertaking is mandatory for the Executives

3) This GTI Scheme will be optional only.

A) JTO to SDE Promotion: GM (Pers) informed that yesterday he met BSNL Counsellor at Ernakulam and explained him to get dismissed  the Contempt case in the Hon'ble CAT Ernakulam in JTO to SDE Promotion. The Contempt case has been listed for hearing on 9.10.2018 and after the clearance from the Court only the process for CPC from JTO to SDE will be expedited.

B) SDE to DE Promotion: GM (Pers) informed that today DGM(Legal) has attended the Hon'ble CAT Chandigarh during hearing and now the case has been posted for  hearing on 5.11.2018 & 6.11.2018.After the clearance from the Hon'ble Court CPCs, if required may be initiated.

27.09.2018 AIBSNLEA meeting with  Committee on CPSU Cadre Hierarchy to examine the SC &ST roster implementation in CPSU : AIBSNLEA was invited by the GM(Pers) to place the views/opinion on SC & ST roster implementation in CPSU Cadre Hierarchy. 26.09.2018Meeting with Director (HR), BSNL Board: GS, President & AGS(Fin)  met Director(HR), BSNL Board and discussed regarding:

A) AO to CAO Promotion:  We requested Dir (HR) to issue Promotion orders from AO to CAO in the light of Hon'ble Supreme Court Judgement delivered today. Dir(HR) after some discussions directed OSD to speak with Sr.GM(FP) and advised her to take the legal opinion if required from the CGM Legal BSNL Corporate Office on the recent Judgement of Hon'ble Supreme Court  instead of waiting for the Legal Opinion from the Sr. Advocate since there is a  clarity on this issue now. Dir (HR) assured an early action for issuing the Promotion orders from AO to CAO.

B) CPCs from JTO to SDE, SDE to DE & DE to DGM (T): We requested to direct GM (Pers) for expediting CPCs from JTO to SDE, SDE to DE & DE to DGM (T). director mentioned that GM (Pers) has gone to Ernakulum, Kerala to attend the Court in the Contempt case filed by some DR.JTOs against JTO to SDE Promotion. Similarly DGM (Legal) Pers, cell has also gone to Chandigarh to attend the Court in the Contempt case filed by  Shri Ramesh Kumar, SDE, Rothak in the SDE to DE Promotion. After the clearance from these contempt cases further promotions can be initiated. DE to DGM (T) court case in the Hon'ble CAT Chandigarh was heard today and now the Judgement is reserved to be pronounced on 15.10.2018. Thus the interim stay orders continue on DE to DGM Promotion.

The CPCs in other disciplines will be considered after the clearance in the above Court cases.

C) Implementation of Rule.206 of TES .Gr ‘B' Seniority on the basis of Hon'ble Supreme Court Judgement dated 14.12.2017:  We appraised Dir(HR) that today morning Member(Services), DOT  allowed AIBSNLEA to present its views before the DOT Officers during the personal appearance of some SDEs/DEs as per the direction of the Hon'ble PB CAT Delhi wherein we appraised the DOT Officers that BSNL has reverted Executives in violation of the Hon'ble Supreme Court Judgement. Also expressed our concern against the Pers.Cell handling of the case wherein without seeking the Legal Opinion form the Sr. Advocate / ASG the Executives have been reverted and the information has been sent to DOT.   Dir (HR) appreciated our concern and assured that the matter will be further discussed with GM (Pers).

D) Consideration of 147 SDEs of SC& ST and OC category candidates who have qualified TES Gr 'B' qualifying Examination and LDCE together and reverted as per the Hon'ble CAT Ernakulam and Hon'ble High Court Kerala Judgements at par with the SC & ST candidates who have qualified only TES Gr'B' qualifying Examination and now promoted as DE: Dir(HR) mentioned that the Promotions in the DE cadre  given to the other SC &ST candidates on the basis of their qualifying Examination will be re-examined  and suitable decision will be taken avoiding the Contempt of Court from Hon'ble High Court, Kerala and Hon'ble CAT Ernakulam.

E) Implementation of 3rd PRC with 15% fitment benefit in BSNL: We requested Dir(HR) to use her good office in the Internal Finance of DOT for getting an early clearance on BSNL Board's  proposal for  3rd PRC implementation in BSNL.  Since the BSNL proposal is pending for clearance in IFD Dir (HR) assured to look in to the matter.

26.09.2018 AIBSNLEA meeting with DDG( Pers.) &Director (Pers.)   DOT  on implementation of Rule 206 of seniority of TES Group B officers  as per Hon'ble APEX court Judgement : In response to AIBSNLEA letter dated 26.09.2018 <<<Click here for letter>>> addressed to Member(Services) DOT  regarding  personal appearance to AIBSNLEA with DOT officers as per PB CAT New Delhi  in the case of implementation of Rule 206 of seniority of TES Group B officers  as per Hon'ble Supreme Court Judgement  dated 14.12.2017 was considered  by DDG Pers.  DOT and allowed AIBSNLEA to present the views in the case. Accordingly GS and President attended the meeting at 11 Hrs today  and explained that BSNL in violation of Hon'ble supreme Court Judgement dated 14.12.2017 has reverted the executives those who have been promoted after 2001 to 2015 whereas Hon'ble supreme court its judgement para 4  it has been order that

" 4. accordingly the issue which arose again was settled by the  in the impugned Judgement , which has given rise to these appeals , while sealing with the appeal on 21.01.2015, the court upheld the view taken in the impugned judgement with further observation that those who have been given further promotions may not be disturbed ."

We further explained the following paras ....

"7.  we don't consider  it necessary any further order on the above recommendations except that 14 persons who are said to have been given promotions -3 persons in BSNL and 11 persons in MTNL  contrary to the law laid  by law laid down by this court in (1997)  10 SCC 226 (Supra) may not be disturbed .their promotions and seniority may be consider personal  to them without their being treated as class or precedent for future . the Judgement of this court in (2015)12 SCC 360 Supra will be treated as final between the parties on principle of seniority .

8.  We however make it clear that no arrears will be payable in terms of the impugned judgment . Consequential benefits of pay fixation including the pensioner benefits if any will be payable in terms of the impugned judgement only w.e.f. from 01.01.2018 and not for past.

9. No further orders are necessary on the application for impleadment and intervention and same stands dispose of.

10. The appeals are disposed off in above terms."

AIBSNL explained that they demanded BSNL management should take the legal opinion from ASG or senior advocate for independent legal opinion before reverting the executives in violation of the hon'ble APEX court judgement but BSNL management ignored and reverted the executives .

AIBSNLEA strongly demanded that DOT should now take independent legal opinion from ASG or Sr. advocate for correct implementation of Rule 206 of seniority of TES Group B officers  in BSNL / MTNL. It is understood that DOT may go for review petition in the  Hon'ble  Supreme Court. Accordingly affected executives may get ready to implead in the case.   

25.09.2018 AUAB Call On 'BSNL at Customer's Door Step' was inaugurated on 24.09.2018 by BSNL Brand Ambassador Ms. Mary Kom - an Indian Olympic boxer in BSNL Corporate Office, New Delhi in the presence of CMD BSNL, Director(HR), All Head of Circles & the representatives of AUAB.

From AIBSNLEA side GS, President, AGS(F) & AGS(DR) attended the function. As per the call given by AUAB & endorsed by BSNL Management has to be implemented sincerely by all the BSNL employees for the growth of BSNL & increase of revenue.

25.09.2018 Meeting with DOT Nodal officers: GS, President met the Nodal officers of DOT and discussed regarding

(a)  Implementation of 3rd PRC in BSNL with 15% fitment benefit:  We confirmed that the reply to the queries raised on the issues of financial condition of BSNL by the internal finance of DOT has again sent to Internal finance of DOT for consideration. It is understood that further action for moving a Cabinet Note by DOT can take place only after the clearance of internal finance of DoT.

(b) Allotment of 4G Spectrum to BSNL: It was informed that some action by DOT is being taken for allocation of 4G Spectrum to BSNL in accordance with the judgment of Hon'ble Supreme Court wherein it has been directed to DOT to allocate Spectrum after bidding process only. It is understood that Legal Opinion in this regard is likely to be obtained by DOT which may take time.

25.09.2018 Meeting with DDG (Budget) & Director (TPF), DoT: GS, President met DDG (Budget) & Director(TPF) DOT and requested to give clearance on the proposal of BSNL Board for the implementation of 3rd PRC in BSNL with 15% fitment benefit. They mentioned that the reply from Director (PSU) on BSNL's reply on the issues of financial condition of BSNL has been received in their section on 21.9.2018. They assured that the file will be cleared within this week.

25.09.2018 Meeting with DDG (Establishment) & Director (Estt) DoT: GS & President met DDG (Estt) & Director (Estt) DOT and discussed regarding

A) Pension revision of the BSNL Pensioners: We requested DDG (Estt)  & Director (Estt) DOT to delink the Pension revision of BSNL Pensioners from 3rd PRC revision. DDG (Estt) informed that some queries have been raised by   DOP&W in this regard, but their queries are yet to be replied. We requested them to reply DOP&W at the earliest to resolve the issue. Director (Estt) further mentioned that they have submitted a proposal to DOP&W explaining that the Pension revision of BSNL Pensioners may take place after the revision of Pay of BSNL Employees. In this regard only DOP&W has asked some queries which will be replied shortly by DOT.  But they were firm to their views that revision of Pension of BSNL Pensioners can take place after the revision of Pay Scales of BSNL Employees only.

B) Payment of Pension Contribution on actual basic pay instead of Maximum Pay:

We requested DDG (Estt) to consider the request of BSNL for the Payment of Pension Contribution on actual basic pay instead of Maximum Pay. DDG (Estt) informed that the file has been sent to Internal Finance wing with positive note as per DOP&T orders for comments and there after only it will be sent to DOE for clearance.

25.09.2018 Status of the Independent Subsidiary Tower Company case: Writ Petition No.5758/2018 filed by AIBSNLEA and other Associations of BSNL against the formation of Independent Subsidiary Tower Company of BSNL and appointment of Shri Amit Yadav, JS (A) as CMD of the Independent Subsidiary Tower Company of BSNL is came up for hearing today in the Court No.5 of Hon'ble High Court Delhi and posted for next hearing on 31.1.2019.

24.09.2018 Status of DE to Dy.GM Court Case: The MA filed by BSNL Corporate Office, New Delhi in Hon'ble CAT Chandigarh in DE to DGM promotion case will come to hearing on tomorrow.

20.09.2018CMD BSNL meets General Secretaries of the major Unions and Associations:

The CMD BSNL held a meeting today, with the major unions and associations. Com. Prahlad Rai, GS, AIBSNLEA , Com. P. Abhimanyu, GS, BSNLEU and Com. K. Sebastin, GS, SNEA attended the meeting. Com. C. Singh, GS, NFTE is on tour. The following issues were discussed in detail wherein CMD BSNL appraised that a very important HOCC is being held in BSNL CO on 24th & 25th Sept. 2018. in this meeting mainly the developments activities and strategies to earn more revenue will be discussed. 

"BSNL At Your Door steps" will be launched on 24.09.2018: The AUAB has already taken decision to conduct "BSNL At Your Doorsteps" movement, to boost BSNL's revenue collection, by stepping up sales and marketing of the Company. The AUAB has also desired that, this movement should be jointly launched by the AUAB and the Management. This issue was discussed in today's meeting.

Finally, the following decisions are taken.

a.      "BSNL At Your Doorsteps" will be jointly launched by the AUAB.

b.     The inauguration of this movement will take place at BSNL Corporate Office on 24th September, 2018 evening. All the CGMs will also participate in this launching. (HOCC is taking place in Corporate Office on 24th & 25th September, 2018).

CMD BSNL also told that he will try to bring BSNL's Brand Ambassador on this occasion.

CMD BSNL will handover flood relief amount to the CM, Kerala.

The AUAB has already requested the CMD BSNL to deduct one day's basic pay from willing officials. In today's meeting the representatives requested that the deducted amount should be handed over by the CMD BSNL, to the Chief Minister of Kerala.

Allotment of 4G spectrum to BSNL: The representatives expressed their concern over the undue delay in the allotment of 4G spectrum to BSNL and also over the network congestion prevailing in many parts of the country. They drew the attention of the CMD to media reports, which have quoted the Hon'ble MoS(C) as saying that, 4G spectrum would be allotted to BSNL only in December, 2018. The CMD BSNL told that, he is taking all out efforts for the early allotment of 4G spectrum and recently he has again written an emotional letter to Secy(T), DoT for immediate allotment of 4G spectrum to BSNL which has 40 watt Tx capacity whereas BSNL's 2G/3G spectrum is having 20Watt Tx capacity  and this is the urgent need of hour.

Subsidiary Tower Company: The AUAB is opposing the Subsidiary Tower Company tooth and nail. Decision has been taken to stall the Board meeting, and also for total walk out by the Executives and Non- Executives, in case Board meeting is scheduled, for giving approval for the appointment of CMD of Subsidiary Tower Company. This issue came up for discussion today.

Consolidation is taking place in a big way in the telecom sector. All the small operators have closed down their business. After the recent merger of Vodafone and Idea, there are only 4 operators in each circle. BSNL, Jio, Airtel, and Vodafone - Idea. Under these circumstances, there will be very less business for the Subsidiary Tower Company and now it has no relevance to operate tower subsidiary company.  Now there is no sustainability of tower subsidiary company. The BSNL Management has informed this to the government, through it's letter, written a last week only. This was explained by the CMD BSNL in today's meeting.

Outsourcing of passive maintenance of BSNL's towers:The representatives expressed their concern at the outsourcing. The CMD BSNL replied that at present the "uptime" of BSNL towers is only 80% - 85%. The uptime will increase to 97%, due to this outsourcing. Further, BSNL will save Rs.100 crore by way of maintenance expenditures through outsourcing. While the active maintenance of towers would be continued to be done by BSNL, only the passive maintenance, including provisioning  of batteries, engine alternators, diesel, payment of EB bill, etc., would be done by the outsourced party. The total payment for this will be Rs.6633 crores. The CMD BSNL further told that, the cases filed in the Delhi High Court and Supreme Court, against this outsourcing, by vested interests, are already dismissed.

BSNL's 3500 of BSNL CSCs to be used by UIDAI:The CMD BSNL informed that UIDAI has decided to utilise 3500 of BSNL's CSCs for Aadhaar authentication. For this, the UIDAI will give money for Capital Expenditure (CAPEX) and Operational Expenditure (OPEX) to BSNL. The CMD BSNL told that this would help BSNL.

CMD BSNL desired that govt. should allot new projects to BSNL.

AO to CAO Promotion: We requested the CMD BSNL to give clearance of AO to CAO Promotions against Vacant CAO Posts and through upgradation to CAO Posts. We explained that AO promoted in the year 2003 is still waiting for CAO promotion.

a) AO to CAO Promotion:  We expressed our serious concern against the delay in issuing Promotion orders from AO to CAO even after the stay order has been vacated by the Hon'ble CAT Chandigarh. Director (HR) mentioned that Sr. GM(FP) is expediting the CPC but on the verdict of the Hon'ble CAT Chandigarh and on SC/ST roster implementation the legal opinion has been sought from a Senior Advocate which will be received within 2-3 days and there after the Promotion order to fill-up the vacant CAO Posts will be issued immediately. We are expecting AO to CAO Promotion order in the next week only.

b) Holding of CPCs in all the disciplines through upgradation: We requested Director (HR) for issuing Promotion orders in all the disciplines through upgradation. Director (HR) mentioned that promotions through CPCs were being issued by upgradation also but meanwhile some Associations opposed CPCs and some individuals filed Contempt cases, which has stalled the process and on issues i.e.  promotions through upgradations and SC/ST roster in CPSU Cadre Hierarchy being examined and after  the clearance of  DoT it will be notified. Director (HR) assured that efforts will be made to fill up the vacant posts through CPCs also.

AIBSNLEA representatives and GS AIRBSNLEWA  met OSD to Hon'ble MOSC (I/C) and discussed regarding Implementation of 3rd PRC in BSNL with 15% fitment benefit, Revision of Pension of BSNL‘s Pensioners ,Payment of pension contribution on actual Basic Pay instead of maximum basic pay and Allotment of 4 G spectrum to BSNL. We submitted our letters dated 10.09.2018 on 3rd PRC enclosing the  DPE letter dated 18.04.2018 on affordability clause for BSNL and our letter dated 05.09.2018 on pension revision of BSNL IDA pensioners .

After detail discussions OSD assured to arrange the meeting with Hon'ble MOSC (I/C) for discussion on the above issues shortly.

AIBSNLEA representative and GS AIRBSNLEWA met DDG (Budget), DOT and requested to give clearance on the proposal of BSNL Board for the implementation of 3rd PRC in BSNL.

DDG (Budget) mentioned that the reply of BSNL was put up by JS (Admin) to internal finance but some more clarification has been asked from the nodal section of DOT. He assured that after receiving the case he will look into.

17.09.2018Meeting with officers of nodal section of DOT: AIBSNLEA representatives and GS AIRBSNLEWA met the nodal officers of DOT and discussed regarding

(a)  Implementation of 3rd PRC in BSNL with 15% fitment benefit: we confirmed that the file has been received from internal finance of DOT wherein they sought some clarifications in BSNL's reply on the issues of financial condition of BSNL. Which will be further clarified within 2-3 days to the internal finance of DoT for consideration .it is understood that further action for moving a Cabinet Note by DOT can take place only after the clearance of internal finance of DoT only.

(b) Allotment of 4 G Spectrum to BSNL: it was informed that some action by DOT being taken for allocation of 4G Spectrum to BSNL in accordance with the judgment of Hon'ble Supreme Court.

17.09.2018Status of Court cases on AO to CAO , SDE to DE and DE to DGM: Today Hon'ble CAT has issued the written   judgment on AO to CAO promotion wherein stay on promotion has been vacated with an interim order that promotions of  AO to CAO can be made subject to outcome of OA. SEA cell BSNL CO today immediately filed CAVEAT in the Hon'ble High court Chandigarh. SEA Cell BSNL CO will issue AO to CAO promotion shortly.

SDE to DE contempt case : The contempt case has been listed for hearing 27.09.2018 for which rejoinder is being filed by BSNL CO shortly .

DE to DGM(Engg) stay on promotion:  the case has been listed in the Hon'ble CAT Chandigarh on 29.10.2018. With the efforts of AIBSNLEA , Director( HR)  has directed Pers Cell BSNL CO to file an MA for preponement  of the hearing date  Accordingly Pers. Cell BSNL CO will file MA based on AO to CAO stay vacation order in the Hon'ble CAT Chandigarh by tomorrow for preponment of hearing date and vacation of the stay order on promotions.

17.09.2018AIBSNLEA UP(E) Circle organized condolence meeting of Com. Late Shri A.K. Singh, CS UP(E) Circle who expired on 03rd Sept., 2018: Our beloved Comrade,  GS Sir, Shri Prahlad Rai attended and addressed  Condolence Meeting of our beloved CS of UP(East) Circle, Late Shri A K Singh Ji on 16/9/2018 at  Lucknow at 13.00 Hrs. GS Sir, along with Comrade Pradeep Kevlani, met with wife of Late Shri A K Singh and assured her of all the help in future.

GS Sir given his Condolences to the family of Shri A K Singh Ji in Condolence meeting which was organised at Mahila Kalyan Kendra(Committee Hall) Telecom Officers Colony Chandralok,  Lucknow on 16.09.2018 at 1:00 PM. All Circle Office Bearers and DSs and members of different Units  attended the meeting.

After Condolence meeting, GS Sir answered the queries of all the members of Telecom, Civil, Electrical, Accounts and other streams regarding promotions, court cases, Pay commission, and other miscellaneous issues. GS Sir asked the Circle Body to organise CEC meeting in a month to co-opt the vacant seats of UP East Circle which are vacant.

Meeting was addressed by President Shri OP Dubey, Shri Pradeep Kevlani, CWC member and Acting CS, Shri A K Verma, ACS(Head Quarter), and DS Lucknow Shri K K Ojha and other members along with GS Sir Shri Prahlad Rai.

12.09.2018 Meeting with Sr .GM (FP), BSNL CO regarding to AO to CAO promotion:  

A) GS, President and AGS (Fin.) met Sr. GM FP and discussed regarding AO to CAO promotions and requested to issue promotion order to CAO Grade.

Sr. GM(FP) informed  that the proposal to fill up the vacant  CAO posts about  600 has been approved by the Competent Authority for expediting CPC. SEA Cell has already called the VCRs of the eligible candidates from CVO. Sr.GM(FP) today met personally with CVO CO, BSNL for issuing VCRs at the earliest. Sr. GM(FP) mentioned that VCRs are expected to be received by day after tomorrow and after conduction of CPCs and approval of minutes by the Competent Authority, the promotion orders may be issued in the next week only.  

GM(Pers) in our last meeting held yesterday informed that the  upgradation of the posts in   all the disciplines, decision will be taken by the Competent Authority only.

It is understood that the Competent Authority is not happy due to filing of the Contempt cases against CMD BSNL, Director(HR) and other Officers for issuing the promotion orders on JTO to SDE and SDE to DE. The contempt cases have been filed in the Hon'ble CAT Ernakulam and Hon'ble CAT, Chandigarh by some DR. JTOs and Shri Ramesh Kumar, SDE & District Secretary, SNEA Rothak, Harayana respectively. So it seems that till the time contempt cases are not withdrawn or disposed off no upgradation of posts will be taken by the Competent Authority.

B) Utilization of MT quota CAO Posts to Seniority quota promotions: We requested the Sr.GM(FP) to take the approval of the  Management Committee of BSNL Board for the utilization of 336 MT quota CAO Posts to Seniority quota promotions till the time diversion of theses posts is approved by the BSNL Board and decision on upgradation to CAO Posts are taken. Sr.GM(FP) assured to look in to the matter.

11.09.2018Meeting with Sr .GM (FP), BSNL CO regarding to AO to CAO promotion: GS, President and AGS (Fin.) met Sr. GM FP and discussed regarding AO to CAO promotions and requested to issue promotion order with upgradation and existing clear vacant posts of CAO. We explained that our AOs are waiting for promotion for the last 15 years. Sr. GM (FP) appreciated our concern and explained that the proposal to fulfill the existing vacant CAO posts about 600 has been sent to GM (Pers.) for clearance to issue promotion orders. She also mentioned that the earlier proposal to upgrade the post in CAO grade is pending in Pers. cell for clearance. After the clearance and approval of the competent authority the upgradation to CAO posts will be considered. She assured for early issuance of the promotion order to fill up the vacant CAO posts the VCRs of the eligible AOs have been called from vigilance cell. We requested to issue promotion order subject to availability of VC at circle level.

We persuaded in the Pers. Cell to the concern officers for giving early clearance to the AO to CAO promotions against vacant CAO posts and upgradation to CAO posts. It is understood that shortly clearance will be given by Pers. cell for AO to CAO promotion against vacant posts but regarding upgradation of the posts in   all the discipline, decision will be by the competent authority.

10.09.2018Meeting with GM (Estt.) BSNL C.O.:

GS, President met GM (Estt.) BSNL C.O. New Delhi and discussed regarding implementation of FR22(1)(a)(i) for the officiating JTOs as per the Judgement delivered by Hon'ble CAT Ernakulum bench and uphelded  by the Hon'ble High Court Kerala and Hon'ble Supreme Court. GM (Estt.) mentioned that the recent Hon'ble Supreme Court Judgment in this regard was sent to CGM (Legal) for legal opinion and they opinioned to file review petition in the Hon'ble Supreme Court. Now Estt. Cell has proposed to the competent authority for its implementation .The decision is yet to be received by Estt. Cell from the competent authority. He assured that as soon as this judgement for Kerala is implemented it will be generalized for all the officiating JTOs in BSNL.

10.09.2018Meeting with CMD BSNL : GS, President & AGS (Fin) met CMD BSNL and discussed regarding

A) Holding of CPCs from AO to CAO, JTO to SDE, SDE to DE and DE to DGM(T)) and other equivalent cadres: We requested CMD BSNL to promote all the eligible executives of all disciplines to their next grade through CPCs by filling up the vacant posts and by upgradation of requisite number of posts in the next grade. CMD BSNL after some discussions on the status of the pending court cases assured to get examine the matter.

Regarding AO to CAO Promotion, we appraised CMD that the screening of about 1405 has been completed by the SEA cell thus the promotion orders should be issued at the earliest.  CMD assured to look in to the matter.

B) Implementation of 3rd PRC with 15% fitment benefit in BSNL: we appraised the CMD BSNL regarding AIBSNLEA meeting with Hon'ble MOS (Water Resources) Shri. Arjun Ramji Meghwal and his assurance for arranging an early meeting with Hon'ble MOSC(I/C). CMD appreciated our efforts and assured his full support.

10.09.2018Meeting with Sr.GM(FP): GS, President & AGS(Fin) met Sr.GM(FP) and discussed regarding AO to CAO promotion. We requested Sr.GM (FP) to process the proposal for upgradation of 1200 Posts to CAO grade to reduce the stagnation. Sr.GM (FP) mentioned that at present the proposal to fill up all the vacant CAO posts is being sent to the Competent Authority for approval. There after the proposal of the upgradation of posts to CAO will be processed. We requested Sr.GM (FP) that both the proposals can be moved simultaneously to avoid the delay. She assured that after discussion with the Competent Authority she will process the upgradation proposal. We requested an early action in this regard.

10.09.2018 Meeting with DDG (Estt), DOT: GS & President met DDG (Estt), DOT and discussed regarding the revision of Pension of the BSNL Pensioners. DDG (Estt) informed that the reply to DOP&W of their queries are yet to be replied. We appraised him about the reply received from DOP&W regarding the ruling position of CDA Pension revision and IDA pension revision. He assured to look in to the matter.

10.09.2018 AIBSNLEA Meeting with Sri Arjun Ram Meghwal  Hon'ble Minister of State for Water resources: GS, President, AGS (Fin) met with Sri Arjun Ram Meghwal  Hon'ble Minister of State for Water resources and requested him to use his good office for arranging a meeting  with Hon'ble MOSC (IC) Sri Manoj Sinha Ji for reconsideration of 3rd PRC with 15% fitment benefit in BSNL, Revision of pension of BSNL Pensioners, Payment of pension contribution on actual basic Pay and allocation of 4G spectrum to BSNL. After detailed discussions Hon'ble Minister of State for Water resources assured to arrange a meeting with Hon'ble MOSC (IC) Sri Manoj Sinha Ji within 2-3 days to discuss the above issues. 07.09.2018 Meeting with Director(HR) BSNL Board: GS, President & AGS (Finance) met Director(HR) BSNL Board and extended sincere thanks for the efforts taken in getting stay order vacated on Promotion from AO to CAO in the Hon'ble CAT Chandigarh by deputing Sr. GM(FP) and DGM(SEA) to brief the BSNL's Advocate and attending Hon'ble CAT Chandigarh. We also requested to issue promotion orders immediately since the CPC work has been completed. Director (HR) appreciated our concern and assured for the early issuance of AO to CAO Promotion orders.
We expressed our serious concern against the casual handling of the DE to DGM (T) stay order vacation case and contempt case against SDE to DE Promotion in the same court at Chandigarh . We explained that yesterday DE to DGM case was not even heard by Hon'ble CAT on the pretext of judgment awaited from the Hon'ble Supreme Court on SC/ST reservation and posted for hearing in October 2018 on DE to DGM case and 27th September 2018 on SDE to DE contempt case. Our members are seriously frustrated and agitated on this issue. Director (HR) appreciated our concern and directed GM (Pers.) and AGM( Legal) Pers. Cell to take immediate steps to get vacated the stay order from DE to DGM and settlement of contempt case on SDE to DE case. Director (HR) assured an early action in these cases. GM (Pers.), GM(SR), OSD and AGM (Legal) Pers. Cell were available in the meeting.

07.09.2018 Congratulations! AO to CAO Promotion stay is vacated by Hon'ble CAT Chandigarh today. AIBSNLEA persistent efforts yielded result. On request of AIBSNLEA, Director(HR), BSNL Board directed GM(FP) & DGM(SEA) BSNL Corporate Office, New Delhi to attend the court in person. Accordingly, GM(FP) & DGM(SEA) met BSNL's Advocate yesterday and briefed the MA filed by BSNL for getting stay order vacated.

AIBSNLEA will continue its efforts for getting CPC expedited from AO to CAO.

06.09.2018 Status of AD(O/L) restructuring case: GS, President met Jt. GM(Pers.) BSNL Corporate Office, New Delhi & discussed regarding notification of restructuring of AD(O/L) Cadre. Jt. GM(Pers.) mentioned that on the basis of DoT clearance a Board Memo has been prepared and sent for approval in the next BSNL Board Meeting scheduled to be held on 18th & 19th Sept., 2018 He assured that after the approval of BSNL Board immediately restructuring of AD(O/L) cadre order will be issued.

06.09.2018Meeting with Member (Services), DoT: GS, President, AGS(DR) met Sh. Ravi Kant, Member (Services), DoT & felicitated him on assuming the high office of Member (Services), DoT. We also requested for the IDA Pension revision of BSNL pensioners. We submitted him our letter dated 05.09.2018 in this regard.

06.09.2018Status of 3rd PRC implementation with 15% fitment benefit in BSNL: GS, President, AGS(DR) met the concerned authorities in DoT and discussed regarding implementation of 3rd PRD in BSNL. It is learnt that the BSNL's Board proposal is still pending in the Internal Finance of DoT for clearance. It is expected that proposal may be cleared by Member(Finance) DoT in the next week after her joining from leave. However, the nodal section of DoT has already prepared the Cabinet Note in this regard. After the clearance of Internal Finance wing & approval of the Hon'ble MOSC(I/C), it will be sent to Nodal Ministries for comments i.e. DoP&W, DPE, DOE, Law Ministry & DoP&T. It is also learnt that the comments of all these ministries are ready available in DoT on the earlier references made by DoT. Now, the whole matter depends on the approval of Internal Finance of DoT.

05.09.2018 Status of court case   on withdrawal of additional increment in the same pay scale on functional promotion under EPP: DoT writ petition filed against the judgement of PB CAT new Delhi on the issue of  withdrawal of additional increment in the same pay scale on functional promotion under EPP was came for hearing yesterday 04.09.2018 in Hon'ble High court Delhi wherein Hon'ble High Court directed DoT  to implement the PB CAT Judgement  by making all the payments and to withdraw the writ petition otherwise court will dismiss the writ petition filed  by DoT . AIBSNLEA Already filed the caveat in the Hon'ble High court   thus the stay on PB CAT could not be granted .AIBSNLEA Advocate was present during the hearing in the court. the case has been posted for hearing on 10th October ,2018.

The order of Hon'ble High Court Delhi will be uploaded on receipt of the same  shortly.

30.08.2018  Advocate report on the ITS Absorption Case in Hon'ble PB CAT New Delhi: This is to inform you that the captioned matter was listed today (i.e. 29.08.2018) as Item No. 9 in Court No. 1 before a Bench Comprising of Hon'ble Justice (Retd.) Narasimha Reddy and Hon'ble Member Ms. Aradhana Johri at the Principal Bench, Central Administrative Tribunal.
When the matter was called out I sought a passover on behalf of Mr. Rao. However, the Bench was not inclined to passover the matter.
Accordingly, I apprised the Bench of the facts of the matter and the decision of the Hon'ble High Court in W.P. 22515/2012 decided on 17.04.2012 and the mandamus issued therein. Thereafter, the Bench was informed of the subsequent Orders passed by the High Court whereby the extensions sought by DOT was rejected. On reading the Impugned Orders dated 11.03.2013 issued by DOT & BSNL, the Bench was of the view that there seems to be partial compliance, and in any event if the same are in violation of the Orders passed by the High Court then the appropriate remedy would lie before the High Court. On this, I informed the Bench of the earlier Writ Petition that had been filed by the Applicants, whereby they were directed to seek an appropriate remedy, which was before the Central Administrative Tribunal. The Hon'ble Bench also opined that the Contempt Proceedings were pending in the High Court and the Applicants should agitate the issue therein. I submitted that the remedy available to the Applicants under the Contempt proceedings is separate from the present proceedings since the Court hearing the Contempt can either order punishment or imprisonment, and cannot grant the relief of quashing the Impugned Orders dated 11.03.2013, which can only be done by the Tribunal. The Bench was also informed of the Order passed by the High Court directed the CAT to proceed with the OA and that the pendency of the Contempt should not come in way of the OA.
After hearing the parties, the Hon'ble Bench was of the view that until the matter is pending in the High Court, the CAT cannot give any direction since ultimately it would be bound by the decision of the High Court. Accordingly, the Original Application has been disposed of with liberty to file a fresh OA after the decision of the High Court.
30.08.2018    NO DOCUMENT WITH DOT AND DOP&PW WHICH CAN PROVE DOP&PW MEMO DATED 04-08-2016(PENSION REVISION) IS FOR  CDA PENSIONERS ONLY: Both DoT and DOP&PW could not supply any note sheet/ order / document which can establish their claim that the pension revision memo F. No. 38/37/2016-P&PW(A)(ii) dated 04-08-2016 is only for those absorbee pensioners who retired from CDA scale and drawing pro-rata pension in reply to RTI applications made by Com. Amit Kumar Gupta, AGS, AIRBSNLEWA.

DoT in its reply said that it is self evident based upon the background material refereed therein" <<view the reply>>

And DOP&PW in its reply said "Obviously , these orders are not applicable to those pensioners who are drawing pension in the IDA pay scale"  <<view the reply>>

30.08.2018 Meeting with GM(Estt.), BSNL CO  : GS  and AGS( DR )met GM (Estt.) and discussed regarding implementation of FR22(I)(a)(i) Pay fixation to officiating JTOs of Kerala as the   SLP Filed by BSNL against the judgement of Hon'ble High court Kerala  has been dismissed .

 We pleaded that the BSNL Co Legal cell opinion to file review petition is nothing but delaying the case and putting executives in loss GM( Estt) appreciated our concern and mentioned that Estt. Cell is of the same opinion for implementation of the Hon'ble High Court Kerala Judgement since the official have performed duties on higher posts . After the approval of competent authority the pay under FR22(I)(a)(i) will be implemented .

29.08.2018 Meeting with Shri A N Rai Advisor to Hon'ble MOSC (I/C):  GS and AGS DR met Advisor to to Hon'ble MOSC(I/C) and requested to use his good office to support in resolution of issues of BSNL employees i.e. implementation of 3rd PRC with 15% benefit , payment of pension contribution on actual basic and revisions of pension of BSNL pensioners. After detailed discussions on these issues , Advisor to Hon'ble MOSC(I/C)   mentioned that tomorrow Hon'ble MOSC(I/C)   is holding review meeting of BSNL which was schedule today .In this meeting assured to extend his support . Regarding BSNL's viability advisor opined that BSNL should concentrate on giving more and more FTTH connections to retain and attract the customers.
29.08.2018 Meeting with Member ( Services) , DoT: GS met Shri Ravikant Member service on courtesy call and greeted him on assuming of the High Office of Member Services .

Member services has fixed up the meeting with AIBSNLEA on 4th September 2018 to discuss regarding payment of pension contribution on actual basic on BSNL pensioners and revision of pension of BSNL pensioners. 

29.08.2018 Meeting with Advisor Finance, DoT: GS met Advisor Finance DOT and discussed regarding denial of First time bound promotion received by BSNL executives of CTD by office of Pr CCA, Kolkata causing reduction of pension and pensionary benefits of retired BSNL executives. After going through our letter advisor finance immediate spoke with Pr CCA Kolkata and advised her to consider the representation given by the association on the basis of EPP provisions. Pr CCA Kolkata assured an early action in this regard.

Implementation of 3rd PRC with 15% benefit, payment of pension contribution on actual basic and revisions of pension of BSNL pensioners. we also informed that BSNL Board's proposal on implementation of 3rd PRC is under consideration with DDG (Fin .), DoT.  Advisor Finance during discussions mentioned that he will discuss the matter with DDG (Fin) for an early clearance but there is feeling among the DOT officers that pension of BSNL pensioners should not be more than pension of DOT pension. Otherwise there was no use of absorption of DOT employees of BSNL. We pleaded that BSNL employees after technical resignation joined BSNL under the assurance of Govt. Pension under Rule 37 A.

29.08.2018 Meeting on the Group Term Insurance for BSNL Executives :GM( Restg) convened a meeting of the committee, BSNL Executive associations AIBSNLEA SNEA and AIGETOA with  SBI Life representatives  for Group Term Insurance for BSNL Executives. GS , AGS(Fin) and AGS(DR) attended the meeting . SBI life representative told that they have provided most competitive rate for Rs 50 lakh cover @ Rs 1.42 per Rs. 1000 cover  for executive  of age band 18- 50 year . This rate will be applicable for executive  upto age less than 51 years without any medical test. For executives above 50 years rate is  Rs 6.98 per Rs1000  cover with medical test .

SBI life rate are applicable for 2 years which may be reviewed +/_10% change in base rate.

Association side expressed that we are expecting for more lucrative offer and asked for consideration of monthly and quarterly payment option.

SBI life submitted that rates offered are most competitive, payment options they will further discuss with their management.

It was decided that negotiations will be hold  in the next meeting by next week  and in that meeting the Scheme will be finalised. Committee suggested launch the scheme on 1st October 2018 on the "BSNL Day".

28.08.2018 Meeting with DDG (Estt), DoT

GS & AGS (DR) met DDG (Estt), DoT and discussed regarding:

(i) Pension revision of BSNL pensioners:  We requested DDG (Estt) to initiate the proposal of pension revision of BSNL pensioners as assured by the Hon'ble MOSC (I/C) in the meeting held with All Unions and Associations of BSNL on 24.02.2018. In this connection DDG (Estt) informed that DoT has referred the case  DoP&W for clarifications. DoP&W in response raised some queries . which is under examination in DoT  and reply will be sent shortly . he further advised to pursue the mater in DoP&W.

(ii) Pension contribution on actual Basic pay : We requested for the reply of DOT to Department of Expenditure (DoE)  after concurrence of internal finance of DoT which is pending for  more than one year in DoT. We also submitted that this issue is very much important for viability of BSNL and Pay revision in BSNL . DDG (Estt) mentioned that matter is yet not cleared by internal finance of DoT.

(iii) Issue of pension fixation by CCA, CTD   by erring calculation of 1st Time bound promotion on 5 years of service:  We expressed our concern about the erroneous calculation  of pensions by  CCA CTD  by calculating first TBP  on 4 &  6 years  for all cases  whereas those executives got first time bound promotion in 5Years their pension is being reduced by calculating 1st TBP on 6 Years. We requested DDG (Estt.) to direct  CCA, CTD as   some execute are touching minimum of next pay scale within 4 to 5 years thus they are given 1st time bound promotion on completion of 5 years as per EPP. He assured to look into the matter .

28.08.2018 GS and AGS (DR) met some senior officers in  DoT and discussed regarding:

(i)  3rd PRC implementation in BSNL: We enquired about the status of the case of  implementation of 3rd PRC in BSNL as assured by Hon'ble MOSC (I/C) in the meeting held with All Unions and Associations of BSNL on 24.02.2018 and 01.08.2018. we were  informed that  tomorrow  Hon'ble MoSC (I/C) is holding a review meeting  with Secretary (T) & CMD (BSNL)  wherein implementation of 3rd PRC is also one of the agenda item. It is understood that picture will be more clear after this meeting.

(ii)Clarification  of DPE regarding  E2 & E3 pay scales against E1A and E2A : It is  informed that the matter has been sent to DPE for examination. Reply is still awaited from DPE.

27.08.2018 Meeting with GM (Estt.), BSNL CO: GS, AGS(DR) met GM (Estt.) and discussed regarding

a.      Implementation of 3rd PRC in BSNL: We enquired about the response of DOT on the reply given by BSNL regarding the issues related to viability of BSNL. GM (Estt ) mentioned that the reply to DOT from Establishment  Cell BSNL CO was sent about one & half month before and  there after it was informed by PSU cell DOT the matter has being processed in internal finance of DOT for clearance . Which is still pending he opined that Hon'ble MOSC (I/C) only can help in this regard.

b.      Extension of deputation of JTOs / JAOs from  5 years to 7 years under Rule-9:We requested GM( Estt.) to consider the extension of deputation of JTOs / JAO for more than 5 years to 7 year as per DOP&T instructions issued in Feb 2016 in supersession of DOP&T order issued in year 2010. GM (Estt.) after detailed discussion assured to look into the matter.

c.      Internal Committee report SC/ ST roster implementation in CPSU cadre Hierarchy: Being the member of the committee GM (Estt.) informed that committee has already submitted its report to the Pers. cell as per the stand taken by Pers. cell on this issue. 

24.08.2018 Meeting with Director (HR), BSNL Board :GS and AGS (Fin) met Director (HR), BSNL Board  and discussed regarding:

(a)      CPCs from AO to CAO, JTO to SDE, SDE to DE and DE to DGM and other equivalent cadres: We expressed our serious concern against the handling of court cases in the Hon'ble CAT on catch up rule wherein all the promotions are held up. Director HR mentioned that CPCs are held up due to the contempt case filled by Shri Ramesh Kumar in the Hon'ble CAT Chandigarh in the case of SDE to DE promotions. Which is listed for hearing on 27.09.2018 .

Director(HR) immediately called   GM (Pers.) and AGM (Legal) and discussed the status of various court cases in the presence of GM(SR) and OSD to Director(HR). GM(Pers.)  informed that contempt case SDE to DE is listed for hearing on 27.09.2018, DE to DGM is listed for hearing on 05.09.2018,   AO to CAO is listed on 07.09.2018 and JTO to SDE contempt case in Hon'ble CAT Ernakulum is listed for hearing on 09.10.2018.   Director(HR) directed GM (Pers.) to make more efforts with BSNL advocates to get vacated the stay orders on promotions. Also directed GM FP to personally attend the Hon'ble Chandigarh CAT on 07.09.2018 or Direct the DGM(SEA) to pursue with BSNL Advocate and be present there. Director(HR) further mentioned that management is keen to promote the executives but due to various court cases promotions are stalled. We further extended our sincere thanks for promoting 12000 executives and to continue the process to promote all eligible executives.

(b) Implementation of rule 206 as per the Hhon'ble supreme court order in true sense: We requested Director(HR) for the true implementation of the Hon'ble Supreme Court Judgment on rule 206. GM (Pers) mentioned that as per the advice given by CGM (legal)  BSNL CO a draft has been prepared by Pers. Cell to send a letter to DOT for comments and on the basis of DOT advice further necessary action will be taken in this regard.

BRIEF REPORT OF THE 3rd CENTRAL WORKING COMMITTEE MEETING OF AIBSNLEA HELD AT DeHRADUN FROM 18th August, 2018 to 19th August, 2018:

 

The 3rd Central Working Committee Meeting of AIBSNLEA held at  'Dev Bhoomi' Dehradun, Uttaranchal on 18th August, 2018 and 19th August, 2018. The Flag Hosting was done by the Com. President and the General Secretary. After the flag Hosting, Com. President in his opening remarks told about the achievement of the AIBSNLEA for the promotion of more than 12000 Executives in last one month span. He requested all to use their positive gesture in enhancing the membership of the AIBSNLEA. He requested all to go through the agenda and involve themselves for the positive participation in the CWC deliberations till end for getting the fruitful results. Com. President mentioned that due to the historical achievements, the believe of executives on AIBSNLEA has increased.

Com. Brij Mohan Dhyani, CS Uttaranchal and Host of the CWC Meet, delivered the welcome address. In his address Com. Dhyani welcomed all guests coming to Dev Bhoomi- Dehradun, from all nook and corners of the country. He told that although the UTTARANCHAL is small Circle but he has tried his level best to make the CWC a comfortable one. CP Uttaranchal Com. L.K. Thapaliyal Ji welcomed the President CHQ by garlanding. CWC Uttaranchal Bisit Ji welcomed the GS AIBSNLEA by garlanding. All CHQ office bearers, Advisors and consultants were warm welcomed by garlanding the Host Circle. Haldwani branch and CWC Uttaranchal Bisit ji presented shawl to GS. All CWC participants were welcomed by presenting Uttaranchal traditional CAP.

After the welcome program Com President appealed all to go through the agenda and tell about the modification. CWC approved the agenda program. One minute silence was observed in the memory of departed comrades.

Self introduction was made by all the comrades on the appeal of President CHQ. All the CWC participants made their self introduction.

After the self introduction the CWC Dehradun confirmed the minutes of the CWC Thiruvanatpuram. CWC Dehradun unanimously confirmed the minutes.

Com. President appealed all the Circle Secretaries to deposit the legal and Diary payments.

Com. Ganeshan from Chennai donated Rs 15000 to CHQ.

Most of the Circles actively participated and placed their report in the CWC Meet at Dehradun expect A&N Circle, ALTTC GZB Circle and J&K Circle due to unavoidable reasons.

After completion of the Circle Secretary reports, Com. President requested Com. GS to Summed up.

Com. GS Summed up with the reply of the queries raised by all the Circle Secretaries.

On the issue of the DGM to Jt. GM promotion, Com. GS informed that we are perusing the case. Com. GS told that after the persuasions of AIBSNLEA only the promotions of JTO to SDE LDCE quota (about 2000) has issued. In SCF 3000 JTOs of 1999 batch have promoted. DRs were not been taken into consideration by the intervention of SCF by the SNEA.  We demanded to promote list No. 8 and 9 and Management agreed on list no. 8 but SNEA raised the issue to bring parity among the cadres in promotions, which has derailed the process. Earlier SNEA was impressing the management to implement the CPSU Cadre Hierarchy w.e.f. 31st July, 2018 but when they get failed in getting its implementation then to stop the promotions through CPCs they demanded parity. The fact remains that there was never parity among the various cadres in promotions due to various reasons even that prevailed in DoT. Management got disappointment due to such attitude of the Majority Association and stop the promotion through CPCs. AIBSNLEA continued to pursue  with CMD BSNL , Director(HR) , GM(Pers.) for issuing the promotions through CPCs in all disciplines and to maintain equalization in the cadres as far as possible. AIBSNLEA also extended its sincere gratitude and thanks to the managements for issuing 12,000 executives promotions within a month time, which has became a history.  AIBSNLEA is also demanded implementation of CPSU Cadre Hierarchy but before its implementation all the existing eligible executives should be promoted to the next grade as per the existing RRs. We also briefed the management that in case CPSU CH  is implanted without conducting CPCs there will be court cases and in case the stay order is granted then BSNL Management will not be in a position to issue any promotion order through CPCs or CPSU CH. BSNL Management has appreciated our concern and assured to examine our apprehensions and for an early  action in this regard.

AIBSNLEA  efforts will continue to ensure holding of CPCs for the promotion for all the eligible executives before implementation of CPCU CH to provide  their service waitage  and financial benefits.

Com. GS told that AIBSNLEA played a big role in vacating the stay on JAO to AO promotion and 2300 promotions took place. In AO to CAO Court case BSNL Management filed the MA on our persuasion only. Stay order date on catch up Rule of DE to DGM hearing is 05.09.2018. DE to DGM contempt case date of hearing is 07.09.2018. AIBSNLEA impledment in AO to CAO case will derail the process.  GS informed that we will pursue the matter of GM (TR) in AP Circle. GS assured to take up the issue of posting new staff at BRBRAITT.

Regarding one day salary to Kerala calamity, Com. GS informed that we will support the donation of one day salary to Kerala Calamity. GS explained that the meeting at Jaipur was extremely necessary due to MV and was held by the approval of President and CHQ Office Bearers at ND. GS explained that the meeting at Delhi was also necessary for the issuance of the promotions before 30.06.2018. So it was not the wasteful expenditure at that time. To have second line leadership, Com. GS explained that AIBSNLEA have five Asstt. General Secretaries along with 15 CHQ Office Bearers who are leading the organization and they are available to serve the association as second line leadership if required.

Regarding the legal fund Com. GS told that now the subscription is directly coming to CHQ so that we have funds but there are so many legal cases AIBSNLEA is fighting. Now Rule 206 has been misinterpreted by the BSNL CO. Thus seprate legal fund is must.

GS assured to take up the matter of Hungama Service with Management. GS assured to takeup the matter of delayed GPF payment in HP Circle. GS informed that 28.08.2018 Board Meeting the AD (OL) case will be taken up.  Com. GS assured that on E-2  & E-3 payscales  revised proposal has been again sent to DPE and we will discuss the case with Secy (T). GS assured that soon our DRs will get the benefits of 7% SAB. GS assured to pursue the matter of Rs. 22820 pay with CMD BSNL. GS assured to take up the Android mobile phone matter with Mgmt. For GTI GS told that we are perusing the case. We will discuss the Death Relief Fund with the Management.

GS assured that we will discuss the case of Special CL but the Majority Association is mounting the pressure on the Management not to deviate REA Rule-2014. GS assured that we will discuss the case of special recruitment drive. GS asked Com. Sukaisema to send the letter of CGM NE-II for tenure problem.

GS explained that Account must be audited from Jan to Dec. GS explained that this monitoring system is very good for financial excellence.

GS informed that shortly a software is being launched for transparency in the IQ booking system.

GS advised all the Circle Secretaries to start the Circle Websites of AIBSNLEA, it is needed in the  competitive  environment .

 Point 2.6 Com GS informed that For Diary 2019 the orders have been placed and   diary will be dispatched to the Circles by the begging of Dec., 2018 with improved quality.

He requested the Dias to take the matter of left out cases for the C/E wings. He also requested for the AO to CAO DPC and clear the bottleneck. He stressed for the energy conservation and energy saving for the BSNL. He requested to fill the SE level posts for the C/E/Arch wings.

 Com. Narendra Advisor:- He appreciated the efforts of the GS and CHQ team for the efforts done for the mega promotions. He requested all to explore the possibilities to finish the pending DPCs. He mentioned that we should take the initiative to find out the possibilities to clear the court case.

Com. Guruprasad, Advisor in his address endorsed the view of Com. Narendra and suggested that the stay is not vacated. AOs drawing CAO scale may be designated  as CAO.

Com. President explained the efforts made by GS AIBSNLEA for expediting the CPCs. He told that AO to CAO DPC cannot be compared with SDE to DE CPC. Com. President told about the factual position in the AO to CAO DPC. 7800 vacancies are available in SDE cadre as on date.

Com. GS explained about the status of the standard pay scale, 22820 pay scales to post 2007 and 2008 batch.  The matter is pending with Director(HR) for consideration.

Com. Karan Singh, Advisor explained in detail the 206 case and requested to implement the decision of the court in the matter of 206 case.

GS AIBSNLEA described the procedure for relaxing the affordability clause. AUAB is supporting us in this mission. We have to peruse it in DoT beurocracy. The fact remains that other then AIBSNLEA no Union or Association is perusing it in DoT.

Inordinate Delay in settlement of Disciplinary cases- GS AIBSNLEA told that now the pendency is reduced. He asked for the details of such cases.

GS told that the Office accommodation of BSNL CO was started by the efforts of AIBSNLEA. We have requested the Management to provide the same facilty to Circle also. GS appealed all Circle Secretary to peruse with the respective CGM.

GS told that the winding up of assets of all Associations is pending.  GS told that we should discuss the possibility of our own accommodation.  CWC suggested not to have associations accommodation in view of the previous bitter experience in this regard. 

Com. GS deliberated about the scenario after the Membership Verification and requested all the Circle / District Secretaries to concentrate for enrolling more members in our association by explaining the efforts of AIBSNLEA in getting 12000 executives promotions.

GS described that initially the apprehension that the creation of tower subsidy will reduce the asset of the BSNL and it will fragment BSNL. So AUAB protested it. Only BSNL Board can decide the CMD of subsidiary company but DoT arbitrarily appointed an IAS officer as CMD of the subsidiary company. This created the panic. We protested against that. CMD BSNL also wrote to DoT about the difficulty to rectification of this appointment process due to strong protest of BSNL's Unions & associations. GS described in detail the status of the subsidiary tower company matter. 

GS concluded the General Secretary Report and it was approved by the house.

Com. T C Jain FS presented the audited account, which was adopted by the House with few suggestions.

CWC unanimously decided the continuation of CHQ Office bearers in the present CHQ body even after their retirement till the next All India Conference as per the provisions of the constitution of AIBSNLEA.

A resolution was moved by Chennai Telephone Circle in appreciation of the host Circle for making best boarding and lodging arrangements to the CWC Members for their comfortable   stay which was seconded by Kolkata TD Circle/West Bengal Telecom Circle, which was unanimously approved by the House. At last Com. GS & President extended their sincere gratitude and thanks to the Host Circle Uttrakhand and all the participants for making CWC Dehradun a grand success and call upon to meet next AIC at VijayaWada. 21.08.2018 OPEN SESSION ON THE OCCASION OF 3RD CWC Meeting of AIBSNLEA ON 19th August, 2018: The Open Session of the 3rd CWC meeting of the AIBSNLEA was successfully organized at Hotel Grand Pearl, Dehradun in a grand Manner.

Shri Ganesh Kothari hoisted the mic arrangement. Com. President CHQ Shri S.Shivakumar presided the Open Session.

Shri Mahak Singh CGMT Uttranchal Circle was the Chief Guest of the Open Session.  Shri A.K. Sinha DGM (SR), BSNL Corporate Office, Shri K.R. Bharti, GM (F) Uttarakhand Circle, GM (CFA) Uttrakhand Circle Shri O.P. Kanojiya, GM(CMTS) Uttarakhand Circle, Shri S.K. Singh  attended the Open Session from Management Side. Shri L.P. Thapaliyal Circle President, Shri Amit Gupta, AGS, Retd. BSNL Executives' Association also shared the Dias.

Ex. Circle Secretary Shri R.P. Singh was also welcomed in the Open Session. From Sister Unions and Associations Shri AB.Uniyal CS NFTE, Shri K.S.Som CS BSNLEU , Shri S.S.Rothan Ex CS SNEA were also welcomed by garlanding. GMTD New Tehri Shri Choudhary, Shri Babu Singh DGM, Shri Mohan Rastogi and Sh. Suba Singh, Senior Member, Shri S.C.Kala  were also welcomed by garlanding.

Shri B.M. Dhyani Circle Secretary Uttrakhand Circle delivered the welcome address. He welcomed all the distinguished guests in Devbhumi and the historic city Dehradun. One minute silence was kept for the former Hon'ble PM Shri A.B.Bajpayee. In his address he praised the quality of service by BSNL in Uttrakhand Circle.

He thanked GS for providing the opportunity to hold the CWC in Dehradun. He told that AIBSNLEA Uttrakhand Circle AIBSNLEA has tried to make every arrangement for a comfortable stay. At last he thanked all for making the CWC a grand success.

Shri Amit Gupta, AGS, Retd BSNL Executives' Association in his address thanked the organizers. He told that pensioners are also have certain problems like pension issues and medical issues. He thanked the SR section for starting the pension grievance cell at BSNL CO. He complained that the delay in pensioners' medical bills is very large. He expressed his dissatisfaction on the DoT view to revise the pension after the pay revision of serving employee. He praised GS AIBSNLEA for his great persuasion of issues.

President CHQ Shri S.Shivakumar in his address welcomed all in the 3rd CWC. He told that BSNL is struggling hard to make its image better. Declining the revenue is a serious concern for all of us. BSNL is not getting any support from DoT. Com. President CHQ informed that AUAB has taken up the issue of the immediate need of the 4G spectrum to BSNL. He informed that BSNL has been established under National Telecom Policy with a specified object to provide the connectivity at every end and also in remote and tribal area.  Com. President CHQ informed that after in June 2018 the revenue has declined by 40%. The cash flow is also reduced so we are not able to make the expenditure. He expressed his gratitude to CMD and Dir (HR) for issuing 12000 promotions in the short span of time. He expressed that these promotions have taken place due to the consistent efforts of AIBSNLEA only. Com. President expressed that by improving the financial health of BSNL, only we can survive. At last he thanked all for making the CWC a grand success.

GS AIBSNLEA Shri Prahlad Rai welcomed all in the 3rd CWC meeting and thanked Com. Dhyani and his team for the successful arrangements in the CWC. GS told that the Uttrakhand Circle is very important Circle for BSNL and the role and spirit of the BSNL Executives in the calamity is commendable. He appreciated that AIBSNLEA is the No. 1 Association in the Uttrakhand Circle. Com. GS told that the commitment of the comrades of the Uttrakhand Circle is appreciable. Com. GS told that we are thankful to the management for this great effort.  GS told that it is the commitment of the BSNL employees towards the nation that BSNL is providing affordable services to the citizens. So the revision of pay scales are the must for the BSNL Employees and Com. GS strongly informed that WE WILL TAKE IT DEFINITELY. Com. GS expressed the struggle of AIBSNLEA towards the pensioners issue, Efforts of AIBSNLEA for standard pay scales, uniform first TBP in four years., 22820 pay scales for JTO/JAO recruited 2007 and 2008 batches, 30% SAB to BSNL Direct Recruits. Com. GS appealed DGM (SR) to arrange to grant the SP. CL to the office bearers of all the levels of AIBSNLEA.  At last he thanked all for making the CWC a grand success.

Shri K.R.Bharti, GM (F) Uttrakhand Circle and Patron of AIBSNLEA Uttarakhand Circle in his address welcomed all in Dev Bhoomi for 3rd CWC meeting of AIBSNLEA. He told that 19% area of Uttrakhand is covered by the snow and 45% is wild life area, and in this area we are successfully giving telecom services. He praised GS AIBSNLEA for excellent speech and good deliberations. He stressed that we should end the position of the cash crunch in the field. We should strengthen our customer base. He highlighted that we should reach to our customer either it is a big customer or small customer. We should not think for our personal benefits but should think for the benefits of the Organization. Thanked for inviting and wished for the success of the Open Session.

Shri A.K.Sinha DGM (SR) BSNL Corporate Office thanked the AIBSNLEA for the invitation. Extended his best wishes for the successful CWC. Director HR has also wished for the success of the CWC. He also read out the message of the Director (HR) for the CWC meeting. In the message Director (HR) congratulated the newly promoted Officers and wished that the CWC will come with the good deliberations for the growth of the company. At last Shri A.K.Sinha thanked for inviting and wished for the success of the Open Session.

The Chief Guest of the Open Session, Shri Mahak Singh, CGMT Uttrakhand Circle in his address welcomed all the distinguished guests in Devbhumi Uttrakhand and wished for the successful CWC. He told that we should see that what we can do the best for the company. He told that the utilization of the Human Resource Management is at most necessary. He thanked GS AIBSNLEA for praising the Executives of Uttrakhand Circle. He told that out of 6, three are hilly SSA in which there is a great public dependency on BSNL. He told that Uttrakhand Circle has got 3 awards for EB Business, No. of Sale Points and Fastest response on twitter category.  Shri Mahak Singh told that in Aseem plan and in plan 99 we are trying to connect with our old customers. And for this category Circle has also received the appreciation letter from CMD BSNL. Apart of this in Landline, Broadband category Uttrakhand is in top 5 cities. Uttrakhand has achieved more than the target assigned. Uttrakhand Circle is in 7th Rank in recovery.

Shri Mahak Singh told that in the Uttrakhand Circle the transfers from the hilly area have been executed in a rotational manner to best utilize the man power. He suggested that we should focus the services which are in trend to enhance the revenue. He told that the data consumption rate has been increased and BSNL has introduced the GB plans. We should spread our FTTH network in big cities for earning the better revenue. He also suggested tying up with Multi service cable operators for this purpose and BSNL Corporate Office is fully supporting the Circles. BSNL Corporate Office suggested reducing the loop length of DSLAM for the better BB services. He told that we have achieved good revenue from BTS sharing and there is very small dip in the revenue due to this. He told that the demand of the BSNL services are very much in Rural areas. We should also lease out our OFC. He also suggested to explore the Civil/Electrical work possibilities in the smart city project. We have increase the commission of the Channel Partners. He opined to explore the talents of the Direct recruits. He told that we have increased the GSM data speed and JIO has put a very less negative effect in Uttrakhand Circle. He suggested to take up the challenge and make intact the customer base in the competitive scenario. Thanked for inviting and wished for the success of the Open Session.
