30.12.2015:  BSNL Executive Diary-2016

 

CMD, BSNL today launched the BSNL Executive Diary - 2016 and the Calendar - 2016.

The BSNL Executive Diary-2016 published by AIBSNLEA CHQ is also being dispatched to the respective consignees. Despite repeated requests, the mobile numbers of the consignees are not given while placing the orders for the Executive Diary - 2016 which is causing immense delay in searching the address by the transporters. It is therefore, once again requested to give the Mobile Numbers of the consignees for a hazel free delivery of the Diary consignment. 

30.12.2015:   GS, AGS (HQ) and Advisor (HQ) met with GM (Estt) and discussed regarding the issue of Fixation of pay of officiating JTO's under FR 22 1(a)(i) and reversion before sending them for Phase-I training. We strongly opposed the arbitrarily issued guidelines in this regard vide Estb Cell letter dated 22.12.2015 and requested to withdraw these guidelines as thousands of  officiating JTOs will get reductions in their Basic Pay. GM (Estb) was very much reluctant on this issue and categorically told that these orders are correct and in the interest of organization.

We will take up the issue with higher authorities in BSNL and if situation prevails will go for agitation to safe guard the interests of our members.

29.12.2015:   Report on the meeting held with Director (HR) on 22.12.2015

A meeting was held with the representatives AIBSNLEA and AIGETOA under the chairmanship of Director (HR). From management side Sr. GM (SR), GM (Pers), GM (Estt), Addl GM (SR), Jt. GM (Pers), DGM (Estt.) were present along with Director (HR) and from AIBSNLEA side, GS, FS, AGS (HQ) along with President, AGS, OS of AIGETOA were present in the meeting. We requested Director (HR) to review the progress on the agenda items of the earlier meetings. Records of discussion on the issues is as under:

 

1. Superannuation benefits to Direct Recruited executives as per the provision of sub-rule (23) of rule 37A of CCS pension rule and as per DPE guidelines. BSNL should contribute 12% of Basic + DA as Superannuation Benefits in respect of Direct Recruits and the effective date of implementation of Superannuation benefits of BSNL Recruited Employees must be 01.10.2000.

Director (HR) highlighted about the progress made so far on the issue. It was informed that the note for the Remuneration Committee is ready to be presented and the same may be done in January month. After the clearance of the remuneration committee, the matter will go to the board and expectedly the same can be presented in the next board meeting. On the quantum, it was informed that the call will be taken by the Remuneration Committee, however Director (HR), though non-committal but assured that she will try to make it as high as possible. United Forum Side once again reiterated that the amount should not be less than 12%. On the date of implementation issue, Forum side once again reiterated its demand for date of implementation should be from the beginning. It was informed by Establishment cell that the date of effect shall be the date of presidential orders. Forum side strongly resented the same. Director (HR) assured the Forum to get the issue reexamined within first week of January.

 

2. Some issues related to Executive promotion policy (EPP) needs immediate settlement in addition to CPSU cadre hierarchy and first time bound promotion after 4 years of service in all these cases.

The same is under progress. There are some observations from Personnel unit which is being relooked into, however the time line of 26th January, 2016 shall be adhered to.

 

On the E2 and E3 standard IDA Pay Scales to JTO and SDE equivalent executives, committee report has been submitted by GM (Estt) Cell to Director (HR) office and it is under consideration. The time line of 26th January, 2016 shall be adhered to.

 

a. Time bound promotion from E-5 to E-6 to the DGMs promoted from Gr. "B" Executives:

The proposal has already been approved by the Management Committee of the BSNL Board. It has been delinked from the HR Plan and now it will be submitted to BSNL Board for its consideration in the next meeting.

 

b. Date of effect of Implementation of revised upgraded IDA Pay Scales for the Executives w.e.f. 1.10.2000 on notional basis:

Establishment cell will submit the case to Director (HR) on the basis of earlier Board decision. The final decision shall be taken by Director (HR) to review the case. The timeline of 26th January shall be adhered to.

 

c. Amendment in BSNL MSRRs of EE (Civil/Electrical/Arch):

The matter is still pending in the court of law. After clearance from the Hon'ble court further action in this regard would be taken.

 

3. Conduction of various CPCs on a regular basis:

a. CPC from JTO to SDE (T) CPC against seniority cum fitness quota: Conduction of DPC for Seniority and fitness quota as per DoPT guidelines for the years 2009-10, 2010-11, 2011-12, 2012-13 and 2013-14 to fill up about 6600 SDEs posts: 

GM (Pers) informed that the draft reply on the rejoinder has been sent to Kerala Circle for further submission to Hon'ble High Court Kerala and as soon as the stay order is vacated from the Hon'ble HC Kerala, the CPC will be expedited and promotion order of 4000 SDEs will be issued immediately. 

 

GS appraised Director (HR) that on 16.12.2015, the last date of hearing at Chandigarh CAT no body from BSNL side appeared. Director (HR) took it very seriously and told that the court case should not be dealt in a casual manner. She further directed GM (Pers) to arrange a fortnightly meeting at the level of DGM (Pers) with the Associations to have a follow up on the pending court cases. The next date of hearing is 9th January 2016. 

 

Director (HR), directed GM (Pers) to monitor the court cases closely and ensure timely action so that the CPC could be conducted.

 

GM (Pers) further mentioned that in the stay order granted by Hon`ble CAT Chandigarh on promotion from JTO to SDE Telecom has been clubbed with AO to CAO court case and one Advocate was nominated to take legal opinion from ASG/SG on the issue of SC/ST roster implementations on promotions and the same has been received. Accordingly the action is being taken by the Pers Cell.

 

b. CPC from SDE (T)/DE(Adhoc) to DE Regular: Immediate CPC to fill up the left out about 11 DEs Posts and  about 750 DEs posts on regular basis up to the vacancies of  year 2013-14.

The court case on AO to CAO promotion is clubbed with SDE to DE promotions. Stay order in the Hon'ble CAT Chandigarh. The case is now listed for herring on 9th January 2016. A Review application also has been filed by the applicants in the Hon'ble High Court Chandigarh on SDE's seniority list number 6 and 7 as per the Hon'ble Apex court directions. BSNL will file rejoinder on this in reply.  

 

c. CPC from DE to DGM (Engg.) on Adhoc/Regular basis to fill up about 700 DGM vacant posts:

GS again requested Director (HR) to give directions to expedite CPC to fill up 480 vacant DGM Posts wherein CPC work is already completed and the VCRs are also available. After a deliberations Director (HR) asked GM (Pers) to take legal opinion immediately in this regard and accordingly, the legal opinion from ASG is being taken shortly on SDE's seniority issue.

  

d. CPC from JAO to AO and AO to CAO to fill up the vacant posts:

GS further appraised Director (HR) that on the last date of hearing at Chandigarh CAT no body from BSNL side appeared. Director (HR) took it very seriously and told that the court case should not be dealt in a casual manner. She directed GM (Pers) and GM (FP) to coordinate to deal with the court case jointly.

 

e. CPC from DGM (F)-Adhoc to DGM (F) - Regular basis:

Director (HR) informed that the CPC work is in progress in SEA Cell & promotion orders will be issued shortly.

 

f. CPCs from JTO (C/E) to SDE (C/E) and SDE(C/E) to EE(C/E):

Director (HR) mentioned that CPCs from JTO(C/E) to SDE(C/E) are in progress. And the CPCs from SDE(C/E) to EE(C/E) have been initiated to fill up the vacant EE(C/E) posts and after the vacation of stay order the promotion orders will be issued.

 

g. CPCs from JTO (TF) to SDE (TF), SDE (TF) to DE/AGM (TF) and LDCE from JTO (TF) to SDEs (TF):

We requested to expedite CPCs to fill up the SDE (TF) and AGM (TF) posts and to notified LDCE from JTO(TF) to SDE(TF) immediately Dir (HR) directed GM(Pers/Rectt) to send the requisition to recruitment cell for the notification of LDCE immediately. GM (Pers/Rectt.) informed that by the 3rd week of January 2016, the notification of LDCE will be issued.

 

4. Post based promotions for PA/PS, common recruitment rules and nomenclature and introduction of promotion policy for stenos (dying cadre):

GM (Pers) informed that the committee headed by ED (CN) has completed its meetings and the report is being prepared. Dir (HR) directed GM (Pers) to ensure submission of committee report within one week to the competent authority.

 

5. Restructuring of AD(OL) Cadre:- The committee constituted under the Chairmanship of Shri Harsh Wardhan Addl. GM(CP&M) BSNL CO. has submitted the report to the competent authority to revise the pay scale of Rajbhasha Adhikari at PAR with SDE/AO Scale. Shortly the case will be put up to the competent authority for approval. We have demanded to restructure the cadre by change of designation as AD(OL) and to ensure promotion up to DD(OL) STS Grade.

GM (Pers) informed that the committee recommendation on restructuring of AD (OL) Cadre has been sent to EF Cell for comments. Director (HR) directed GM (Pers) to have meeting with PGM (EF) for early clearance of the file.

 

6. Immediate implementation of digital signature by all circles with respect to EPF cases settlement of BSNL recruited employees, resolution of all EPF Anomalies, and EPF contribution during training period.

It was informed to Director (HR) that despite the court orders, field units including BSNL CO has not implemented it so far which may result into the contempt of the court which association may soon file if BSNL continues to show its apathy to the judgement. Director (HR) directed Establishment cell to seek the status from all the circles and field units.

 

7. Promotions through LDCE in SDE cadre:

Forum Side strongly protested the slow movement of Personnel cell and non-appearance of BSNL side in the court cases specially those which have kept the promotional avenues of BSNL executives at bay. Director (HR) instructed the Personnel cell to strictly monitor all the court cases related to LDCE and other Promotions and to give a fortnightly progress to Director (HR) as well as Forum. She further cautioned personnel cell that non-appearance and casual handling of the court cases shall be viewed very seriously and responsibility shall be fixed. Personnel unit assured for an early action in this regard so that the promotion orders may be issued without any further delay.

   

8. Settlement of pay anomaly cases wherein senior Executives are drawing less pay than their juniors and antedating of pay:

Forum pleaded to implement the Honorable Supreme Court judgment allowing stepping up of pay to all affected executives as the AIBSNLEA was party in the Apex court. Case of 124 executives decided based on court judgement. However as discussed in the meeting with Director (HR) and union the case is to be seen in generality and gentility. GM (Pers) informed that the information of the eligible executives has been called from Circle to calculate the financial implications. We requested to an early action in this regard. Director (HR), directed GM (Pers) to look into the matter.

 

Regarding antedating of pay, Director (HR) directed GM (Estt.) to hold further discussions with the association separately to resolve the issue at the earliest.

 

On the issue of an increment @ 3% at the time of executive time bound upgradation on their basic pay on time bound promotion and subsequently 3% increment benefit on vertical promotion, GM (Estt) informed that the case has been sent to DoT again in view of the comments received from DPE/DOT in this regard for issuing the directions.

 

9. E1+5 Increments benefit to JTO (SRD), JAOs 2013 batch and PAs: The BSNL Management Committee has cleared the proposal of E1+5 Increments benefit to JTO (SRD), JAOs 2013 batch and PAs which is pending for BSNL Board approval.

It was informed by the forum that despite clearance by Management Committee, the same has not been presented to board. It was also informed that the same needs to be presented as fresh agenda item to the board for its consideration. Management side assured for the same.

 

10. Early finalization of New SDE RR-2014 & JTO RRs-2014 (without degradation of Scale & Qualification) and in line with the suggestions submitted by associations:

Director (HR) informed that the SDE RR-2014 has been resubmitted before BSNL Board de linking from HR plan. Earlier Board had returned the case with remarks - to be decided after approval of HR plan  

 

11. Request for fixation of pay in respect of departmental outsiders (TTAs) appointed as JTOs through JTO Direct recruitment 2007- Issuance of clarification regarding.

Forum side strongly represented the case of Shri Dheeraj Kumar, one of the departmental outsider TTAs who was also present in the meeting. Forum side highlighted that BSNL has been repeatedly ignoring the issue and the same has been pending despite repeated representations from the Forum side. Establishment cell has been completely silent on the issue and is not issuing the clarification which will give these departmental outsiders their rightful due. Director (HR) asked Establishment cell to examine the submissions by forum in detail and give the feedback to her expeditiously.

 

12. Improvement in the revised policy for service GSM, RSRTC & Broadband to Executive

a. Enhancement of 200 free calls limit per month on RSTC & enhancement of free call limit on GSM Telephone connection to STS level officers from 500 to 800 calls.

b. Rent free broadband service connection to all executive with BSNL 750 Plan. Sr. GM (Admn) has processed the case to the competent authority for rent free Broadband connection

c. All the BSNL Executive should be provided GSM handsets of the cost Rs. 3000/-Rs. 4000/- & Rs. 5000/- to the JTO/SDE/DE level executive instead of Rs.1500/-, Rs. 2500, Rs.3500/- respectively.

d. All executives should be allowed CUG facility on RSTC at Circle level.

e. 3G mobile service with Data facility to all Executives.

All above issue were discussed in details with justifications and it was assured by Director (HR) that all above issues are under consideration and shortly decision in regard will be taken. Regarding data facility on service mobile connections, Management Committee has already approved it and the orders will be issued after approval from BSNL Board.

23.12.2015:   GS met with GM (Pers) and discussed regarding the orders of the executives who are working in soft tenure station and relieved through ERP which is against the Tenure Transfer Policy and their orders are to be cancelled. He assured to look into and to issue cancellation of the orders by today itself.

Further, regarding the executives who have been relieved through ERP without prior intimation to individuals and not getting TA/TP advance or salary payments etc we requested GM (Pers) to issue necessary instructions to the circles in this regard. GM (Pers) assured to issue some instructions in this regard.

22.12.2015:    Scheduled Agenda Meeting with Director (HR), BSNL Board.

The representatives of AIBSNLEA and AIGETOA jointly met Director (HR) i.e. GS, FS, AGS (HQ), Advisor (HQ) and President, AGS, OS AIGETOA. The agenda submitted by AIBSNLEA incorporating the issues of AIGETOA was discussed in details in the presence of PGM (SR), GM (Estt), GM (Pers), Addl GM (SR), Jt. GM (Pers) and DGM (Estt). The meeting lasted for more than two hours at 19.30 Hrs. The record of discussion will be uploaded shortly.

22.12.2015:    Meeting with CMD BSNL

GS, FS met CMD BSNL and discussed regarding:

a. Non-filling up of the  vacant DGM posts: We expressed our serious concern against the non-filling up of the vacant posts of the DGMs in Engineering wing.  We explained that that already the approval to fill up 480 DGM posts is available since long with the Pers Cell. The assessment of ACRs have been completed and the VCRs of the eligible DEs are also available  but the promotion orders are not being issued on the pretext of court cases whereas there is no stay order on promotion. CMD appreciated our concern and assured to discuss the matter with Director (HR) for an early decision.

b. Non-settlement of the long pending HR issues: We expressed our concern against non-settlement of the long pending genuine HR issues despite the several formal/informal meetings are conducted by Director (HR). We also explained that none of the HR issue is being resolved due to the complete negative and biased approach of the HR units of BSNL towards our issues. CMD assured to look into the matter.

22.12.2015:    PENSION REVISION IN BSNL & MTNL

A delegation comprising of S/Shri PrahladRai, GS/AIBSNLEA, KishanSingh,GS/AIRBSNLEWA, Chandeshwar Singh, GS/NFTE(BSNL), Mange Ram Sharma, President / U.F, M.K.Bagchi, Convener/U.F, A.K.Kaushik, GS/TEAM and S.S. Nanda, GS/RTOWA,Delhi have met Shri N. Sivasailam, additional Secretary (T)/DOT to discuss the prospects of taking up the issue of the pension revision of the pensioners of BSNL and MTNL with the Empowered Committee constituted in connection with the recommendations of the 7th CPC. We have pointed out that even though 7th.CPC failed to make any reference of this issue in their recommendations, still there is a scope to take up this issue with the Empowered Committee through the Implementation Cell which DOT is supposed to constitute. This is apparent from the DO No.1-4/2015-EIII(A) dated 21.11.2015 of Ms Annie George Mathew, Jt. Secretary (Pers.), Min. of Finance, Deptt. of Expenditure.

 

Shri Sivasailam informs that DOT has already constituted its Implementation Cell with Shri S.C.Sharma, DDG/CA as the Nodal Officer. He has assured us of taking up this issue appropriately with the Implementation Cell of DOT.

22.12.2015:    Meeting with GM (Pers) on the Soft Tenure Transfer Policy

GM (Pers) conducted a meeting with the representatives of Executives' Associations in which GS, AGS (HQ) attended and discussed in detail regarding the recently issued clarification on the Soft Tenure Transfer Policy. We strongly opposed the issued clarification which has diluted the very purpose of  Soft Tenure Transfer Policy and requested to withdraw it immediately as after this the executives, for break of their circle tenure would prefer to opt for neighboring circles instead of serving in Soft Tenure stations of their present circle. In this manner the soft tenure stations of a Circle would remain un-filled. GM (Pers) assured to re-look into the mater.

All the CHQ office bearers, Circle/Branch Secretaries are requested to ensure successful implementation of the  Lunch/closing hours demonstrations on 22.12.2015 (today), wearing black badges etc regarding inordinate delay in extending the benefit of 78.2% IDA fitment to the retired BSNL employees.

21.12.2015:   GS, Advisor (HQ) & CS Delhi Circle met GM (Pers) and discussed:

a. CPC from JTO to SDE (T) and SDE (T) to DE (T): We expressed our resentment against the casual approach of BSNL Management in handling the court cases related to to Executive promotions i.e. on 16th November 2015 in the Hon'ble Chandigarh CAT neither advocate nor any officer attended the Hon'ble court from BSNL side and the case is now posted for hearing on 9th January 2016 Also the rejoinder has not been submitted by BSNL Kerala Circle yet in the Hon'ble High Court Kerala to get vacate the stay order on JTO to SDE (T) promotions.  It is a known fact that due to the stay order against promotions from JTO to SDE (T), SDE (T) to DE (T), AO to CAO granted by Hon'ble CAT Chandigarh the CPCs are held up since long and the BSNL Management is dealing court cases very casually. It is a most frustrating situation. GM (Pers) appreciated our concern and assured to concentrate on all these court cases carefully.

b. CPC from DE to DGM (Engg): We expressed our serious concern against non-filling up the vacant DGM posts on the pretext of pending court cases whereas there is no stay order on promotions. Every time BSNL Management is assuring that promotions orders will be issued by 31st October then 31st December and now 31st March 2016 which is not a reality. It reflect that BSNL Management with an indifferent attitude  to deprive the eligible DEs from promotions is dragging the issue. It has caused serious frustration and resentment among the executives. GM (Pers) appreciated our concern and expressed his ineligibility in issuing the promotion orders in absence of the clearance from higher ups. AIBSNLEA will further discuss the matter Director (HR) and CMD BSNL for an early decision in this regard.

c. Cancellation of transfer orders of SDEs / DEs / DGMs serving or served the soft tenure stations: We resented against the relieving of SDEs/DEs/DGMs  serving or served the soft tenure stations through ERP in violation of the soft tenure transfer policy and its arbitrary modification. GM (Pers) mentioned that tomorrow 1430 Hrs he has called a meeting of all Executive Associations to discuss the matter for an early solution. Similarly, he also assured that some SDEs wrongly relieved through ERP have been examined and their transfer orders will be cancelled shortly.

21.12.2015:   Forum of BSNL Unions and Associations Core Committee meeting with CMD BSNL:

GS along with the members of Core Committee met CMD BSNL and discussed regarding implementation of Service With A Smile (SWAS). CMD expressed his happiness in the efforts being taken by the BSNL Unions and Associations in observing SWAS a very good endeavor to make happy BSNL customers. He mentioned that BSNL Management will be equally concerned and party in implementing the SWAS Program for 100 days and to continue thereafter.  He decided that SWAS will be launched  on 30th December 2015 at 10.00 AM at BSNL Corporate Office, Circle HQs and SSA HQs in the presence of all BSNL Unions / Associations representatives and CMD BSNL, BSNL Board of Directors, CGMs and SSA Heads by observing oath in this regard.

He also apprised that BSNL has now launched new attractive schemes which are to be made popular  i.e.

1. Call rates are reduced by 80% on NTC in the first two months.

2. On Christmas and New Year the talk value on the recharge coupons has been increased by 20% i.e. Customer will get talk time of Rs 6000 on the recharge of Rs 5000 like wise on Rs. 1200 talk time  on the recharge of Rs 1000.

He further emphasized that since Airtel - Vodafone - Idea (AVI) have joined hands and their market share is more than 65%, BSNL has to compete with this situation and to grow its market share by providing best telecom services to its users at an affordable price. He also told that BSNL now has to start its services in other foreign countries also like Iran, Saudi Arabia etc with Joint Venture to increase its business which is the need of hour.

Forum in its meeting dated 09.12.2015 decided to conduct a 100 days drive as "SERVICE WITH A SMILE".

The Forum meeting held on 09.12.2015 decided to call on the Executives and Non-Executives to observe a 100 days drive, which will be called "SERVICE WITH A SMILE - (SWAS)", starting from 1st January, 2016. The objectives of the 100 days drive will be  

(1)    Vigorous marketing of mobile, landline and broadband connections.

(2)    Ensure fault free services.

(3)    Reconnection of Broadband and landline connections.

(4)    Special focus on MNP. 

All the CHQ Office Bearers, Circle/ Branch Secretaries are requested to participate and implement the same with 100% success.

16.12.2015: Meeting with CMD,BSNL on 16.12.2015 :GS, AGS (Engg.) and President, AGS AIGETOA met CMD BSNL and handed over the letter of deferment of agitation programs and requested for true implementation of his direction for the settlement of demands. CMD assured for the settlement of the demands in time bound manner as assured  and advised that "SWAS" Programme should be implemented in true sense for its implementation, one date and time may be fixed up in the last week Dec -2015 for its launch w.e.f  01-01-2016.

We also requested for the withdrawal of revised soft tenure transfer policy order issued by Pers. Cell wherein the soft tenure stations of the circle will now remain unfilled which will adversely affect the growth of BSNL. CMD assured to look in to the matter etc.

16.12.2015:  Meeting with Director (HR) BSNL Board on 15.12.2015:GS, AGS (Engg) and President, AGS, AIGETOA met Director(HR) and handed over the letter of deferment of agitation Programs in response to the positive gestor shown by BSNL management and with that all the assurances given will be honored in full and time bound manner.  Director (HR) appreciated our concern and further assured that immediate steps will be taken to resolve the demand in the assured time frame. 

However, she advised to be in regular touch to remind the issues as follow up action.

We also protested against the modified soft tenure transfer policy provisions, Director (HR) assured to look in to the matter.

Director (HR) confirmed that Committee Recommendations on E-2 and E-3 IDA Pay scales to JTO/SDE equivalent executives proposal has been received by her office from GM (Estt) office and now it is  being examined. The Committee recommendations on CPSU cadre hierarchy is yet to be processed by Pers/Restructuring Cell.  However, she assured early action and decision on both the issues.  She immediately fixed up a meeting with United Forum of BSNL Executive Associations of AIBSNLEA & AIGETOA on 22nd Dec-2015 at 17-00  hrs  to discuss further the pending HR issues.

16.12.2015:  GS, AGS (Engg) met GM (FP) and discussed regarding consideration of some request / tenure transfer cases of AOs / CAOs / DGM (Fin). GM (FP) assured to look into the cases submitted by the Association.
16.12.2015:  GS, AGS (Engg) met GM (Pers) and protested against the clarification issued on the Soft Tenure Transfer Policy. GM (Pers) assured to hold a meeting on this issue in the next week to discuss the matter separately. However, on the reliving of SDEs / DEs through ERP we protested wherein the transfer cases of SDEs / DEs already cancelled, working in soft tenure stations and requests for cancellation / modification / retention are pending have been relived. He assured to examine and for immediate decision on all these cases with in two-three days. 

16.12.2015:  Meeting with Shri Rakesh Garg, Chairman (TC) and the Secretary (T), DoT on Revision of Pension in BSNL & MTNL:

GS, AGS (Engg) and Com. M.K. Bagechi, Convener, United Forum of MTNL Unions & Associations, Com. Kishan Singh, GS, All India Retired BSNL EWA met Shri Rakesh Garg, Chairman (TC) and the Secretary (T), DoT and discussed regarding implementation of 78.2% IDA fitment benefit to BSNL Pensioners, withdrawal of 60:40 provision from Rule 37A and to take up with DPE to include the issue of Pension revision of BSNL/MTNL pensioners immediately in the terms and reference of 3rd PRC. Secretary (T) appreciated our concern and mentioned that the Cabinet Note on 78.2 % IDA fitment benefit to BSNL Pensioners has been finalized in DoT and now sent to the Ministry of Law for legal clearance since earlier on the Cabinet Note the legal opinion / comments were given at lower level and now since the Cabinet Note will go to cabinet, Secretary (Law) comments are necessarily required. He assured as soon as the legal clearance is received, the Cabinet Note will be sent to cabinet for approval. On 60:40 withdrawal issue Secretary (T) categorically told that DoT will get removed this provision through this Cabinet Note from cabinet. Regarding the issue of Pension revision of BSNL/MTNL pensioners Secretary (T) appreciated our concern and advised to give a letter in this regard. 14.12.2015:  GS, FS, Advisor (HQ) and CS Rajasthan Circle met GM(FP) and discussed regarding-

a)  CPC from AO to CAO:- we requested to expedite CPC from AO to CAO. GM (FP) mentioned that the court case on SC/ST roaster implementation is coming for hearing on17th December 2015  in the Hon'ble CAT Chandigarh wherein Pers. Cell BSNL CO will submit all the data/information required  as per suggestions of ASG.. He assured that, in case the stay order on promotions is vacated, the CPC from AO to CAO may be expedited and the CPC from JAO to AO may also be initiated.

b)  50%MT (336 CAO) Posts diversion:- We requested to get the approval of the BSNL Board on diversion of 50% MT (336 CAO) Posts to the seniority quota. GM(FP) assured to resubmit the case in the next BSNL Board meeting for approval.

c) Consideration  of request transfer cases of AOs/CAOs:-  We requested for the consideration of pending transfer cases for cancellation/modification in view of the hardships of the executives. GM (FP) assured to re examine the pending transfer cases for consideration.

14.12.2015:   Happy Energy Conservation Day - 14th December 2015:

Wishing All the Executives  of AIBSNLEA/BSNL  a very happy Energy Conservation Day 14th Dec., 2015. Today  BSNL bagged  three State level Energy Conservation award for  BSNL Haryana Circle. The award  has been given to 1st Prize, Pehowa Building - Rs -2 lacs for year 12-13, 1st Prize Ladwa, Kurukshetra 2.00 lac , 2nd Prize for Rohtak 1.0 lac  and 3rd Prize for Kalanaur Building, cash amount is Rs 0.50 lacs respectively. In addition to this the BSNL EW unit have already added 8  Nos. National level award and  22 nos. State Level award along with certification etc.. This is due to relentless work done by BSNL executives country wide to not only build a country wide BSNL Brand image but also to contribute in National growth. the organisation feel pride at this moment and congratulate and motivates comrades further to achieve this commendable job under the leadership of CMD BSNL.

11.12.2015: United Forum meeting with CMD BSNL and Director (HR): The representatives of United Forum of BSNL Executives Association of AIBSNLEA and AIGETOA were invited by Director (HR) to discuss the demands raised in the agitation notice in the presence of PGM (SR), GM (PERS) and Additional GM (SR).  GS AIBSNLEA, Advisor (HQ) AIBSNLEA and President AIGETOA, AGS AIGETOA, CS DELHI AIGETOA & Delhi CWC Member AIGETOA attended the meeting on behalf of United Forum. All the demands were discussed in detail but Director (HR) preferred to take the final view by CMD BSNL for resolution of the demands and she immediately arranged a meeting of United Forum with CMD BSNL in his chamber. Further, on the issues, all the demands were discussed in detail with CMD BSNL in the presence of Director (HR) and other officers. CMD appreciated our concern and after detailed discussions, directed Director (HR) to give written assurance for the settlement of the demands in a time bound manner. The minutes of the meeting will be released on Monday and thereafter United Forum will decide the future course of actions.

CMD BSNL appreciated the concern of United Forum and acknowledged that under the changed scenario in BSNL, the MT recruitment is not the requirement of BSNL since ITS officers are continuing in BSNL on deployment basis, STS level executives are being promoted to DGM (Posts) in all disciplines, absorbed group A level executives are being promoted to the grade of SAG and HAG in BSNL and enough internal talent is available in BSNL to take the higher managerial positions with new promotion policies to be framed.  CMD BSNL emphasized that there is need for promoting internal talent in the company and hence HR wing should devise strategy to promote the internal executives and groom them for taking higher responsibilities.  United Forum requested that if Management is not willing to recruit Management Trainees any further, then there is no need to hold the SRD recruitment also as when the main exam is not taking place then there is no question of filling up the reserved vacancies either. United Forum side also emphasized that when there has been no recruitment for even vertical reservation posts for SC/ST/OBC categories etc., how BSNL can hold SRD for PWD candidates which is a horizontal reservation. CMD BSNL acknowledged the associations side views but explained that the ongoing process for Recruitment of MT (SRD) is being done under the directions of DoP&T/DoT on the basis of Hon'ble Supreme Court Judgment and BSNL is under compulsion to hold the exam unless until there is specific directive from the  Hon'ble court for not going ahead. United Forum side told CMD BSNL that the directions of Hon'ble Supreme court is for filling up the unfilled vacancies and not for filling up the vacancies of a cadre which has not yet been born in BSNL.  United Forum further informed that this has happened due to reporting the unfilled vacancies of MT as back log inadvertently and hence there is no need for going on for recruitment in a cadre whose future in BSNL is yet uncertain. CMD BSNL expressed his inability to stop the process in absence of any specific directions from court. However, CMD BSNL directed Director (HR) that MT exam which was deferred on 7th July 2015 be deferred for another six months further and in the meanwhile the proposal for scrapping of MT recruitment altogether be taken up in the next meeting of the BSNL Board.  

CMD BSNL also asked Director (HR) to finalize the implementation of committee recommendation on CPSU Hierarchy and Standard IDA Pay scales (E2 and E3) to JTO and SDE equivalent executives by 26th January 2016. He further directed Director (HR) and GM (Pers) to fill up all DGM Vacant posts by 31st March 2015 on regular basis.

On DGM recruitment, he directed GM (Pers/Recruitment) to declare the results of internal executives who appeared in the exam. GM (Recruitment) said that the same has not been done in view of the court orders. United Forum side informed that there is no bar by Hon'ble Court on declaring the results and Hon'ble Court has only upheld that framing the recruitment rules are prerogative of BSNL. CMD BSNL acknowledged the United Forum view and asked GM (Pers) to arrange for the declaration of results and if required, he should seek the permission of Hon'ble court. He also asked GM (Pers/Rectt) to review the DGM RRs for ending the discrimination vis-'vis internal executives and come up with a revised RR where there is no discrimination with internal executives. On the ongoing recruitment process, CMD BSNL asked GM (Pers) to keep him informed on the further developments and to inform the association side before taking any final decision.

On other issues, Director (HR) assured that she shall be looking for their resolution of these issues within a defined time frame and requested association side to be in continuous touch for expediting all issues like filling up of the vacant posts in Group B/STS/JAG equivalent grades, creation of PPS posts, implementation of 30% Superannuation Benefits to Direct Recruits,  restructuring of AD (OL) Cadres, E1+5 advance increment benefit to JTO (SRD)/JAO 2013 batch and PA Cadre, Declaration of LDCE results, allowing of Stepping of Pay to seniors w.r.t their Juniors, framing of policy in regard to Rule-8 cases, etc.

United Forum side also requested for holding a joint agenda meet with Director (HR) on all issues shortly hereafter.

11.12.2015: The Status of 206 Seniority case in Hon'ble Supreme Court: The 206 seniority case along with the experts committee report came up before Hon'ble Supreme Court today. The case is now posted for hearing to 16.02.2016 along with 147 case.

11.12.2015: Massive Demonstrations successfully conducted all over the country: As per the call given by United Forum of Executive Associations, Massive lunch hour demonstrations were conducted successfully throughout the country.  Executives turned out in large number and participated actively in the demonstrations. We are thankful to all the office bearers and members for the organizing the demonstrations successfully throughout.

11.12.2015: In continuation to the earlier notified UF's agitation programs against the arbitrary notification of MT (SRD) recruitment and non-settlement of long pending HR issues; CHQ  decided to hold demonstration during lunch/closing hours on 11.12.2015(today).

10.12.2015: Report Received from TN Circle-Meeting of AIBSNLEA & AIGETOA TN Circle and Chennai TD office bearers with CMD BSNL:  AIBSNLEA and AIGETOA TN Circle & Chennai TD Office bearers met CMD, BSNL during his Official visit on yesterday. We requested the CMD to withdraw the MT recruitment notification (SRD) dated 05.11.2015 immediately, scrapping of the MT, DGM RRs and cancel the DGM(DR) Exam scheduled to be held on 13.12.2015 since it will drastically affect the career progression of the young and talented executives of BSNL and immediate implementation of the recommendation of the committee headed by ED(NB) on CPSU Cadre Hierarchy in BSNL and standard E2 & E3 scales for JTO, SDE Equivalent executives.
We also informed about the agitation notice served jointly by the AIBSNLEA & AIJETOA against the arbitrary notification of MT (SRD) recruitment and non-settlement of long pending HR issues even after the assurances given repeatedly in the formal/informal meetings. CMD replied that the said Exam is to be conducted as per the Hon'ble Supreme Court  directions obtained by 7 PH candidates. However, he assured to look in to the matter and consider our demands favourably.

10.12.2015: Report Received from TN Circle-Meeting of FORUM Leaders of TN Circle and Chennai TD with CMD BSNL::  Forum Leaders of TN Circle & Chennai Telephones met CMD yesterday. An interactive session has been arranged with CMD. Director(CFA) and CGMs and other higher Officers were also present in the meeting. Forum Leaders explained the efforts taken by their employees to restore our services.

CS AIBSNLEA in his speech pointed out that out of Nine Networks that exist in Chennai, BSNL was the only Network functioning during the Floods and requested the CMD to extend NGN Network throughout Tamilnadu Circle and informed the CMD BSNL that due to non availability of MPLS Ports, BSNL is losing an annual revenue of Rs.300 Crores and requested to allot 30000 Ports to STR to upgrade the Leased Circuits as per the request of the EB Platinum customers viz. SBI, Syndicate Bank, etc., He also requested to allot funds to GPF payment without any limitation upto Mar'2016 and also requested to release funds in the R&M Head, Corporate IT Head, Capital Head so as to maintain hassle-free services.

CMD appreciated and thanked for the efforts making BSNL proud throughout the country by providing connectivity during flood in TN Circle & Chennai which has built an image to BSNL among People, & Govt. Officers and requested to continue the same spirit for the coming days. He also conveyed the appreciation of the Tamilnadu Chief Secretary for the Services of BSNL during Flood. He narrated the latest position of the Company, Business decisions and efforts to make it turnaround by 18-19.

Forum Leaders demanded flow of GPF to both the Circles, Flood advance to the areas affected, compensation to those lost their valuable things and seamless supply of Materials. CMD agreed to look into these matters and assured that a Committee will be formed to assess the losses and due compensation will be paid to the those employees who lost their valuable things. 10.12.2015: Report Received from TN Circle-Meeting of AIBSNLEA & Others of TN Circle and Chennai TD office bearers with Director(CFA), BSNL Board: CS AIBSNLEA TN Circle, District Office Bearers of AIBSNLEA, BSNLEU, NFTE STR Branch, Tamilnadu  Circle with lady comrades met Director(CFA), BSNL Board  at CGMM STR Office, Chennai on 09.12.2015 during his Official visit to assess the damage caused to BSNL's System due to flood. CGMM, STR, CGM STP,GM(F), STR/STP DGM(F) & DGM(OP) were also present in the meeting.

We requested the Director(CFA) to extend relief to the flood affected BSNL staff, release flood advance of Rs.25,000 to the staff of BSNL in flood affected parts of Tamilnadu Circle and release the funds for GPF without delay or restrictions to the staff of Tamilnadu, STR &STP upto Mar'2015. Director(CFA) patiently heard views and suggestions given by association and assured that BSNL Management will support/help its employees as per the assurance given by the CMD in the meeting had with Forum Leaders on 09.12.2015 F/N.

Dear Comrades,

A good number of supply orders for the Executive Diary - 2016 are being received at CHQ. While compiling them, it is found that many of the orders are not having contact details of the consignee. Moreover in some cases, the exact mailing address is also not given. These deficiencies creates hurdles in dispatching the diaries.

 

Therefore, to facilitate timely dispatch of the diary consignments it is requested that while placing the orders kindly ensure to give-

1. the mobile number of the consignee and

2. the exact mailing address along with the pincode of the consignee

United forum of BSNL Executive Association comprising AIBSNLEA and AIGETOA today i.e. on 07.12.2015 served Supplementary Notice to resume organizational action programs which was deferred on 7th July 2015. The agitation notice has been served against the arbitrary notification of MT (SRD) recruitment and non-settlement of long pending HR issues even after the assurances given repeatedly in the formal/informal meetings. BSNL management with an indifferent attitude has notified MT (SRD) recruitment to block the career progression of the young and talented executives of BSNL. The demands are as under:

1.    Immediate withdrawal of the MT recruitment notification (SRD) dated 05.11.2015, scrapping of the MT, DGM RRs altogether and implementation of the recommendation of the committee headed by ED(NB) on CPSU Cadre Hierarchy in BSNL and standard E2 & E3 scales for JTO, SDE Equivalent executives.

2.    Resolution of various other long pending HR issues like extending 30% Superannuation Benefits to Direct recruits, Rule-8 transfer cases, Pay loss to JTOs/JAOs recruited after 01.01.2007 and fixation of pay in respect of departmental outsider (TTA) appointed as JTOs, conduction of various CPCs in a time bound manner, first time bound upgradation in four years, declaration of LDCE results, notional pay fixation of all upgraded pay-scales w.e.f. 01.10.2000, post based promotions to PS to PPS/Sr. PPS, settlement of Pay Anomaly cases where junior executives are drawing more pay than senior executives, special recruitment drive for hard tenure/shortfall circles, restructuring of AD (OL) cadres, finalization of new SDE RR 2014 in line with association suggestions and other long pending HR issues submitted earlier.

03.12.2015:  Meeting with Director (HR) -  GS, FS and GS, President of AIGETOA were invited by Director (HR) in response to the agitation notice and discussed all the demands but in  the absence of a concrete assurance  for immediate cancellation of MT Exam, implementation of committee report on CPSU cadre , E-2, E-3 standard IDA Pay scales to JTO/SDE equivalent executives and other long pending issues the talk failed and our agitation programs will continue.  All the CHQ/Circle/Branch office bearers are requested to mobilise all the executives for making a full success of the agitation programs

03.12.2015:  GS and GS AIRBSNLEWA met GM (CIT) and GM (Admn) regarding enhancement of free call limit and linking with ERP of BSNL Pensioners medical claims.  GM(CIT) further assured to examine the case and favorable action to link with ERP and GM (Admn) informed the proposal to enhance the free call limit has been sent to Sr.GM(Legal) to get approval from BSNL Management Committee. They assured an early action in this regard.

03.12.2015:  GS and GS AIRBSNLEWA Sh Kishan Singh met Director (Staff) DOT and discussed regarding:-

a)78.2%IDAPay fixation of BSNL Pensioners:  We expressed our serious concern against delay in settling the 78.2% IDA Pay fixation case of  BSNL Pensioners since JUN-2013.  Director (staff) informed that the reply to DOE queries   is being prepared after receiving the comments of internal finance wing of DOT and PSU Cell of DOT.  By next week the reply will be sent to the DOE.  It is understood that after the acceptance of DOT reply by DOE the cabinet note will be processed.  Hence, now efforts are required in DOE for early clearance.  Meanwhile, all unions/Associations are required to impress up on the DOT for early settlement of the issue because 60:40 provision was never the part of Rule 37 A Pension Rule and on this pretext the 78.2% Pay fixation is being dragged in unjustified manner.

b) CGHS Medical facility to BSNL Pensioners: We requested Director (Staff) for early issuance of CGHS Medical facility to BSNL Pensioners. Dir(Staff) informed that matter has been sent to MHRD for consideration but they have made some queries on IDA to CDA pay scale mapping issue which has also been now replied.  However, he assured an early action in this regard.

02.12.2015:  United Forum of BSNL Executives Associations (comprising of AIBSNLEA & AIGETOA) CHQ Office bearers met today to discuss and decide the strategies for successful implementation of agitation programs against the indifferent and biased attitude of the BSNL Management wherein the arbitrary notification of MT (SRD) recruitment has taken place and against the non settlement of the other pending HR issues.  United Forum unanimously decided to make a strong agitation programe to fight against the indifferent and biased attitude of the BSNL Management.  United Forum appeals all the executives to come together and fight against  the injustice  being taking place.  All the CHQ/Circle/Branch office bearers are requested to make agitation programe a complete success.

02.12.2015:  GS, FS met Addl. GM (Pers) and discussed regarding:-

a)     Filling up of the vacant DGM Posts:- We expressed our concern against non ?filling up of  about 800 DGM  vacant Posts . Addl GM (Pers) mentioned that the CPC work is in advance stage  but the legal opinion of  Sr. GM (Legal) BSNL CO is awaited on TES Group 'B' seniority  lists.  He further mentioned that TES Group 'B' seniority case of Rule 206 and year of recruitment basis (1966 Rule) is listed for hearing on 11th Dec 2015.  Hence on the basis of Expert committee report  the case will be  argued by the respective parties and Hon'ble Supreme Court may finally decide the TES Group's seniority issue.  Hereafter the clarity will be there and the promotion from DE to DGM may be easier.

b)    CPCs from  JTO to SDE (T) and SDE to DE :- We requested to expedite  CPCs from  JTO to SDE and SDE to DE.  Addl .GM (Pers) informed that the necessary data on SC/ST Roster implementation on the basis of DOP&T guidelines have been prepared and will be submitted shortly to the Hon'ble CAT Chandigarh and praying for stay vacation.  Here after the decision for Appeal in the High court against stay order will be taken.  He further informed that similar is the problem in SDE to DE and AO to CAO CPCs also.  He assured an early decision in this regard.

c)     Creation of PPS Posts in BSNL's field units:-  We expressed  our concern against the delay in finalizing the committee report on creation of PPS Posts and common  RR of BSNL CO & field units. Addl. GM (Pers )informed that committee meetings are over and  the committee report will be ready by this weekend and thereafter it will be put up to the competent authority for approval.  He assured early decision in this regard.

d)    Restructuring of AD (O/L) cadre:- Addl. GM (Pers) informed that the comments of Estt Cell has been received and shortly the proposal of Restructuring of AD(O/L) cadre will be submitted to the competent authority.
