03.03.2014:Report of Special General Body Meeting held on 26th February 2014 at Telecom Factory,BRBRATTC Jabalpur ,T&D Circle & GMTD Jabalpur Branch: Special General Body Meeting of Telecom Factory Jabalpur was held on 26th February 2014 in the conference hall of Telecom factory, GS Com.Prahlad Rai along with Circle President M.P.Circle Com H.M. Bajpai, Circle Secretary Md. Parwez Khan, Circle Treasurer Com Amar Singh attended the meeting. Meeting was attended by all the executives of Telecom Factory.GM TF Com.& Shri Jaswant Singh President TF Branch & Shri Narender General Manager Telecom Factory were present. Branch Secretary Com.S.M.Prasad outline the issues of Telecom Factory .Circle President MP Circle Com. HM Bajpai in his address give stress on the fourth coming membership verification. & appeal to work hard for it.In his address Circle Secretary Com. Parwez Khan advocated the demand of Secretary TF for considering the demand of Branch Secretary TF in respect of HR issues. He also appeal the members to work hard for the viabilty of BSNL,he also out line the views of GS in respect of functioning of Telecom Factory. He appreciated the concern of GS in respect of Telecom Factory. His views that before out sourcing, Telecom Factory should be given opportunity to carry out the manufacturing the work of BTS Towers, Sim Cards, Telephone Instruments, Power Plant Battaries etc.

Com  Prahlad Rai GS, AIBSNLEA, CHQ  addressed and briefed on going activities related to CPCs of various disciplines . He informed regarding  promotion orders to fill up about 26 SDE's (TF) posts, from JTO (TF) to SDE (TF).He also explained about E-2 & E-3 IDA pay scales and resolution of 2007 and 2008 batchs pay anomaly. details regarding the viability of BSNL i.e. payment of spectrum charges (3G & BWA) of Rs 18500 crores, non reimbursement of OPEX charges, withdrawal of ADC, payment of interest @ 14.5% on notional loan of Rs 7500 chores etc. He further informed that BSNL is spending more than 9000 crores in maintenance of all the 28000 rural exchanges in India. He explained the efforts made by BSNL Unions/Associations in getting approval of refund of Rs 6724 crores of BWA spectrums and made appeal to all the members to support actively during membership verification and try to make AIBSNLEA a number one executive association. In reference to the   Implementation of Assured Executives Promotion Policy in BSNL & Implementation of CPSU cadre hierarchy he also informed that we are demanding Change of designations on each Time Bound up gradation on functional  First time bound promotion on 1-10-2004 after completion of four years w.e.f. 1-10-2000 in all the cases. BSNL Management has granted benefit of residency period w.e.f. 1.10.2000 to the Executives i.e. JTO/SDE (Civil/Electrical/Arch./TF) Engineering wings, CSSs, PAs/PSs, JAOs etc. for whom the RRs were notified after 1.10.2000 and accordingly the pay scales were upgraded. Whereas, as per Dr. Vinay Shahi's Committee recommendations the upgraded scales for the above executives' should have been implemented w.e.f 1.10.2000 on actual basis or notional basis. Recently, notional pay fixation from 01.10.2000 in the upgraded pay scales has been allowed to JAOs. Similar treatment is required to be given to JTO/SDE (Civil/Electrical/Arch/TF.) engineering wings and PAs/PSs cadres. GS also explained the case of Settlement of Pay anomaly cases wherein senior Executives are drawing less pay than their juniors & give the latest position in this respect.GS inform the house regarding Amendment in BSNL MSRRs allowing Diploma holders to the promotion of Executive Engr. (Civil/Electrical) wings at par with other discipline of executives.

In addition to this, in the Architecture discipline, having valid registration as Architect with the council of the Architects is made compulsory, which is gross injustice CPSEs  to the absorbed Executives of Arch Engineering wings in BSNL. GS Inform that as per Recommendation of 2nd PRC, DPE has issued order to all wherein it is clarified that there is no justification for introducing intermediary pay scales. In BSNL the Executives of JTO/SDE level are placed in the lower pay scales against their standard IDA pay scales E2 to E3. Almost all the Oil sector, Steel Sector and Power Sector PSUs including MTNL are already adopted the entry level Executives' pay scale starting from E2 scale. The demand to place JTOs and SDEs in standard pay scales of E2 and E3 is very legitimate.

BSNL Management is not at all serious to introduce CPSU cadre hierarchy and implementation of E-2, E-3 IDA pay scales for JTO & SDE equivalent executives. The Joint Committee of BSNL officers headed by PGM (SR), BSNL CO, New Delhi and the representatives of BSNL Executives Associations was constituted in Feb-2012 to discuss and submit its report on both the issues within a period of six months but even after a laps of two years, no serious discussions has taken place in the Committee Meetings. Executive Associations has already submitted their unanimous opinion/ suggestion on CPSU Cadre hierarchy but the Management side has not started discussion on this. GS also replied the queries of members. Meeting ended in a full satisfaction of members & slogans of gathering.

Meeting at TTC Jabalpur:

In his second assignment GS reached AB Hall BRBATTC Jabalpur to address the trainees who were in ongoing training from TTA to JTO.The hall was jam packed to cpacity.The trainees were from Madhya Pradesh, Bihar & Gujrat. The office bearers of BRBRATTC Jabalpur,District Secretary GMTD Jabalpur Shri P.S.Rathore,CWC Member Kailash Nayak, Branch Secretary TF Shri Prasad were also present. GS Shri Prahlad Rai,Circle President BRBATTC Shri Pagare,Circle President MP Shri HM Bajpai, Circle Secretary MP Shri Parwez Khan were welcomed by the organizers. The Stage was also shared by All India SANATTA President Shri Manish Samadhiya, there CHQ Office Bearer Tejas Tadsare ,Central Co-coordinator Shri Yogesh Bakshi,Circle secretary MP Shri Siraj Qureshi, Circle Secretary Bihar Shri Shehnawaz Akhtar,Circle Secretary Gujrat Shri Sandeep Solanki, MP Circle Coordinator Shri & ADS GMTD Bhopal Shri Ravi Krishnan. CWC Member AIBSNLEA Shri Kailash Nayak Welcomed the young JTO's & Garland them. CP BEBATTC Shri  Pagare presented the welcome Speech CP MP Circle Com. HM Bajpai in his address out line the functioning of AIBSNLEA & appeal to join & strength the hands of AIBSNLEA in the coming membership verification. In his address Com. Manish Samadhiya appreciated the efforts made by AIBSNLEA & its GS Com. Prahlad Rai in respect of justified demands of BSNL recruits TTA's. He raised the issue of  Superannuation Benefits, EPF issue of Direct Recruited Employees of BSNL.He also demand 2 Extra increments at the time of promotion. In his address GS Com.Prahladh Rai give the details how AIBSNLEA was formed by the merger of 11 cadre Associations. AIBSNLEA is the only association who raise the issue of all the executive cadres of BSNL. He replied to the points raised by Com.Samadhiya and informed that regarding Superannuation benefits to directly recruited employees as per DPE guidelines. This Association has already submitted its crystal clear views about the issues related to provisions of Superannuation Benefits to directly recruited employees. He informed the house that We requested BSNL Management to resolve superannuation benefits to directly recruited employees as per DPE guidelines. BSNL should contribute 12% as Superannuation Benefits in respect of Direct Recruits, to fulfill the limit of 30% contribution and the effective date of implementation of Superannuation benefits of BSNL Recruited Employees must be 01.01.2007.

This Association has already submitted its crystal clear views about the Early Resolution of EPF anomalies with serious discrepancies in respect of Direct Recruited Employees of BSNL in its letter dated 30.01.2014.GS explained that Yearly EPF statement is being supplied to BSNL recruited Executives in response to our detailed letter and we are continuously monitoring the same. We requested Director (HR/EB) to resolve EPF issue for BSNL recruited JTOs at the earliest. GS appreciated the contribution of TTA's in BSNL & welcome them to the Executive cadre. He appeal them to work whole heartedly for the viability of BSNL,the need of the hour for young generation to contribute to uplift BSNL from the present crises.He appeal them to strength the AIBSNLEA as this is the only association who care for every cadre, they can use this establish platform & fight untidily  for their genuine demands. He gave the proposal to the office bearers of SANATTA to attend CWC, CEC as special invitee. Shri S.K.Jain presented vote of thanks. By National Anthem the meeting was ended. The programme was conducted by CS MP Circle Shri Parwez Khan. His 'shayri' give pleasant effect & every enjoyed it.

Special meeting of T&D Circle and GMTD Jabalpur Branch:

In the evening GS addressed the Spl.GB of T&D Circle & GMTD Jabalpur branch in the seminar hall of T&D Circle. Large number of members attended the meeting.Shri N.D.Gupta President T&,D Branch.Branch Secretary Shri Rhul Dongre were present. Direct recruit JTO Shri Pradeep Chourasey, Shri Piyush Soni & Shri Praveen Kumar actively participated in the meeting & gave useful suggestions. The meeting was anchored by Organising secretary T&D Circle Shri D.K.Khare. GS thank the organizers for conducting the very successful programme in a very short notice. In the evening GS return back to CHQ.

28.02.2014:The demonstration on 28.02.2014 on the call of Forum of BSNL Unions/Associations are successfully organised through out the country. Com. GS along with Advisor CHQ Com. Karan Singh, Com. Bhagwan Singh, Auditor(CHQ), Com. H.L. Awasthi, Circle President and Com. M.K. Morodia, Circle Secretary, Rajasthan Circle and other Circle Office Bearers attended & addressed the Demonstration at Jaipur, Rajasthan, demanding immediate settlement of HR issues, Pension and Disinvestment before merger of BSNL and MTNL.  

Com. AGS(HQ) along with other CHQ Office Bearers, Circle Secretaries Delhi Circle and BSNL Corporate Office  also attended and addressed the Demonstration at BSNL Corporate Office, New Delhi. Further course of actions will be decided in the Forum Meeting on Monday.  <<<Click here for glimpses>>>>

28.02.2014:Meeting with GM(Estt.), BSNL CO, New Delhi on dated 25.02.2014: GS & AGS(Fin.) met GM(Estt.) and discussed regarding

(i) Consideration of request transfer cases of DR JTOs from Hard tenure Circles i.e. NE, Assam, J&K, A&N Circles and from deficit Circles i.e. Gujarat, Punjab Telecom Circles etc. GM(Estt.) mentioned that shortly, the details of DR-JTOs requests from these Circles will be taken and on joining of new JTOs from TTAs on promotion their requests of transfer under Para-8 or deputation will be considered.

(ii) Regularization of Offg. JTOs & framing of JTO RR-2014: We requested for an early action on regularization of Offg. JTOs by framing JTO RR-2014 wherein the clause on seniority fixation should also be incorporated. GM(Estt.) mentioned that to finalize the JTO RR-2014, Committee meeting is schedule to be held on 3rd March-2014 wherein introduction of seniority clause will also be considered.

28.02.2014:

(i) CPC from SDE(T)/DE(Adhoc) to DE(Regular) : VCRs for vacancy year 2013-14 for regular AGM/DE(T) called for as a preparatory work:  <<<Click here for list>>>

CPC from DE to DGM(Adhoc) and DGM(Adhoc) to DGM(Regular) : It is understood that the VCRs for majority of the officers to fill up 480 DGM (T)(Adhoc) posts has been received and only few i.e. 25-30 Nos VCRs are awaited and the same  is under updation. After updation, the leftover will be intimated by shortly.

The proposal to initiate CPC from DGM(Adhoc) to DGM(R) is being sent to the competent authority for approval shortly.

25.02.2014:2nd Circle Executive Committee (CEC) Meeting of AIBSNLEA Gujarat Circle  and Bi-annual General Body Meeting of Ahmedabad Telecom District branch held  on 22.02.2014 at Sardar Patel Hall, Jilla Panchayat Bhavan, Ahmedabad : The 2nd Circle Executive Committee (CEC) Meeting of AIBSNLEA Gujarat Circle  and Bi-annual General Body Meeting of Ahmedabad Telecom District branch was  held  on 22.02.2014 at Sardar Patel Hall, Jilla Panchayat Bhavan, Ahmedabad in a grand manner.

 

The meeting was attended by Circle Office bearers, CWC Members, Advisor,  and Branch Presidents and Secretaries of   Gujarat. Our dynamic and beloved leader Shri Prahlad Rai GS CHQ, Shri C.M. Saste, Organization Secretary (West) CHQ and Shri M.M. Kanani Advisor CHQ also  graced the  occasion.

 

Shri R.C. Dhala, Circle President welcomed the Chief Guest, Guests of Honour, CHQ leaders and all the delegates. He briefed the members the status of Revenue in Gujarat Telecom Circle, association activities and took the points as per agenda.  Shri R. M. Belani, Circle Secretary  in his speech, heartily welcomed the members and also newly joined members, and requested to work together actively in the interest of all disciplines of cadres and briefed activities related to HR and general issues taken up  with CGMT, Pr. GM(Fin.), GM(HR/Admin) and Pr. GM  Ahmedabad  and  with SSA Heads during the period.  

 

All the Branch Secretaries also submitted their branch reports  and submitted  the pending  present  issues to be taken-up at Circle as well as CHQ level.  

 

Shri T. Raja, Finance Secretary requested all branches to ensure collection of subscription for CHQ & Circle Quota in time.

In CEC, it was discussed on unnecessary harassment meted out to executives by creating fear of transfer etc. in Vadodara SSA on the pressure of representatives and leaders of other rival association. We have informed to take up such activities of other association in the notice of Pr. GM Vadodara for the immediate action and safe guard of executives without anybody favour in the interest of BSNL and stop the facilities availing for such activities.  Our CHQ leaders also viewed seriousness of such activities and suggested for immediate action to stop it by SSA head without any fear and same to be followed in all SSAs. The issue was noted seriously and resolved to fight the case at appropriate authorities including at CHQ level, if needed.

 

Com. C.M. Saste, O S (West) CHQ graced the occasion and in his address he assured to look into reported issues related to Gujarat Executives at CHQ level and viewed in all seriousness of rival association leaders on undesirable actions in Vadodara SSA and informed all executives to contact him any time for cadre related issues and appealed to all members to increase the membership and support actively during membership verification and try to make AIBSNLEA number one position.

 

OPEN SESSION

During the open session, Shri B.K. Sinha CGM Gujarat Circle, Shri Balraj, PGM Ahmedabad Telecom District, Shri P.B. Parmar General Manager (Fin) graced the occasion and addressed the gathering. During his speech, CGMT appreciated the efforts taken by Com. Prahlad Rai GS for guarding the interest of executives and the development issues of BSNL.  CGM emphasized the  need  to work  together  among all disciplines of cadres in the interest of  BSNL and take responsibility  of work to increase in  revenue  particularly in  broadband  and land line segment. Our staff should be alert when our cables are damaged by keeping proper coordination with Local authorities.

 

Shri Balraj, PGM Ahmedabad Telecom District, in his address requested the executives to attend the problems presented by customers promptly in field units and in CSCs.

 

Shri P.B.Parmar GM (Finance) Gujarat Circle, also addressed the meeting and touched various revenue matters and urged the members for increase the revenue collection of billed amount.

 

Com  Prahlad Rai GS, AIBSNLEA, CHQ  addressed and briefed on going activities related to CPCs of various disciplines  and updated the status of court cases   pending in various courts relating to various cadres. He also explained the   efforts made for direct recruited JTOs/JAOs in settlement of EPF, Superannuation benefits, E-2 & E-3 IDA pay scales and resolution of 2007 and 2008 batchs pay anomaly. He also explained the efforts made for grace marks for JAO Part II exam & option for pay fixation of JAO's from 07/05/2010 and details regarding the viability of BSNL i.e. payment of spectrum charges (3G & BWA) of Rs 18500 crores, non reimbursement of OPEX charges, withdrawal of ADC, payment of interest @ 14.5% on notional loan of Rs 7500 crores etc. He further informed that BSNL is spending more than 9000 crores in maintenance of all the 28000 rural exchanges in India. He explained the efforts made by BSNL Unions/Associations in getting approval of refund of Rs 6724 crores of BWA spectrums and made appeal to all the members to support actively during membership verification and try to make AIBSNLEA a number one executive association. On this occasion, the bi-annual G.B. meeting of Ahmedabad Telecom District also took place.   Com.  C.M. Saste, O.S. (West) CHQ   guided the proceedings.  Shri S.R. Mishra AO (Cash) RLP, Shri  N.P. Patel DE (Extl), NVP and  C.K. Patel  JAO elected as President ,District secretary and Fin. Secretary respectively.

24.02.2014: AIBSNLEA meeting with BSNL management in response to our letter dated 19.02.2014:GS, FS, AGS (HQ) and OS (North) attended meeting with BSNL Management in response to our letter dated 19.02.2014 on long pending HR issues. GM (SR), GM (Pers.), GM (Estt), GM (Restructuring), GM (EF), DGM (Pers.), DGM (SR) and AGM (Pension-Estt. Cell) were present in the meeting. GM (SR) welcomed the Association representatives in the meeting and mentioned that management is inclined to settle the issues and proposed to hold the regular meetings to reduce the number of pending issues. GS thanked for arranging the meeting and initiated discussions on the HR issues as under:

1.   Implementation of Assured Executives Promotion Policy in BSNL

a. Implementation of CPSU cadre hierarchy- Change of designations on each Time Bound upgradation on functional basis. First time bound promotion on 1-10-2004 after completion of four years w.e.f. 1-10-2000 in all the cases.

We have already given the detailed letter on this issue on 20.12.2013. On each time bound upgradation to the next higher grade, the designation and the duties/ responsibilities associated with the grade should also be changed as assured at the time of absorption to the Gr.'B' officers in BSNL i.e. "Non post based time bound promotions upto SG JAG level grade and post based promotions after SAG level post ". Also first time bound promotion on 1-10-2004 after completion of four years w.e.f. 1-10-2000 in all the cases.

Reply: GM (Restructuring) mentioned that a draft proposal in this regard has been prepared and in the next week the same will be circulated to Executives Associations for discussion in the meeting. We mentioned that United Forum has already submitted common proposal on this issue but it has not been discussed in detail and management has started discussion on the CPSU Cadre hierarchy of other PSUs, BHEL, NTPC, ONGC etc. We pleaded that BSNL is a PSU converted from a Govt. Department; it has executives absorbed from DoT and BSNL recruited. Hence, after detail discussions the United Forum has submitted the proposal for consideration. GM (Rstrg) assured that shortly matter will be discussed.

Recently, notional pay fixation from 01.10.2000 in the upgraded pay scales has been allowed to JAOs. Similar treatment is required to be given to JTO/SDE (Civil/Electrical/Arch.) engineering wings and PAs/PSs cadres.

Reply: We further pleaded that notional pay fixation of pay w.e.f. 01.10.2000 should be implemented to JTO/SDE (C/E/Arch) Engineering wings and PAs/PSs cadre as already implemented for JAO cadres. GM (Pers.) assured to examine the case at the earliest.

c.  Settlement of Pay anomaly cases wherein senior Executives are drawing less pay than their juniors:

Committee headed by PGM(FP) submitted its report and denied stepping up of the pay of seniors w.r.t. their juniors as per the provision of EPP and also did not consider the advice of Hon'ble CAT Ernakulam, bench O.A. NO. 109 of 2011 with O.A. No. 110/2011 and 236/2011 judgment dated 07.12.2011 in the Seniors (SDEs promoted as adhoc DEs before getting the second TBP ) getting less pay than Juniors ( SDEs promoted as adhoc DEs after getting the second Time Bound Promotion ) case :  "The respondents are directed to step up the pay of the applicants to the level of pay of their juniors with effect from the date of arising of the anomaly of seniors drawing less pay than their juniors in respect of each of the applicants within a period of 3 months from the date of receipt of a copy of this order. However, this order will not stand in the way of the Committee set up to deal with the issue under consideration in these O.As, giving a more beneficial recommendation for the applicants."

BSNL CO, Pers. Cell appeal against above judgment has been dismissed by Hon'ble High Court Kerala at Ernakulum i.e. "Hon'ble High Court of Kerala has dismissed the petitions OP CAT 1576,1560 & 1592 of 2012 filed by BSNL against the order of Hon'ble CAT Ernakulum in OAs 109, 110, 236 & 241 of 2011(filed by Sethumadhavan & others) which directed BSNL to fix the pay of the seniors at par with the juniors drawing more pay. The Hon'ble Court also observed the unconstitutional part of the condition incorporated in the pay fixation criteria which prohibits complaining against anomalies. Court also commented that such condition is very primitive and against the fundamental rights. As the applicants in the OAs have already filed petition for contempt of court against BSNL, the Hon'ble Kerala High Court allowed three months' time for BSNL to implement the orders passed by CAT" but BSNL first filed SLP in the Hon'ble Supreme Court in this regard denying its implementation but later on Hon'ble Kerala High Court judgment is implemented for the applicants. We request to extend the same treatment to similar executives.

Reply: We pleaded for the implementation of Hon'ble Kerala High Court Judgment to all affected executives by allowing stepping –up of pay under EPP. GM (Pers.) mentioned that BSNL has implemented Hon'ble Kerala High Court judgment for the applicants and has filed SLP in the Hon'ble Supreme Court. However, he assured to make efforts for early hearing in the case. AIBSNLEA has already filed application for impleadment in the case. We further, pleaded to generalize the Hon'ble Kerala High Court judgment.

d.  Amendment in BSNL MSRRs allowing Diploma holders to the promotion of Executive Engr. (Civil/Electrical) wings at par with other discipline of executives.

As per the BSNLMSRRs, the existing JTOs/SDEs (C/E/Arch) Engineering wings having diploma qualification were not eligible to be promoted to the grade of Assistant General Manager/EE/Arch. and against the DoP&T guidelines & CPWD RRs wherein Diploma holders are also allowed to be promoted to the grade of EE (C/E/Arch). AIBSNLEA strongly protested against this discrimination and demanded to remove discrimination on the pretext of degree/diploma qualification to the promotion of EE from SDE (C/E/Arch) and parity with the JTO (T) / SDE (T) as per BSNL Board decision.

In addition to this, in the Architecture discipline, having valid registration as Architect with the council of the Architects is made compulsory, which is gross injustice to the absorbed Executives of Arch Engineering wings in BSNL.

Reply: We pleaded for giving parity to JTO/SDE (C/E/Arch) with JTO/JAO and SDE/AO cadres in the promotional avenues as assured at the time of absorption by amending the BSNLMSRRs. GM (Pers.) mentioned that a draft proposal has been prepared by PGM (BW/EW) and is now being sent to the competent authority to put up in the BSNL Management Committee and BSNL Board for approval. We requested for an early decision so that about 50 EEs (E) and 100 EEs (C) vacant posts may be filled up. They further assured an early action in this regard. Regarding validity of degree from Distance Education, Committee meeting is being held tomorrow morning at 11.00 AM.

2.    Implementation of E-2, E-3 IDA pay scales for JTO/JAO & SDE/AO equivalent executives in BSNL.  AIBSNLEA has taken the issue many times and recently provided the letter on 20.12.2013 on the issue. As per Recommendation of 2nd PRC, DPE has issued order to all CPSEs vide Letter No. 2(70)/08-DPE(WC)-GL-VII/09 dated 02/04/2009 wherein it is clarified that "There will be no change in the ten pay scales of below board level posts as indicated in OM dated 26/11/2008 and there is no justification for introducing intermediary pay scales. In BSNL the Executives of JTO/SDE level are placed in the lower pay scales against their standard IDA pay scales E2 to E3. Almost all the Oil sector, Steel Sector and Power Sector PSUs including MTNL are already adopted the entry level Executives' pay scale starting from E2 scale. The demand to place JTOs and SDEs in standard pay scales of E2 and E3 is very legitimate.

No intermediary scales have been permitted under DPE O.Ms. dated 26.11.2008 and 02.04.2009. Generally, promotion has to be from one ‘Grade'to next higher ‘Grade'with its corresponding scale as per the promotion policy of respective CPSEs. A CPSE cannot have more than one pay scale in a grade (say DGM & GM in E8 pay scale) to promote its executives within the same grade". Ignoring the DPE O.Ms. on implementation of 2nd PRC recommendation for standard pay scales E-2 & E-3 for JTO/SDE equivalent executives, BSNL Management is continuing efforts to implement E1A & E2A intermediate IDA pay scales in BSNL for JTO/SDE equivalent executives, which is not at all justified. In view of this, standard IDA pay scales E-2 & E-3 as recommended by 2nd PRC are to be implemented in BSNL for JTO and SDE equivalent executives to provide justice. 

BSNL Management is not at all serious to introduce CPSU cadre hierarchy and implementation of E-2, E-3 IDA pay scales for JTO & SDE equivalent executives. The Joint Committee of BSNL officers headed by PGM (SR), BSNL CO, New Delhi and the representatives of BSNL Executives Associations was constituted in Feb-2012 to discuss and submit its report on both the issues within a period of six months but even after a laps of two years, no serious discussions has taken place in the Committee Meetings. Executive Associations has already submitted their unanimous opinion/ suggestion on CPSU Cadre hierarchy but the Management side has not started discussion on this. Similarly, E-2, E-3 standard IDA pay scales implementation case has so far not even discussed in any meeting. It clearly shows the ignoring attitude of the BSNL Management.

Reply: GM (Estt) mentioned that a proposal for E-1A & E-2A IDA pay scales for JTOs/SDEs equivalent cadres  has been sent to DoT to get approval from DPE and shortly, the decision is expected. We mentioned that intermediate IDA pay scales E-1A and E-2A had been rejected twice from DoT and now again DoT will reject the proposal since DPE has not allowed creation of intermediatory pay scales. GM (Estt) mentioned that E-1A and E-2A IDA pay scales earlier were approved by DPE only and now DPE should only suggest the replacement scales of these E-1A and E-2A scale in 2nd PRC recommended scales. He further mentioned that now DoT has assured to take up the matter with DPE to get settled. However, we strongly demanded implementation of standard IDA pay scales E-2 and E-3 for JTO/SDE equivalent executives.

3.     Pay anomaly in the pay of JTOs of 2007 and 2008 batches (recruited after 01.01.2007)

AIBSNLEA has submitted its view on this issue in its letter dated 20.01.2014. Around 5000 talented Direct Recruit JTOs have joined BSNL after 1.1.2007 in JTO 2007 and 2008 batch. They are demoralized and frustrated due to a large difference of around Rs 3500/- in basic pay as compared to the JTOs recruited prior to 01.01.2007. At the time of their recruitment, it was advertised that their pay will be fixed in E1A pay scale, but it is unfortunate that their pay was later fixed in revised E1 scale.

It is worthwhile to mention here that a committee was constituted under the Chairmanship of Shri K C G K Pillai, the then PGM (FP) to find out the possibilities to overcome the situation of the pay loss to 2007 and 2008 batch JTOs/JAOs. The committee was in favour to recommend standard pay scales i.e. E2 for JTO/JAO and E3 for SDE/AO, but the committee recommend provisional pay of E1+5 increments only due to possible enhancement in pension contributions in that situation. Management has extended the E1+5 increments of JTO 2007 and 2008 batches but it is definitely not a permanent solution. The pay differences between the JTOs recruited after 01.01.2007 and their counterparts who joined before 01.01.2007 will boost up largely in 3rd PRC in 2017.

DoT has rejected the proposal of BSNL Management for Intermediary pay scales of E1A and E2A for the JTO/JAO, SDE/AO equivalent cadres. It is pertinent to mention here that as per the recommendations of 2nd PRC, DPE has issued orders to all CPSEs vide Letter No. 2(70)/08-DPE(WC)-GL-VII/09 dated 02/04/2009 wherein it is clarified that "There will be no change in the ten pay scales of below board level posts as indicated in OM dated 26/11/2008 and there is no justification for introducing intermediary pay scales. DPE has provided the guidelines that all CPSUs should switch over to standard pay scales recommended by 2nd PRC. It is pertinent to mention here that many PSUs in Oil, Power and Electrical sectors including the MTNL have already switchover to the new standard IDA pay scales w.e.f. 01.01.2007 as per the guidelines of DPE.

4.   30% Superannuation benefits to directly recruited employees as per DPE guidelines.

This Association has already submitted its crystal clear views about the issues related to provisions of Superannuation Benefits to directly recruited employees in its letter dated 20.12.2013.We requested BSNL Management to resolve superannuation benefits to directly recruited employees as per DPE guidelines. BSNL should contribute 12% as Superannuation Benefits in respect of Direct Recruits, to fulfill the limit of 30% contribution and the effective date of implementation of Superannuation benefits of BSNL Recruited Employees must be 01.01.2007.

As per DPE OM 26.11.2008, CPSEs would be allowed 30% of Basic Pay as Superannuation benefits. So, BSNL should contribute at the rate of 12% Basic plus DA on monthly basis and 8.33% Contribution of BSNL and 1.16% of Government to EPS Fund should be continued. Further, as per DEP OM dated 24-1-2013, it has also been clarified that DEP OMs do not provide for mandatory contribution on the part of employees and suggested that employees contribution to their post retirement benefit would enhance their social security and therefore CPSEs can frame scheme as per their requirement. We suggest that the employee contribution in this respect should not be taken mandatory.

Recently BSNL Management has organized a meeting on 15.01.2014 with all the Unions/Association on this issue and insisted for providing only 2% additional contribution as superannuation fund. But all the Unions/Association including AIBSNLEA has submitted their crystal clear stand for providing the remaining 12% contribution as superannuation fund only.

Reply: GM (SR) mentioned to re-examine both the issues at Sl. No. 3 and 4, a high level (HLC) committee has been constituted under the Chairmanship of ED (Finance). The committee will shortly take feed back from the Executives Associations and submit the report at the earliest. We further demanded 12% BSNL's contribution Basic + DA as per DPE guidelines towards superannuation benefits of BSNL recruited employees.

5.  Early Resolution of EPF anomalies with serious discrepancies in respect of Direct Recruited Employees of BSNL.

This Association has already submitted its crystal clear views about the Early Resolution of EPF anomalies with serious discrepancies in respect of Direct Recruited Employees of BSNL in its letter dated 30.01.2014. 

Yearly EPF statement is being supplied to BSNL recruited Executives in response to our detailed letter and we are continuously monitoring the same. We requested Director (HR/EB) to resolve EPF issue for BSNL recruited JTOs at the earliest. GM (Estt.) & GM (CA) met EPF Authorities to centralize the EPF accounts online. EPF authorities clarified that EPF account of employees has been centralized at Regional Level and efforts are being made to centralize it on All India level shortly.   But even after a lapse of one year the EPF is not centralized. Hence, BSNL should centralize the EPF. Para-32 of EPF Act clearly stipulates that "no past contribution can be recovered from current salary of the employees, past arrear if any shall be paid by employer in respect of both the contribution". But in many field units in BSNL the past contribution has been recovered from current salary of the employees. A clarification may be issued to field units regarding the same including the refund of the already recovered amount.

BSNL has neither contributed for the diet allowance, nor for the stipend for the period of training, inspite of the mandatory provision of EPF Act. An order in this regard may be issued from BSNL CO for making both the contributions. BSNL Field units (except BSNL CO) are not providing the display of monthly EPF statement to the employees; Due to this the employees are unaware with their actual contribution and relevant shortcomings. Strict instructions may be issued to field units for providing regular EPF statement. The EPF slips are issued with a great delay by EPF authorities. Instructions may be issued to the all concerned IFAs to persue the same with EPF authorities to avoid the said delay.

Reply: GM (SR) assured that all the circles will be asked to maintain proper EPF account of BSNL recruited employees. Already an EPF cell has been operated in BSNL CO under GM(CA).

6.    CPCs to fill up the vacant PGM/GM/DGM (Engg.)/DGM(Fin), DE/CAO,SDE(T)/ AO equivalent posts in BSNL on Adhoc/ Regular basis.

A good number of PGMs/GMs/DGMs/DEs/SDEs equivalent posts are lying vacant since long. It is adversely affecting the viability of BSNL and causing stagnation in the career prospects of executives. Hence, immediate CPCs to be conducted to fill up all vacant Group -‘A' and Group-‘B' level posts.

Reply: CPCs from JAO to AO., AO to CAO, CAO to DGM (Adhoc) and DGM (Adhoc) to DGM (Regular), GM (SR) mentioned that as per the status report given by GM (FP) the CPCs from AO to CAO, CAO to DGM (Adhoc) and DGM (Adhoc) to DGM (Regular) are in progress. VCRs are being collected to expedite the CPCs. Regarding the CPC to fill up 1800 AOs posts, Director HR) has given the approval to initiate CPC from JAO to AO. The clarification on SC/ST roster implementation as per Hon'ble CAT Chandigarh judgment is being asked from DoP&T through DoT. The discussions on CPCs from JTO to SDE (T), SDE to DE (T) and DE to DGM (T), SDE (C/E) to EE (C/E) will be held in the next meeting.

11. Antedating of pay - anomaly due to accrual of increment of Junior earlier than the senior after fixation of pay in revised pay scale implementation of 2nd PRC.

We requested to BSNL Management to restore the original order dated 23.09.2009 wherein provision for ante-dating the increment of the senior to that of the junior was envisaged. Alternatively, management can think of any other solution that will address the issue of anomaly wherein the junior does not draw more pay than the senior and also the senior does not face any drop in his basic pay which he/she will be drawing by virtue of the 3% annual increment provided in the rule.   

Reply: We pleaded that BSNL CO's initial order on antedating of DNI was correct but later on it has been withdrawn and a wrong clarification has been issued herein senior executives are put in loss. GM (Estt.) and GM (EF) assured to have separate discussions on this issue with certain examples wherein seniors are at loss on revised order. Shortly a separate meeting will be held on this issue with GM (Estt) and GM (EF).  

The meeting ended at 18.30 Hrs with an assurance by GM (SR) to discuss further pending items of our letter dated 19.02.2014 at the earliest. After, the completion of discussions on all the items and observing the concern of BSNL management, we will decide further course of action.

13.       Two weeks of training to executives whose pay is upgraded and on every promotion under EPP.

14.       Inordinate delay in settlement of disciplinary cases.

15.       Modifications in Executives Transfer Policy for soft tenure stations.

16.       Recruitment of JTO (E)/ JTO (TF) from TTAs cadre through LDCE.

17.       Improvement in the revised policy for service GSM, RSTC & Broadband to Executives.

21.02.2014:GS, AGS (HQ) met GM (Estt.) and discussed:-

(a) Regularization of officiating JTOs: We requested for an early action on regularization of officiating JTO's. GM (Estt.) mentioned that on 03.03.2014, the committee is going to meet to discuss and finalize the proposed modification in the JTO RR 2001. The committee report will be submitted immediately to management committee for approval. We further requested that in the JTO RR-2014 the provision of fixing seniority should also be incorporated. GM (Estt) assured top look into.

(b) 3% pay fixation in the lower / old scale and 3% pay fixation in the higher grade on promotion:  GM (Estt.) mentioned that the case had been referred to the Director (PSU) of DOT for clarifications on DPE guidelines. He assured to further pursue with Dir (PSU) for sending the clarifications at the earliest.

(c) Case of Double HRA at Andaman & Nikobar and Shillong etc: GM (Estt.) mentioned that the case had been referred to the Director (Estt) of DOT. He assured to further pursue with Dir (Estt) for issuing necessary guidelines in this regard.

(d) Compassionate Ground Appointment Cases: GM (Estt.) mentioned that the revised norms for deciding the eligibility regarding the Compassionate  Ground Appointment (CGA) are being finalized and after getting the approval from the management, these will be circulated to the filed units.

21.02.2014:GS, AGS (HQ), AFS met PGM (EW) and discussed regarding the CPC from SDE (E) to EE (E).  PGM (EW) mentioned that the proposal to fill-up the vacant posts of EE (E) has been sent to the competent authority through GM (Pers.) for according the approval. The CPC will be initiated immediately on receipt of the approval.

(a)   Erroneous implementation of EPP to DGM (Adhoc): we impressed upon for early issuance of clarification on implementation of EPP w.r.t. DGM (Adhoc) for granting E-6 -IDA scale. GM (Pers.) assured to look in to the matter.

(b)   Non settlement of the pending issues i.e. Creation of PPS posts, Restructuring of AD (O/L) cadre, CPCs from JTO to SDE, SDE to DE and DE to DGM posts, Amendment in BSNL MSRRs allowing Diploma holders to the posts of EE (C/E) wings etc: GM (Pers.) mentioned that all these issues status is known but he will like further to discuss in the meeting being held on 24.02.2014.

20.02.2014: GS, AGS (Finance) and CS TN Circle met GM (FP) and discussed regarding-

(a) CPC from JAO to AO: GM (FP) mentioned that today he has received the approval from Director (HR) to initiate the CPC from JAO to AO and to immediately seek clarification from DoT on Hon'ble CAT Chandigarh judgment on SC/ST roaster implementation. He mentioned that shortly SEA cell will issue instructions to the circles to conduct screening of ACRs/VCRs and thereafter to send to BSNL CO for final promotion orders and meanwhile efforts will be made to take clarification from DoT. However, he assured an early action in this regard.

(b) CPC from AO to CAO: GM (FP) mentioned that diversion of 336 MTs post to seniority quota of CAOs posts proposal is pending for MC approval. As soon as the approval is given the CPC will be completed. The ACRs/VCRs are being scrutinized by SEA cell.

(c) CPC from CAO to DGM Adhoc and DGM (Regular): GM (FP) mentioned that both the CPCs are in process but VCRs are awaited.

Director (HR) mentioned that he has already directed GM (SR) on our letter dated19.02.2014 to hold a meeting with our association immediately.

(b) CPC from JTO(C) to SDE(C): We requested for an early approval for promotion from JTO (C) to SDE (C) since the CPC has been completed and minutes and posting on promotion proposal has been sent by PGM(BW) through GM (Pers.) to his good office. Director (HR) assured to look in to the matter.

(c) CPC from JAO to AO: We requested for early clearance to initiate CPC from JAO to AO to fill up about 1800 AOs posts. We also explained that BSNL SEA cell has already taken legal opinion on Hon'ble CAT Chandigarh judgment and has submitted the proposal to initiate CPC for the approval to his good office. He assured an early decision in this regard.

(d) Filling up of the vacant EE (C/E) vacant posts: Director (HR) mentioned that proposal is under consideration and shortly CPCs from SDE (C/E) to EE (C/E) will be initiated.

19.02.2014:  GS, FS, AGS (Finance) and CS TN Circle met GM (FP) and discussed-

(a) CPC from JAO to AO: We expressed our serious concern against delay to initiate CPC for promotion from JAO to AO. GM (FP) appreciated our concern and mentioned that for the last three-four days he is trying to discuss the legal opinion given by BSNL advocate on the judgment of Hon'ble CAT Chandigarh Bench with Director (HR) to initiate CPC but due to continuous busyness of Director (HR), he could not meet him and discuss the matter. However, he assured that as soon as the matter is discussed with Director (HR) and after getting the clearance, the CPC to fill-up about 1800 AOs Posts will be initiated.

(b) Allowing option to JAOs appointed after 07.05.2010: We requested to hold committee meeting to discuss the matter early to give the solution. GM (FP) mentioned that GM (Estt.) remained busy during last week and he will try to hold the meeting in the next week to discuss the matter.

19.02.2014: GS, CS TN Circle met GM (Estt.) and discussed regarding regularization of officiating JTOs. GM (Estt.) mentioned that the views / suggestions of all the Associations / Unions on the JTO-2001 RR amendment have been compiled and in the next week, the committee meeting will be held to discuss the matter. He assured that the committee report on this issue will be placed in the management committee immediately and thereafter to the BSNL Board for approval. He assured an early action in this regard.

19.02.2014: GS discussed with PGM (BW) regarding:

(a) CPC from JTO(C) to SDE(C): PGM (BW) mentioned that the CPC minutes and posting on promotion proposal has been sent to the competent authority through GM (Pers.) for approval, the approval is awaited. He assured that as soon as the approval is received, the promotion orders will be issued to fill-up about 22 SDEs (C) posts.

(b) Discrepancies in the Answer Key of LDCE from JTO(C) to SDE (C): We requested to examine the discrepancies in the answer key of LDCE for promotion from JTO (C) to SDE(C) as submitted by this Association and individuals. PGM (BW) mentioned that he has already proposed a three member's committee to examine the Answer Key and sent to Sr.GM (Rectt.) for necessary action. Sr.GM (Rectt.) may be contacted on this issue.

(c) Modifications in BSNL MSRRs of EE(C/E): PGM (BW) mentioned that matter is under consideration to the BSNL management and shortly decision will be taken in this matter. He also mentioned that the committee meeting to discuss the UGC reply and other feedback on validity of the degree acquired through Distance Education Mode is being held on 21-02-2014.

19.02.2014: GS met Director (CM/Fin.) and discussed regarding poor GSM services in the western zone due to poor support from M/s ITI. Director (CM/Fin.) appreciated our concern and explained that due to a dispute between M/s ITI and M/s ALCATEL on payment issue, the AMC of BSNL GSM equipment is adversely affected wherein M/s ALCATEL has now threatened to withdraw their support for ITI due to non payments. BSNL is trying to resolve the issue so that GSM services of BSNL are not affected.

19.02.2014:GS, AGS (HQ) and CS (TN) met Addl. GM (CP&M) the Chairman Committee regarding restructuring, revision of Pay Scale and Hindi Posts assessment of AD (OL) and JHT/SHT cadres in BSNL and discussed: Addl. GM (CP&M) mentioned that the committee meeting was held on 18.02.2014 and has discussed all the feedback provided by our Association. He apprised that some documents on RR modification, designation change, DoT Cadre structure, 6th CPC recommendations, other CPSU's AD (OL) cadre structure etc have been discussed and some documents are required for discussion. However, he mentioned that shortly next meeting of the committee will be held and final report will be prepared on this issue. We further requested for an early action.

18.02.2014:GS and CS (Tamilnadu) met GM (SR), BSNL CO and discussed regarding holding an urgent meeting with AIBSNLEA to discuss the pending issues for the settlement to avoid unrest among the members. GM (SR) appreciated our concern and advised to further submit a brief of some pressing issues for holding an urgent meeting with AIBSNLEA. We assured him to submit the pending issues by tomorrow itself for necessary action. Regarding views/comments of BSNL Unions/Associations on proposed merger of BSNL and MTNL he mentioned that all the feedbacks received in this regard from Unions/Associations and are being compiled and shortly will be sent to DoT for further necessary action. 

18.02.2014:GS and CS (Tamilnadu) met Shri Pracheesh Khanna, Director (Estt), DoT and discussed regarding status of implementation of 78.2 % IDA Pay fixation to BSNL pensioners. Dir (Estt) mentioned that the reply from Deptt of Expenditure has not been received in DoT yet. We requested to send reminder to DoE since more than one month time is over. Director (Estt) immediately directed concerned officer to immediately draft a D.O. on behalf of DDG (Estt) to Jt. Secy, DoE for sending an early reply. Director (Estt) assured that within 2-3 days D.O. will be sent to DoE in this regard. He also assured to talk further with Director DoE for sending an early reply.

18.02.2014:GS, CS (Tamilnadu) Com Veerapandian and GS, BSNLEU Com Abimanyu met Addl. Secy. (T) DoT and expressed our concern regarding the proposal of merger of BSNL and MTNL and connected matters on the revival of BSNL. Addl. Secy. (T) Smt. Rita Teaotia mentioned that the letters from BSNL Unions and Associations have been received in DoT and they have gone through all these letters. She appreciated our concern on some HR and financial issues on the proposed merger of BSNL & MTNL and clarified that the steering groups constituted in DoT to examine the proposal are fully aware of all these issues and while finalizing the report these will be considered. She further explained that after 10 years finally Govt. has started the move of BSNL and MTNL merger which will help both the PSUs as synergy in having PAN India presence. It will certainly improve the market share immediately by 15% to 16%. She also explained that EGoM has taken decision to refund BWA spectrum to BSNL and MTNL which will also help both the PSUs. EGoM has already recommended Govt. pension under Rule-37A to MTNL employees. Some more decisions are being taken by EGoM for the revival of BSNL and MTNL but the BSNL/MTNL employees should raise to the occasion to provide quality service to the customers who want to take services from BSNL/MTNL.  

Regarding formation of Tower subsidiary in BSNL, she confirmed and told that it will give more revenue to BSNL and will be fully under the control of BSNL. On our anxiety to disinvest tower subsidiary in future, she mentioned that in future Govt. may decide any thing which can not be predicted now. We pleaded that condition of mandatory 30% of GSM equipment purchase from ITI to be scrapped in view of its poor support in the west zone of BSNL. AST mentioned that now the PO is revised wherein, incase ITI does not supply the required equipment or response to BSNL within 15 days, BSNL may cancel the order. ITI is being considered mandatory since it is a Govt. PSU. 

18.02.2014:Special GB meeting of Shikohabad Branch at Shikohabad, UP (West) on 17.02.2014: GS and CS UP (West) Circle Com J.M. Meena attended and addressed the special GB meeting of Shikohabad Branch at Shikohabad, UP (West) on 17.02.2014. The Branch Secretaries of Agra TD, Mainpuri TD and Eta TD along with their some members also attended the meeting. Com GS in detail appraised the status of HR issues i.e. mainly CPCs from JTO to SDE, JAO to AO, SDE to DE, AO to CAO, DE to DGM, CAO to DGM (F), JTO (C) to SDE (C), SDE (C/E) to EE (C/E) etc and other cadre related issues. He also explained that in true sense AIBSNLEA is the only Association which is taking up the issues of all the cadres of Telecom Engg., Telecom Finance and Accounts, Telecom (C/E/Arch/TF) Engineering Wings, PAs/PSs, AD (O/L) and General line disciplines in BSNL with sincerity for the settlement, hence during membership verification of Executives Association, all the executives should support AIBSNLEA to make majority Association.

18.02.2014:Felicitation Programme of Shri Kapil Sibbal, Hon'ble MoC & IT organized by United Forum of MTNL Unions/Associations of Delhi and Mumbai in the Mavlankar Hall, New Delhi on 17.02.2014:GS attended and addressed the Felicitation Programme of Shri Kapil Sibbal, Hon'ble MoC & IT organized by United Forum of MTNL Unions/Associations of Delhi and Mumbai in the Mavlankar Hall, New Delhi on 17.02.2014. Hon'ble MoC &IT in his address mentioned that MTNL employees pension issue he found justified and took up in EGoM. He succeeded in settling it in the interest of MTNL and its employees. Similarly to make MTNL a number one PSU, shortly decision of BSNL and MTNL merger will be taken wherein merged company will have PAN India presence and it will help in its growth in telecom sector.

17.02.2014:147 SDE(T) Seniority case in Hon'ble Supreme Court - SLP (C) No.32284/2013, Mamnoj Kumar Tripathy & Ors. Versus Union of India & Ors: The abovenoted matter came up for hearing before the Hon'ble Supreme Court today and the counsel for the petitioners circulated letter for adjournments of four weeks as the petitioners intended to file counter-affidavit. An objection was raised to the effect that the Department may not make any promotion in the garb of the order of maintenance of status quo. The Hon'ble Court observed that if any such orders are made contempt proceedings can be initiated. However the Hon'ble Court adjourned the matter for four weeks and directed the same to be listed after four weeks.

17.02.2014:Special General Body Meeting Held in Kolhapur on 03/02/2014:Special General Body Meeting of Kolhapur Branch was held on 3rd February, 2014 under the Chairman-ship of President of AIBSNLEA CHQ New Delhi, Shri P. Details regarding the viability of BSNL payment of spectrum charges (3G & BWA) of Rs 18500 crores, non reimbursement of OPEX charges, withdrawal of ADC, payment of interest on notional loan of Rs 7500 crores etc,. were given by Him. He has informed BSNL is spending more than 9000 crores in maintenance of all the rural exchanges in India. He has explained the efforts made by AIBSNLEA in getting approval of refund of Rs 6724 crores of BWA spectrums. Finally, explained the details of membership verification issue & expressed that AIBSNL in Maharashtra Circle has maximum number of members in all India. Important decisions of Forum of BSNL Unions/Associations meeting held on 13.02.2014: An emergency meeting of the Forum of BSNL Unions and Associations was held on 13.02.2014. The meeting seriously discussed the formation of subsidiary companies for Tower Asset, proposed merger of BSNL and MTNL as well as other recommendations of the GoM. The meeting also discussed about the expansion of BSNL networks to face competition. GS & AGS(HQ) attended the meeting. After detailed discussions, the meeting decided to submit a memorandum <<<<Click here for Memorandum>>> addressed to Dr. Manmohan Singh, Hon'ble Prime Minister of India, New Delhi on the following issues.
1) MTNL is having a huge market liability of around Rs.12,000 crores. Further, MTNL shares have already been sold in the market to the extent of 46%. Lot of HR issues are also there to resolve before merger. Under these circumstances, if BSNL and MTNL are merged, it will seriously affect the revival of both BSNL and MTNL. Hence, the meeting decided that the government should first address these issues comprehensively, before the merger of BSNL and MTNL.
2) The meeting strongly condemned the unilateral decisions taken by the BSNL Board to create subsidiary companies-
one for the infrastructure and one for the land asset. The tower asset, land and the Optical Fiber network are the major strength of BSNL. If they are separated from BSNL, then nothing remain in BSNL leaving the 2.4 lakh employees. The meeting demanded that these decisions should be scrapped.
3) The meeting decided that the government should fully compensate the loss being incurred by BSNL, on account of running rural landline service only to meet the social obligations of the Govt.
4) The meeting decided that the governmen
t should extend soft loans to BSNL, to meet its capital expenditure, for procurement of equipments, for the immediate expansion/upgradation of its networks to face the aggressive competition from the competitors.
5) The meeting decided that, BSNL should be exempted from the payment that the government has stipulated for spectrum liberalisation. It may be noted that liberalisation of 900 Mhz spectrum is very much essential for BSNL to provide 4G service. BSNL should be given the freedom of spectrum trading, since it will help BSNL to mobilise resources. As per the conditions laid down by the GoM, BSNL cannot trade its spectrum.
6) The meeting decided that BSNL should be given freedom to procure equipments for all the four zones through tender. At present, the government has mandated that BSNL should procure 30% of the equipments (West Zone for mobile) only from ITI. Expansion of networks in the West Zone is seriously affected for the past so many years, as a result of this condition. ITI is not manufacturing any GSM equipment.
7) The meeting decided to write to the Prime Minister, demanding not to grant any extension of service to the incumbent CMD, after his superannuation, as well as to take immediate action to fill up the posts of DIR(HR) and DIR(Fin).
8) The meeting decided to further take up the issue of 30% superannuation benefit to the BSNL recruited employees with CMD/BSNL. BSNL recruited about 31983 employees (20016 Non Executives and 11967 Executives). In the agreement signed on 12.06.2012 with BSNL Mgt and Forum, BSNL agreed to review the decision.

13.02.2014:  GS, FS, AGS (Fin) met GM (FP) and discussed-

(a) CPC from JAO to AO: We requested to initiate CPC from JAO to AO to fill up about 1800 AOs vacant posts. GM (FP) mentioned that the legal opinion from BSNL's advocate on the implementation of Hon'ble CAT Chandigarh judgment has been taken wherein it has been advised that BSNL may issue promotion orders as per the Hon'ble CAT Chandigarh judgment without considering the SC/ST roaster. Now the legal opinion is being processed to the competent authority for further directions. However, he assured an early action in this regard.

(b) CPC from AO to CAO: GM (FP) mentioned that the proposal for diversion of 336 MTs posts to seniority quota is pending for MC approval. As soon as the proposal is approved these posts will also be filled up. However, the CPC work is in progress, the VCRs have already been called from CVO.

(c) CPCs from CAO to DGM (Adhoc) and DGM (Adhoc) to DGM (Regular): GM (FP) mentioned that CPCs from CAO to CAO (Adhoc) and DGM (Adhoc) to DGM (Regular) are in progress. The VCRs have already been called from CVO. He assured an early action in this regard.

(d)  Grace marks to JAO Part-II Exam OC candidates: GM (FP) mentioned that the proposal is being sent to the competent authority for consideration and decision in this regard.

13.02.2014:GS, AGS (HQ) met Addl. GM (CP&M), Chairman Committee to submit report on AD (OL) cadre restructuring. We expressed our serious concern against the delay in completing the report. Addl. GM (C P&M) assured to hold a meeting with association on 18.02.2014 to discuss and finalize the committee report.

10.02.2014:Meeting with GM(Pers.), BSNL C.O. on 07.02.2014: GS, AGS (Engg.) met GM (Pers.) and discussed regarding modification of some SDEs(T) posting order from soft tenure to hard tenure circles. GM (Pers) mentioned that many SDEs from AP circle has requested for change of posting to hard tenure circles but these are not considered due to non availability of vacancies in hard tenure circles. Regarding CPCs, He further mentioned that due to court cases all the CPCs i.e. JTO to SDE, SDE to DE and DE to DGM are held up.

10.02.2014:Meeting with PGM(EW), BSNL C.O. on 07.02.2014: GS, AGS(Engg.) met PGM (EW) and requested to take an early decision on the issue of degree acquired through distance education to give the promotion of EE since the UGC reply on this issue has been received. PGM (EW) mentioned that he has already spoken to GM (Pers.) to hold the committee meeting to discuss the issue and GM (Pers.) has assured to conduct meeting in the next week itself.

BSNL CO and discussed regarding allowing to execute option to the departmental JAOs appointed after 7.5.2010 GM(Estt) mentioned that 7.5.2010 was the  "cut of date" for implementation of 2nd  PRC for non - executives and the pay of non-executives has to be revised w.e.f 7-5-2010, the cut of date can't be changed. We requested to consider that as special case wherein the JAO exam result was declared in March 2010 but they were sent to training centers later on in different months due to shortage in Training centre and these JAOs  could join after 7.5.2010 only and they are not allowed to exercise option  on
